3 Overtime Regulations - Overview DOL rule released in July 2015 would increase the salary threshold that an employer must take into consideration in making determination of who is eligible for overtime. Current law requires that in order for an employee to be exempt from overtime, the employee must meet a 3-part test: (1) paid on a salary basis; (2) the salary threshold paid must be at least $455 weekly/$23,660 annually; and, (3) the employee must meet certain duties test. The proposed rule makes no changes to the duties test but would increase the salary threshold by 113% to $970 weekly/$50,440 annually Salary threshold would automatically update every year. A final rule is expected late summer/fall this year. Legislative Update Bipartisan Members of Congress Send Letter to DOL Representatives Cresent Hardy (NV) and Steve Knight (CA) Letter urges DOL to reconsider moving forward with the rule as drafted noting the unintended consequences for employers and employees. 4 Legislative Update Public Sector Letter Sent to Congress SHRM spearheaded a letter signed by 30 public sector groups representing state and local governments, public schools, and public institutions of higher education to Congress. Committee Leaders Urge DOL for More Information Education and Workforce Chairman John Kline (R-MN) and Subcommittee on Workforce Protections Chairman Tim Walberg (R-MI) sent a letter requesting documentation detailing the Department s outreach efforts prior to publishing its proposed overtime rule. Legislation Forthcoming Stay tuned for legislative proposals to address overtime rule, including an appropriations strategy will be busy! SHRM A-Team Involvement Continues 8 February 1 st SHRM A-Team member, Elizabeth Hays, presented at a U.S. Chamber of Commerce Event on how the overtime rule will impact vulnerable employers. Non-profit sector highlighted March 4 th Roundtable scheduled in Congressman Steve Knight s district (CA) will include participation by SHRM A-Team member, Mariann Stopyra, Senior Director, Human Resources at Children s Hunger Fund is confirmed.
