2 REGULAR BOARD MEETING BOARD OF COMMISSIONERS JUPITER INLET DISTRICT MINUTES March 14, 2018 COMMISSIONERS PRESENT George Gentile, Chairman Thomas Howard, Vice Chairman Michael Martinez COMMISSIONERS ABSENT Patricia Walker, Secretary/Treasurer Kenneth Mays OTHERS PRESENT Michael J. Call to Order Chairman Gentile called the meeting to order at 7:03 PM. After the Pledge of Allegiance, he stated "let the record show that we have a quorum and [on behalf of the Commission] the District sends its good thoughts and wishes to Commissioner Walker for a speedy recovery and to Commissioner Mays for good luck [in his emergency situation] as well.

3 March 14, 2018 Regular Meeting Minutes 2. Comments from Public None. Chairman Gentile asked the Board's permission to move Item 9.A. AustinBlu Foundation Presentation of Memorial Model/Consideration of Agreement between JID and AustinBlu Foundation, Inc. to the top of the Agenda. Commissioners Howard and Martinez were in agreement. Blu Stephanos presented a plaster model of the proposed memorial to the Commission. Discussion ensued regarding the size, the mounting, exposure to the elements, exposure to the public, etc. All remarks were very favorable. Discussion continued as to what Mr. Stephanos would like as an inscription on the memorial. Ideally, he would like to see small plaques placed on the statue with the names of those lost. He was asked to submit a couple of ideas as his first and second choices of wording of an inscription. Mr. Stephanos additionally stated that if it just has to be the statue itself [with no inscription] for the Commission to approve its placement, he would concede to that. Mr. Stephanos was given a copy of the proposed agreement regarding disposition of the statue in the future: maintenance; repair; necessity to move it under any circumstance. Mr. Stephanos was assured that the document is a working draft, a starting point, and that if he had questions or concerns, he was encouraged to contact Mr. Grella or Mr. Broome directly. Commissioner Howard also suggested we investigate the possibility of the statue being lit at night. Action Item: Mr. Craig suggested the project may require a Coastal Construction Line (CCL) permit and committed to finding out before the next meeting

February 14, Regular Meeting Minutes Chairman Gentile entertained a MOTION to approve the Minutes of the Regular Meeting of February 14, Commissioner Howard so MOVED; Commissioner Martinez SECONDED. Chairman Gentile called for discussion; there being none, the MOTION CARRIED unanimously. 5. Submission of Bills Chairman Gentile called for a MOTION to approve the Submission of Bills along with the eight (8) additional bills/checks that were processed after the accountant's visit and presented at the meeting. Commissioner Howard so MOVED; Commissioner Martinez SECONDED. There being no further discussion, the MOTION CARRIED unanimously. 6. Treasurer's Report A. Approval of February 2018 Treasurer's Report Staff recommended approval. Chairman Gentile entertained a MOTION to approve the February 2018 Treasurer's Report. Commissioner Howard so MOVED; Commissioner Martinez SECONDED. Chairman Gentile called for discussion; there being none, the MOTION CARRIED unanimously. 7. Executive Director's Report Living Shorelines Pilot Project Mr. Grella stated that JID has submitted a pre-application to the National Oceanographic and Atmospheric Administration (NOAA) for the project through its Coastal Resilience Grant Program for a 2: 1 match in funds. We will hear back if the project is selected ("short-listed") to put in a full application. Additionally, he stated that he met on-site at Jupiter Inlet Lighthouse Outstanding Natural Area (JILONA) with Stephanie Thoburn (Town of Jupiter), along with Janet Zimmerman of the Florida Inland Navigation District (FIND) and the Town's consultants, Wantman Group, to discuss the Town's proposed water taxi service and to see if construction of a dock for the service might interfere with - 3 -

5 March 14, 2018 Regular Meeting Minutes our proposed project. It was determined during the visit that the projects will not only not interfere with one another, but may be seen as complementary. Moonshine Creek Oxbow Restoration Project Mr. Grella stated that unfortunately, we received no construction bids on the project. He has attempted to contact the County's annual contract vendors to no avail. Mr. Grella has spoken to Jamie Rader from Ducks Unlimited. He ed details of the project to Mr. Rader who believes it may be possible for us to piggy back on work being done in Jonathan Dickinson Park by Ducks Unlimited. Additionally, Mr. Grella spoke with Tom Reis who gave him the name of a person whose company has done coastal restoration on both coasts of Florida and Mr. Grella will be contacting them in the near term. Legislative Update The two bills being opposed by FASO (HB7/SB1426) and (HB11/SB354) have died and never made it out of the legislature. Unrelated Comment Commissioner Howard mentioned that he had spoken to Chad Kennedy of FDEP he said that the next time we ask for an extension [on the Mangrove Island Restoration Project], even though we may not have an exact construction date, we need to submit a date by which the project will be complete because he cannot keep going to his boss. Commissioner Howard stated that Mr. Kennedy said "Even if JID estimates it may be two years down the road, I can do that more easily than what I am doing now." Commissioner Howard further clarified that we need to come up with a specific date even if it is outside of this fiscal year. Mr. Grella stated that he, too, has spoken with Mr. Kennedy and he understands. He reiterated that, hopefully, we will get some input/assistance from Ducks Unlimited

6 March 14, 2018 Regular Meeting Minutes 8. Engineer's Report Jetty Observation Mr. Craig stated that the jetties received a "pounding" from the high surf over the last week or two. The railings have held up and, overall, everything looks good. DMMA Salinity Mr. Craig reported that he provided another month of salinity data to Mr. Grella. Taylor Engineering staff collected salinity data earlier in the month (the fifth month of data collection) and there was nothing unusual in the trends. Jupiter Inlet Sand Trap Dredging The contractor's newly installed engine in the main dredge failed. Caterpillar spent a week on-site; the dredge is up and pumping now. Because of the high surf, they are not seeing a lot of growth on the beach as the ocean "steals back some of the sand" that is being pumped to the beach. Mr. Craig expects another week or two of pumping and the job will be done. Moonshine Creek Oxbow Restoration Project The project bid opening was held at the JID office on Friday, March 2 at 2:00 p.m. No bids were received. Mr. Craig stated how frustrating it is to have not received any bids and is looking forward to speaking to the Ducks Unlimited representative. He also mentioned that he has not "given up" on the Palm Beach County annual contractors, but concedes that it is very difficult to make contact with them. Mangrove Island Restoration Project Same dilemma as Moonshine Creek Oxbow Restoration project. Railroad Bridge (AAF) Span Modification Taylor received the go ahead from Mr. Grella to move forward with the permit application for the channel under the proposed modified span and is doing so

7 March 14, 2018 Regular Meeting Minutes Living Shorelines (JILONA) Project Mr. Craig stated that Taylor is moving forward with permitting for this project. Sims Creek Dredge Project Mr. Craig stated that sediment and water sampling has been completed. Although the results are in, rather than rush the analysis, he will bring them to the April meeting. He may ask Dr. David Stites (Taylor Engineering - Senior Biologist/Environmentalist) to accompany him to better explain the results as this is Dr. Stites field of expertise. Additionally, Mr. Craig stated that he took a kayak onto Sims and Jones Creeks today at low tide to try and identify possible outfalls. Ther~ are a few (e.g., a cleared lot with a failed silt fence and a couple of others). Although he is not certain what can or will be done about them, he stated that when Taylor looks at the sampling, if there is anything that is "hot," Taylor can look and see if there is any correlation with the outfalls. 9. Legal Report Mr. Broome has been working on the AustinBlu Foundation Memorial Agreement and the resolution for the policy regarding "Placement of Signs, Plaques, and Other Materials on District Property." The AustinBlu agreement was discussed earlier in the meeting and the Board's suggestion was that Mr. Broome receive comments from the AustinBlu Foundation and incorporate them into the agreement and then bring it before the Commission at the next meeting. As to the policy resolution, Commissioner Howard remarked that he did not believe that there should be any language to imply or obligate this Commission, or future Commissions, to a "good faith review and consent." He wants it stated clearly that it is the JID policy that there will be no placement of signs, plaques, and other material on JID property

8 March 14, 2018 Regular Meeting Minutes He suggested that the resolution address that it would be at the Commission's sole discretion whether it would take a request into consideration. Mr. Broome's suggestion was the addition of language under paragraph three (3.) ''The Board may deny consent in its absolute discretion." A MOTION was made by Commissioner Howard to approve the Resolution as revised and that it be presented for adoption at the next meeting; Commissioner Martinez SECONDED. The MOTION passed unanimously. 9. Unfinished Business A. AustinBlu Foundation Presentation of Memorial Model/Consideration of Agreement between JID and AustinBlu Foundation, Inc. Moved to and discussed at the beginning of the meeting. B. Consideration of Resolution Adopting Policy Regarding Placement of Signs, Plaques, and Other Materials on District Property Discussed under Legal Report. 10. New Business None. 12. Commissioner Reports/Remarks Commissioner Martinez Commissioner Martinez volunteered to take over the responsibilities of acting Secretary/Treasurer until Commissioner Walker returns. The Board thanked him for his great gesture and accepted his offer. Commissioner Howard MOVED that Commissioner Martinez become Acting Secretary/Treasurer in Commissioner Walker's absence; Chairman Gentile relinquished the Chair to Commissioner Martinez and SECONDED the MOTION; the MOTION passed UNANIMOUSLY. COMMISSIONER MARTINEZ RELINQUISHED THE CHAIR TO COMMISSIONER GENTILE. Commissioner Gentile Chairman Gentile stated that he was invited by the new CEO of Brightline, Patrick Goddard, to sit at its (Brightline's) table in attendance of the Mayor's Ball (for the benefit - 7 -

9 March 14, 2018 Regular Meeting Minutes of the Homeless Coalition). Also seated with them was former Mayor and current Palm Beach County Commissioner Stephen Abrams and Brightline staffers. He stated that he had a "long discussion with Bill [Mr. Broome] prior to attending the event or accepting the invitation." At the dinner, Chairman Gentile was informed that Brightline anticipates construction "on northward portions of the rail to begin in the next quarter - as early as April." He additionally stated that he asked about the Loxahatchee River Railroad Bridge project and All Aboard Florida's (AAF) agreement with the district. The CEO is "brand new," so Mr. Roberts and Chairman Gentile disclosed to Mr. Goddard the essence of the agreement. The remainder of the time the Brightline people were monitoring an accident situation with one of their locomotives. Commissioner Howard stated that he believed that a circumstance such as this [an event where a Commissioner will be attending as a representative of the Jupiter Inlet District] should be brought to the Board for its input prior to a Commissioner attending the function. Chairman Gentile stated that in the future he would do so and that in this case, the timeline was too short to bring it before the Board, which is why he discussed it with Mr. Broome prior to accepting. There was extensive discussion regarding the Board's concern that JID is spending taxpayer dollars moving ahead with its portion of the agreement with AAf/Brightline [the channel under the modified span] and has not received any information from them on the status of the span design, a time-line of the project, etc. Mr. Grella stated it has been six months since receiving a returned or phone call and has personally heard nothing back from AAF. Since Mr. Broome has had positive experience in receiving responses from AAF's attorney, Miles Tobin, he was directed to reach out to Mr. Tobin. Should Mr. Broome's request go unanswered, the Board directed him to draft a letter of a more serious tone to be sent out under the Chair's name

GRELLA, EXECUTIVE DIRECTOR SUBJECT: EXECUTIVE DIRECTOR'S REPORT DATE: APRIL 6, Living Shorelines (JILONA) Pilot Project To be discussed as part of Director's Report. 2. Update on Mangrove Island and Moonshine Creek I have had no more success reaching Palm Beach County's "annual contract vendors" than our engineers. In fact, one of their vendors, Vance Construction, Inc., made it clear to me they had no interest in bidding on the project. In contrast, Ducks Unlimited thinks our projects are "feasible within their delivery" and proposes that "they bid our two deliveries in conjunction with the Jonathan Dickinson delivery late this fall as a single package to get the best price and most qualified contractor. Staff respectfully requests Board authorization to initiate the process of developing agreements, establishing a DU P#, while looking at timelines for bid and delivery." 3. DMMA Salinity At the board meeting, we will present salinity and groundwater elevation data collected to date. Jupiter Inlet Sand Trap Dredging 2018 Dredging began on 3/5 and ended on 3/18. A final walkthrough took place on 3/21. Cavache dredged 52,751 CY and has demobilized completely. The beach nourishment reduces visibility of the water's edge from the newly-installed lifeguard stations. We will try to address this issue in next year's design. We will send the FDEP the Engineer's Report in the next few days. Moonshine Creek Oxbow and Mangrove Island Restoration Taylor Engineering is continuing its search to identify a viable contractor to move these projects into the construction phase. AAF In-Water Permitting Per direction of the JID Executive Director, Taylor Engineering has resumed design and permitting tasks for the proposed navigation channel. Taylor Engineering provided JID with plan and cross-section views of the proposed navigation channel to submit to FEC for review. Living Shorelines Project Taylor Engineering is in the process of developing the preliminary design for the project and the subcontract for Lidberg Land Surveying, Inc. to collect topographic and bathymetric data. Sims Creek Dredging Project Taylor Engineering will present a summary of the sediment and water quality data collected from Sims and Jones Creeks at the April board meeting. Taylor Engineering is in the process of developing the preliminary dredging design and permit application package.
