Vote 2-0 Ms. Gooch-Yes Ms. Ford-Yes Ms. Gooch, Vice Chair, moved to approve the minutes of the regular meeting of March 6, PRELIMINARY DISCUSSION OF THE PERSONNEL COMMISSION BUDGET FOR THE FISCAL YEAR DIRECTOR S REPORT 205. Mr. Cobos, Personnel Director, presented the preliminary Personnel Commission Budget to the Commission for discussion. No action was required Recruitment updates: Mr. Cobos provided updates on completed eligibility lists, along with current and upcoming recruitments. Mr. Cobos reviewed two errors made on the Custodian II and the Media Center Clerk eligibility lists. Staff made the appropriate corrections, reviewed the errors with Human Resources, and apologized to the applicants. Staff has reviewed and corrected department procedures to prevent errors in the future. Page 1 of 5

7 207. Classification and Salary updates: Mr. Cobos reported that the Food Services study completed in 2015, will be re-examined and recommendations will be submitted to Administration for review. Mr. Cobos, in the absence of Mr. Samreth, Personnel Analyst, reported that Ms. Jill Rojas, Assistant Superintendent, Human Resources, met with staff and provided suggestions to incorporate in the class descriptions for the Instructional Support Study. Staff will schedule discussions with incumbents and with the Unions, prior to making recommendations to the Commission. Mr. Cobos reviewed the verbiage changes made to the reclassification recommendation for Associate Personnel Analyst to Personnel Analyst, listed on the agenda Mr. Cobos invited the Commissioners to attend the following conferences: PCASC Mini-conference in Anaheim on June 1, CSPCA Annual conference in Anaheim in February Mr. Cobos reminded the Commissioners of the Classified Employee Service Awards on Wednesday, April 18, He welcomed and invited everyone to attend the celebration with the classified employees being honored. COMMUNICATIONS 210. Ms. Margaret Caldera, CSEA President, welcomed Mr. Cobos to his new position of Personnel Director. Ms. Caldera spoke to the Commission to review CSEA concerns regarding the action taken on July 11, 2017, to reclassify the position of Associate Personnel Analyst to Personnel Analyst, and the revised class description and salary allocation for the Warehouse Delivery Worker Mrs. Annie Bui, Associate Superintendent, Business Services, spoke to the Commission to clarify that the budget process should have included a meeting with her to review the proposed budget, prior to submitting it to the Commission, and that she had not yet reviewed the preliminary Personnel Commission budget. Mrs. Bui, on behalf of Business Services, requested that the Commission rescind the action of July 11, 2017, to reclassify the Associate Personnel Analyst to Personnel Analyst. The District opposed the reclassification because it would create a misalignment in the management to employee ratio Ms. Jill Rojas, Assistant Superintendent, Human Resources, welcomed Mr. Cobos to the position of Personnel Director. 8 Ms. Rojas thanked Ms. Patricia Heineke, Interim Personnel Director, for recognizing the memo dated July 11, 2017, to reclassify the Associate Personnel Analyst to Personnel Analyst, had incorrect information. She requested the Commission to table the action on the agenda and schedule a meeting between the District and the Commission in order to discuss and agree on a resolution Ms. Marie Erazo, Instructional Aide II Special Education (IA II), Stimson Learning Center, addressed the Commission to inquire about the status of the Instructional Support Study. She expressed concern that the current class description does not include some of the duties and training required of the position. Ms. Erazo believes the program at Stimson and the duties performed by the IA II s provide necessary support to the District and the Community. She requested the additional duties and required training be included in the class description, along with appropriate compensation Ms. Maria Wise, Instructional Aide II Special Education, Stimson Learning Center, spoke to the Commission to express the same concerns as Ms. Erazo. She agreed that the duties and training required of the position need to be included in the class description, along with appropriate compensation Ms. Liza Guzman, Instructional Aide II Special Education, Stimson Learning Center, expressed the same concerns as Ms. Erazo and Ms. Wise regarding the class description and appropriate compensation. In addition, she shared her concern for the safety of the students and staff, because there is no security assigned to the Stimson Learning Center site Ms. Jeanette Raygoza, Personnel Technician, addressed the Commission to ask why the Commission approved replacing the Senior Personnel Analyst position with Personnel Analyst. Ms. Ford thanked the Stimson Learning Center IA II s for their participation in the meeting, and expressed appreciation for the work being performed at Stimson. Ms. Ford thanked Ms. Carol Kelly, Personnel Assistant, for her dedicated service to the District and Personnel Commission Ms. Gooch expressed her support of classified employees and thanked the employees in attendance for sharing their concerns with the Commission Ms. Perez thanked the audience for attending the meeting, and expressed her appreciation to the IA II s from Stimson Learning Center for sharing their concerns. 20 PROVISIONAL ASSIGNMENT REPORT April 2018 Education Code Sections on Provisional Assignment When no eligibility list exists for a position in the classified service, an employee may receive provisional appointments which may accumulate to a total of 90 working days. A 90- calendar-day interval shall then elapse during which the person will be ineligible to serve in any full-time provisional capacity. No person shall be employed in provisional capacities under a given governing board for a total of more than 126 working days in any one fiscal year, except that when no one is available on an appropriate eligibility list for a part-time position, as defined in Section 45256, successive 90 working days provisional appointments may be made to the part-time position for a total of more than 126 working days in any one fiscal year The personnel commission may authorize the extension of a provisional employee's assignment for a period not to exceed 36 working days provided the following requirements are met: (a) An examination for the class was completed during the first 90 working days of his provisional assignment. (b) Evidence satisfactory to the personnel commission is presented indicating: (1) That an adequate recruitment effort has been and is being made. (2) That extension of the provisional assignment is necessary to carry on vital functions of the district. (3) That the position cannot be satisfactorily filled by use of other employment lists or procedures. 22 SUBJECT TO THE APPROVAL OF THE PERSONNEL COMMISSION RECLASSIFICATION: ASSOCIATE PERSONNEL ANALYST TO PERSONNEL ANALYST Report Date: April 26, 2018 Recommendation The Personnel Director recommends that the Personnel Commission rescind the action taken July 11, 2017, to reclassify the Associate Personnel Analyst incumbent to the position of Personnel Analyst, and place at Range M-7 effective July 12, 2017 to comply with Education Code Background During the Personnel Commission meeting on July 11, 2017, the Commission took action to reclassify the Associate Personnel Analyst incumbent to the position of Personnel Analyst. Since that time, this action has not been sanctioned due to conflicting points of view between the Personnel Commission and District Administration regarding the action. A few of the issues that have been brought forth are: Number of management positions in the Personnel Commission (the reclassification of the Associate Personnel Analyst position to Personnel Analyst would create another management level position with a ratio of 3 management positions out of 6 total positions in the Personnel Commission office) o This management employee to total employee ratio is unfavorable in comparison to all other departments in the district Conflicting points of view regarding the reason (gradual accretion of duties over two years) for the reclassification of the position o Due to specific circumstances related to the intermittent nature of the two year time frame in which the gradual accretion of duties occurred, there is not alignment on the reason and the wording of the original action that took place on July 11, 2017 Analysis Actions Taken Meetings have taken place to understand the concerns of those involved and interested in the original action that took place during the Personnel Commission meeting on July 11, 2017: o Personnel Commission Meeting on October 3, 2017 o Personnel Commission Meeting on November 7, 2017 o Personnel Commission Meeting on April 10, 2018 o Meeting with Jill Rojas, Assistant Superintendent, Human Resources o Meeting with Annie Bui, Associate Superintendent, Business Services o Meeting with Margaret Caldera, CSEA President o Meetings with Patricia Heineke, Interim Personnel Director Review and analysis of the duties for the classifications of Associate Personnel Analyst and Personnel Analyst o Findings No significant overlap of duties based on the class description

23 Recommendation Based on all the information that has been gathered and reviewed, the Personnel Director recommends rescinding the action taken July 11, 2017, to reclassify the Associate Personnel Analyst incumbent to the position of Personnel Analyst, and place at Range M-7 effective July 12, 2017 to comply with Education Code This action will allow the Personnel Director to further analyze the department work structure and work flow to assess and ensure efficiencies, productivity and achievement of strategic objectives of the Personnel Commission. In addition, the Personnel Director will be able to ensure the team is working in their intended classification until it can be determined if a reclassification is indeed necessary. At that time, the topic of reclassification can be validated, revisited and presented in a manner in which the action will be supported on all sides.
