16 Climate in Congress -Recent Congressional Activity on Banking Issues, cont.: Minimum Wage Bill Passed House Committee Stage - The Raise the Wage Act (H.R. 582) will raise federal minimum wage from $7.25 to $15 an hour; advanced through House Committee on Education and Labor by a party line vote of 28 to 20. Congresswoman Lori Trahan (D-MA) voted to support the measure CFPB Director Testified Before House Finance - CFPB Director Kathy Kraninger delivered her first testimony before the House Committee on Financial Services. Committee Chairwoman Maxine Waters (D-CA): a top priority is to closely monitor the CFPB and the changes that have been made by the Trump administration. Reintroduced her legislation, H.R. 1500, to reverse the changes to the CFPB made to under the Trump administration 29 co-sponsors, including: Congressman Ayanna Pressley (D-MA) and Congressman Stephen Lynch (D-MA) 16
17 Climate in Congress -Upcoming Congressional Activity on Banking Issues: House Financial Services Subcommittee to hold BSA/Anti-Money Laundering hearing: Promoting Corporate Transparency: Examining Legislative Proposals to Detect and Deter Financial Crime on Wednesday, March 13 H.R. 389, Kleptocracy Asset Recovery Rewards Act introduced Congressman Stephen Lynch (D-MA) -creates a rewards program to encourage individuals to notify the government of assets in U.S. financial institutions that are linked to foreign corruption. H.R., Corporate Transparency Act of 2019 [DRAFT] -require corporations and LLCs to disclose their "beneficial owners" to FinCEN. The FinCEN database would be available to law enforcement agencies and to banks to help police their customers. H.R., To make reforms to the Federal Bank Secrecy Act and anti-money laundering laws, and for other purposes [DRAFT] -imposes new rules on art dealers and real estate transactions, strengthens whistleblower protections and increases monetary damages for repeat Bank Secrecy Act violations Last session, Senator Warren released BSA proposal 17

25 Alert: New Legislation, cont. Purpose: To provide the National Credit Union Administration Board flexibility to increase Federal credit union loan maturities, and for other purposes. Bill language: Section 107(5) of the Federal Credit Union Act (12 5 U.S.C. 1757(5)) is amended by inserting after shall not exceed 15 years, the following: or any longer maturity as the Board may allow, in regulations,. NCUA Rulemaking on Loans to Members and Lines of Credit Final Rule expected Thursday, March 14 25

27 Issue: Data Security/Privacy No Data Security without Data Privacy Objective: The Association is in favor of strong national data security and consumer notification standards with effective enforcement provisions. Any new data protection law should address both privacy and data security. This legislation should be applicable to any party who collects, uses, shares, or has access to important consumer financial information. Working Group and Member Survey Issue now includes Data Privacy 27

29 Issue: Community Reinvestment Act -Last Congressional Session: In 115 th Congress, CRA included within Massachusetts Senator Elizabeth Warren s housing bill, the American Housing and Economic Mobility Act -Current Congressional Session CCUA Eliminated: CRA application to all state and federally-chartered credit unions -New Draft Today Revised focus: addition of low income/underserved areas to fields-of-membership Continuing efforts: Emphasis on HMDA data and percentage of loans sold into the secondary market 29
30 Issue: Cannabis Banking Two different bills introduced: SAFE Banking Act and the STATES Act (Warren) Goal: Business Flexibility Problem: Marijuana is illegal under the federal Controlled Substances Act; credit unions are prohibited from knowingly providing services to illegal enterprises. No position taken on legalization of marijuana 46 states have laws permitting or decriminalizing marijuana or marijuana-based products. Washington D.C., Puerto Rico, Guam, and a number of tribes have similar laws Delaware, New Hampshire, and Rhode Island allow medical use Massachusetts allows recreational and medical use 30
31 Issue: Cannabis Banking SAFE Act - H.R Co-Sponsors: 108 total, including: Cong. Katherine Clark (D-MA), Cong. Jim McGovern (D-MA), Cong. Chris Pappas (D-NH), Cong. David Cicilline (D-RI) Prohibits liability for financial services offered to legitimate cannabis-related businesses. 31
32 Issue: Cannabis Banking STATES Act Introduced by Senator Elizabeth Warren (D-MA) in the 115 th Congress; reintroduction expected Purpose: Ensures that each State has the right to determine for itself the best approach to marijuana within its borders. The bill also extends these protections to Washington D.C, U.S. territories, and federally recognized tribes, and contains common-sense guardrails to ensure that states, territories, and tribes regulating marijuana do so in a manner that is safe and respectful of the impacts on their neighbors. Creates an exception for persons involved in a variety of capacities relating to marijuana as long as they were acting in compliance with state law. Holistic approach: extends protections to a variety of banking activities beyond simply the credit union s role as a depository. 32
33 Issue: Tax Congressman Richie Neal (D-MA) Chairman, House Ways and Means Committee Credit union tax exemption was maintained in recent tax reform debate and passage of H.R. 1, the Tax Cuts and Jobs Act The final tax bill will require technical corrections, which will re-open the tax discussion Position: Credit unions thank Congress for preserving the credit union tax status. As Congress considers corrections to recent tax reform, credit unions urge Congress to maintain the credit union tax status: Credit unions are exempt from federal income tax because of their structure as not-for-profit financial cooperatives and their mission to promote thrift and provide access to credit for provident purposes. 33
