The Oath of Office was signed and presented to the Fund Solicitor. APPROVAL OF MINUTES OPEN SESSION Chair Mahon entertained a motion to approve the meeting minutes of the February 21, 2018 Executive Committee Meeting. Motion by Mr. Wahl, seconded by Ms. Picard, to approve the meeting minutes of the February 21, 2018 Executive Committee Meeting. All in favor. Motion carried. APPROVAL OF MINUTES CLOSED SESSION Confidential Closed Session Meeting Minutes were distributed to the Executive Committee Members. Chair Samuelsen entertained a motion to adopt the Closed Session Meeting Minutes of the February 21, 2018 Meeting of the Fund as presented. Motion by Mr. Ridings, seconded by Ms. Perez, to approve the Closed Session minutes of the February 21, 2018 Executive Committee Meeting as presented. All in favor. Motion carried. The Closed Session meeting minutes of the February 21, 2018 meeting shall not be released to the public until the reason(s) for their remaining closed is no longer applicable and the Fund Solicitor has had the opportunity to review them. Confidential Closed Session Meeting Minutes were collected. CLOSED SESSION - RESOLUTION # Be it moved by the Atlantic County Municipal Joint Insurance Fund that the public be excluded from this portion of the meeting to permit the Executive Committee to consider in closed session matters affecting the safety and property of the public and to discuss pending or anticipated litigation and/or contract negotiations and that the minutes covering these matters and the results of closed session will be released to the public when the reasons for discussing and on them in closed session no longer exists as required by the Open Public Meeting Act.

AUTHORIZATION OF CLAIMS PAYMENTS Chair Mahon presented the claims for payment as discussed in Closed Session. Chair Mahon asked if there were any questions at this time. No questions were entertained. Chair Mahon entertained a motion to approve the claims for payment as discussed in Closed Session. CLAIMS REVIEW COMMITTEE REPORT OPEN SESSION ITEMS Ms. Perez noted that the Claims Review Committee report was given in closed session and she had nothing further for open session.

10 ACM JIF Executive Committee Meeting Minutes March 27, 2018 Page 6 CLAIMS ADMINISTRATOR S REPORT Lessons Learned from Losses March Mr. Roselli reported that the Lessons Learned from Losses this month focuses on Defense and Indemnity. He noted that when another company is contracted to complete work or provide services, assuring that company and their insurance carrier will defend and indemnify your town is crucial. He encouraged consulting with your town s solicitor, your RMC or one of the other JIF professionals to determine the exposures involved and assess how the risk may be transferred to the other company. He also suggested checking all the indemnification agreements and contracts to make sure your town has been added as the additional insured and you have the certificate of insurance, the signed and dated contract itself and any indemnity agreements in your possession. He noted that by lying the groundwork by assuring these contracts and agreements are executed properly will assist us in defending any claims brought against your town. Mr. Roselli reminded the members to review this newsletter and share it with their employees. Mr. Roselli asked if there were any questions. No questions were entertained. The remainder of the Claims Administrator s report was provided in Closed Session. MANAGED HEALTH CARE REPORT In Ms. Beatty s absence, Mr. Roselli reviewed the Managed Care Report for February Lost Time v. Medical Only Cases Mr. Roselli presented the ACM JIF Lost Time v. No questions were entertained. SOLICITOR S REPORT Mr. DeWeese presented the following reports: Closed Claims Mr. DeWeese noted that there were three (3) case(s) closed in March. He noted that a detailed synopsis of the claims can be found in the agenda packet and provided the following brief synopsis of each case: Closed Case Goodwin Estate v. Township of Galloway Zottola v. City of Ocean City Description Death by Auto via malfunctioning traffic signal. Defense Counsel, L. Patricia Sampoli, Esquire was assigned. Defense Counsel was able to convince the Plaintiff to execute a Stipulation of Dismissal with Prejudice as to the Township as the County maintains and operates the signals. Bike crash. Assigned Defense Counsel James Birchmeier, Esquire, was assigned. Defense Counsel negotiated the settlement from $500,000 to $212,000. The settlement was reached prior to an ERISA lien being asserted in the amount of $98,000.

12 ACM JIF Executive Committee Meeting Minutes March 27, 2018 Page 8 Mancinelli v. Stephen Kane d/b/a Kane builders v. Borough of Wildwood Crest Trip and Fall/sidewalk. Assigned Defense Counsel Jim Birchmeier, Esquire, was assigned. He filed a Motion to Dismiss based upon third-party plaintiff s failure to file the appropriate Notice of Tort Claim. The judge dismissed with prejudice. Bona Fide Offers Mr. DeWeese noted that he provided the Claims Review Committee with a Bona Fide offer report for January 1, 2017 to December 31, He informed the members that this report detailed the cases where a Bona Fide offer was advanced which effectuated a savings by reducing the amount of fees paid to the petitioner s attorney through an advanced offer. For the 2017 Fund Year, $18, in savings on 14 cases was recognized through utilizing this program. Mr. DeWeese complimented Ms. Davidson, Qual- Lynx, and our Assigned Defense Counsel on their efforts in aggressively utilizing this program. Mr. DeWeese stated that John Geaney, a WC attorney at Capehart & Scatchard, sent correspondence noting that yesterday the Senate Labor Committee was considering bill to stop the use of the Bona Fide offer programs. He believed the bill would be approved by the Committee. It will then be voted on by full Senate and then move to the Assembly. He stated this bill will eliminate the savings under the Bona Fide offer program and will eliminate injured employees from receiving money early in the process; thus waiting until the claim has settled. Mr. Geaney noted that this program saves millions a year. Mr. DeWeese noted the MEL drafted correspondence opposing bill. He urged the members to call the legislators if they opposed. Revised Tort Claims Act Questionnaire and Resolution Mr. DeWeese stated that he has completed the revisions to the Tort Claims Act Questionnaire and Resolution. He stated he had consulted with members of the Defense Panel, as well as the liability supervisors and adjusters at Qual-Lynx, and he has included additional questions and updated and revised not only the questionnaire, but the resolution as well. Some of these updates included: Additional requests for all diagnostic testing including CAT scans, MRI s and other medical info; and Additional request for photographs of the scene to be provided, and to identify on the photograph specifically where the incident occurred; and Additional requests to include any and all criminal and traffic tickets/complaints that were issued and the disposition of those charges; and Detailed and specific medical information is requested requiring a more complete medical history, including surgeries; and Detailed and specific employment information section was added. Mr. DeWeese noted that these documents have been provided to the Claims Review Committee for review and approval and will be included in the Executive Committee agenda next month. Once everyone has had the opportunity to review the questionnaire and it is deemed to be acceptable, it will be presented at the April Executive Committee meeting for adoption by the Fund. It will then be distributed to all members for adoption. Once adopted, Qual-Lynx will be responsible for distributing the Tort Claim

13 ACM JIF Executive Committee Meeting Minutes March 27, 2018 Page 9 Questionnaire to a Claimant and receiving the completed Questionnaire on behalf of the member. He noted that the resolution designates Qual-Lynx as the agent for the member. Mr. DeWeese asked if there were any questions. No questions were entertained. COMMITTEE REPORTS Safety Committee March 15, 2018 Ms. Picard noted that the minutes form the Executive Safety Committee meeting will be available at the next meeting. She highlighted: Wellness Policy Ms. Picard noted the Safety Committee is reviewing the existing Wellness Policy and will be asking all members to adopt the wellness policy. Training Ms. Picard asked everyone to review the training schedule and sign up for the required Risk Management Seminar for all supervisors. She reminded the members of the upcoming dates, noting: May 8, September 11, and September 27, Safety Kickoff Breakfast Ms. Picard noted the breakfast was held March 27, 2018 and was very well attended. MEL Safety Education Meeting (Beach Signage) Ms. Picard attended the March 16 th meeting. She noted that they are still working to obtain a professional to work on the beach signage wording. Mr. DeWeese noted that he has contacted a professional for beach signage and he will be submitting a proposal before end of week. Chair Mahon noted that Wildwood Crest is waiting until the professional is in place to replace their signs. New Member Review Middle Township Fire District #1 Mr. Forlenza stated that Middle Township Fire District #1 made application to the JIF in January 2018 as an additional insured through Middle Township as they cannot be a standalone member in the JIF. He noted that they had a very good loss control survey and his office received a complete application from the Risk Manager. He highlighted that their budget is $1.2 million; they carry twelve (12) vehicles valued around $3.4 million; they currently insure three buildings valued around $5.6 million; miscellaneous equipment around $500,000; 38 volunteers; and 9 part time paid employees. He further stated they handle approximately 600 calls per year; no junior firefighter program; no drivers are under 25 years old; and they do not rent out their facilities to third parties. He stated that they have 5 good years of loss history with two property losses valued at $56,000 and seven WC claims valued at $4,700. He informed the members they are looking for an April start date as their current policies are up for renewal at that time. Mr. Forlenza asked if there were any questions. Ms. Stollenwerk inquired why we do not have the New Member Committee review these applicants. Mr. Forlenza stated that the Committee meets to review new member applications. The application before the Fund is really the addition of a new exposure to an existing member. Coverage for fire districts is only available through the insured municipal entity; therefore, he did not see a need for a New Member Review Committee meeting. No other questions were entertained. Motion to Release Assessment and Bind Coverage-Middle Township Fire District #1

14 ACM JIF Executive Committee Meeting Minutes March 27, 2018 Page 10 Chair Mahon entertained a motion to Authorize the Executive Director to release an assessment and bind coverage for the Middle Township Fire District #1. Motion by Ms. Perez, second by Mr. Wahl, to Authorize the Executive Director to release an assessment and bind coverage for the Middle Township Fire District #1 as presented. All in favor. Motion carried. WELLNESS DIRECTOR S REPORT Ms. Valerie Smith noted that her report can be found in the agenda packet. Ms. Smith stated that it is beneficial for a member to have at least one point person for wellness if a committee cannot be formed and she will work with them. She then provided a brief synopsis of the wellness activities for the members including Avalon (Biggest Loser and health challenge), Corbin City (step challenge), Longport (mini health fair), North Wildwood (fresh fruit Fridays; Did you know? ), Sea Isle City(yoga), Ventnor (Biggest Loser with secondary prizes), and West Wildwood (CPR certification). Ms. Smith announced that this month s shout out goes to Estell Manor and Linda Kent. She sent in pictures of employees doing wellness activities and exercises. Ms. Kent created fun ways to incorporate wellness into their daily routines. Ms. Smith noted that the March newsletter was sent via and is on the website. She stated that she wants to remind members that this month s focus is Health Risks from sitting still and stretches for lower back pain. She asked members to share the newsletter. Ms. Smith asked if there were any questions. No questions were entertained. EXECUTIVE DIRECTOR S REPORT Mr. Miola reviewed the Executive Director s Report found in the agenda packet with the membership. He highlighted the following items from his report: Lost Time Accident Frequency Report Mr. Miola noted these are in the agenda packet. He noted that the Atlantic JIF was.99 with the overall average of 1.17 for MEL affiliated JIFs. Certificates of Insurance Mr. Miola stated these are in the agenda packet and will be made part of today s meeting minutes Safety Incentive Program Mr. Miola noted that a letter was ed to all members on or about February 9, 2018 regarding the Safety Incentive Program awards. The training covers the introduction of the cyber risk management program, EPL/POL issues, land use issues and police issues. Please encourage your elected officials to attend. MEL Cyber Risk Management Program Mr. Miola noted that the program was ed to the members on December 18, He stated the Fund Underwriter has started getting checklists back for this program. 22 LESSONS LEARNED FROM LOSSES MONTHLY NEWSLETTER April 2018 MOWER SAFETY Shut the mower down and use a broom handle sized implement to remove stuck objects. Always keep people away from areas being mowed. Footwear that is proper is very important. Ear protection should be worn. Make sure all mower shields and guards are in place. Only mow an area that has been walked to remove objects/obstructions. Wear safety glasses always. Every mower should have a kill switch that stops the engine when the operator is not seated. Reach under a mower only when it is off. Example #1: An employee was cutting the grass on a riding mower when a soccer goal s netting became entangled in the back of the mower. Instead of shutting down the mower and properly untangling the netting, he tried to do it while on the mower by reaching behind himself. The mower lurched forward pulling his arm backward. He has had 2 shoulder surgeries and the total incurred on the file is over $173,000. This is a very preventable injury. Example #2: An employee was on riding lawnmower cutting grass when he struck a broken sign post hidden by the grass and was thrown from the mower to the ground landing on his head and shoulder. He sustained a torn labrum in his shoulder requiring surgery and physical therapy. The total incurred on the file is currently over $92,000. This employee could have been injured much more severely and it could have been prevented by inspecting the area to be mowed first.

24 ATLANTIC COUNTY MUNICIPAL JOINT INSURANCE FUND APRIL 2018 CLOSED CASES 1.) Elm v. City of Cape May-This matter involved the Plaintiff s allegations in a Superior Court of New Jersey, Cape May County Complaint that on May 7, 2015, the Plaintiff, Susan Elm, was walking her dog on the sidewalk adjacent to the Defendant, Estate of George Lieb s property located at 1006 Washington Street, in the City of Cape May, when she was caused to trip and fall as a result of an alleged dangerous condition, specifically, a crack in the concrete. The Plaintiff alleged that as a result of the fall, she has suffered a nasal fracture and a neck injury. The case was assigned to James R. Birchmeier, Esquire on May 3, Defense Counsel accepted the Assignment and he filed an Answer and he proceeded with Discovery. Depositions were conducted and the Discovery End Date was March 7, Defense Counsel proceeded with the filing of a Motion for Summary Judgment arguing that the sidewalk was not public property, that there was no actual or constructive notice of any defects, that Cape May s action or inaction was not palpably unreasonable and that the Plaintiff s injuries did not pierce the Tort Claims Act threshold. Defense Counsel s Motion was granted by the Honorable Judge Gibson on March 29, 2018 based upon all of the arguments set forth above. 2.) Timmons v. Township of Hamilton-This matter involved the pro se Plaintiff s allegations in a Superior Court of New Jersey, Atlantic County Complaint that on May 6, 2017, the Plaintiff, Kenyotta Timmons, was harassed and unlawfully arrested by Township of Hamilton Police Officer, Bill McElrea. The Plaintiff further alleged that an air soft pellet gun and mace were taken from his person while in police custody and that the items have yet to be returned to him. The Township of Hamilton Police Report indicated that new charges were not filed against the Plaintiff on the date of the incident; however, the Plaintiff was found to have several warrants out of the City of Vineland which required him to be lodged in the Atlantic County Justice Facility on a warrant. The Plaintiff alleged that as a result of the incident, he sustained monetary damages and a violation of his civil rights. The Plaintiff further alleged that the Township of Hamilton was negligent in its duty to properly train and supervise the members of the Township of Hamilton Police Department. The case was assigned to James R. Birchmeier, Esquire on September 7, Defense Counsel accepted the Assignment and he filed our Answer and he proceeded with Discovery. The Plaintiff failed to respond to discovery demands and on October 16, 2017, Defense Counsel filed a Motion to Dismiss. Oral Argument on the Motion was conducted on December 12, The Plaintiff failed to appear and the Court entered an Order dismissing the Plaintiff's Complaint without prejudice. The time for the Plaintiff to file the appropriate Motion to reinstate the Complaint has expired and on March 13, 2018 an Order was entered dismissing the Plaintiff s Complaint with prejudice. 1

25 3.) Kounnas Estate v. Township of Upper-This matter involved the Plaintiff s allegations in a Superior Court of New Jersey, Cape May County Complaint arising from a fatal motor vehicle accident which occurred on June 5, The Plaintiff alleged that the Decedent, Dennis A. Kounnas, Sr., was operating his 2007 Harley Davidson motorcycle, traveling Southbound on Route 50 at or near its intersection with Katherine Avenue (milepost 0.8), in the Township of Upper, when he was caused to collide into the back of a motor vehicle being operated by Gary Crager as a result of an alleged dangerous and hazardous condition of the roadway, specifically, that there was a right curve in the road where foliage and shrubbery that was overgrown and not maintained, overhung into the roadway at the Decedent s eye height, obscuring his view of any vehicles that would be in front of him. The Plaintiff alleged that the Decedent ultimately died as a result of the injuries he sustained in the accident. The Plaintiff further alleged that the Township of Upper was negligent in allowing a dangerous/hazardous condition of the roadway to exist. The case was assigned to Patrick J. Madden, Esquire on December 27, Defense Counsel was ultimately able to convince the Plaintiff to execute a Stipulation of Dismissal with Prejudice as to the Township of Upper only which was filed with the Court on March 9, ) Caronte v. Township of Waterford-This matter involved the Plaintiff s pro se allegations in a Superior Court of New Jersey, Camden County Complaint that on May 3, 2013 the Defendants, Police Officers of the Waterford Township Police Department, effectuated the arrest of the Plaintiff and in the process, the Plaintiff sustained injuries. The Plaintiff also alleged that he suffered potential hardship with his employment. The Plaintiff alleged that the Defendant, Lieutenant Chiumento, over-tightened the Plaintiff s handcuffs causing injury to the Plaintiff s wrists. The Plaintiff further alleged that Defendant, Lieutenant D Amico, obstructed justice by his failure to provide the Plaintiff with a list of all of the police officers on duty on the date in question. As a result of the incident, the Plaintiff claimed that he sustained serious and permanent injuries. The case was assigned to Thomas B. Reynolds, Esquire on February 24, Defense Counsel accepted the Assignment and this matter was transferred from the Superior Court of Camden County to the United States District Court. The Plaintiff's initial Demand was for a payment in the amount of $25, which was subsequently reduced to a payment in the amount of $10, Defense Counsel filed a Motion for Summary Judgment in the Fall of 2016; and on March 2, 2018, the Honorable Judge Bumb entered an Order and Opinion granting Defense Counsel s Motion. 5.) Nastasi v. City of Wildwood-This matter involved the Plaintiff s allegations in a Superior Court of New Jersey, Cape May County Complaint that on August 31, 2014, the Plaintiff, Nicholas Nastasi, Jr., was operating his motor vehicle traveling West on Schellenger Avenue, at or near its intersection with Park Boulevard, in the City of Wildwood, when his vehicle was involved in a collision with a vehicle, owned by the ARC of Cape May County and being operated by Kristian Schena, that was traveling North on Park Boulevard at or near its intersection with Schellenger Avenue. Mr. Schena subsequently received a citation for failure to observe a traffic signal/red light. The Plaintiff alleged that as a result of the accident, he has suffered serious and permanent injuries. The Plaintiff further alleged that the City of Wildwood and the 2

26 employees and professionals named as Defendants exercised ownership, dominion, and control over the vehicle being operated by the Defendant, Kristian Schena. The case was assigned to James R. Birchmeier, Esquire on September 13, 2016 and he was instructed to provide notice to the Plaintiff s attorney to dismiss the Complaint in accordance with R. 1:4-8 based upon non-jurisdiction. Defense Counsel accepted the Assignment and he filed an Answer on behalf of the City and the Mayor and provided notice to Plaintiff's attorney to dismiss the frivolous Complaint based upon nonjurisdiction. Defense Counsel subsequently filed a Motion for Summary Judgment which was denied on December 16, Plaintiff's Counsel ultimately agreed to voluntarily dismiss the Mayor of the City of Wildwood with Prejudice. A Stipulation of Dismissal without Prejudice as to the Mayor of the City of Wildwood was executed by Plaintiff s Counsel on March 17, 2017 and was filed with the Court of April 5, Defense Counsel was continuing to monitor the matter to determine if the Plaintiff would reinstitute litigation against Wildwood Mayor Troiano. Discovery has now concluded in the matter and an Arbitration Hearing has been scheduled for April 19, Defense Counsel has now closed their file. 3

Members with elected officials that attended this training will receive a credit of $250 for each municipal elected official who attended one of the in person training sessions. Earlier this month, the MEL announced the availability of online training for elected officials via the MEL Safety Institute. Elected officials that complete the online training session by May 1, 2018 will also be eligible for the $250 per elected official credit. MEL Cyber Risk Management Program On December 18, 2017 the MEL released the MEL Cyber Risk Management Program. The program includes employee training, the adoption and implementation of cyber related policies and procedures, and other software and hardware related compliance components. 42 2018 Elected Officials Online Training While we recommend that public officials attend a training class, the MEL is also making available an on line training program for Elected Officials and Authority Commissioners to earn their $250 training credit. 43 Municipal Joint Insurance Fund Police Command Staff Risk Management Seminar As part of their continuing commitment to Police Command Staff Training the Atlantic, Burlington, and Gloucester, Salem, Cumberland Counties Municipal Joint Insurance Funds are jointly sponsoring a seminar on Police Risk Management. The seminar is intended for all Command Staff who manage or supervise other officers within your municipality. This includes, but is not limited to, Chiefs, Deputy Chiefs, Lieutenants, Captains, Sergeants, and Corporals. Attendance at bi-annual employment practices training is mandatory for Police Command Staff in order to comply with the MEL s Employment Practices Liability (EPL) Plan of Risk Management. Your local government entity has determined that you are a local government officer (LGO) who is required to file. N.J.S.A. 40A: g defines a local government officer as any person, whether compensated or not, whether part-time or full- time: (1) elected to any office of a local government agency; (2) serving on a local government agency, which has the authority to enact ordinances, approve development applications or grant zoning variances; (3) who is a member of an independent municipal, county or regional authority; or (4) who is a managerial executive employee of a local government agency, as defined in rules and regulations adopted by the Director of the Division of Local Government Services in the Department of Community Affairs pursuant to the Administrative Procedure Act, P.L. 1968, c. 410 (C.52:14B-1 et seq.), but shall not mean any employee of a school district or member of a school board. For most LGOs your public service will be a gratifying personal experience, and you will no doubt be exposed to various types of public policy and fiscal challenges facing your community. However, public office and employment are a public trust. The annual filing requirement serves as an important reminder to each LGO that the citizens of New Jersey hold you to a high standard of ethical conduct. As such, both paid and volunteer LGOs are required to file a FDS. This Local Finance Notice outlines filing procedures that are designed to facilitate efficiency and enhance transparency by using available technology to capture and report the financial disclosure statements we collect. This notice was written for local government officers with the goal of being concise yet informative, and contains specific step-by-step instructions for successfully filing the financial disclosure statement using the online process. A separate Local Finance Notice has been issued to municipal clerks, county clerks, and other local government entity representatives who have administrative responsibilities under the Local Government Ethics Law pertaining to financial disclosure statements. If you desire a more comprehensive explanation of the financial disclosure statement filing requirements you should read Local Finance Notice and other materials that are posted on the Division of Local Government Services (Division s) web site, Online Filing Procedure Beginning with the 2013 filing year, online filing of FDS forms became mandatory for all local government officers (LGOs). Paper FDS forms will not be accepted by the LFB. The current filing process uses a web based system and is similar to online banking or purchasing goods from a company that has an online ordering system. If you filed an FDS in 2014, 2015, 2016, or 2017, you should have an LGO profile/account created in a prior year. To file your FDS electronically, use the login ID ( address) and Password from the prior year. You only need a new PIN# if you have any new or additional positions that were not on your 2017 FDS. If you have additional positions for which you have been assigned a new PIN#, you must also validate the new PIN# using the Manage Positions button after logging in. If you are a new filer, you will first need to obtain the PIN# from your local government entity representative (e.g., municipal clerk or county clerk) and confirm with the representative how your name was listed on the roster (e.g. James Smith vs. Jim Smith). Your first and last name entered to validate the PIN# must match the name as it was entered on the roster by your local government entity representative. If you are a new filer who is identified as an LGO by multiple local government entities (e.g., you serve as a business administrator for a municipality and also serve as a commissioner for a joint insurance fund), you will receive separate PIN#s from each entity. You will link each PIN# to a single LGO user account by using the Manage Positions feature after you validate the first PIN# issued and create your profile. The previously filed FDS will also remain available through the public search tool. Filing Deadline Financial disclosure statements must be filed annually on or before April 30 th each year. In addition, once the annual filing deadline has passed, per N.J.S.A. 40A:9-22.6(b) new local government officers shall file a financial disclosure statement within 30 days of taking office. Information for Law Enforcement Officers The Legislature passed a series of Police Information Laws, N.J.S.A. 2C: (posting of information on the Internet); N.J.S.A. 47:1-17 (publishing certain information by government entity) and, N.J.S.A. 56: (person, business, association prohibited from publishing certain information on the Internet), that pertain specifically to the disclosure of certain law enforcement officers' home addresses and home telephone numbers on the Internet. To comply with the legislation, the LFB made a change to the FDS form and the availability of the information supplied on the form. Since 2014, the FDS has been filed online at The public can search both rosters of governmental entities and submitted FDSs on the website. Prior to 2017, all information entered on the FDS by the LGO when they filled out the form was available on the public search portion. Per N.J.S.A. 40A: (a)(5) the LGO is required to list the address and brief description of all real property in the State in which the local government officer or a member of his immediate family held an interest during the preceding calendar year. The FDS form was amended in 2017 to allow the below statement to appear on the form under Section II, E where LGOs list this information: Are you a law enforcement officer or retired law enforcement officer or is a member of your household a law enforcement officer pursuant to N.J.S.A. 47:1-17? Yes, I qualify as a law enforcement officer for purposes of N.J.S.A. 47:1-17 No, I do not qualify as a law enforcement officer for purposes of N.J.S.A. 47:1-17 Pursuant to N.J.S.A. 47:1-17, the home addresses and unpublished telephone numbers of law enforcement officers are protected. If you or a member of your household, are a law enforcement officer/ retired law enforcement officer, you must answer YES to identify your home address exempt from online disclosure. Please note that you must still provide the real property information under Section II.E. If you do not select YES check box, you have

52 Local Finance Notice April 3, 2018 Page 5 waived protection under N.J.S.A. 47:1-17 and the provided property information will be available on the Internet as part of your Financial Disclosure Statement. If you select the checkbox that indicates that you do qualify as a law enforcement officer for purposes of N.J.S.A. 47:1-17 and mark a property as a home address, your home address will not show up on the FDS through the public search. Instead, the language exempt from disclosure will be reflected on that property s line. Other properties that you may have that are not home addresses will still show up on the FDS form. The home address information will continue to be collected by the LFB. Multiple Positions With the electronic system, LGOs submit one form regardless of the number of positions they might hold. However, the LGO needs to link all of the positions together and make sure that all positions are listed on the FDS under Section I. Personal Information. If you are registering for the first time, validate all PINs before you submit the FDS. If you have already submitted your FDS and receive another PIN, login and click the Manage Positions button to validate any additional PIN#s. After adding any PINs, re-submit the FDS. JIF Members Joint Insurance Funds are deemed separate local government entities for purposes of the Local Government Ethics Law and, therefore, members of Joint Insurance Funds (JIFs) are usually listed on two rosters-the municipality s roster and the JIF s roster. Those LGOs who are on JIFs should link the PIN supplied by the JIF to their profile. LGOs should make sure that their FDS reflects the positions under Section I. Personal Information as listed on the JIF s roster, as well as their titles on the municipality s roster. For example, in Section I. Personal Information it should read ABC Municipality-Business Administrator and XYZ JIF-Member. Being listed as a JIF member by the municipality will not satisfy the requirement of being listed on the JIF roster as the JIF is considered a separate local government entity. Compliance The LFB may periodically conduct audits for compliance with the filing requirements and initiate investigations. Notices of Violations are issued by the LFB. LGOs can be assessed an appropriate fine that is not less than $100 nor more than $500 pursuant to N.J.S.A. 40A: In addition, for elected officials, the failure to file a FDS can subject the municipality to a loss of State Aid as it is a question on the Best Practices Questionnaire. Ignorance of the requirement to file the FDS is not considered good cause. It is expected that LGOs will take time to understand their responsibilities under the Local Government Ethics Law and will consider the annual filing requirement an important duty to be fulfilled as part of their public service. The LFB reminds LGOs that the Division does not send out reminder s to LGOs directly. In addition, any such s are sent as a courtesy and are not a statutory requirement. The LFB further reminds LGOs that compliance is not just submitting an FDS, but filing a complete FDS. The LFB can, and does, find violations against LGOs whose FDS s are incomplete. For example, in recent years, violations have been found against local officials who failed to disclose their pensions as one of their sources of income and who failed to disclose rental properties as sources of income, as well as, real estate in which an interest was held.

Management Committee: Committee met in February to review draft professional service agreements reflecting some modifications requested by vendors and an overall change to outline services in the contract. (In 2006, format was changed to refer to other documents for delineation of services, such as bylaws and risk management plan.) Board accepted the Committee s recommended changes. Board also accepted Committee s recommendation and confirmed the MEL s arrangement with QBE to increase land-use liability limits. Committee was also authorized to approve final details for a policy offer to individual planning board members (that complete MEL training course). Due to timing matters, not all local JIFs included this funding in the 2018 budgets. We recommend the MEL reimburse this cost to the local JIF for 2018; the Board approved a budget transfer of $900,000 from the MEL s Aggregate Loss Fund Contingency Account to the MEL s 2018 Liability Premiums account. Local JIFs will need to include in their 2019 budget. Emergency Restoration Services Request for Qualifications (RFQ): The MEL issued an RFQ for Emergency Restoration Services to update the list of qualified vendors that member towns/authorities can select from for the period of 2018 through In January, the Board agreed to add firms on a rolling basis that respond following the initial deadline. Once approved a copy of each vendor s response will be posted to the MEL website. Board voted to update the list to include responses received on 3/1/18 from ServPro of Woodbury/Deptford and on 3/19/18 from Stretch s Professional Cleaning Services Inc.

56 Crossing Guard Training Video: The MEL awarded a contract to Rutgers to produce an updated crossing guard video with December 31, 2017 as the contract term. Board approved Rutgers request for no cost extension until August 31, 2018 for completion of filming and production. Legislative Committee: Committee submitted the minutes of their January 12 th February 26 th meetings. and Coverage Committee: Committee submitted the minutes of their February 15th meetings. Safety & Education Committee: Committee submitted the minutes of their January 19 th and March 16 th minutes. Marketing Committee: Committee submitted the minutes of their March 2 nd meeting. Model Personnel Policy Committee: Every two years, the MEL asks members to update their Employment Practices Compliance Program. The Program includes updating Personnel Manuals and compliance with training requirements. The Committee met on February 15 th and March 16 th (minutes enclosed). Committee expects to complete its process and announce the EPL Program requirements during the month of April. Cyber Task Force: The Task Force last met on February 15 th to outline its next steps. Task force plans to work on a program to educate members on the tools available to them through the MEL. RCF: A copy of Commissioner Clarke s report on the RCF s January Reorganization distributed for information. Risk Management Information/Operating System (RMIS): The data has been successfully transitioned to Origami. Perma issued member logins to most JIFs. Initial announcement included a link to short training videos. Once members have an opportunity to review the videos and the worksheets, training webinars will be scheduled MEL & MRHIF Educational Seminar: The 7th annual seminar is scheduled for Friday, April 20 th beginning at 9:00 AM at the National Conference Center in East Windsor, NJ. League Magazine: Executive Director distributed the latest in the series of Power of Collaboration ads to appear in the League magazine Financial Disclosures: The Division of Local Government Services has notified the Fund office that rosters of those that are required to file must be finalized by April 4 th. Following this, the DLGS expects to issue a separate notice with filing instructions, which must be completed by April 30 th.

Opra Requests. Fund Attorney said her office works with Perma to respond to Opra requests. She noted, in particular, a recent request from newspaper that contacted individual towns. Brad Stokes from Perma contacted the newspaper and was able to directly provide the information requested, alleviated this burden from member towns.
