1 MAY 20, 2015 CITY COUNCIL BRIEFING AGENDA CERTIFICATION This certification is given pursuant to Chapter XI, Section 9 of the City Charter for the City Council Briefing Agenda dated May 20, We hereby certify, as to those contracts, agreements, or other obligations on this Agenda authorized by the City Council for which expenditures of money by the City are required, that all of the money required for those contracts, agreements, and other obligations is in the City treasury to the credit of the fund or funds from which the money is to be drawn, as required and permitted by the City Charter, and that the money is not appropriated for any other purpose. 4 General Information The Dallas City Council regularly meets on Wednesdays beginning at 9:00 a.m. in the Council Chambers, 6th floor, City Hall, 1500 Marilla. Council agenda meetings are broadcast live on WRR-FM radio (101.1 FM) and on Time Warner City Cable Channel 16. Briefing meetings are held the first and third Wednesdays of each month. Council agenda (voting) meetings are held on the second and fourth Wednesdays. Anyone wishing to speak at a meeting should sign up with the City Secretary s Office by calling (214) by 5:00 p.m. of the last regular business day preceding the meeting. Citizens can find out the name of their representative and their voting district by calling the City Secretary s Office. Sign interpreters are available upon request with a 48-hour advance notice by calling (214) V/TDD. The City of Dallas is committed to compliance with the Americans with Disabilities Act. Rules of Courtesy City Council meetings bring together citizens of many varied interests and ideas. To insure fairness and orderly meetings, the Council has adopted rules of courtesy which apply to all members of the Council, administrative staff, news media, citizens and visitors. These procedures provide: That no one shall delay or interrupt the proceedings, or refuse to obey the orders of the presiding officer. All persons should refrain from private conversation, eating, drinking and smoking while in the Council Chamber. Posters or placards must remain outside the Council Chamber. No cellular phones or audible beepers allowed in Council Chamber while City Council is in session. Citizens and other visitors attending City Council meetings shall observe the same rules of propriety, decorum and good conduct applicable to members of the City Council. Any person making personal, impertinent, profane or slanderous remarks or who becomes boisterous while addressing the City Council or while attending the City Council meeting shall be removed from the room if the sergeant-at-arms is so directed by the presiding officer, and the person shall be barred from further audience before the City Council during that session of the City Council. If the presiding officer fails to act, any member of the City Council may move to require enforcement of the rules, and the affirmative vote of a majority of the City Council shall require the presiding officer to act. Section (b) of the Texas Election Code provides, "For an election held on the uniform election date in May, the local canvass must occur not later than the 11th day after election day and not earlier than the later of: (1) the third day after election day; (2) the date on which the early voting ballot board has verified and counted all provisional ballots, if a provisional ballot has been cast in the election; or (3) the date on which all timely received ballots cast from addresses outside of the United States are counted, if a ballot to be voted by mail in the election was provided to a person outside of the United States." The canvassing period falls between Tuesday, May 12, 2015, and Wednesday, May 20, Canvassing the election results on Wednesday, May 20, 2015, provides assurance that all votes cast are counted/canvassed with no special meeting being required to accept the canvassing committee's report. No candidate in Places 3, 7, 8 and 10 received a majority of the votes cast in the general election held Saturday, May 9, 2015; therefore, a runoff election is required to elect council members to represent Places 3, 7, 8 and 10. Section 2.025(a) of the Texas Election Code provides, in part, that "... a runoff election shall be held not earlier than the 20th or later than the 45th day after the date the final canvass of the main election is completed." In accordance with the joint election contract with the Dallas County Elections Department, June 13, 2015 has been determined as the runoff election date. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) Resolution No , passed by the City Council on March 25, 2015, approved an ordinance amending Ordinance No to change certain election day polling locations and certain early voting locations, dates, and times for the Saturday, May 9, 2015, general election. The Elections Administrator must provide an estimate of the election cost to be deposited in a general election services contract fund. The resolution which authorized the joint election contract for May 9, 2015 provided that, in the event a runoff election becomes necessary, the Elections Administrator would provide the City (and any other jurisdictions holding a runoff) with an estimate of additional election expenses. An increase for the City Secretary's Elections budget is necessary to cover the current estimated additional cost of the contract for a runoff election and additional advertising, translation and security expenses. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) Resolution No , on March 25, 2015, passed by the City Council, authorized an increase in the joint elections agreement and election services contract between the City of Dallas and Dallas County for the May 9, 2015 general election. Resolution No , on February 25, 2015, passed by the City Council, authorized a joint election agreement and election services contract between the City of Dallas, Dallas County, and various other jurisdictions within Dallas, Collin and Denton Counties, for the conduct of a joint election to be held on Saturday, May 9, 2015 and incorporated certain stipulations should a runoff election be needed.

27 COUNCIL CHAMBER May 20, 2015 WHEREAS, the City of Dallas held a general election on Saturday, May 9, 2015; and WHEREAS, no candidate for Member of Council Place 3, 7, 8 or 10 received sufficient votes to be elected at that election; and WHEREAS, the City Council has ordered a runoff election to be held Saturday, June 13, 2015, in City Council Districts 3, 7, 8 and 10; and WHEREAS, the City contracted with the Dallas County Elections Administrator for election services for the May 9, 2015 general election in accordance with Subchapter D of Chapter 31 of the Texas Election Code; and WHEREAS, the election services contract provides that, in the event a runoff election is necessary, the Elections Administrator will furnish the City Secretary with an itemized list of additional estimated election expenses to be deposited in the election services contract fund after authorization by the City Council, and that the Elections Administrator will continue to perform or supervise the performance of election duties and functions necessary for the proper administration of the runoff election; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DALLAS: Section 1. That the election services agreement between the City of Dallas and Dallas County is extended to provide for services for the runoff election to be held Saturday, June 13, Section 2. That the City Controller is hereby authorized to transfer funds not to exceed $460,000 from Fund 0001, Dept. NBG, Unit 1000, Revenue Source RTRF, to Fund 0001, Dept. SEC, Unit 1190, Revenue Source 9229; and a clearing entry, in the same amount, to Fund 0001, Dept. BMS, BSA 0991 (Debit) and to Fund 0001, Dept. BMS, BSA 0950 (Credit). Section 3. That the City Manager is hereby authorized to increase the City Secretary's Office appropriations in an amount not to exceed $460,000 in Fund 0001, Department SEC, Unit 1190, Object 3070; increase total General Fund expenditure appropriations by $460,000 from $1,167,400,810 to $1,167,860,810; and increase total General Fund revenue appropriations by $460,000 from $1,167,400,810 to $1,167,860,810. Section 4. That the Chief Financial Officer is hereby authorized to disburse funds in accordance with the terms and conditions of the contract from Fund 0001, Dept. SEC, Unit 1190, Object 3070, Encumbrance No. 15ELE1190I13, to Dallas County Elections (Vendor ) in an amount not to exceed $460,000.

The joint election agreement and election services contract between the City of Dallas, Dallas County and other jurisdictions in Dallas County for the conduct of a runoff election to be held on Saturday, June 13, 2015, provides the Dallas County Elections Administrator be responsible for the selection, training and compensation of all precinct election judges and clerks, early voting clerks, and other appointed election officials. However, it is typical that the election judges and alternates used during a May general election will remain the same during a runoff election. This action authorizes the Elections Administrator to appoint election officials for the June 13, 2015 runoff election from the list of currently qualified election judges and alternates maintained by Dallas County. The election services contract also provides a procedure for a participating jurisdiction to ask that a particular person be appointed as election judge or alternate judge in the event the County list suggests a different person, subject to agreement by all jurisdictions holding an election at the polling location. Dallas County Elections Department will be responsible for the appointment of the presiding judge and alternate judge for each polling location subject to the approval of the city council.

That the Dallas County Elections Administrator be notified the City interposes no objection to the appointment of the individuals named on Attachment A as election judges or alternate election judges for the precincts shown beside their names for the June 13, 2015 joint runoff election, insofar as each meets the eligibility requirements of Subchapter C of Chapter 32 of the Texas Election Code, except as noted on Attachment B. That final selection, appointment, training, and pay of election judges, alternate election judges and election clerks shall be in accordance with the joint election agreement and election services contract. That the City Secretary is authorized to approve on behalf of the City of Dallas any changes in the list of recommended election/alternate judges which may become necessary because of the inability or refusal to serve of any of the persons named in Attachment A or Attachment B.
