1 MOUNT PLEASANT TOWN COUNCIL Tuesday, 6:00 p.m. Council Chambers Municipal Complex Ann Edwards Lane Mount Pleasant, SC MINUTES Mayor Swails called the meeting to order at 6:00 p.m. Council members present were Thomasena Stokes-Marshall, Kenneth Glasson, Chris O Neal, Elton Carrier, John Burn, Chris Nickels, Craig Rhyne and Linda Page. Chaplin Harry Sewell led Council in prayer. Mr. Glasson led the Pledge of Allegiance. Counsel David Pagliarini certified compliance with the Freedom of Information Act. Mayor Swails said he wanted to take the opportunity to wish Thomasena Stokes-Marshall a Happy Birthday on her birthday tomorrow. Council members wished her well. Mayor Swails called for approval of the agenda. Mr. Glasson so moved; motion seconded by Ms. Stokes-Marshall. Motion carried unanimously. PUBLIC HEARINGS, AWARDS & PRESENTATIONS Sweetgrass Basket Stand Project Recognition: Mr. Morrison recognized Ms. Blair Goodman and company for coordinating over 60 locations for the newly constructed sweetgrass basket maker stands along Highway 17 after the road construction project. Ms. Goodman managed to secure a federal grant for her exemplary human environment initiative. Ms. Stokes-Marshall said she is involved with the Sweetgrass Cultural Arts Festival Association (SCAFA) that sponsors the annual sweetgrass festival. When the town engaged the services of Blair s company, she got involved and they have collaborated for almost five years. They had meetings with the basketmakers and they believed that it was extremely important to inform the members of the basket making community exactly what the road project entailed and the potential for it to impact their roadside stands. With the cooperation of Ms. Blair Goodman and the Town, the National Park Service, Federal Conservation and the SCDOT, they have worked for five years to ensure that the sweetgrass basket stands were preserved, rebuilt

2 and/or relocated along Highway 17. This effort helped to instill a sense of pride for the basketmakers who own the stands, but also for the Town s residents. Basket making has been an art form that has been in existence for over 300 years. People come from all over the world for this treasure that we have here in our community. She thanked Ms. Goodman for her patience, understanding and cooperation in the efforts concerning this preservation. Local Artist Presentation: Mr. DeMoura said that Steve Jordan is a renowned local artist who would present the Town with a painting of Shem Creek. Mr. Jordan stated that when the Shem Creek boardwalk opened, he was determined to be the first artist to do a painting of Shem Creek. He was proud to present his painting to the Town that he did from the boardwalk at the new Park. He said Shem Creek is the reason he moved to this area. ITN Charleston Trident Presentation: Jim Ledbetter, Terry Brown and Dick Giffin presented an umbrella with their logo to Mayor Swails and Ms. Stokes-Marshall as a gesture to thank them for their help. Mr. Giffin talked about the services provided by ITN. He stated they provide transportation services for seniors sixty years and older and for the visually impaired who are eighteen years and older. The service is provided 24/7 for any ride purpose. The transportation service is provided in private automobiles or vehicles donated to ITN. Volunteer drivers are used to a large extent. He pointed out that the senior population is growing and will comprise 25% of the population within a couple of decades. Their biggest need has been identified as transportation. He said that the Town of Mount Pleasant was the first municipality to provide them with support and continues to do so. He said that since their inception six years ago, they have now provided their 36,000 th ride. They currently provide over 6,000 rides per year and that number is growing. They have served over 700 individuals through this process and they currently have over 400 active riders. He said they are proud to present this ITN report to Town Council and are happy with Council s support during that entire time. Mr. Terry Brown, vice-chair on the board of trustees of ITN, presented Council with a plaque of appreciation. Page 2 of 16

3 Page 3 of 16 Mount Pleasant Town Council Longevity Awards: Corporal Kim Herring was recognized for 20 years of service with the Police Department. She could not be present due to illness. The presentation will be made at the March Council meeting. Recreation Sports Recognition: Mr. Ayoub introduced the 12 and under All Star football team. They won the State Championship for the third straight season. Cross Country Team State Champions: Mr. Ayoub said they won 9 of the 11 teams they played in their age group. In the national meet in December, of the 53 total runners who qualified for the national, 29 were able to attend the meet. He said this could not be accomplished without the volunteer coaches. Tim Tyler, member of USATF State board and first vice president, said that Tammy Dennis won the award for outstanding volunteer of the year for the southeast region. She also received the National Youth Chair award and the significance is that only seven people in the whole nation received that award. APPROVAL OF MINUTES FROM THE JANUARY 8, 2013 TOWN COUNCIL MEETING AND THE JANUARY 2013 FINANCIAL STATEMENT. Mayor Swails called for approval of the above listed. Mr. Glasson moved for approval of the January 8, 2013 Town Council meeting minutes; motion seconded by Ms. Stokes-Marshall. Motion carried unanimously. Mr. Glasson moved for approval of the January 2013 Financial Statement; motion seconded by Ms. Stokes-Marshall. Motion carried unanimously. CORRESPONDENCE AND PUBLIC STATEMENTS Daniel Berryman, 967 Cottingham Drive, Cooper Estates: He said they are having a hard time with the traffic that flows through their neighborhood. The Police Department is doing a great job and has a presence in the neighborhood. During the road construction, a road was cut off by McDonalds and a lot more traffic started to come through the neighborhood. He said that families, kids, bicyclists, are numerous and it is getting rough.

4 Page 4 of 16 Mount Pleasant Town Council He said they have some speed humps and are trying to minimize the flowthrough traffic. He said he brought the problem to Council and is asking for help on how to rectify the problem in the neighborhood. Mayor Swails said that he grew up in the area of The Groves and Cooper Estates and those subdivisions are a part of his culture. He said that, given the opportunity, the administrator and staff find solutions to fix problems. They would welcome Mr. Berryman s ideas as well. He asked him to attend the March Transportation Committee meeting. PLANNING New Business First Reading: An Ordinance providing for the annexation of an approximately 0.29 acre parcel of land known as Lot 1A, located at 1111 McKnight Road and identified by TMS No (Ord. No ) Ms. Farrell introduced the Ordinance. She said the Annexation Committee recommended approval. Mr. Glasson moved to approve items 1 & 2 on the agenda (Ordinance Nos , 13006); motion seconded by Ms. Page. Motion carried unanimously. First Reading: An Ordinance to zone AB, Area-wide Business District, an approximately 0.29 acre parcel of land known as Lot 1A, located at 1111 McKnight Road and identified by TMS No (Ord. 5 Page 5 of 16 Mount Pleasant Town Council First Reading: An Ordinance to zone AB-2, Area-wide Business-2 District, a 1.41 acre parcel of land known as Lot B, Daniel Jerman Subdivision, located at 1161 SC Highway 41 identified by TMS No (Ord. No ) Ms. Farrell introduced the Ordinance. It was approved by the Planning Commission and Committee. Ms. Stokes-Marshall moved to approve Ordinance No ; motion seconded by Mr. Glasson. Motion carried unanimously. First Reading: An Ordinance to amend the Wilson Tract Planned Development District Ordinance (No ) pertaining to a 5.98 acre portion thereof known as Tract 4-A-1, bearing TMS No , allowing a Planned Development Multi-Family Use. (Ord. No ) Ms. Farrell introduced the Ordinance. She stated that the Planning Commission recommended approval to include staff comments, to only allow a maximum of 47 units, to require a 32 foot right-of-way, and require an updated drainage study and improvements as required in Ordinance No The Planning Committee recommended the same except to allow the requested 49 units. Ms. Farrell stated that in regard to the drainage, they have been working with the developer on an updated model to the current basin and met with Mr. Mitchell, the town engineer, earlier today. He found that what they have provided so far is thorough and accurate. The next step is to actually run the model with the new development and then to proceed with the normal process. They would have to update the model to determine whether improvements will be needed. Mr. Nickels asked Ms. Farrell to provide a little of the rationale as to why the Planning Commission recommended 47 units as opposed to the Planning Committee recommending 49. Ms. Farrell replied that when the Commission discussed it, there were two different things. The first was consistency with what was already approved. They had a lot of discussion about the trees that were on the property and the open space. There was some thought that the difference in two units would provide some flexibility to preserve additional open space and trees. The Committee heard from the applicant who expressed that he

6 Page 6 of 16 Mount Pleasant Town Council would like to pursue the 49 units since that met the density and the open space requirements. Mr. Nickels asked if she knew what the vote was on the Commission. Ms. Farrell replied that it was unanimous for the 47 units. Ms. Stokes-Marshall said one of the reasons the Committee voted to allow 49 units after the discussion was that the green space provided by the applicant was more than what was required. Ms. Farrell stated that the green space they are providing on the plan, even with 49 units, exceeds what is required which is that 8% of the property must be open green space. Ms. Stokes-Marshall explained that in reference to Mr. Nickel s question as to why the Commission recommended 47 units and the Committee recommended 49 units, it was because the applicant expressed to them that if the two additional units were not added, it would present a hardship for him. Once they were able to determine that the green space he was providing exceeded the requirements, they agreed to allow the two additional units. Ms. Farrell stated that the committee vote was unanimous as well. Mayor Swails asked Kevin Mitchell, the town engineer, if he was satisfied with the drainage situation. Mr. Mitchell responded that the model has been updated with more accurate information. There was a discrepancy with the 2000 model but at current conditions, it is much more accurate than it was before. There is still work to do as far as demonstrating that there is not going to be an impact downstream as a result of development. Any conditions or changes to their system within the Hidden Lakes subdivision would have to be approved through the HOA. Mayor Swails said he appreciated that information and he was more worried about it in 2006 when hurricane Gaston came through. The Town had a malfunction that caused some problems, but those have been addressed. Ms. Page moved for first reading of Ordinance No ; motion seconded by Ms. Stokes-Marshall. Mr. DeMoura stated that two speakers had signed in. J. R. Nelson, 1809 Falling Creek Circle: He said he was a member of the HOA for Sweetgrass whose responsibility is the ponds. When he heard

7 of the development going in at the back of the development, he was a little concerned about the drainage. He met with the developers in several meetings and expressed concern about the drainage to the small pond. If drainage was bypassed, that pond could actually dry up. Since then, the developer has come up with some ideas to address the drainage problem to the pond and also for some areas behind the houses. He said he was very impressed with the way they handled it. They did an excellent job in presenting their plan and now he does not have as many concerns. They are still working on the pond to make sure it does not turn into a mud hole and cause flooding behind the houses. He said he is comfortable with what he has heard and hopes they can continue with the project. Charles Mascari, 1326 Hidden Lakes Drive: He is a member of the Hidden Lakes HOA board of directors. They had raised several issues at both the Planning Commission and Committee. They were pleased to meet this morning with Pulte Homes who presented an updated drainage model. They feel fairly confident that the issues have been addressed. Hidden Lakes HOA has no objections at this point. They have two suggestions: one is that because the 2006 Ordinance included a drainage study from 2006, the new drainage study needs to be documented. Second: Perform a water quality testing. They have an arrangement with Towne Centre to test the quality of the water that enters Hidden Lakes on a monthly basis from the retention pond. Some kind of requirement should be considered for discharge from this property as well because it is not just a discharge from the townhouses; the flow from the Sweetgrass Shopping Center, the Irongate Shopping Center, the car wash and the Mexican restaurant all end up going through this pond into Hidden Lakes. As they resize that pond, some of the water will get to Hidden Lakes quicker than it used to, so they would feel more confident if there were some kind of water testing requirements similar to that of Towne Centre. Mayor Swails stated that he was so confident of what Mr. Mitchell had said, he was okay with it. He called for the vote. The motion carried unanimously. Page 7 of 16

Ms. Stokes-Marshall moved for first reading of Ordinance No ; motion seconded by Mr. Carrier. Motion carried unanimously. First Reading: An Ordinance to amend Section , AB-2, Areawide Business-2 District, and Section , LI, Light Industrial District, of Chapter 156 of the Mount Pleasant Code of Ordinances establishing standards for an indoor shooting range use. (Ord. No ) Ms. Farrell introduced the Ordinance. Mr. Rhyne moved for first reading of Ordinance No ; motion seconded by Mr. Nickels. Motion carried unanimously. Planning Old Business Final Reading: An Ordinance providing for a First Amendment to PD- MU-SR, Mixed Use Suburban-Rural Planned Development District Ordinance No.07047, pertaining to property formerly known as the First Baptist Church-North Campus and now known as the Church at Lifepark. (Ord. No ) Ms. Farrell introduced the Ordinance. There was first reading last month on a revised plan. The revised plan was reviewed by the Planning Commission in between first and final readings and was recommended for approval. Mr. Glasson moved for final reading of the Ordinance; motion seconded by Ms. Stokes-Marshall. Motion carried unanimously. Mr. DeMoura read FINAL READING BY TITLE ONLY. 10 COMMITTEE REPORTS Accommodations Tax Advisory Committee Elton Carrier Mr. Carrier stated the committee met on February 7 th and heard requests for funding from six different entities. The committee will make funding decisions at the March meeting. Because of time constraints on one applicant, they were allowed to make their presentation at the meeting and funding was approved at that same meeting for the Mardi Crawl. The committee asked that Town Council fund the event in the amount of $2,000. The Mardi Crawl will be held later this month. Mr. Carrier moved to approve funding the Mardi Crawl in the amount of $2,000.00; motion seconded by Ms. Page. Motion carried unanimously. Annexation Committee Linda Page Ms. Page said the committee agreed on the annexation request for the two properties heard earlier in the agenda, under Planning New Business. Bids & Purchases Committee Kenneth Glasson Mr. Glasson said the committee met and there were two items to report. The first was the award of a bid to accomplish the work on a portion of Coleman Boulevard from Fairmont to Pherigo Streets. Three bids were received and the lowest bid was Gulf Stream Construction in the amount of $520, The committee awarded Gulfstream the contract for that amount. In other business, the committee authorized the purchase of a high definition portable CCTV Inspection System mounted on a Kubota RTV 1100 in the amount of $261, from Southern Municipal Equipment Company. This equipment will be a part of the infrastructure support system for inspections. Both companies were the lowest bidder. Economic Development Committee Chris O Neal (No meeting, no report) Page 10 of 16

11 Page 11 of 16 Mount Pleasant Town Council Finance Committee Elton Carrier Mr. Carrier said the committee met and there are several items that will be addressed under Council New Business Item XI.A.2., Consideration of current year budget adjustments and Council New Business Item XI.A.3., Consideration of Resolution to adopt a Capital Improvement Plan. In other business, the committee recognized Natalie Cayouette for five years of service in the Purchasing Department. Mr. Carrier also wanted to commend the Finance Departments heads for keeping the Town on schedule as far as expenditures are concerned and he thanked them for their astuteness with the finances of the Town. Fire Committee Kenneth Glasson (No meeting, no report) Human Resources Craig Rhyne Mr. Rhyne stated that the committee met briefly to discuss the Town s position regarding charities. The committee received information from staff and shared opinions with no action taken. Patriots Point Development Authority Mayor Billy Swails Mayor Swails stated that the authority met in a two-hour executive session. All that he was at liberty to say was that they are hopeful of getting a lease signed regarding the museum. Planning Committee Thomasena Stokes-Marshall Ms. Stokes-Marshall had two action items from the committee meeting. The first is a request for an annual extension of vested rights for a project known as Belle Hall Gardens. Ms. Stokes-Marshall so moved; motion seconded by Ms. Page. Motion carried unanimously. The second item is consideration of request from Cooper River Village Apartments. A condition of approval of the impact assessment for the apartments was that the roundabout be completed prior to issuance of a Certificate of Occupancy for any portion of the project. The developer requested relief from this requirement as it is taking more time than

12 anticipated to receive SCDOT approval. The committee recommended that the Town issue a CO only for the amenity building at this time which will allow the property management staff to begin the work; but that no residential permits are issued at this point. Ms. Stokes-Marshall so moved as stated re the request from Cooper River Village Apartments; motion seconded by Mr. Glasson. Motion carried 8 1 with Mr. Nickels voting no. Mayor Swails complimented the Planning Committee on working out a great compromise on that issue and they all appreciated it. He said we will soon see the fruits of that labor. Ms. Stokes-Marshall had two items to report. Staff provided the Committee with a review of the Master Bike and Pedestrian Plan as well as the Mobile Food Vending Pilot Program. In regard to the Master Bike and Pedestrian Plan, the committee recommends that it be included in the Comprehensive Plan and that staff should move forward with this amendment with the Planning Commission. The next item is the Mobile Food Vending Pilot Program. The program has been in effect for one year and is about to expire. The Committee recommended that the program be permanently adopted with the modifications as recommended by staff and to proceed with a public hearing with the Planning Commission. Ms. Stokes-Marshall pointed out that when this issue was first brought before Council, there were concerns as to whether or not it would work and how it would impact the existing businesses in permanent structures. She said that the plan has worked quite well over the past year and the restaurants in permanent structures and the mobile food vendors have been relatively pleased with it. She said she could see no reason not to support this. It will be taken to the Planning Commission next. Police, Legal & Judicial Committee Eric DeMoura Mr. DeMoura said the Committee discussed executing a Memorandum of Agreement between the Town of Mount Pleasant and Charleston County regarding the Consolidated Dispatch. He asked that Council consider that favorably. Page 12 of 16

Mr. DeMoura stated that in Committee, there was a recognition ceremony for the Police Department members who were recipients of the annual awards. Chief Ritchie also had some recommendations for the Police Department going forward. Public Services Committee Chris Nickels Mr. Nickels said the committee did not meet, but he wanted to say that the Town has the greatest public service employees anywhere. They recently responded to a special need near Waterfront Park on short notice, did the job and reported back to him, as a professional courtesy. He thanked Jody Peele and Matt Maurer for a great job. Recreation Committee John Burn Mr. Burn said that the committee met and approved five facility rental requests. Also, two new staff members in the Recreation Department were introduced. They were updated on the Joanna Foundation Grant for Community Centers. The committee also discussed recognition for volunteers at the Thomasena Stokes-Marshall Senior Center. The committee was updated on the Park West score board the three local businesses purchased for the Park West football field. Mr. Burn gave a rundown on the Recreation Department monthly events for January. Transportation Committee Brad Morrison Mr. Morrison said the committee received a report on some pending changes that CARTA is implementing East of the Cooper. The report was well received. They are modifying their highest performing route and are eliminating the flex route and a circulation route that was not performing well. They will also begin a new route on Coleman. They also received an update on all of the ongoing projects. Page 13 of 16

14 Page 14 of 16 Mount Pleasant Town Council Waterworks Commission John Burn Mr. Burn stated that in addition to the work being done in the Old Village, Waterworks will perform a major sewer/waterline replacement project. There is a full schedule on the Town and Waterworks websites indicating what, when and when it is being done for anyone who may be interested. Water Supply Committee John Burn (No meeting, no report) ADMINISTRATOR S REPORT Eric DeMoura Boards & Commissions Vacancies: Mr. DeMoura announced that all seven seats on the Historical Commission expire in April and they will advertise the vacancies. COUNCIL New Business First Reading: An Ordinance to amend Title XIII, Chapter 132, Section of the Mount Pleasant Code of Ordinances, pertaining to the discharge of firearms. (Ord. No ) Mr. Rhyne moved for first reading of the Ordinance; motion seconded by Ms. Stokes-Marshall. Motion carried unanimously. First Reading: An Ordinance to amend the Budget for the Town of Mount Pleasant for the Fiscal Year Commencing July 1, 2012, and ending June 30, (Ord. No ) Mr. Carrier moved for first reading of the Ordinance; motion seconded by Mr. Glasson. Motion carried unanimously. A Resolution: A Resolution to adopt the Capital Improvement Plan for the Town of Mount Pleasant for the Fiscal Years through (R.13021) Ms. Stokes-Marshall moved to approve the Resolution; motion seconded by Mr. Glasson. Mr. Carrier moved to approve the re-appointment of Monique Semper- Flynn to Seat #5 on the Accommodations Tax Advisory Board; motion seconded by Ms. Stokes-Marshall. Motion carried unanimously. Ms. Stokes-Marshall moved to appoint Josh Malone for Seat #5 and Saila Smyly for Seat #6 on the Board of Zoning Appeals; motion seconded by Ms. Page. Motion carried unanimously.
