Minor Subdivision , 3802 Happy Valley Road Approval of Subdivision; Authorization to Record Parcel Map Action: The City Council approved and authorized the execution of the subdivision agreement and recordation of the parcel map. Steven Falk, City Manager and Tracy Robinson, Administrative Services Director Resolution FY2013/14 Proposed Budget and Workplan Action: Conducted public hearing and adopted Resolution FY2013/14 Budget and Workplan as amended removing the bike park project, adding $50,000 for an Emergency Services Analysis and establish a Stormwater Pollution Reserve of $50,000 to increase by $10,000 per year for next 10 years. Jennifer Russell, Parks, Trails & Recreation Director Ordinance 619 Amending Section of the Lafayette Municipal Code, Entitled Limitations on the Use of Land, Park Facilities, and Fees Action: Continued to July 8, Vote: 5-0 (Ayes: M. Anderson, Tatzin, B. Andersson, Mitchell and D. Michael Cass, Associate Planner Appeal by Michele Chalmers of the Planning Commission s approval, subject to conditions, of: L11-12 Dana Finegold (Applicant & Owner), R-40 Zoning: Request for: (1) a retroactive Land Use Permit (2) a Variance to permit structures in excess of 6-0 in height within setback areas, and (3) an Exception to permit the recreation court to (a) encroach within the front yard setback and access easement, (b) be located between the residence and the street, and (c) to be located less than 50-feet to an adjacent residence, located at 3357 Kincheloe Court, APN Action: Directed the property owners to install a sound barrier recommended by the project engineer. Directed staff to conduct a new noise analysis to assess the mitigation of the sound barrier and noise impacts on the surrounding properties. In the interim, allow the use of the batting cage between the hours of 10 a.m. and 7 p.m. for up to two times per day for a maximum of 15-minutes per use, provided no metal bats allowed.
