6 ITEM D R-137/17 It was MOVED and SECONDED That Council give first three readings to 2017 Tax Rates Bylaw 1365 ; and, That adoption of 2017 Tax Rates Bylaw 1365 be scheduled for the Regular Council Meeting of May 8, CARRIED J-3 Official Community Plan and Zoning Amendment Bylaws Centennial RV Park - Contract Planner presented his report R-138/17 It was MOVED and SECONDED That Official Community Plan Amendment Bylaw and Zoning Amendment Bylaw be read a first and second time and proceed to a public hearing; and That Council considers the process, as outlined under the Public Process section of this report, to be appropriate consultation for the purpose of Section 475 of the Local Government Act; and That in accordance with Section 477 of the Local Government Act, Council has considered Amendment Bylaw No in conjunction with its Financial and applicable Waste Management Plans; and That the holding of the public hearing be scheduled for May 8, 2017; and That staff give notice of the public hearing in accordance with the requirement of the Local Government Act. 7 ITEM D R-140/17 It was MOVED and SECONDED That Council consent to assigning the Diana Covert Airport Hangar #19 Lease to Douglas Franklin with all the terms and conditions of the lease remaining the same, except for: the Term of the lease shall be reduced to 5 years (from April 25, 2017 to September 30, 2022) That Council authorizes the signing authorities to execute the agreement as presented in the Corporate Officer's report dated April 24, CARRIED K-3 Oliver Parks and Recreation - FCC AgriSpirit Fund Application - Chief Administrative Officer presented her report R-141/17 It was MOVED and SECONDED That the Town of Oliver support the Oliver Parks & Recreation s application for funding through the Farm Credit Canada AgriSpirit Fund for the Joel Waines Small Wheels Playground project; and That the Town act as the fiscal manager of all grant funds received and allow the Oliver Parks and Recreation to implement the project using the entirety of these funds by waiving the 10% administration fee; and That Council authorize the Town signing authorities to execute the contract should Oliver Parks and Recreation be successful in receiving funding through the FCC AgriSpirit Fund. CARRIED L CORRESPONDENCE April 10, 2017 Correspondence Report - Corporate Officer presented her report L-1 Correspondence dated April 12, 2017 from Salish Sea Trust seeking support from local governments to include the Salish Sea as a UNESCO World Heritage Site. R-142/17 It was MOVED and SECONDED That Council direct staff to provide a letter of support to nominate the Regular Open Minutes of April 24, 2017 Page 4 of 7 Page 7 of 71

J-3 Downtown Oliver Action Plan - Chief Administrative Officer presented her report CARRIED CW-38/17 It was MOVED and SECONDED That Council appoint a Council member to the Oliver Downtown Revitalization Advisory Committee and direct staff to invite members from the South Okanagan Chamber of Commerce and Oliver Tourism Association to participate on the Advisory Committee; and, That Council appoint Councillor Doerr and the Chief Administrative Officer as members on the Oliver Downtown Revitalization Advisory Committee. 14 ITEM G REGULAR OPEN COUNCIL REPORT Operations Department For the May 8, 2017 Council Meeting DATE: May 02, 2017 File No TO: FROM: Mayor and Council Jeff Marion, Engineer Technologist RE: Water Quality Summary Report for March 2017 RATIONALE: The purpose of this report is to provide a summary of the water system operations by the Town in the month of March OPTIONS: 1. 15 ITEM G BACKGROUND: The distribution system is in the WINTER MODE of operation using ground water ONLY for domestic use. A summary of noteworthy activity in the operation of the water system is as follows: RURAL Water Systems March 1 New epoxy was used to repair the erosion in the canal s siphon that occurred during last year s irrigation season. March 3 High beaver activity over the winter at Tuc-el-nuit outflow structure made things difficult and took extra effort for the men to clear the blockage to prevent the lake from flooding this spring. March 6 A new pump base for pump one at Mud Lake Pumping Station was replaced due to deterioration. March 6 Late start due to the weather, but the general annual canal repairs commenced this day with a crew of four canal workers. March 13 Reinstalled pump three at Rockcliffe Irrigation Pump Station after routine scheduled maintenance. March 14 Due to leaking a 150mm (6 ) gate valve on Sunflower Street was replaced with a new one. March 17 Structural inspection and routine maintenance was undertaken at Flume three in preparation of the 2017 Irrigation Season. March 22 Reinstalled pump three at Black Sage Domestic Pump Station after routine scheduled maintenance. March 22 To accommodate agricultural users, in filling their sprayers, the pressurized irrigation system was activated in systems four, six, and seven using Fairview Pump Station. March 23 To accommodate agricultural users, in filling their sprayers, the pressurized irrigation system was activated in system one with the town water interconnect. March 31 Closed all canal drains, in preparation to fill the canal for the 2017 Irrigation Season. IN-TOWN Water Systems March 6 Service crew replaced the domestic service valve for 6458 Main St, due to leaking. March 14 Replaced water meter at 340 Mckinney Rd, due to noise. March 23 Decommissioned Centennial Park well number one. March 28 Service crew replaced faulty domestic service valve located on Chardonnay Place. LITERS PER PERSON PER DAY (l/pp/pd) Oliver approximately used 617(l/pp/pd) during the month of March, which is an increase of 20% from the previous month of February. This result is also an increase of 8% from the previous year in Page 16 of 71

According to Environment Canada the Oliver normal for March, from , has a daily average MAX temperature of 12.0 C, an average MEAN temperature of 6.2 C, and an average MIN temperature of 0.4 C. Having a recorded rainfall of 24.0mm, and a recorded snowfall of 4.0cm. According to Environment Canada the normal precipitation for Oliver, from , is 24.9mm for the month of March. 25 ITEM J BACKGROUND: The Community Charter specifies that council may, by bylaw, establish or amend street names and house addresses in the municipality. Because the Charter specifies that this may be done by bylaw, it cannot be delegated to municipal staff. Upon substantial completion of the civic addressing update, council adopted Civic Addressing Bylaw 1320 in April, At the time it was noted that in future years, as new subdivisions occur or as corrections are made, new street names and house numbers will be consolidated into a single bylaw change each year or two, whereby the map attached to Bylaw 1320 as Schedule A can simply be adopted by council as part of a simple amending bylaw. Attached Bylaw proposes to update Bylaw 1320 for addressing changes that have occurred over the past few years. It should be noted that because Schedule A to Bylaw is a large map, it will be on display in the council chambers and is not attached to this report. Draft Bylaw was previously considered by Council at its meeting of January 23, 2017, and proposes, amongst other things, to introduce the following as permitted uses: agri-tourism accommodation; greenhouse; brewery, distillery or meadery, cidery; the operation of a food and beverage service lounge, if the area of the lounge does not exceed 125 m2 indoors and 125 m2 outdoors; processing, storing and retail sales; carriage house; and kennel. In support of these uses, the amendment bylaw proposes to introduce supportive definitions and a series of new general regulations (i.e. for agri-toruism accommodation, kennels and provisions for retail sales of farm and/or off-farm products ). OPTIONS: 1. Council may choose to support the recommendation. 2. Council may choose to refer back to staff for additional information. 3. Council may choose not to support the recommendation. This bylaw may be cited for all purposes as Zoning Amendment Bylaw The Town of Oliver Zoning Bylaw 1350 is amended by: i) deleting the definition of winery at Section 4.0 (Definition). ii) replacing the definition of agri-tourism at Section 4.0 (Definition) with the following: agri-tourism means a tourist activity, service or facility accessory to land that is classified as a farm under the Assessment Act; iii) iv) replacing the definition of agri-tourism accommodation at Section 4.0 (Definition) with the following: agri-tourism accommodation means accommodation for rental to the traveling public on an operating farm which is accessory to and related to, the principal farm use of the parcel; adding a new definition of brewery, cidery, distillery, meadery or winery at Section 4.0 (Definitions) as follows: brewery, cidery, distillery, meadery or winery means the brewing or distilling of alcoholic beverages or alcoholic products with alcoholic content exceeding 1% by volume that is licensed under the Liquor Control and Licensing Act to produce beer, cider, spirits, mead or wine. May include processing, storage and retail sales of farm products and a food and beverage service lounge. v) adding a new definition of food and beverage service lounge at Section 4.0 (Definitions) as follows: food and beverage service lounge means an establishment serving alcohol products produced on the premises, in addition to food, that has a lounge endorsement to the license issued under the Liquor Control and Licensing Act. 42 ITEM J Zoning Amendment Bylaw Page 2 vi) vii) viii) adding a new definition of retail sales of farm and/or off-farm products at Section 4.0 (Definition) as follows: retail sales of farm and/or off-farm products means retail activity which is an accessory use to a farm use and which may include the sale of goods produced on or off that farm as permitted in a given zone and which includes buildings and structures necessary for the sale and storage; replacing Section 6.14 (Provisions for Retail Sales and Processing, Packing and Storage of Farm Products and/or Off-Farm Products) at Section 6.0 (General Regulations) in its entirety with the following: 6.14 Provisions for Retail Sales of Farm and/or Off-Farm Products.1 Where retail sales of farm and off-farm products is permitted in a zone, farm products, processed farm products, and off-farm products may be sold to the public subject to the following regulations: a) the area used for retail sales of off-farm products shall not exceed ½ of the total area used for all retail sales on the parcel; b) where off-farm products are offered for sale, farm products and/or processed farm products shall also be offered for sale; and c) the retail sales area for farm products and off-farm products shall not exceed 300 m 2..2 For the purpose of calculating the area used for retail sales in a building or structure, the following shall be included: a) aisles and other areas of circulation; b) shelf and display space; c) counter space for packaging and taking payment; and d) any area used for the service and consumption of hot and cold food items. Any office area, wholesale storage area, processing facility or parking area or driveway, whether used for retail sale or not, shall not be included..3 in addition to the floor area permitted under sub-section 1(c), where food and beverage service lounge is permitted in a zone, the lounge floor area shall not exceed 125 m 2 indoors and 125 m 2 outdoors. adding a new Section 6.16 (Agri-Tourism Accommodation) at Section 6.0 (General Regulations) as follows: 6.16 Agri-Tourism Accommodation Page 42 of 71

Agri-tourism accommodation is permitted only on a parcel if all or part of the parcel is classified as a farm under the Assessment Act. 2. Agri-tourism accommodation shall be for short term use by a person up to a maximum stay of 30 consecutive days with 30 days in between any subsequent stay. 3. The number of agri-tourism accommodation sleeping units permitted parcel shall be as follows: PARCEL AREA MAXIMUM NUMBER AGRI- TOURISM ACCOMMODATION SLEEPING UNITS Less than 1.0 ha ha to 5.0 ha 5 Greater than 5.0 ha All agri-tourism accommodation sleeping units shall be contained under one roof. 5. No agri-tourism accommodation sleeping unit shall have an area of greater than 30.0 m 2. A washroom is not included as part of the area of the agri-tourism accommodation sleeping unit. 6. No cooking facilities shall be provided for within individual agritourism accommodation sleeping units. 7. One (1) parking space per agri-tourism accommodation sleeping unit is required in addition to parking required for the principal single detached dwelling. ix) adding a new Section 6.17 (Kennel Facilities) to read as follows: 6.17 Kennel Facilities A kennel is permitted where listed as a permitted use, provided that: 1. No kennel shall be permitted on a parcel less than 2.0 hectares in size; and 2.
