6 I am happy to report the total distribution numbers for the year The numbers you are about to see are proof of what is possible when a whole town works together as one to help the needy of the community. We are proud to say that this organization is supported by the City of Del Rio, Val Verde County, The San Felipe Del Rio ISD, Laughlin AFB volunteers, the local business community, nine churches, and many individual donors. In the last twelve months we have distributed to 13,042 families, made up of 21,238 adults and 10,388 children, for a total of 32,238 individuals. 297,993lbs of food has been acquired from the Laredo South Texas Food Bank. Food Bank officials are very proud of the accomplishments of our food pantry. They are using our pantry as an example to other pantries for what can be accomplished if a whole community bands together. Mr. Fred Knoll came forward to thank Danny Jalomos and the Gas Department for all of the information they provided to him. Mr. Knoll is attending Angelo State University to pursue a degree in Border Protection. He also thanked the City Secretary and City Attorney for their professional help with Public Information Requests that he has submitted with the City in relation to his business.

10 6. MAYOR'S COMMENTS (NO ACTION WILL BE TAKEN) Mayor Roberto Fernandez stated that he attended the State Advisory Committee meeting in San Antonio. He advised that Mr. John Steen is resigning. He stated that the Bridge Board met yesterday. They discussed administrative changes at the Bridge concerning security. The Mayor also met with Civil Service at Laughlin Air Force Base to discuss the "Grow Your Own" program. He will also meet with the local universities to discuss the same matter. The Mayor commended Staff on the City's Awards Ceremony. He stated that he and Ms. Jackie Robinson, Public Information Officer, attended the State of the City in Acuna. He re-iterated that trade with Mexico affects six million jobs in the United States. He ended by congratulating Ms. Anna Chapman, Deputy City Secretary, for her recent appointment to the Texas Military Preparedness Commission. This will support the City in BRAC negotiations. 7. INFORMATION ITEMS (NO ACTION WILL BE TAKEN) a. Introduction of Michael Diaz as new Whitehead Museum Director - Roberto Fernandez, Mayor Mayor Roberto Fernandez introduced Mr. Michael Diaz as the new Whitehead Museum Director. Mr. Diaz thanked the Board for his appointment. He stated that he will be working with both the City and County and invited the Council to visit the Museum. 8. Eads to Sign a Five-Year Contract with RR Waste Solutions, Inc. to Provide Residential Waste, Commercial Waste, Bulky Waste, Yard Waste, and Recycle Collection and Disposal Services. - Ryan Rapelye, Assistant City Manager Councilperson Luna moved to approve Ordinance No. O: Councilperson Arreola seconded the motion. Mr. Robert Eads, City Manager, gave a Power Point Presentation which covered the background of the bidding and negotiations the Waste, Recycle Collection and Disposal Services. A copy was provided of the Red River Waste Solutions' rates, Current City Rates Compared to City Rates with a 5%, and 10% increase and the Refuse Service Contract Price Proposal. A draft copy of the contract was also provided. Councilperson Garza asked why the other interested parties did not submit a bid. Mr. Eads stated that the other parties did not discuss their business models, but it could have been because of the changes to the recycling, brush collections and penalties. Mayor Roberto Fernandez pointed out that the Council did not have to make a decision today. Mr. Eads agreed. He stated that there was not anything legally binding at this time. Mr. Eads named the committee members that worked on this and listed current services versus the proposed services with this contract. Councilperson Wrob asked who would handle the recycling. Mr. Eads stated that Red River would pick up the recyclables, to include plastic, paper, cardboard, tin and aluminum. Councilperson Contreras asked about price increases and incentives, to which Mr. Eads stated he will cover them.

12 Councilperson Garza stated that Red River moved from automated to a two-man system. He asked if that would remain the same. Mr. Eads stated that we proposed semi-automated and that yard clippings will also be picked up. Councilperson Luna asked if the Scale House would be cash only. Mr. Eads stated that they would be instituting debit/credit to be implemented in February. Mr. Eads stated that some issues that they were asked to improve were the underperformance of brush collections and issues with the Landfill Operations and oversight. Mr. Eads continued on to discuss Recycling. The benefits of the new contract are Accountability with Administrative Penalties. The new Recycling Service would provide the customer an 18 gallon bin with pick-up every two weeks. There will be Operation Oversight and the City will take over brush collections. Councilperson Garza asked what department will handle the brush. Mr. Eads stated the Health Department but they will need more manpower. Councilperson Wrob asked how many trucks does the City have for this. Mr. Eads stated two. Mr. Eads also pointed out that there are two distinct pricing sets. One for Red River and one for customer pricing. He then proceeded to go over the customer rates. Councilperson Luna stated that the current rate is $ With a 5% increase of $0.83, the rate would be $ Mr. Eads stated that there was a 5% increase in 2012, but the City did not adjust the rate every time. Councilperson Garza asked, if someone put something that cannot be recycled in the bin, would everything in the bin be left. Mr. David Cooper, Red River, stated that they would separate the items. He also stated that they will educate the Public and the Recycle trucks will run before the Trash Trucks. Mr. Eads pointed out that recycling will divert trash from the Landfill. He advised the Council of the City being charged by tonnage at the Landfill. Recycling costs to the customer will be $2.95. Councilperson Contreras asked about the people who do not want to recycle. Mr. Eads gave the example of the School Tax. Mr. Eads stated that the City will continue operations and education. Mayor Roberto Fernandez stated that recycling helps and is an advantage to the tax payer and the community. The City will not have to open another cell (at the Landfill). Mr. Eads discussed opting out of recycling. Ms. Suzanne West, City Attorney, stated that the City should not opt out for convenience, only for cost. She pointed out that the Commercial accounts are for cardboard only. Mr. Eads stated that they have to look at Revenue Collections and the Revised Alternate Rate. He stated that the City should increase 10% with recycling to "stay out of the red". The City will be fair and show its costs. The Mayor stated that he has some concerns. Automated service is more expensive. He referred to page 7 in the contract, Section He stated that a replacement cart would incur a $7.50 delivery fee. He does not believe this to be fair. He also referred to Section Mr. Eads stated that the $7.50 delivery fee would be assessed to the City. There was a discussion as to the cart cost and repair costs. Mr. Eads referred back to Section He stated that Red River will not charge for a replacement as long as the annual replacement is less than 1.5% of the house count. The Mayor referred to page 11 in the contract,. He stated that services to City Facilities will be at no charge. Mr. Cooper stated that some City buildings are not listed. Ms. West stated that while this will be modified and added while discussing negotiations. The Mayor referred to page 14, Section It reads that if the contractor does not pick up at 7:00 p.m., will pick up the next day. Mr. Cooper stated that GPS is to verify. The Mayor referred to page 15, 12.5, Penalties. He stated that if work is not performed, there is an appeal. He asked to strike the wording "the Council's determination". The Mayor referred to page 19 B, Roads. He asked if this referred to roads leading to the Landfill or within the Landfill. Mr. Cooper stated the City is responsible to the Landfill and Red River within. The Mayor referred to page 21, Section 13.7, Contractor responsible for compacting 1,200 pounds

13 per cubic yard. Mr. Eads stated that they are still negotiating this number. Mr. Cooper believes it is too high. Mr. Cooper stated that the TCEQ website lists Maverick County at 1,058. This is an arid region. The Mayor stated that this needs to be discussed before approval. He is not happy with less. There was a discussion as to compaction. Mr. Eads stated that the current contract does not have a ratio. The Mayor and Councilperson Wrob stated that they would sign the contract. Mr. Eads stated that there is no pressure to sign. Staff still needs direction on some items, i.e. brush. The Mayor referred to page 25, Section 17.2, New Accounts. He has concerns that the Customer will be charged for a full month if they open an account after the 1st. The Mayor referred to page 26, Section He stated that if the CPI goes over 4%, the increase will be charged to the customer He also referred to Section 18.6 where it states that the Contractor can petition. He asked why the City is not mentioned. Ms. West stated that the City can terminate for cause. The Mayor stated that he would like the City to verify the reasonable rate. The Mayor stated that this is a good contract. He recommended the Council call a Special Meeting to sign, once the corrections are made. This way the Council will know what is being signed. Councilperson Garza asked if a customer wanted to return a 2nd cart, would there be no fee. Mr. Eads stated that they will be opening a Customer Service Center. A 2nd Recycling bin would be $1.75. The Mayor asked if they would educate the Public on this matter. Mr. Eads stated that they would be working with Red River on this. Ms. West referred the Council to Bulky Waste. She stated that Red River will pick it up once a month. Mr. Eads stated that Staff will be bringing the contract and rates before the Council. These will be two separate items. The Council agreed to hold the Special City Council meeting on Monday, December 30th, at 12:00 p.m. No vote was taken on the motion. 10. EXECUTIVE SESSION (ACTION MAY BE TAKEN ON THESE MATTER) a. Attorney/Client Consultation to Discuss Solid Waste Services Pertaining to the Solid Waste Contract between the City of Del Rio and Red River Waste Solutions The Council did not go into Executive Session. 11. ADJOURNMENT There was no further business to come before the Council, therefore, the Mayor adjourned the meeting at 8:29 p.m.

R: A Resolution of the City Council of the City of Del Rio, Texas Ratifying Mayor Roberto Fernandez Execution of a Letter of Support for the Texas Water Development Board Research Planning Fund Grants Application for the City of Laredo, Texas Water Study - Roberto Fernandez, Mayor Mayor Roberto Fernandez stated that during the holidays he received a phone call. He was informed that the City of Lareo will be conducting a Study on the Water Shed of the Rio Grande. The Study will look at the water that flows into the Rio Grande. They were requesting a Letter of Support from the City of Del Rio. The Mayor informed them that he would send a letter on his behalf, but he would need to inform the Council. Councilperson Wrob stated that he supports the Resolution. Councilperson Wrob moved to approve Resolution No. R: Councilperson Arreola seconded the motion. Vote: 7-0

16 3. ORDINANCES (ACTION MAY BE TAKEN ON THESE MATTERS) a. O: An Ordinance by the City Council of the City of Del Rio, Texas Authorizing and Directing the City Manager Robert A. Eads to Sign a Five-Year Contract with RR Waste Solutions, Inc. to Provide Residential Waste, Commercial Waste, Bulky Waste, Yard Waste, and Recycle Collection and Disposal Services. - Ryan Rapelye, Assistant City Manager Councilperson Contreras moved to discuss Ordinance No. O: Councilperson Luna seconded the motion. Mr. Robert Eads, City Manager, stated that representatives from Red River were in attendance. He stated that the compaction ratios (1,200 pounds per cubic yard) were reduced to 1,050 pounds. Currently, they are averaging 700 pounds per yard. There will be no Administrative Fee if achieved. If the compaction ratio gets worse, the Administrative Fee will apply. Mr. Eads referred to a hand out and stated that, under Expenses, the Refuse Service Contract for the FY Adopted and Revised Budget $3,137, 127. Under Balance, the Original Price Proposal Refuse Contract Proposal Difference is $3, , while the Revised Alternate Proposal is $3,067,968. The Revised Balance for the Revenue Increase by 8% is $355,756, an Increase by 8.5% is $378,016 and an increase by 10% is $422,130. He stated that the Revenue Increases are not exact numbers because they do not know the tonnage that will be produced, nor can they predict recycling. Mr. Eads also stated that a 5% Increase without recycling will only "break even" and would not leave the City in a good position. Mayor Roberto Fernandez stated a 21% increase to the Maintenance & Operations is too high. He stated that it is a good contract, but referred to page 7, Repairs. The Mayor stated that the customer would have to pay a fee for a cart and a delivery fee. Ms. Suzanne West, City Attorney, stated that the initial delivery is free. If the cart needs repairs, they will pay the $7.50 delivery fee. Mr. David Cooper, Red River, stated that they have to re-coup the expense. Ms. West reiterated that it was only for repairs and Mr. Cooper stated that if it is a minor repair, such as a wheel, there is no charge. The Mayor they were increasing the fee from $18.18 to $ He stated that he has a problem with the increase. The bulk of complaints are over brush pick-up. The new contract will take the task away from Red River and give the responsibility to the City. Mr. Cooper stated that the 21% increase is because they have less employees and they had to repair equipment. He believes this to be a good contract and pointed out that everything is more expensive. He stated that the City and Red River have been working back and forth on the contract. The City will see recycling benefits in a few years. The Landfill will be evaluated in a few years to look at savings. Also, recycling steers away from the Landfill. Councilperson Wrob asked if there was an incentive for going over the compaction rate. Mr. Eads stated that the City could, but if they do not achieve it, they will be fined. The City has to look at costs, which could be large. Mr. Cooper pointed out that they do not know what materials will be coming in, i.e. construction materials. Councilperson Arreola asked, besides the $2.99 for recycling, what other increases are there? Mr. Eads pointed out that, if the City remains at the current rate, the City will be in the red. He asked that they look at the Revised Balance %'s and recommended the 10%. He stated that the City pays on the Landfill side of this. Councilperson Contreras stated that an increase will hurt some people. Councilperson Wrob stated that he feels that the City needs to pass on the increase due to the General Fund subsidizing shortages. Councilperson Arreola asked if they can ensure that this contract is better than the current one. Ms. West answered yes. The Mayor asked if the M & O is negotiable and if the Council could go into Executive Session to discuss it. Ms. West answered yes. Councilperson Garza asked who will be overseeing this. Mr. Eads stated Hector Canales, himself and sometimes Suzanne West and Manuel Chavez. He stated that there are tools in this contract with

This would involve an eight and a half percent (8.5%) increase to all solid waste accounts and landfill site fees. BACKGROUND: After reviewing the proposal for a Refuse Service contract the City staff reviewed and recommends an increase of 8.5% to rates for collecting and hauling solid waste, and other refuse at the city landfill site. The solid waste and landfill site fees were last amended in October By having the fees increased, it will generate the revenue that is necessary to service all solid waste accounts and meet the needs of the Refuse operating expense in conjunction with the new refuse contract for DISCUSSION: As per discussion during the regular City Council meeting of December 17, 2013, staff recommended to increase the rates to 10% for all solid waste accounts and landfill site fess, while reducing the cost of an additional 96 gallon cart to $5.00. During the special Council meeting on December 30, 2013, staff introduced other scenarios including a 8.5% increase. This ordinance will also introduce new fees that have been identified as part of the new refuse service contract. The increase in revenue will help meet landfill needs and provide services to all residential and commercial accounts under the new refuse service contract. See Exhibit A The landfill site fees were last amended in October of The fees proposed for amendment are: 1.) Eads to apply for and accept the FY2012 Operation Stonegarden Supplemental Grant through the Val Verde County Sheriff's Office. BACKGROUND: On October 1, 2012, the Department of Homeland Security Secretary announced Operation Stonegarden along the Mexican border. Val Verde County received $840, to purchase additional equipment and overtime to help fight crime along the border. The County earmarked $116, to the City of Del Rio Police Department. DISCUSSION: The funds will allow the Del Rio Police Department to purchase one (1) 2014 Chevrolet Tahoe PPV for $45, and pay overtime in the amount of $71, PROS: The equipment in this grant will enhance our law enforcement response and modernize our agency. The equipment purchase through the grant will not require any matching funds or the use of the budgetary process to procure the needed equipment. Also, this grant provides overtime monies through the grant to pay for the manpower utilized and will not require any matching funds or the use of existing budgeted funds. CONS: The purchase of the needed equipment and overtime will cost the City of Del Rio $116, if this grant is not utilized. RECOMMENDATION: Staff recommends approval of an ordinance to authorize and direct City Manager Robert A. Eads to apply for and accept the FY2012 Operation Stonegarden Supplemental Grant through the Val Verde County Sheriff's Office. EADS TO APPLY FOR AND ACCEPT ON BEHALF OF THE DEL RIO POLICE DEPARTMENT, TO THE BORDER SECURITY PROGRAM (STONE GARDEN) FY2012, TO PROVIDE ADDIONAL MANPOWER BY LOCAL LAW ENFORCEMENT AGENCIES FOR STATE LED BORDER SECURITY BY PROVIDING THE DEL RIO POLICE DEPARTMENT WITH PAYMENTS OF OVERTIME, OPERATIONAL COSTS AND EQUIPMENT TO ASSIST WITH THE DRUG AND CRIME ACTIVITY ALONG THE U.S./MEXICO BORDER, IN THE CITY OF DEL RIO. BACKGROUND: There have been classification and compensation plans that have been approved for the Non-Civil Service and Civil Service employees recently that do not specifically address a pay table for the Fire Chief, Deputy Fire Chief, Police Chief and Police Captains. They are mentioned in each of the classification and compensation plans mentioned above which has caused confusion. This is an effort to specifically address the positions of Fire Chief, Deputy Fire Chief, Police Chief and Police Captains with a specific pay table for FY just as all other City employees are. DISCUSSION: There was a section in the Non-Civil Service classification and compensation plan that was approved by O: that provided a 4% cost of living to the Fire Chief, Deputy Fire Chief, Police Chief and Police Captains for FY but there was no pay table showing the positions mentioned. The revised classification and compensation plan for the Fire Chief, Deputy Fire Chief, Police Chief and Police Captains includes the following: 4% Cost of living increase applied to the compensation table in exhibit A and B PROS: The classification and compensation plans continue to be a working document for the City of Del Rio. Cost of living increases are beneficial for City of Del Rio employees and their families. CONS: This revision of the classification and compensation plan will increase personnel costs for the City of Del Rio. RECOMMENDATION: Staff recommends approval of an ordinance to adopt the revised classification and compensation plan for the Fire Chief, Deputy Fire Chief, Police Chief and Police Captains. Eads to reject all previously submitted proposals and to give notice to re-advertise for the invitation of bids for the construction of the Kings Way Overlay project. BACKGROUND: The original project shall consist of Kings Way from Cantu Drive to Windcrest Circle (4,390 Feet). The construction shall consist of wedge milling the pavement edges from 1" to 0" six feet wide. Once that is done there will be a 1 course surface treatment placed to seal the existing cracks and 1.5" final Hot Mix Asphalt Concrete Pavement. New striping will be installed. Staff identified additional paving to be included in the project. This section is Wildcat from Cantu Drive to Ramon Cardenas Drive (2,480 Feet). The same construction method will be used as described in the previous section The project total is now 6,870 Feet. DISCUSSION: The City of Del Rio only received two bids on this project. The first was from 90 West Contractors in the amount of $332,657 but did not submit the required forms and was considered non responsive. The second was from Reece Albert, in the amount of $376,008 with all the forms included. The estimated construction cost was $370,000. Staff discussed the non responsive bid and the possibility of extending the project to include Wildcat and determined that rejecting bids and rebidding would be the best course of action. PROS: By approving this Ordinance the City will be able to request bids for the entire Kings Way project, adding the portion from Cantu to Ramon Cardenas.. CONS: By approving this ordinance prices could potentially be higher. RECOMMENDATION: Staff recommends approval on an ordinance to authorize and direct City Manager Robert A. Eads to reject all previously submitted proposals and to give notice to re-advertise for the invitation of bids for the construction of the Kings Way Overlay project FISCAL IMPACT: Fiscal Impact
