1 ATLANTIC COUNTY BOARD OF CHOSEN FREEHOLDERS Stillwater Building 201 Shore Road, Northfield, New Jersey ~ ~ ~ Minutes of Meeting April 25, 2017 CALL TO ORDER OPEN PUBLIC MEETING STATEMENT PRAYER AND FLAG SALUTE A regular meeting of the Atlantic County Board of Chosen Freeholders was called to order by Chairman Frank D. Formica at 4 p.m., Standard Time, on the above-mentioned date, in the Stillwater Building located at 201 Shore Road, Northfield, NJ. Statement of Open Public Meeting Compliance: Pursuant to the Open Public Meetings Act, Chairman Formica announced that adequate notice of this meeting, as required by said Act, has been published in The Press of Atlantic City, and mailed to The Current, The Daily Journal, The Hammonton Gazette and The Hammonton News; posted on the bulletin boards at 1333 Atlantic Avenue, Atlantic City, the Stillwater Building, 201 Shore Road, Northfield and the County Clerk s Office in Mays Landing. The prayer was led by Freeholder Marino, followed by the flag salute led by Chairman Formica. ROLL CALL The following roll call was recorded: PRESENT: Bertino, Carman, Coursey, Dase, Kern, Marino, Risley and Formica. ABSENT: Gatto. A quorum was present. MINUTES OF MEETING March 28, 2017 Freeholder Coursey moved and Freeholder Bertino seconded a motion to adopt and dispense with the reading of the March 28, 2017 minutes. call: AYES: Bertino, Carman, Coursey, Kern, Marino, Risley and Formica. NAYS: None. ABSTAINED: Dase. BOND ORDINANCE NO. 1 FINAL READING Bond Ordinance providing for various 2017 capital improvements Freeholder Bertino moved and Freeholder Risley seconded a motion to adopt on final reading Bond Ordinance No providing for various 2017 capital improvements by and in the County of Atlantic, State of New Jersey, appropriating $16,807,500 therefor and authorizing the issuance of $15,967,125 bonds or notes to finance part of the cost thereof. Chairman Formica opened the public hearing at 4:04 p.m. There 4:04 p.m. BOND ORDINANCE NO. 2 FINAL READING Bond Ordinance providing for the boiler replacement project for the Atlantic County Special Services School District Freeholder Kern moved and Freeholder Risley seconded a motion to adopt on final reading Bond Ordinance No providing for the boiler replacement project for the Atlantic County Special Services School District by and in the County of Atlantic, State of New Jersey, appropriating $985,903 therefor and authorizing the issuance of $985,903 bonds or notes to finance the cost thereof.

2 Chairman Formica opened the public hearing at 4:04 p.m. There 4:04 p.m. BOND ORDINANCE NO. 3 FINAL READING A Bond Ordinance providing for various capital improvements for fiscal year 2017 Freeholder Dase moved and Freeholder Risley seconded a motion to adopt on final reading Bond Ordinance No. 3 providing for various capital improvements for fiscal year 2017 by and for the Atlantic Cape Community College located within the County of Atlantic, State of New Jersey; appropriating $2,900,000 therefor and authorizing the issuance of $2,900,000 bonds or notes of the County of Atlantic, State of New Jersey, for financing such appropriation, the principal of and interest on the aggregate principal amount of which will be entitled to State Aid, pursuant to Chapter 12 of the Laws of New Jersey of Chairman Formica opened the public hearing at 4:06 p.m. There 4:06 p.m. CAPITAL ORDINANCE NO. 1 FINAL READING Providing for information technology improvements and general capital improvements to various county-owned facilities motion to adopt on final reading Capital Ordinance No providing for information technology improvements and general capital improvements to various county-owned facilities, in and for the County of Atlantic, State of New Jersey, and appropriating $1,800,000 from the capital improvement fund to pay for the cost thereof. Chairman Formica opened the public hearing at 4:07 p.m. There 4:07 p.m. MOTION TO REMOVE RESOLUTION 168 FROM TABLE Freeholder Bertino moved and Freeholder Marino seconded a motion to remove Resolution No. 168 from the table. call: AYES: Bertino, Carman, Dase, Kern, Marino, Risley and Formica. NAYS: None. RESOLUTION NO. 168 Authorizing a subordination, nondisturbance and attornment agreement Freeholder Kern moved and Freeholder Bertino seconded a motion authorizing a subordination, non-disturbance and attornment agreement with B & B Parking and Ocean First Bank for the real property located at 133 North Carolina Avenue, Atlantic City. Mr. Mike Price, resident of Egg Harbor Township, requested further explanation of Resolution No Eileen Toland, resident of Northfield questioned if the resolution would be approved tonight. County Administrator DelRosso responded.

3 RESOLUTION NO. 172 Submission of E-Rate Applications to the Schools and Library Division of the Universal Service Administrative Company for all eligible schools and libraries Risley and Formica. NAYS: Coursey. Freeholder Coursey moved and Freeholder Dase seconded a motion for submission of E-Rate Applications to the Schools and Library Division of the Universal Service Administrative Company to provide affordable access to telecommunications services for all eligible schools and libraries for a total funding of approximately $153, for the period from July 1, 2017 through June 30, RESOLUTION NO. 173 Reimbursement agreement for construction cost associated with the resurfacing of Brigantine Boulevard, section 1B in the City of Brigantine Freeholder Dase moved and Freeholder Carman seconded a motion to execute a funds exchange program-cost reimbursement agreement with the New Jersey Department of Transportation for funding from the FY 16 Transportation Trust Fund for construction costs associated with the resurfacing of Brigantine Boulevard, Section 1B in the City of Brigantine in amount of $919, RESOLUTION NO. 174 Submission of an application for a Violence Against Women Act grant Freeholder Kern moved and Freeholder Bertino seconded a motion to authorize a submission of an application for a Violence Against Women Act grant to the New Jersey Division of Criminal Justice, Office of Victim Witness Advocacy for funding in an amount not to exceed of $46, for the period commencing January 1, 2017 and terminating December 31, The County shall provide a County In-Kind match of $15, for a total program amount not to exceed $61, RESOLUTION NO. 175 Grant application for FY 17 Annual Transportation Plan Freeholder Coursey moved and Freeholder Bertino seconded a motion to submit a grant application to the New Jersey Department of Transportation for FY 17 Annual Transportation Plan in the amount of $3,433,500.00, which will be provided to the County as projects are bid at 100% of the construction award amount. RESOLUTION NO. 176 EUS contract for reduction of insurance deductible Freeholder Coursey moved and Freeholder Kern seconded a motion to enter into an EUS contract with Insurance Agencies, Inc., to purchase a policy which will reduce the named storm wind deductible to $68,

4 RESOLUTION NO. 177 EUS contract to obtain flood insurance Freeholder Kern moved and Freeholder Bertino seconded a motion to enter into a EUS contract with Insurance Agencies, Inc., to obtain flood insurance for the Atlantic County Animal Shelter in the amount of $2, RESOLUTION NO. 178 Bid contract to provided preventive maintenance and emergency repairs motion to authorize a contract with Multi-Temp Mechanical, Inc., to provide preventive maintenance and emergency repairs on Atlantic County s category 1 chillers for the total sum not to exceed $119, to do work and/or supply the materials as set forth in the contract. Mike Price, resident of Egg Harbor Township, asked where the chillers will be located. County Administrator DelRosso responded. RESOLUTION NO. 179 Change Order to contract for the replacement of Bridge EH- 17 over Miry Run Freeholder Carman moved and Freeholder Bertino seconded a motion to approve Change Order No. 3, final contract with Midlantic Construction, LLC, for the replacement of Bridge EH- 17 over Miry Run in an amount of $17, (net decrease) and $2,807, for a total amendatory contract amount. RESOLUTION NO. 180 Amended lease agreement for the real property commonly known as 133 North Carolina Avenue, Atlantic City motion authorizing an amended lease agreement with B & B Parking d/b/a Park Place Parking for the real property commonly known as 133 North Carolina Avenue, Atlantic City. RESOLUTION NO. 181 License Service Agreement to install, operate and maintain an irrigation pipe line across Chew Road in Hammonton, located at Block 1402, Lot 29. Freeholder Carmen moved and Freeholder Kern seconded a motion to authorize a license agreement with Anthony Vaccarella to install, operate and maintain an irrigation pipe line across Chew Road in Hammonton, located at Block 1402, Lot 29. MOTION TO COMBINE AND ADOPT RESOLUTION NOS. 182 AND 183 RESOLUTION NO. 182 Appointment to the Board of Education of the Special Services School District and the Vocational School District of the County of Atlantic Freeholder Kern moved and Freeholder Marino seconded a motion combine and adopt Resolution Nos. 182 and 183. Advising and consenting to the appointment of Kathleen Quish to the Board of Education of the Special Services School District and the Vocational School District of the County of Atlantic as an ex-officio non-voting member.

5 RESOLUTION NO. 183 Appointment to the Atlantic County Youth Services Commission MOTION TO COMBINE AND ADOPT RESOLUTION NOS. 184 TO 187 RESOLUTION NO. 184 Egg Harbor City RESOLUTION NO. 185 Buena Vista Township RESOLUTION NO. 186 Absecon RESOLUTION NO. 187 Egg Harbor Township Advising and consenting to the appointment of Damon Tyner and Kathleen Quish in mandated positions to the Atlantic County Youth Services Commission. motion to combine and adopt Resolution Nos. 184 to 187 Authorizing consent for a roadway solicitation event by Egg Harbor City Fire Department on the 100 Block of Philadelphia Avenue (CR 563) in Egg Harbor City on Friday, May 19, 2017 and a second roadway solicitation at the same location on Friday, August 25, Authorizing consent for a roadway solicitation event by Buena Vista Township Emergency and Medical Services, Inc., at the intersection of Tuckahoe Road (CR 557) and Landis Avenue/Cedar Avenue (CR 540), also known as the County s portion of Five Points, in Buena Vista Township on Friday, May 26, 2017 and Saturday, May 27, Authorizing consent for a roadway solicitation event by the Rotary Club of Absecon at the intersection of Mill Road (CR 651) and New Jersey Avenue (CR 601) in the City of Absecon on Sunday, June 18, Authorizing consent for a roadway solicitation event by Egg Harbor Township Kiwanis at English Creek Road (CR 575) at its intersection with West Jersey Avenue in Egg Harbor Township on Saturday, September 9, 2017 and on Sunday, September 10, RESOLUTION NO. 188 Recognizing April as Autism Awareness Month. REPORTS OF SPECIAL COMMITTEES OF THE BOARD Freeholder Carman moved and Freeholder Dase seconded a motion to recognize April as Autism Awareness Month. There were no reports of special committees of the Board. UNFINISHED BUSINESS NEW BUSINESS There was no unfinished business. Chairman Formica reported on the groundbreaking of the Stockton University campus located at Albany Avenue and announced the Stockton University Aviation Technology Park groundbreaking which will take place on May 15, Freeholder Coursey remarked about the groundbreaking.

6 WRITTEN COMMUNICATIONS AND PETITIONS PUBLIC COMMENTS No written communications. Chairman Formica opened the meeting to the public at 4:39 p.m. Tracy Irwin, resident of Somers Point, spoke on behalf of five volunteers in attendances that are not happy with their experience at the Animal Shelter. Dawn Jacoby, resident of Northfield, spoke regarding the dogs that are euthanized and the promotion of the dogs on Facebook. Amanda, Atlantic City resident, reported her negative experience at the Animal Shelter. Terry Benjamin, resident of Northfield, stated she is not a volunteer but interested in the reason a security guard is hired at the Animal Shelter. Anna Strang, resident of Egg Harbor Township, requested the Board review the surveillance tapes. Eileen Toland, resident of Northfield, stated that the volunteers have been ignored and it should be investigated. Requested to inspect the Shelter. Heather Webertson, resident of Hammonton, asked how Pinelands Commissioners are appointed. Mike Price, resident of Egg Harbor Township, questioned the euthanizing of an animal. Asked for an update on the Animal Shelter. Gayle Bittel, Ventnor resident, spoke concerning animals that had been killed at the Animal Shelter. Lisa Corseone, former volunteer, was kicked out of the shelter. Questioned Freeholder Coursey as to what he was looking for at the shelter. Mary Finkle, Northfield resident, questioned the $148,000 contract for security. Kathy Kelsey, Manager for the Atlantic County Animal Shelter, addressed some of the issues that had been raised regarding the Shelter. Nancy Marzelina, Atlantic County Human Resources/Labor Relations representative outlined the process for complaints. Ms. Marzelina explained the guillotine doors at the Shelter. There being no further comments, Chairman Formica closed the public portion at 5:47 p.m. GOOD OF THE ORDER ADJOURNMENT Freeholder Kern announced April is Sexual Assault Month. Chairman Formica entertained a motion to adjourn the meeting. Freeholder Marino moved and Freeholder Kern seconded a motion to adjourn the Freeholder meeting. The motion was unanimously passed. The meeting was adjourned at 5:50 p.m.
