1 AMERICAN COUNCIL OF ENGINEERING COMPANIES/MARYLAND EXECUTIVE COMMITTEE MEETING SEPTEMBER 17,2015 A meeting of the Executive Committee of the American Council of Engineering Companies/Maryland was called to order by W. Barrett, President, at 8:04 A.M. on Thursday, September 17,2015 at the ACEC/MD office, Baltimore, MD. IN ATTENDANCE: A. Barrett, President; S. Robinson, Vice President; J. Jannetti, Treasurer; S. Taub, Secretary; T. Frascarella, S. McCone, M. Sidhu, V. Pielli, ACEC Directors; D, Knight, ACEC Alternate Director; J. Amoriello, J. McCormack, and J. Otradovec, Executive Director MINUTES OF THE AUGUST 27th MEETING: A motion was duly moved and seconded that the minutes of the August 27,2015 meeting be approved. FINANCIAL REPORT: J. Jannetti distributed copies of the Statement of Financial Condition for the Council as of August 31,2015, as follows: ASSETS: Cash checking T. Rowe Price Prime Reserve Fund Accounts Receivable Dues Receivable Local National Affiliate Dues Receivable Joint Council Dues Receivable LIABILITIES: Accounts Payable ACEC/PAC Raffle NET WORTH: Beginning Balance 7/1/15 Total to Date $ 217, , , $ 199, , , $ 555, $ 32, $ 36, $ 280, $ 518, The Statement of Income and Expense, which is attached to the minutes, was reviewed for two months ending August 31,2015. J. Jannetti reported that, while a substantial amount of dues income was received, it is imperative that firms pay all outstanding invoices. The statement reflects income from the ACEC BIT royalty payment, and expenses associated with printing the EEA brochure and conference registration for the upcoming ACEC conference. After discussion, it was duly moved and seconded to accept the financial report as presented. 1

2 OLD BUSINESS: 1. SMART Goals W. Barrett reported that a meeting will be held at McCormick Taylor's office on September 28* to update the Smart Goals for the new fiscal year. Committee chairs are requested to provide goals for the year. 2. Liquidated Damages for MBE Compliance S. McCone and J. Otradovec reported the following: S. McCone, C. Ritter, and J. McBride participated in the kick off meeting for the Task Force to Study Small and Minority Design Firm Participation in State Procurement on August 27*. During their presentations, agency procurement officials did not provide many details. Herb Jordan, Deputy Secretary at GOMA, expressed support for expanding the SBR program and concerns about inefficiencies inherent in MBE programs. Wayne Frazier and a couple of engineering firm representatives from the Maryland Washington Minority Companies Association (MWMCA) have accepted ACEC/MD's invitation to attend ACEC/MD's GMM on October 8*. He also expressed willingness to work with ACEC/MD to correct the law so that it would not damage engineering firms. A meeting is scheduled with GOMA Secretary Rhee on September 23"* 3. Amicus Brief J. Otradovec reported there has been no update on the amicus on the merits brief regarding a case in the Supreme Court in Virginia involving an underground stormwater management system. The case revolves around a design engineer being held responsible for the manufacture's failure to provide material as represented in the manufacturer's literature. 4. Support/Endorsing Federal House and Senate Candidates J. Otradovec reported the following: Congressman Harris' campaign office is identifying dates in late October through early December for a fundraiser at the Engineers Club. As was done in the past, the Executive Committee will act as the host committee, and contribute $500 and secure five other contributors at $125 each. Member firm representatives have been contacted by House of Delegates E&T Chair Barve about contributing to his campaign for an open U.S. Congressional seat. Due to his position in the General Assembly, the Legislative Committee will be asked to weigh in on whether ACEC should be contacted about contributing to his campaign. For the open Senate seat, reportedly. Congressman Van Hollen has outraised Congresswoman Edwards by 4:1 and has a 9:1 advantage in cash in hand. He has raised 70% of his funds from in state sources versus 19% for Edwards. SPECIAL REPORTS: 1. ACEC Reports J. Otradovec reported the following: In preparation for ACEC's next threeyear budget, the ACEC Budget Committee is seeking assistance in identifying priority areas and best ideas for allocation of resources. ACEC's Fall Conference will be held in Boston, October 1417 at the Westin Copley Place. The leadership breakfast and board meeting will be held Wednesday, October 14*. New this year. Local Color Night will be included in the registration package. 2

3 The voting item on the BOD agenda proposes to change "growing" ACEC/PAC to a $1 million per year PAC to "sustaining" the PAC at that level. Discussion items will include achieving the $1 million goal for this year; latest trends in M&A; and a presentation from ACEC Treasurer H. Floyd on the new threeyear budget preparation. ACEC/MD's officers will participate in an orientation session for MO leaders, October While ACEC/MD has achieved $ 14,050 of the $20,923 goal for ACEC/PAC in 2015, only 45 out of the required 108 raffle tickets have been purchased by member firm employees. In order to comply with federal election laws, member firm employees are encouraged to contribute to this effort by purchasing ACEC/MD raffle tickets. The drawing will be held October 8*. COMMITTEE REPORTS: 1. Educational Facilities M. Sidhu reported a meeting is scheduled with UMCP on September 17*. 2. DGS Liaison/Interprofessional M. Sidhu reported that, at DOS' request, the next liaison meeting has been rescheduled for September 30*. DGS' Assistant Attorney General Turhan Robinson is scheduled to attend to address ACEC/MD's concern about DGS' opposition to the Duty to Defend legislation. Also, responding to requests from member firms, ACEC/MD has included the D/B issue on the proposed agenda. 3. Small Business Enterprise J. Otradovec reported the next committee meeting is scheduled for October V\ 4. MDOT Liaison T. Frascarella and J. Otradovec reported the following: SHA An internal meeting was held following the August Executive Committee meeting to address open SHA issues such as: o Pilot preengineering policy Apparently, even though firms were asked to comment on their experience with the policy, there is a lack awareness of its existence by both SHA and the consultant community, o o o $80/hour threshold Practical Design While ACEC/MD has recommended participants for a Practical Design subcommittee, SHA's Planning group has initiated an independent discussion group. The ACEC/MD initiated task force would address expectations from MDOT Secretary Rahn. Recommended participants include: J. Makar (WRA), S. Montgomery (RK&K), S. Hawtof (GF), W. McFall (AECOM), and D. Nichols (PTG). Although D. Nichols works out of PTG's Missouri office, he was cited by Secretary Rahn as an individual that is well versed on his interpretation of the process. Timely payment on SIRE Construction Inspection contracts A meeting, attended by both prime and sub representatives, was held with SHA representatives on September 16*. All parties agreed that an initial course of action would include ensuring that primes provide 3

4 subs with detailed billing procedures and that SHA would eliminate the requirement to provide Form 00C71 otherwise known as the PIF. SHA is also reviewing the possibility of changing the rules for time and expense charges on these contracts, o Due to the desire to include new SHA Administrator Greg Johnson at the next partnering meeting, the meeting is rescheduled for October 7* o SHA's use of MES. o Alternative delivery subcommittee's approach to progressive desigir1?uild SHA is working toward arranging a public forum to address the issue. o MTBMA is concerned about the schedule for the Rt. 404 project and will pursue a meeting with SHA to address the process. o AECOM is working with SFIA on a pilot program focusing on highway safety. Their employees will be invited to a luncheon program that is envisioned as a model that could be rolled out to other o firms. Consistency across all modes After discussing the matter with SHA and MTA, ACEC/MD will schedule a meeting with MDOT. It was reported that SHA will not allow primes to pass the cost through to subs for the cost of the sub's protection equipment on highways. 5. Construction Services J. Amoriello reported the following: Kickoff meetings have been held addressing training, certifications and the approval process. Only a limited number of firms responded to the request for information on training programs in place. At ACEC/MD's request, SHA has agreed to extend the due date for the Supplemental Engineering Services contracts from September 16* to September 30th. MDTA's D. Ferrara will be contacted about hosting the next semiannual meeting in the November time frame. 6. Business Finance T. Frascarella and J. Otradovec reported the following: A meeting is scheduled with MTA Audits on September 22 '^ to address their Price Proposal Guidelines and other issues such as approving 2014 audits A meeting is scheduled with SHA's B. Conner, N. Calvert, and J. Pasch on September 2E' to address open items such as the application of field versus office overhead. An internal meeting will be held September 24*. Following up on concern from the last meeting that SHA is not applying their new mileage policy retroactively, it was reported that firms must make a request in writing. 7. Membership S. Robinson presented applications from AKRF, INC. and CH2M HILL for consideration as Regular members. After discussion, a motion was duly made and seconded that: "The applications from AKRF, INC. and CH2M HILL for Regular Membership be presented to the membership for acceptance in ACEC/MD." Motion approved. 4

5 Also, contact has been made with the following firms, who continue to express interest in joining ACEC/MD: Chesapeake Environmental Management (CEM), MA Engineering, ISR, Aurora, KimleyHom, CityScape Engineering and Bryant Assoc. ARCADIS and Bowman Consulting have also been identified as candidates. D. Knight and S. McCone will take another run at CEM, D. Knight will follow up with MA Engineering and J. Jannetti will make another contact with ISR. 8. County/Municipal Government Liaison A. Barrett reported that, following a meeting on September 2"*^, it was determined that there was insufficient time to prepare a presentation for the CEAM Conference focusing on alternative delivery systems. CEAM has expressed interest in providing an opportunity for the program during next year's fall conference. 9. Gov. Golf Outing Greystone Golf Course, White Hall (May 2,2016) No report. 10. Human Resources J. Otradovec reported the committee meeting scheduled for September 10* will be rescheduled in November. 11. QBS J. Otradovec reported that QBS Council Executive Director R. Lepson participated in the planning session for the CEAM presentation, and is working with the chair to develop a strategy for addressing QBS in specific counties. Also, concern was expressed that, due to a perceived lack of professional services, MAA recently pulled back a project and readvertised it as a price proposal. 12. Awards & Recommendations J. Otradovec reported that there were 23 entries in this year's EEA competition. The deadline for entries in ACEC's Young Professional competition is October 2^'^. Also, firms are encouraged to consider candidates for the Community Service Award. 13. Environmental J. Otradovec reported the chair is planning on scheduling a meeting in October. 14. Public Relations J. Otradovec reported that at the committee meeting on September 15*, it was decided that a Linkedin account should be established for ACEC/MD. Initially, the account will be used to establish groups for committees and to publicize ACEC/MD events and grassroots activism. Concern was expressed that recruiters are now using Linkedin to steal employees. Also discussed at the meeting was recognizing ACEC/MD's 60* anniversary, increasing ACEC/MD's external publicity, and recent problems with ACEC/MD's website due to the presence of old codes. 15. CEPAC S. McCone reported the next committee meeting is scheduled for September 30*. A list of recent contributions to the following elected officials was reviewed: Sen. Kasemeyer Sen. Reilly Del. Carey Del. A. Miller Del. B. Robinson Del. West 5

6 16. Legislative S. McCone and J. Otradovec reported the following: Due to the Governor's edict that no new fees would be initiated, DLLR will be issuing guidance regarding firm permitting. A meeting is scheduled with Delegate Rosenberg, lead sponsor of the Certificate of Merit legislation, on September 22"'' to address strategies for getting the legislation through the Senate JPR committee. A meeting is being pursued with JPR Chair Zirkin to address both Certificate of Merit and Duty to Defend. Representatives from Affiliate members Lee & McShane and CBIZ will attend the September 30* DGS Liaison meeting to address DGS' opposition to the Duty to Defend legislation ACEC/MD's Legislative Breakfast is scheduled for November 12*. The Executive Committee suggested the following speakers: former Delegates DeBoy and Malone, Sandy Schrader, and Jim Smith. Jim Soltesz has been named cochair of the state Regulatory Reform Commission addressing efficiencies in government. To finalize a speaker for the legislative breakfast and initiate discussion of the 2016 business agenda, a committee meeting is scheduled for September 30*. ACEC/MD will once again be represented at the Black Caucus event in November. Also see Old Business. 17. EWC/ESBAC Liaison J. Otradovec reported that mentors are needed for the SABES program in Baltimore City Schools. 18. Program/Annual Conference (Hyatt Regency, Newport RI, June 2225, 2016) J. Otradovec reported the following: Newport, RI has been identified as the site of next year's conference that will be held June 2225, Incoming ACEC/MD President Barrett as selected the Hyatt on Goat Island, which is located on the water within walking distance of the center of town. Rates for the weeknights will start at $249 per night, while weekend rates are $399. All resort and parking fees have been waived. Shelley Row, P.E., PTOE, MBA will be the featured speaker at the October 8* GMM. Her presentation will focus on how to use neuroscience to understand and activate reward or threat centers in the brain. At the meeting, the EEA finalists and ACEC/PAC raffle winners will also be announced. On November 19* Architect of the Capitol Stephen Ayers, FAIA, LEED AP will discuss doing business with this important agency. 19. Nominating No report. 20. Past Presidents Advisory/Bylaws/FcIIows J. Otradovec reported the committee's annual dinner will be Nov. 4* at Ouzo Bay restaurant in Harbor East. 21. Federal Gov. Liaison/Corps of Engineers Liaison J. Otradovec reported the next semiannual meeting with USACE will be held in the December time frame. 6

7 22. Baltimore City Liaison J. Otradovec reported the next liaison meeting is scheduled for October 5*. In addition to the caps issue, concern has been expressed about the city's overtime policy contained in their new invoicing procedure. 23. Career Outreach J. McCormack reported the committee meeting on September 18* will focus on: getting younger engineers to participate in outreach efforts current initiatives SABES program CTEAC Internships Mentoring Providing speakers A member of the Executive Committee questioned whether ACEC/MD should be focusing on getting younger professionals involved in ACEC/MD since it is important to have the leaders of firms participating. 24. Information Technology J. Otradovec reported the last committee meeting focused on CAD management. Also, committee members were surveyed on typical CAD Manager billing.
