1 Bermuda Terrace Property Owners Meeting Minutes May 20, 2009 Open Meeting Type: Open Place: Tiki Hut Date: Wednesday May 20, 2009 Time: 7:30 PM Board Attendees: See attached sign-in sheet. The meeting called to order by Mike Burnick at 7:30 pm 1. ADMINISTRATIVE: a. The meeting minutes from the April 20, 2009 were accepted. b. The Secretary had no issues to bring forth. c. The Treasurer reported that a deposit of $13, was made to the bank account; Cash $ 4, Deposit $13, Subtotal $17, Dock Reserve $23, Total Cash $41, d. There are 70 paid members of the. A discussion regarding sending a Bill to the outstanding members was held. Steve Martin will coordinate with the former Treasurer, Teri S., regarding the format. e. The Dock-master reported that all gate keys have been returned except for one. There are three dry slips available; Larry V. will send an to the community advertising the three slips. 2. GENRAL DISCUSSION: a. The Common area gate was damaged and recorded with the Sheriff s Office. The local neighbors didn t notice a disturbance. b. Mike Galloway met with Dan Coston Marine Services (DCMS) on May 9, 2009 to discuss an overview of the proposed boat ramp and dredging project. Another meeting held on May 19, 2009 with DCMS. DCMS s subsidiary company, Environmental Permitting Associates, Inc. (EPAI), provided a quote of $2, to perform engineering services for the boat ramp repairs, see attached. DCMS was given a copy of the bathymetric survey that Larry Vicars performed and was informed of the and meeting that took place. DCMS/EPAI and was asked to provide quotes for the following scope items; Quote for complete Engineering package to furnish drawings and obtain a permit to dredge all of the boat slips west of the tee section to three feet below Mean Low Water Level and repair the boat ramp. Provide a quote to dredge all of the boat slips west of the tee section to three feet below Mean Low Water Level based on the bathymetric survey furnished to him as described above. Provide a construction cost to repair the boat ramp based on Engineering drawings. c. Tom D Allessandro asked if any Engineering quotes have been solicited. Since we had the meeting the prior Friday, May, 15, 2009, EPAI was the only request thus far. Additional quotes from other Engineering firms will be solicited. d. Tom D. asked if Anchor Marine has been contacted. Mike G. stated he has called but has not received a return call. Tom D. stated that he had a discussion with Mark Bolhaze (sp?) and would engineer the ramp for approximately half of the $2, e. Mike G. stated that DCMS s opinion was that bulkheads need to extended on both sides of the ramp. f. Geoff Burke asked are there any specifics on the scope of design. g. Chuck Finn asked if the boat slips will continue to fill in. h. Ted Spinelli asked what does the $2, fee include. i. Geoff B. stated that Anchor Marine is a design-build concept. j. Mike G. responded to the questions; we are still on a fact finding mission and based on the preapplication meeting with on 5/15/09 we now have a better understanding of what is required and now can provide a better defined scope of services. k. Tom D. asked if we needed to help soliciting quotes. Mike B. and Mike G. stated we may call on Tom D. to assist.

2 l. Larry V. summarized the pre-application meeting with, see the attached minutes. Tom D. asked if they would provide a timeline on obtaining a permit. Larry V. stated that it will depend on the completeness of the application package. It is his understanding that if no Request For Additional Information (RAI) is issued within 30 days they have to issue a permit. m. Chuck F. asked why do the dredging project before the boat ramp repair. Mike G. and Tom D. responded with we are losing potential income. n. Nancy Calleja suggested having a fund raiser to generate monies for the proposed dredging and boat ramp repair projects. o. Mike G. will be collecting estimates on dock repair/replacement cost for the purpose of establishing a cap on the dock reserve fund. Chris Barlow stated that a line item for potential demolition should be included in that estimate. p. Nancy C. discussed parliamentary procedures regarding the annual meeting and stated that people are confused about the fees. Mike B. reiterated the clarification presented in the Spring newsletter. The fees for 2009 are considered a one time event by the current Board and that based on information gathered throughout the fiscal year a new budget will be generated for the 2010 fiscal year. q. A discussion of electricity use and imposing surcharges for above normal use was held. The Board will investigate. r. Kevin Quinn asked when the first By-Laws review committee meeting was going to be held. Hank Resch stated that the first meeting is scheduled for June 24, 2009 at 7:30 PM at the Resch residence. s. Kevin Q. also asked if the website could be updated. Larry V. stated that a new website, bermudaterrace.net, has been set up and is online. We are still gathering and transferring information from the previous Board, therefore, the information presented on the website may not be the most current but it the latest information on-hand. t. The next Board meeting is scheduled for June 17, Location to be determined. u. The meeting was adjourned at approximately 10:00 PM These are my interpretations of the meeting. 3 Bermuda Terrace Property Owners Association Meeting Minutes May 15, 2009 Meeting Type: Florida Department of Environmental Protection () Pre-Application Meeting Place: Office located at 400 N. Congress Ave. West Palm Beach, FL Date: Friday May 15, 2009 Time: 2:00 PM Attendees: Benny Luediki, Chris Barlow and Larry Vicars. For brevity herein Mr. Luediki will represent and Chris Barlow and Larry Vicars will represent Bermuda Terrace Property Owners Association (). The purpose of this meeting is begin the dialogue with and their permit requirements for a proposed dredging and boat ramp repair project located at Gulfstream Way, Tequesta, FL. The parcel of land is a common area to residence and contains approximately 35 dry storage spaces, 18 wet boat slips (Dock), a boat ramp (Ramp), asphalt paving, city water supply and a covered sitting area. The property is owned and maintained by the. An aerial and a current bathymetric survey were presented for illustrations depicting the accumulation of sand at the Dock and Ramp. The is proposing to engage in a Dredging project and a future ( 1-2 years) Ramp repair project. It was shown at low tide on May 5, 2009 that slip #18 had approximately 5-inches of sand bottom exposed; slips #1 and #17 had an approximate average water depth of 6-inches. It was also shown that several other slips had water depths less than 24-inches. Do you have Submerged Land Lease for the Dock? Presented a copy of their current Submerged Land Lease, No Confirmed that they have a Record of the Land Lease on file. Stated that permit for dredging and ramp repair is achievable. Do you have a survey for the parcel of land other than hand sketch that is included in the Land Lease? will investigate. During the next Lease renewal scheduled for October 31, 2012, it is probable that a survey will be required. Is there a maximum and recommended water depth for the Dredging project? Prefers the depth of water to be 12-inches below a boat s propeller at low tide. Under certain conditions we will allow up to 60-inches. Suggested using 36-inches of water depth for the permit application. This will facilitate future dredging maintenance, if required, by requiring a less expensive and exhaustive Exemption permit. Please explain the different permits that are issued by. The order of permits (with fee structure) are; o Exemption $ o Notice General Permit (NGP)--$ o Standard General Permit (SGP) For upland area less than 1-acre and wetland area less than 1-acre-- $ For upland areas between 1 and 40 acres and wetlands less than 1-acre-- $ o Individual Not applicable.

4 The Dredging project will require a SGP. The Ramp repair will require a NGP. The area may be an Aquatic Preserve which may trigger a Public Perception Notice. As we understand it, the permit application package should include, in part; aerials, surveys, existing bathymetric drawings, proposed bathymetric drawings, exhibits, construction methodology, section drawings and details. Also, once a permit is issued it is open for five years. Are there any issues with preparing one permit application for both the Dredging project and the Ramp repair project and have them described as Phase I and Phase II, respectively? As long as the Phases have time periods described, i.e. Phase I to begin upon permit issuance and Phase II to begin in the year 20XX, there should not be any issues. A sea grass report needs to be included with the permit application. What options do we have with regards to the spoils that are removed from the Dredging project? If the spoils are stored on-site will require soil samples which include in part; presence of oil, toxicity test, Polycyclic Aromatic Hydrocarbons (PAH), etc. Soils may be disposed of at the local landfill. Are Geo-Tubes appropriate for preventing sand accumulation to our existing boat ramp? Geo-Tubes are typically used in applications for shoreline stabilization and may be exposed to atmosphere during certain tide conditions. Geo-Tubes are not favorable for this application due to; o Impacting (sand build-up) areas outside of the boat launch area. o The integrity of Geo-Tubes will be compromised if struck by a boat propeller.
