1 City of Morristown IN SOUTHERN MINNESOTA LAKES REGION I Best Little Town By A "Dam Site" I Box 362 Morristown, MN (507) MORRISTOWN CITY COUNCIL MINUTES Regular Meeting January 7,2008 At 5:30 p.m., in accordance with advertised notice, the Morristown City Council met to review applications for the full time maintenance position. Thirty-four applications were received and reviewed. It was decided to interview seven candidates and to interview them Monday, January 28,2008 in 15 minute intervals beginning at 6:00 p.m. A regular meeting of the Morristown City Council was called to order on Monday, January 7, 2008 at 7:00 p.m. in the Council Chambers at 402 Division Street South by Mayor Steve Felix. Councilmembers present were Verdis Flaten, Jeff Lang, Steve Nordmeier and Jared Taylor. Also present were Virginia Schmidtke, City Clerk/Treasurer; David Osborne, Police Chief; Troy Dahle, Fire Chief; Jack Schwichtenberg, Dan Morris and Lisa Karsten. The Pledge of Allegiance was recited. Motion by Nordmeier, seconded by Taylor and carried unanimously to approve the minutes of the regular meeting held December 3, 2007, the minutes of the Truth in Taxation meeting held December 4, 2007 and the minutes of the work session/special meeting held December 17,2007 as printed. Motion by Nordmeier, seconded by Lang and carried unanimously to approve the financial report for the month ending November 30, 2007 which showed a balance $8, in the checking account and $864, in the investment accounts. Motion by Nordmeier seconded by Flaten and carried unanimously to accept the police report for the month of December, 2007 and approve the schedule for the month of January, 2008 as printed.

2 ( Morristown City Council Minutes January 7,2008 Page 2 Motion by Lang, seconded by Flaten and carried unanimously to adopt Resolution requesting coverage in the Public Employees Police and Fire plan for Thomas Bokman. RESOLUTION WHEREAS, the policy of the State of Minnesota as declared in Minnesota Statutes is to give special consideration to employees who perform hazardous work and devote their time and skills to protecting the property and personal safety of others; and WHEREAS, Minnesota Statutes Section permits governmental subdivisions to request coverage in the Public Employees Police and Fire plan for eligible employees of public departments whose position duties meet the requirements stated therein and listed below. BE IT RESOLVED that the City Council of the City of Morristown hereby declares that the positions titled part time police officer, currently held by Thomas Bokman meets all of the following Police and Fire membership requirements: 1. Said position requires a license by the Minnesota peace officer standards and training board under sections to and this employee is so licensed; 2. Said position's primary (over 50%) duty is to enforce the general criminal laws of the state; 3. Said position charges this employee with the prevention and detection of crime; 4. Said position gives this employee the full power of arrest, and 5. Said position is assigned to a designated police or sheriff's department. BE IT FURTHER RESOLVED that this governing body hereby requests that the above-named employee be accepted as a member of the Public Employee Police and Fire Plan effective the date of this employee's initial Police and Fire salary deduction by the governmental subdivision. Chief Osborne reported that he met with school officials and presented a schematic of where "no parking school days - 7:30 a.m. - 4:00 p.m." signs, bus parking signs, a second handicap parking stall and speed limit signs should be placed on Washington Street between Division Street and 2 nd Street S.E. and also on 1 st Street S. E. between Washington Street and Main Street East. Motion by Taylor, seconded by Flaten and carried unanimously to purchase 15 signs and 6 posts as per Chief Osborn's recommendation. 3 f Morristown City Council Minutes January 7, 2008 Page 3 Police Chief, Dave Osborne recommended the City of Morristown become a member of the Rice county Drug Suppression Unit because of the work the Unit does and because the City receives benefits from becoming a member of this partnership. Motion by Nordmeier, seconded by Taylor and carried unanimously to donate up to $1,500 to become a member of the Rice County Drug Suppression Unit as per Chief Osborn's recommendation. Motion by Lang, seconded by Nordmeier and carried unanimously to pay Rice County $250 to offset costs for the County's K-9 team as per previous agreement. Chief Osborne reported the City of Morristown would not be charged by Rice County for consolidated records management services in Motion by Taylor seconded by Nordmeier and carried unanimously to approve the Fire Department report for the month of December, 2007 as printed. The Council received an invitation from the Morristown Fire Department to attend the annual meeting of the Morristown Fire Department to be held January 14, 2008 beginning with social hour at 6:00 p.m. A letter was received from the Morristown Fire Department inviting the Council to attend the NIMS level training sessions to be held January 16 th and 17 th at 6:30 p.m. at the Morristown Community Center. There was no Zoning Board report as the Zoning Board did not meet in December. There was no Economic Development report as the Economic Development Authority did not meet this evening. Comments and Suggestions from Citizens Present: Dan Morris asked when the siren would be repaired. Steve Nordmeier reported the City can get Webster's siren free of charge but that it needs to be taken down, transported and erected. Steve will look into it this week. (,

4 ( Morristown City Council Minutes January 7,2008 Page 4 Motion by Taylor seconded by Flaten and carried unanimously to pay the printed claims totaling $6, from the General Fund, $16, from the Morristown Fire Department Fund, $ from the Water Operations Fund, $1, from the Wastewater Operations Fund and $3, from the Refuse Fund. Motion by Nordmeier, seconded by Flaten and carried unanimously to pay a late claim from Timm's Trucking for $5, for snow removal in December, Jared Taylor left the meeting at 7:40 p.m. C There will be no decision regarding the purchase of a generator to be used at the Community Center until the next auction. Discussion concerning the Floodplain Insurance Program was tabled until the next work session/special meeting. Motion by Nordmeier, seconded by Lang and carried unanimously to adopt Resolution Resolution WHEREAS, the American Legion Post 149 has submitted a request to renew their Class A Gambling Permit License to sell pull-tabs at the American Legion Post 149, 101 Main Street West, Morristown, Minnesota. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MORRISTOWN, MINNESOTA, to approve the request as submitted. A letter was received from the Minnesota Pollution Control Agency stating that each local SSTS (septic system) must have at least one person on staff who has attended an administrative training session. It was decided to contact Jeff Dahle concerning whether or not he has had this training and, if so, if he would be the City's representative. (

A letter was received from the League of Minnesota Cities announcing that the City of Morristown received a property/casualty dividend of $3,527. B. Information was received from the League of Minnesota Cities regarding a leadership conference that will be held January 18-19, 2008 in Bloomington, Minnesota. C. A letter was received from Amy Larsen thanking the Morristown Police Department for all the work they do to keep the citizens of Morristown safe and especially for controlling the speed on Division Street. Councilmembers present were Jeffrey Lang and Steve Nordmeier. Also present were Virginia Schmidtke, City Clerk/Treasurer; David Osborne, Police Chief and Dave Sanderson; PeopleService Representative. Councilmembers Verdis Flaten and Jared Taylor were absent. The Pledge of Allegiance was recited. PeopleService water/wastewater report for the month of December, 2007 was presented. The report showed the monthly performance records, the operation and maintenance done at each site and expenditures for the month. Motion by Lang, seconded by Nordmeier and carried unanimously to approve the People Service report as printed. Voting Yes: Felix, Lang and Nordmeier Absent: Flaten and Taylor Dave Sanderson presented a quote from North Star Pump to rebuild a submersible pump at the wastewater treatment plant that does not work. North Star Pump installed a loaner pump and will sell it as installed for $1,800 plus tax. They also provided a quote of $1, plus tax to rebuild the existing pump and reinstall it. Motion by Nordmeier, seconded by Lang and carried unanimously to accept the bid of $1, from North Star Pump to pull the ABS pump at the plant and repair it as per quote. Voting Yes: Felix, Lang and Nordmeier Absent: Flaten and Taylor It was discussed that all items at the water and wastewater plants should be inventoried showing the serials numbers and a schedule of the maintenance on each item. Motion by Nordmeier, seconded by Lang carried unanimously to accept the Community Center report for the month of December, 2007 as printed. The report showed the revenues and expenses, hours spent managing and listed the events that will be held in December. A copy of the report is on file with the Clerk. 8 ( Morristown City Council Minutes January 22, 2008 Page 2 A balance sheet and profit and loss statement was received from the Morristown Commercial Club for the Morristown Commercial Club Bar Account from January through December There was no Skywarn report. Steve Nordmeier reported the City can get the City of Webster's siren free of charge. As soon as the ground is thawed the City will get the get the pole and siren and have it put up. There was no new information regarding the purchase of a generator to be used at the Community Center. Discussion was held concerning a question as to whether or not the City Council would be opposed to someone opening a grocery store at 119 Division Street North. There was no opposition to the request. The request was forwarded to the Zoning Board. Discussion was held concerning salary increases for Motion by Nordmeier, seconded by Lang and carried unanimously to increase the salaries of the City Clerk and Police Chief three percent effective January 1, 2008 and to increase the salaries of the part time police officers three percent after satisfactory completion of probation. Voting Yes: Felix, Lang and Nordmeier Absent: Flaten and Taylor Motion by Lang, seconded by Nordmeier and carried unanimously to pay the printed claims totaling $8, from the General Fund, $609 from the Morristown Fire Department Fund, $29, from the Water Operations Fund, $44,506 from the Wastewater Operations Fund and $3, from the Refuse Fund. Voting Yes: Felix, Lang and Nordmeier Absent: Flaten and Taylor A Notice of Decision to Revise and Update the Local Water Management Plan was received from Jennifer Mocol-Johnson, Rice County Water Planner. Notice was received from the Minnesota Department of Health stating that submissions are being accepted for the Drinking Water Revolving Fund Project Priority List. Present were Mayor Steve Felix and Councilmembers Verdis Flaten, Jeffrey Lang, Steve Nordmeierand Jared Taylor. Councilmembers present were Verdis Flaten, Jeff Lang, Steve Nordmeier and Jared Taylor. Also present were David Osborne, Police Chief; David Sanderson, PeopleService Representative; Lisa Karsten and Larry Dahle. Virginia Schmidtke, City Clerk/Treasurer arrived at 8:00 p.m. The Pledge of Allegiance was recited. Motion by Flaten, seconded by Nordmeier and carried unanimously to approve the minutes of the regular meeting held January 7, 2008, and the minutes of the work session/special meeting held January 22,2008 as printed. Motion by Nordmeier, seconded by Taylor and carried unanimously to approve the financial report for the month ending December 31, 2007 which showed a balance $4, in the checking account and $1,002, in the investment accounts. Motion by Flaten, seconded by Taylor and carried unanimously to approve the police report for the month of January, 2008 and the schedule for February, 2008 as printed. A letter was received from Richard Cook stating that the City owes a fee of $750 to the Rice County Tactical Unit to offset costs for equipment and operational expenses. Motion by Flaten, seconded by Lang and carried unanimously to pay the remaining balance.

Chief Osborne indicated that officers had been advised to enforce the City ordinances to address this problem. Chief Osborne requested authorization to attend the Minnesota Chiefs of Police Executive Training Institute to be held April 21-24, 2008 at the Duluth Entertainment Convention Center. Motion by Flaten, seconded by Taylor and carried unanimously to grant approval to Dave Osborne to attend the conference, get the payment in to get the discount and also to include 32 hours pay, lodging, meals, mileage and conference registration. Taylor asked about enforcement of the City ordinances regarding dilapidated houses and sheds in the City of Morristown. C Motion by Taylor seconded by Flaten and carried unanimously to approve the Fire Department report for the month of January, 2008 as printed. There was no Zoning Board report as the Zoning Board did not meet in January because of NIMS training. Motion by Lang, seconded by Flaten and carried unanimously to approve the minutes of the December 3,2007 meeting of the Economic Development Authority as printed. EDA needs to add a member to replace Darrel Haag. Virginia Schmidtke is to put a notice on the cable channel for a new EDA member. Next EDA meeting will be held March 3, 2008 at 6:00 p.m. Dave Osborne reported that he has a computer reserved for Morristown in Woodbury. He just needs to pick it up, it is free. Motion by Nordmeier, seconded by Lang and carried unanimously to pay the printed claims totaling $4, from the General Fund, $2, from the Morristown Fire Department Fund, $ from the Water Operations Fund, $1, from the Wastewater Operations Fund and $3, from the Refuse Fund.

Lisa Karsten recorded the minutes until Virginia Schmidtke arrived at this point in the meeting. Dave Sanderson presented prices for new, used and rebuilt submersible pumps. The bids were as follows: Electric Pump Co New Flygt submersible pump $4,635 plus freight and tax Electric Pump Co. Used Flygt submersible pump $2,555 plus freight and tax North Star Pump Repair City owned ABS pump $1, North Star Pump Loaner pump as installed $1, Motion by Nordmeier, seconded by Lang and carried unanimously to rescind a motion adopted at the Council meeting held January 22, 2008 to accept the bid of $1, from North Star Pump and instead, to keep the loaner Flygt pump as installed for $1,800. Voting Yes: Felix, Flaten, Lang, Nordmeierand Taylor A list of the pumps and equipment at Well House # 2, Well # 1 and the Wastewater Treatment Facility was presented by Dave Sanderson. He stated that he will create a form for each item on which he will record the serial number and list all repairs and maintenance. Motion by Taylor, seconded by Lang and carried to extend an offer to Tim Minske as maintenance worker. Voting Yes: Flaten, Lang, Nordmeier and Taylor Voting No: Felix Virginia Schmidtke reported that it is not necessary to hire a licensed surveyor to establish the first elevation to determine if structures are in the flood plain in regards to the Minnesota floodplain permit process. If the structures are in the flood plain, the property will have to be surveyed by a licensed surveyor. No action was taken. (

14 ( Morristown City Council Minutes February 4, 2008 Page 4 A letter was received from Kurt Fischer, Prosecuting Attorney for the City of Morristown, stating that he is raising his billing rate for the year 2008 to $105 per hour. Motion by Nordmeier, seconded by Lang and carried unanimously to approve the increase as requested. Steve Nordmeier reported that according to Lee Tollefson, Rice County will be obtaining bids in the near future to seal coat County Road 16 and asked if the Council would want to include seal coating some City streets in the bid. The estimated cost is $12,000 per mile. The City has approximately three miles of streets that should be seal coated. Motion by Taylor, seconded by Flaten and carried unanimously to send a letter to Rice County stating that the City is interested in seal coating a portion of the streets. A letter was received from Cannon Valley Cablevision stating that the franchise fee payment by Cannon Valley Cablevision to the City of Morristown is $7, for the year Discussion was held concerning a request from the Rice County Small Business Development Center to support their services with a contribution of $500 in 2008 and $750 in It was decided to invite a member of the advisory board to the next EDA meeting to present information to the EDA concerning the SBDC. Virginia Schmidtke presented a list of things to consider before advertising for a deputy clerk, an application for employment, a job description and a training and experience form for the Council to review before the work session/special meeting to be held Tuesday, February 19,2008. Present were Mayor Steve Felix and Councilmember Steve Nordmeier. Also present were Virginia Schmidtke, City Clerk/Treasurer; David Osborne, Police Chief, Dave Sanderson; PeopleService Representative and Tim Minske. Counciimembers Verdis Flaten, Jeff Lang and Jared Taylor were absent. PeopleService water/wastewater report for the month of January, 2008 was presented. Morey Schaefer, Abdo Eick and Meyers Accountant, was present and reviewed the annual 2007 financial report and management letter. Councilmembers present were Verdis Flaten, Jeff Lang, Steve Nordmeier and Jared Taylor. Also present were Virginia Schmidtke, City Clerk/Treasurer; David Osborne, Police Chief; Troy Dahle, Fire Chief, Larry Dahle and Loren Dahle. The Pledge of Allegiance was recited. Motion by Nordmeier, seconded by Lang and carried unanimously to approve the minutes of the regular meeting held February 4, 2008, and the minutes of the work session/special meeting held February 19, 2008 as printed. Motion by Flaten, seconded by Lang and carried unanimously to approve the financial report for the month ending December 31, 2007 which showed a balance $7, in the checking account and $974, in the investment accounts. Motion by Lang, seconded by Nordmeier and carried unanimously to approve the police report for the month of February, 2008 and the schedule for March, 2008 as printed. Chief Osborne reported the computer he received free of charge from the Minnesota State Chiefs Association and Target Corporation arrived, the fuel pump on the police car was replaced and that he issued citations to two people for illegal dumping at the brush site. v Motion by Taylor seconded by Nordmeier and carried unanimously to approve the Fire Department report for the month of February, 2008 as printed.

17 f Morristown City Council Minutes March 3, 2008 Page 2 Motion by Lang, seconded by Nordmeier and carried unanimously to approve the Fire Department Officers as selected by the Morristown Fire Department at their annual meeting held January 12, The officers for 2008 are Troy Dahle, Chief, Steve Nordmeier, Assistant Chief, Adam Uittenbogaard, Training Officer, Jackie Saemrow, Secretary and Dave Schlie, Randy Meschke, Tim Minske and Mike O'Rourke, Captains. Motion by Nordmeier, seconded by Lang and carried unanimously to approve the minutes of the February 21, 2008 meeting of the Zoning Board as reported by Virginia Schmidtke. There was no Economic Development Authority meeting held in March. Dan Morris reported that approximately 800 attended the play held February 29 th and March 1 st and 2 nd at the Community Center. It was discussed by members of the cast to donate $500 to build a loft in the east storage room if approved by the City Council. Members of the cast would build the loft free of charge. They also will donate their time to build a loft in the west storage room if the City Council will purchase the building materials. Motion by Lang, seconded by Flaten and carried unanimously to pay for the materials for a second loft. Dan Morris questioned the status of the warning siren. Felix stated that it should be installed by the April 2008 meeting. Dan Morris reported that Skywarn training will be held Wednesday, March 5, Tim Minske was present and reported that he has been working on the city truck and tractor, organizing and cleaning the shop and removing the Christmas decorations. It was discussed to change locks in the doors at the maintenance shop and the Community Center. The front door of the Community Center also needs a brace in the center panel. Motion by Taylor, seconded by Lang and carried unanimously to have Tim look into the purchase of a brace and to change the locks on both doors.

18 ( Morristown City Council Minutes March 3, 2008 Page 3 A letter was received from Myrna and Gerald Bauer in regards to a concern they have about the difficulty they have seeing traffic coming from the east when stopped at the stop sign at the intersection of Franklin Street and Division Street. It was discussed that this issue was addressed a few years ago and the cars at Nordmeier Bros. Chevrolet are not parked on the street but are parked behind the yellow lines between the curb and sidewalk. The school currently uses the field free of charge in return for mowing it. 24 ( Morristown City Council Minutes April 7, 2008 Page 2 Fire Chief, Troy Dahle, reported that the new pumper truck arrived and will be in service in two to three weeks. Motion by Lang, seconded by Flaten to pay Tim Minske's cell phone bill each month to T-Mobile as long as it does not exceed the maximum minutes. Cost of the service is $42 per month Voting Yes: Felix, Flaten, Lang and Taylor Absent: Nordmeier Maintenance Report: 1. Tim Minske reported that he installed a reinforcement bar in the center of the Community Center front doors and will call Tom's Lock and Key next week to have the locks at the Community Center and maintenance shop changed. 2. Tim will open the bathrooms in the park and turn on the water in the middle of April or as soon as the weather is warmer. 3. Tim reported that he shut off the water at the elevator. 4. Lisa Karsten presented information and prices to install a portable toilet by the Dam. The cost would be $75 per month and includes weekly cleaning service. It was discussed not to have a portable toilet but instead to install directional signs to the bathrooms in the park. The matter was tabled until the next meeting. Chad Hoepner reported that Tim Flaten was appointed Assistant Director of Skywarn and that a new computer and software is being purchased for Skywam use. 2. Chad Hoepner asked on the status of the siren. Mayor Felix reported that he contacted Cedar Lake Electric to take down a siren that the City of Webster no longer uses and will donate to the City of Morristown and bring it to Temple Electric to have it rewired. He stated that the siren should be up and working within a couple of weeks. 3. Chad Hoepner stated that Skywarn members voted to donate $5,000 towards the purchase of a generator and will donate the money after the generator is purchased. 4. Lisa Karsten asked Chief Osborn to clarify whether a person can fish from the walkway over the Dam. Dave stated that the City Ordinance states that "No person shall fish from any bridge within the City of Morristown". It was discussed whether this includes the walkway over the Dam. It was decided the Ordinance should be amended to read "roadway bridges". Motion by Flaten seconded by Lang and carried unanimously to pay the printed claims totaling $4, from the General Fund, $1, from the Morristown Fire Department Fund, $2, from the Water Operations Fund, $1, from the Wastewater Operations Fund and $3, from the Refuse Fund. An invitation was received from the League of Minnesota Cities inviting city officials to serve on a League of Minnesota policy committee. The annual dog clinic will be held Saturday, April 12, 2008 at the Fire Hall from 1:00 p.m. to 3:00 p.m. Virginia Schmidtke reported that fifteen applications were received for the city clerktreasurer position. Tim Minske reported that Cedar Lake Electric removed the siren and pole that was given to the City by the City of Webster and that they are storing the pole until the siren has been repaired. Tim brought the siren to Temple Electric for repair. It was suggested that the siren be placed by the watertower. It was decided to contact the Rice County Emergency Management Director to see if the siren could be moved. Tim Minske reported that he is cleaning the storm sewers. It was reported that the storm sewer on Bloomer Street is full. Tim is to contact either Dahle Enterprises or the Rice County Highway Department regarding the manhole. C Tim Minske reported that many garbage bags filled with leaves, a television set and large stumps were dumped at the brush site. The company that dumped the stumps was called and they will return and remove them. Jeff Boran and Joel Whitehurst were present to discuss a letter the WEM School Board received from the City of Morristown stating that, in the future, the City maintenance worker will mow and trim the baseball field and charge Waterville, Elysian, Morristown School Board $150 per mowing because the City Council received complaints from the Morristown Baseball Association that the baseball field is not mowed in a timely manner and that the lawn mower they use chops the grass instead of evenly mowing it. Mr. Whitehurst stated that he did not know the field had not been properly maintained and felt $150 per mowing was too much to charge. After lengthy discussion, a motion was made by Taylor, seconded by Flaten and carried that in accordance with the on-going agreement with WEM, that WEM mow the baseball field on Thursday or Friday and that if it is not acceptable to the Baseball Association, to charge WEM $80 per mowing. It was decided to draft a joint powers agreement to be signed by both the City and the School Board. Mr. Whitehurst thanked the Morristown Fire Department for inviting the students to a mock crash that was held in Waseca on Monday. (

29 Morristown City Council Minutes April 21, 2008 Page 3 Motion by Flaten, seconded by Lang and carried unanimously to install a portable restroom in the park by the Feed Mill and to authorize Steve Nordmeier to contact the company that provided portable restrooms for Dam Days for a bid and to decide and contract with whichever company is the cheapest. Lisa Karsten asked if a light can be installed on an electrical pole that is located by the Feed Mill. It was discussed to work with the Morristown Baseball Association in regard to designing an area at the baseball field for a skating rink, horseshoe pits, a warming house, concession stand and restrooms. Discussion was held concerning a quote from Timm's Trucking for street maintenance services for the period of April 1, 2008 through March 31, It was suggested that the city purchase a truck with a plow and sander. Motion by Nordmeier, seconded by Flaten and carried unanimously to accept the quote from Timm's Trucking as submitted., A copy of the quote is on file with the City Clerk. Tim Minske presented a proposal of $17,600 from LaCanne Paving to haul in rock and limestone and prepare an area north of the Community Center for a parking lot and to pave and stripe the area. The paving would also include a strip on the east side of the building that is used by caterers and musicians. It was suggested that money be spent on parks and streets instead of at the Community Center. No action was taken. It was decided not to have a cleanup day this year. Steve Felix reported that he met with a DNR representative and visited three sites that could possibly be used for an access into town from the State Trail. The DNR representative offered to attend a meeting to discuss a proposed trail. Motion by Nordmeier, seconded by Flaten and carried to offer the full time City Clerk- Treasurer position to Kristalyn Pilcher.
