Anti-trust statement he cardinal rule in keeping an association s operations within anti-trust laws is that there should be no agreements express or implied which restrain the member s freedom to make independent decisions in matters that affect competition. Each member must be completely independent to set prices, establish production and sales levels, choose the markets in which he or she will operate and select his or her customers and suppliers. 3. Introductions Committee Chair, Natalie Cornell welcomed attendees and the members present at the meeting introduced themselves. Meeting Notes from May Meeting he minutes from the May meeting were approved. 4. Work Plan Reports a. Update on FA Pilot Program and NPRM re: geographic preference including local hiring All he Chair explained that Los Angeles issued an addendum to their procurement about local content requirement. Madeline Janis from LAANE explained that points are given also for hiring disadvantage workers (e.g. veterans, people of color, people with disabilities. etc.)

4 he pilot program is supposed to be a one year program but might get extended. he program is to report the results back to DO. As we know the whole process until a procurement is finished can take 8-9 years, so nobody will understand the effects of the local hiring preference until then. Business members continue to express their displeasure with the geographical preference requirements. However, other voices came forward during the meeting about the importance of saying yes to the regulation. hey expressed the importance of understanding the pressure on the transit CEOs and helping the industry leadership. he members continued to discuss the pilot program, and how to talk about next steps especially how to market our message better. Action: A conference call will be schedule to discuss positive actions that can be taken to handle this issue. b. A&E issues Stan Grill he A&E session during the last conference was well attended and very interesting. 5. Procurement issues in Reauthorization: a. US content b. Options c. A few possible bills he group discussed the issue of US content which Congress now wants to raise. It is important that we continue to let our congresspersons know the issues this would create for our business. he American market is a small market and if we keep pushing this issue some foreign manufacturers might drop off. We should discuss the possibility of a compromise, i.e. 60% bus, 70% rail. 6. Update on Procurement Sessions at 2015 conferences M. Garcia-Colberg informed the members of the sessions that are earmarked for the Annual Conference. Please try to attend these sessions and show your support. 7. New Business APA standard discussion APA will be working on Zero Emissions standards. All Business members are invited to attend and participate in BMBG meetings. he next BM Procurement Committee meeting will be held at the BMBM Meeting in Hawaii. 7. Adjourn he meeting was adjourned.

6 Business Member Board of Governors Summary Report PROCUREMEN COMMIEE Committee Work Program update January ) Monitor and React to Changes to US Content Requirements Accomplishments: Worked with Legislative Affairs Committee to draft letter to Congress from bus builders and component suppliers explaining impact of changing rules to more than 60% US content. Anticipated Actions: We will continue to monitor this push through the reauthorization process and current procurements (Amtrak high speed train sets, for example) and develop acceptable language for responses from across the industry. 2) Monitor US DO Pilot Program on Local Hiring Initiative Accomplishments: Panel session held at Annual Meeting was full of revelations on both the FA s goals and how LACMA will judge benefits. So far, LA is the only property to paaly to the program and have procurements accepted into the pilot: 1 bus procurement; 1 heavy rail new vehicle procurement; 1 heavy rail overhaul; 1 light rail overhaul. Anticipated Actions: Work with APA research team (Darnell Grisby) to help craft questions for an industry survey on jobs created by the transit industry; provide input on results and framing messages. 3) A&E Contract s & Cs and other contracting issues (risk sharing) Accomplishments: items to be covered A sub-committee has met and developed a list of Anticipated Actions: Refine the items and position them as ways agencies can also win (so A&E firms aren t perceived as just wining about their profits); identify the best ways to educate agencies about the issues: webinars, conference sessions, work with the Procurement Steering Committee to draft standard A&E procurement guidelines. 4) Expand on work completed last year Accomplishments: New Procurement Handbook for ransit Executives was published and distributed at EXPO and posted on the APA website at

7 Four work groups identified areas where procurement practices could be improved and while the high level ideas were included in the handbook there is still opportunity to expand and educate further. Anticipated Actions: Develop education materials that can be used to explain the issues to agency procurement teams: webinars, conference sessions and updates to the FA training materials. Coordinate with the Procurement and Materials Management Committee to highlight issues of interest.
