1 CITY COMMISSION REGULAR MEETING October 17, 2017 On October 17, 2017 the City Commission met for their Regular Meeting at the San Benito Municipal Building (Cesar Gonzalez Meeting Hall), 401 N. WELCOME. Mayor Ben Gomez called the meeting to order, stating, and The City Commission and I welcome you to your Regular City Commission Meeting. The time is 5:30 p.m., and we have a quorum. ITEM 2. PLEDGE OF ALLEGIANCE TO THE U. S. FLAG AND TO THE TEXAS FLAG. Commission er Esteban M. Rodriguez led the Pledge of Allegiance to the U. S. Flag and to the Texas Flag. ITEM 3. INVOCATION. Invocation was recited by Lionel Betancourt, San Benito Citizen. ITEM 4. ANNOUNCEMENTS: ITEMS OF COMMUNITY INTEREST. Commission er Esteban M. Rodriguez thanked Victor Gonzalez for the sweet bread, drinks and thanked everybody that showed up to the Town Hall Meeting and there will be another one announced later. Mayor Ben Gomez said to thank the fire department for an awesome job they did when Shane Scoggins was stung by the bees. Community Events include the Resaca Music Festival on Saturday, October 21, from 3pm to midnight. Tickets are on sale for $5.00, children under ten are free. October 30, 2017 the Library is having their fall festival. El Dia de los Muertos on Monday, October 30, 2017 from 5pm to 8 pm. October 31, is Tent R Treat at the Heavin Trail hosted by the Special Events Board from 5:30pm to 8pm free event, GED classes held at the Library, Zumba classes also conducted at the Cultural Center. ITEM 5. PUBLIC COMMENTS
2 Santiago Perez complained about two employees getting a 25% pay increase and at the same time you are asking for an increase for streets. He spoke against the proposed against aquatic center. Rosie Olivarez spoke about the proposed $2.00 fee on the water bill, storm water fee and marquee at the Resaca Trail, the hiring of two assistant city managers and a secretary, and the $10,000 to the City Manager. Lynn Pare said there are a lot of encouraging things happening in San Benito, and also the Town Hall meetings and trash pickup, and suggested reducing rates to $6.00 and once a month service. Lionel Betancourt requested the presence of fire and police for the annual adopt the children event. This will be done administratively. ITEM 6. CONSIDERATION AND POSSIBLE ACTION ON APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF SEPTEMBER 19 AND SPECIAL MEETING OF SEPTEMBER 27, Commission er Esteban M. Rodriguez moved to approve. Mayor Pro Tem Carol Lynn Sanchez seconded the motion. Voting Aye: Mayor Pro Tem Carol Lynn Sanchez, Commission ers Antonio Gonzales and Esteban M. Rodriguez for the meeting of the 19 th, Mayor Ben Gomez abstained due to his absence. Commission ers Antonio Gonzales and Esteban M. Rodriguez abstained for the meeting of the 27 th. Motion carried to approve MINUTES OF THE REGULAR MEETING OF SEPTEMBER 19 AND SPECIAL MEETING OF SEPTEMBER 27, ITEM 7. CONSIDERATION AND POSSIBLE ACTION ON APPROVING RESOLUTION NOMINATING A PERSON AS THE CITY OF SAN BENITO S CANDIDATE FOR THE CAMERON APPRAISAL DISTRICT BOARD OF DIRECTORS. COMPANY OF THE RATES PRESCRIBED HEREIN; AND ESTABLISHING AN EFFECTIVE DATE. Manuel De La Rosa, City Manager, briefed the Commission on the nominee for Cameron Appraisal District which currently the position is held by Ricardo Morado, City Attorney, and we are one of thirteen cities that currently have one representative. Commission er Esteban M. Rodriguez moved to nominate Ricardo Morado. Mayor Pro Tem Carol Lynn Sanchez seconded the motion. Motion carried to approve RESOLUTION NOMINATING RICARDO MORADO AS THE CITY OF SAN BENITO S CANDIDATE FOR THE CAMERON APPRAISAL DISTRICT BOARD OF DIRECTORS. ITEM 8. CONSIDERATION AND POSSIBLE ACTION ON APPROVAL OF ORDINANCE NO. 2545: AN ORDINANCE ADOPTING A UNANIMOUS SETTLEMENT AGREEMENT, SETTING RATES AND ESTABLISHING TARIFFS FOR THE PROVISION OF NATURAL GAS SERVICE BY TEXAS GAS SERVICE COMPANY, A DIVISION OF ONE GAS, INC., WITHIN THE CITY OF SAN BENITO; DECLARING THIS ORDINANCE TO BE A FINAL DETERMINATION OF RATES; REQUIRING ACCEPTANCE BY TEXAS GAS SERVICE Manuel De La Rosa, City Manager, briefed the Commission on Ordinance No which provides a summary of the settlement agreement reached with Texas Gas Service Company in the TGS rate case. The Firm of Lloyd Gosselink, Attorneys at Law who represent the cities. He recommend ed approval of this ordinance so the settlement can be resolved. Commission er Esteban M. ITEM 9. CONSIDERATION AND POSSIBLE ACTION TO APPROVE RATIFICATION OF THE CONCESSION AGREEMENT WITH PRIM S PLACE LIVE, LLC TO PROVIDE BEER SALES AT THE RESACA CITY MUSIC FESTIVAL. Luis Contreras, Museum Coordinator, briefed the Commission on the request to authorize the Mayor to sign the Concession Agreement with Prim s Place LLC to provide beer sales at the Resaca City Music Festival. Motion carried to approve RATIFICATION OF MAYOR S SIGNATURES TO THE CONCESSION AGREEMENT WITH PRIM S PLACE LIVE, LLC TO PROVIDE BEER SALES AT THE RESACA CITY MUSIC FESTIVAL. ITEM 10. CONSIDERATION AND POSSIBLE ACTION ON APPROVAL OF PAYMENT REQUEST NO. 9 FROM JONES CONSTRUCTION OF THE SAN BENITO CULTURAL HERITAGE MUSEUM. Rachel Siller, EDC Coordinator, briefed the Commission on payment request No. 9 for work completed from September 23 through September 27, 2017, at which time substantial completion was obtained at 98.16% of the contract amount. This payment due now is in the amount of $41, to Jones Construction is for the construction of the San Benito Cultural Heritage Museum. This is not the final payment, but is the final applied from our grant. We still have the remaining work from September 28 plus the retainage which will be applied to the EDA grant as a grant closure. We came $11,000 under the original amount of the contract. Bernard Rodriguez, Director of Planning and Zoning briefed the Commission on the appointment of Abraham Villagran by Mayor Ben Gomez to position place 5 to the Planning and Zoning Commission, whose term will expire on May 31,

DISCUSSION AND UPDATE ON ROAD IMPROVEMENTS FOR FISCAL YEAR Manuel De La Rosa, City Manager, briefed the Commission on the booklet they had received with 81 streets listed with the greatest number of complaints and in worst conditions with a total-in-house cost for repairs of $6,428, He asked the Commission to study and make recommendations on which street s they want done. No action required. ITEM 15. CONSIDERATION AND POSSIBLE ACTION ON APPROVING THE REQUEST FOR STREET CLOSURE ASSISTANCE FROM FATHER MARIO ALBERTO CASTRO, QUEEN OF THE UNIVERSE AND SAINT JOSEPH CATHOLIC CHURCH, IN CELEBRATING THEIR ANNUAL FALL FESTIVAL LOCATED AT 1001 WEST BUSINESS 77 ON NOVEMBER 4 TH AND 5 TH, 2017 AND ON NOVEMBER 11 TH AND 12 TH AS RAIN MAKE UP DAYS. Mario Perea, Police Captain, briefed the Commission on the request from Father Mario Alberto Castro for Queen of the Universe and Saint Joseph Catholic Church in their annual celebration on 1001 West Business 77 on November 4 th and 5 th, 2017 and or November 11 th and 12 th as rain make up days to approve closure of the following streets: 1. Doherty Street: From Business Hwy 77 to Madero Street 2. Whitney Street: From Business Hwy 77 to Madero Street 3. CONSIDERATION AND POSSIBLE ACTION TO APPROVE RESOLUTION , ALLOWING THE MAYOR OR HIS DESIGNEE TO APPROVE THE APPLICATION AND ACCEPTANCE OF ANY LOCAL BORDER SECURITY PROGRAM GRANT FUNDS FOR THE PERFORMANCE PERIOD OF SEPTEMBER 1, 2017 TO AUGUST 31, Mario Perea, Police Captain, briefed the Commission on the request for the Mayor s signature to approve the application and acceptance of any local Border Security Program Grant Funds for the performance period of September 1, 2017 to August 31, Local Border Security Program Grant monies would benefit public safety locally by providing enhance d law enforcement patrols and allow agencies to use funds for certain law enforcement operating expenses while participating in border security operations approved by the Office of the Governor Homeland Security Grants Division. 5

CONSIDERATION AND POSSIBLE ACTION ON APPROVING THE YEARLY PAYMENT OF $20,760 TO THE RIO GRANDE VALLEY COMMUNICATIONS GROUP FOR RADIO USER FEES. Mario Perea, Police Captain, briefed the Commission on the request for payment of $20,760 to the Rio Grande Valley Communications Group for radio user fees for the Fire and Police Department. This item is budgeted for fiscal year , but since it is over $10,000 we bring it before the City Commission for approval. Mayor Pro Tem Carol Lynn Sanchez moved to approve. CONSIDERATION AND POSSIBLE ACTION TO APPROVE THE SALE AND AUCTION OF THE 8 SEIZED VEHICLES AND 1 DECOMMISSION ED POLICE MOTORCYCLE. Mario Perea, Police Captain, briefed the Commission on their upcoming sale and auction of nine (9) vehicles, eight (8) of which are seized vehicles and one (1) Harley Davidson Motorcycle that was already approved by the City Commission on March 21, Commission er Esteban M. Rodriguez moved to approve. Commission er Antonio Gonzales seconded the motion. Voting Aye: Mayor Ben Gomez, Mayor Pro Tem Carol Lynn Sanchez, Commission ers Antonio Gonzales and Esteban M. Rodriguez. Motion carried to approve THE SALE AND AUCTION OF THE 8 SEIZED VEHICLES AND 1 DECOMMISSION ED POLICE MOTORCYCLE. ITEM 19. DISCUSSION ON TRASH PICKUP SCHEDULE AND AMENDING THE AGREEMENT WITH REPUBLIC SERVICES. Commission er Esteban M. Rodriguez briefed the Commission on his proposal regarding possible solution to citizens complaints on the streets by trying to reduce the garbage pickup to one day, on one side, and the other day on the other side. He was told this would amend the contract with Republic Waste Services. He said he was not aware, but this would cancel the renegotiate the contract. Ray Alegria, representative with Republic, who confirmed that there is an agreement in place and if the contract is amended we would have to renegotiate. The cost for moving it to one day would be very minimal because the landfill is about one hundred (100) miles from here. He said Republic is here to help in any way they can. Mayor Ben Gomez 6
7 questioned the community involvement from happy with them helping with Christmas Party citizens, not to us. No action required. to the City ITEM 20. CONSIDERATION AND POSSIBLE ACTION ON THE APPROVAL OF A PROPOSAL FROM AVERY RESOURCE CONSULTANTS, L.L.C., FOR AN AQUATIC CENTER. Mr. Damian Guevara, Managing Partner from Avery Resource Consultants, briefed the Commission on a proposed Memorandum of Understanding between the City and Avery for a Hybrid P3 development (Public Private Partnership), the purpose of developing qualify of life project in the form of a P3 Development. The sole purpose of this MOU is to outline the parameters of the project for the development to move forward in preparation to closing. Mayor Pro Tem Carol Lynn Sanchez questioned the project as far as financial responsibility, interest payments for the first two years, hiring of staff, lifeguards who would do that, maintenance fees, chemicals, what models are being based on, any models based on our population and economics, would the management fee be included in the $11,000, and how long is this covered, what would monthly payments look like, income was projected too high not realistic for a city like San Benito, management fee not included in the $11,000,000.00, and asked if it has this been discussed with our financial advisors. Commission er Esteban M. Rodriguez stated it was a good project that we need to look at it on a positive and not on a negative side. He said he also spoke to Don Gonzalez, financial advisor, and Don stated not to get in debt, but we can do it and everything is a chance. Mayor Ben Gomez also stated we mentioned working with the school district and we have not even talked to them or worked something out with them. Mayor Pro Tem Carol Lynn Sanchez questioned if we could do this without taking it to other developers. Ricardo Morado, City Attorney, stated the document that is before the Commission is very sketchy, very few details, and based on that it is kind of like you are taking a step but you are not taking a step. My recommendation quite frankly is I would like to see the details of the proposal before you in writing so you can study it and then decide whether or not it is going to work before anything is signed and that way you take a step with that information. There has been a P3 proposal brought to this community before, I think in connection with housing, and there were some issues regarding the city s ultimate responsibility for payment if the revenue stream was not as strong as projected, so you need to study it carefully. Mayor Pro Tem Carol Lynn Sanchez stated, I cannot vote on a one-page and this is what it is, and I am not closing the door, but we need more detail. Mr. Damian Guevara, Managing Partner from Avery Resource Consultants, stated that in order to continue he needed the signed memorandum otherwise he could not continue. Commission er Antonio Gonzales asked the city attorney if we were bound or not bound if we signed the Memorandum : yes or no. Ricardo Morado, City Attorney said, like I mentioned earlier, this document is a step forward and is not, it purports to be unbinding but it does set a time line, it does set the expectations. Commission er Esteban M. Rodriguez stated it is just giving Avery the authority to move forward and it is not binding. Mr. Damian Guevara, Managing Partner from Avery Resource Consultants, stated I don t believe it is sketchy. It just gives us to get the financial partners to get the best deal possible. 8 Morado, City Attorney, stated, I stand on my that it was sketchy you made repres entation to this council that have and compiled data and made projections on wha this project can accomplish none of that is laid out for the council to consid that the document is sketchy.
