2 MEETING MINUTES OF A REGULAR MEETING OF THE VILLAGE OF SPRING GROVE AUGUST 18, 2015 Council Chambers, Spring Grove, Illinois, ; a Regular Meeting of the Village Board was held this date at 6:00 p.m., at the Municipal Centre, 7401 Meyer Road; President Eisenberg presiding. Roll Call. Roll call showed the following Board members present: President Mark Eisenberg; Trustees Jim Anhalt, Ron Kopke, Pat Mazzanti, Bob McMahon, Lloyd Simonson an d Randy Vinyard - 7. Absent: None. Also present for the Village were: Sandi Rusher, Village Clerk; Scott Puma, Village Attorney; Tom Sanders, Chief of Police/Executive Assistant; Sgt. Jason Hintz, Police Department; Matt Wittum, Public Works Supervisor; Trent Turner, Building and Zoning Officer; an d Mike Gaj ewski, Planning and Zoning Chairperson. President's Report. A local flooring company thanked the Village for the temporary suspension of impact fees as it may help spur his business. Clerk's Report. Sixteen residents participated in blood drive held on August ll ll \ Engineering Report. No report. Building and Zoning Report. No new construction permits have been issued and the finishing touches are being done on the Hatchery Park pavilion. Public Works Report. The road program, Sunset Road, should be finalized this week and the vi Hage is co-sharing the road repairs on Spring Ridge Drive with the developer. Discussion then ensued regarding who is responsible, the Village or I DOT, for the sinkhole repairs at Route 12 and Blivin Street. The Village is at a stalemate with I DOT over the terms of a maintenance agreement executed by the Village back in the 1970's or 80's and has reached out to Senator Pamela Althoff to see if there is anything she can do. McHenry County Department of Transportation is willing to put a plate over the sinkhole if the Village excavates and fills it in with a material of their choice but wants a permanent repair done by winter. As much as the Village wants to see the intersection open to southbound traffic, concern was expressed that if the Village makes this temporary repair it may be responsible for future repairs. It was agreed to have Attorney Puma review the agreements and to grant permission to he and Executive Assistant Sanders to move forward with the temporary repair without assuming responsibility for any future repairs. Police Department Report. No report. Committee Reports. None. Public Discussion. President Eisenberg then opened the meeting up for discussion by the public.

3 Page 2 of 4 Ted I rzaskowski thanked Sgt. St. Clair and K-9 Hunter for their demonstration at the St. Peter's Summer Social. Gail Brown stated her and her husband are working hard to restore their home and farm on Winn Road in unincorporated Spring Grove and would prefer to remain unincorporated. President Eisenberg replied he understands and the Village is not looking to take away their rights. Adam H in kler, 1804 English Prairie Road in unincorporated Spring Grove, inquired why the Board is discussing the annexation of properties surrounded by tlie Village. President Eisenberg stated he will explain later in the meeting. Consent Agenda. Trustee Kopke moved, seconded by Trustee Simonson to accept the consent agenda. Roll call vote: Ayes: Anhalt, Kopke, Mazzanti, McMahon, Simonson and Vinyard 6. Nays: None. Motion carried. A. August 5, 2015 Village B oard Regul ar Minutes B A Resolution Celebrating the 25' 1, Anniversary of the Passage of the Americans with Disabilities Act C. An Ordinance authorizing the sale of forfeited and surplus personal property owned by the Village D. A Resolution approving the Customer Agreement wi th J.P. Morgan Securities LLC E. Allow the consumption of alcohol at I helen Park on August 29, 2015 for the Stateline Comets Kick Off Party Trustee Kopke moved, seconded by Trustee Simonson to approve the consent agenda. Roll call vote: Ayes: Anhalt, Kopke, Mazzanti, McMahon, Simonson and Vinyard 6. Nays: None. Motion carried. Unfinished Business. None. New Business. Approval of an Ordinance approving a Special Use Permit and Variances at 2008 Main Street. The Planning and Zoning Commission recommended the approval of the petition that sought variances not to provide off-street parking, to allow outdoor seating and outdoor live music beyond 9:00 pm, to increase the square footage of the existing accessoiy building beyond the allowed 300 sq. ft. or to allow two accessory buildings and special use permits to allow a beer garden and to allow outdoor seating and a tent in the outdoor seating area from April 1 st - November 15 subject to the conditions outlined in the ordinance, trustee Kopke moved, seconded by Trustee McMahon to approve the ordinance as presented. Roll call vote: Ayes: Anhalt, Kopke, Mazzanti, McMahon, Simonson and Vinyard - 6. Nays: None. Motion carried.

4 Page 3 of 4 Discuss the annexation of properties surrounded by tke Village. President Eisenberg prefaced tke discussion stating a resident in tke Higkland Estates subdivision called tke Village to complain about a rooster being kept on a 5 acre parcel in unincorporated Spring Grove, surrounded by residential komes, and tkat tke rooster is waking up tke residents. Tke county informed tke resident tkat tke property owner is allowed to kave tke rooster kecause tke property is zoned for agriculture. Anotker property of concern is tke goat farm on Winn Road wkose smells and appearance effect village residents but it is zoned for agriculture and governed by tke county's ordinance. Tke issue is twofold because tkere are unincorporated properties tkat are governed by tke county's rules and regulations tkat are generating complaints from village residents and reaping tke benefits from village services suck as road maintenance and police protection kut do not pay tke village for tke cost of providing tkese services. It is not tke Village's intent to take away tke property owner's ri gkts and negatively impact tkem but to work witk tkem on annexing into tke village. Ike involuntary annexation for tkese properties will be a last resort. President Eisenberg tken sougkt tke Board's input on tke annexation of tkese surrounded properties. 1 rustee Kopke stated tke Board kas discussed tkis matter over tke years and ke would like to see tkese properties be annexed as tkey are reaping tke benefits from village sendees. He suggested grandfatkering tke existing uses until tke property is sold. 1 rustee Mazzanti stated tke irony is tkat people wko move into subdivisions moved kere for tke country. He opined tke annexation of all of tkese properties is not necessary but to only annex tkose wko affect village residents. Trustee Kopke didn't tkink tke Village skould pick and ckoose but annex all properties as tke county doesn't kelp witk tke enforcement of complaints. Trustee McMakon cited tke Rickardson Farms annexation as an example of tke village working witk an unincorporated property owner wko kenefited from annexing as tkey gained uses. President Eisenkerg added tkat it is easier to work witk tke village, at times, tkan tke county. In response to inquiries, Attorney Puma stated tke islands of unincorporated land were created tkrougk tke annexation of subdivided land and tke goal of tke Village skould be to "close up tke kole in tke donut". ike annexation of properties wkolly surrounded by tke village and less tkan 60 acres doesn't kave to ke under sole ownerskip. He went on to explain tke process for annexing properties. Ward Brown stated if tke village wants to work witk affected property owners tken tkey skould kave given tkem notice of tonigkt's meeting. He and kis wife ckose to move into an unincorporated agricultural property and use tkeir land responsikly. He acknowle dged tke Village can forcikle annex tkeir property but tkey will figkt it. President Eisenberg replied notice was not given kecause ke wanted to discuss it witk tke Board to get tkeir input first.

5 Page 4 of 4 Cetty Vanderlip bought 2.2 acres on Winn Road because it was not in tke villa ge so they could raise chickens and she is fixing it up into a hohby farm. I he grandfathering doesn't help them because they can't sell it as they are using it. She doesn't believe the Village should be able to take away their ri ghts. Adam Hinkler, whose father-in-law owns 42 acres on English Prairie, expressed concern with their rights being taken away. President Eisenberg stated he wants these unincorporated properties to be a part of our community but at the same time the Village needs to protect the investment of the vi Hage residents should the farming uses not be controlled. Attorney Puma added the Village can look at creating a new zoning district to give some protection to those "hobby farms" and address the concerns of the residents. The Board thanked the unincorporated property owners for coming to the meeting and voicing their concerns. The Board will have a follow up meeting and invite all affected property owners to discuss further. Other Business. None. There b eing no further business, I rustee Kopke moved, seconded by Trustee Mazzanti to adjourn the meeting at 6:46 p.m. On voice vote, the motion carried unanimously.
