1 STAFF REPORT SAUSALITO CITY COUNCIL MEETING DATE: AGENDA TITLE: June 6, 2017 Consideration of Appointment to the City Council LEAD DEPARTMENT: Administration: City Attorney and City Clerk/Assistant City Manager,,,,,,,, ============================== RECOMMENDED MOTION: Consider appointing a Sausalito resident to the City Council or calling for a Special Election SUMMARY Councilmember Herb Weiner resigned from the Sausalito City Council effective April 18, Under existing State law within 60 days of the effectiveness of the resignation, the Council must either: fill the vacancy by appointment, or call for a special election. On May 2, 2017 the Council discussed the aptians to fill the vacancy and directed staff to solicit applications from interested residents. The application deadline was May 17th. Thirteen applications were submitted. Two applications were found to be ineligible. The Council interviewed the eleven candidates on May 23rd and May 30 th. Due to the number of applicants the Council on May 30, selected a subset of fou r candidates to move forward in the appointment process. The Council now has an opportunity to make an appointment to the City Council or call for a special November 2017 election. BACKGROUND On or before June 17, 2017 the City Council is required to fill the existing vacancy on the Council by appointment or call for a special election. The Council, decided to move forward with soliciting applications from interested residents and to follow a process similar to the one used to make appointments to boards and commissions. Notice of the opportunity to apply for the vacant Council seat was provided as follows: Wednesday, May 3, Notice posted on City website - Notice sent in a special edition of the Sausalito Currents - Notice posted on Nextdoor, Facebbok and Twitter Page 1 of 6
2 Friday, May 5, Article in the regular edition of the Sausalito Currents /2"x11" tri-folded notice/mailer begins to arrive in mailboxes Thursday, May 11, Notice posted on Nextdoor and Facebook Friday, May 12, Article in the regular edition of the Sausalito Currents Tuesday, May 16, Notice posted on Twitter Wednesday, May 17, 2017: deadline to submit applications DISCUSSION/ANAL YSIS App/ications. Residents of Sausalito who are registered to vote in the City of Sausalito, are 18 years and older, and who submitted an applícation by the deadline were eligible to be considered for appointment. The City received applications from the following candidates: Keith Stoneking Susan Cleveland-Knowles Robin Harris Kate Stohr Bill Werner Nathaniel Hastings Melissa Blaustein Nathan Scripps Charles Turlínski Terence Moran Isaac Lappert Patrick Cassidy Scott Wilmore Mr. Wilmore did not submit a complete application and he is not registered to vote in Sausalito. Therefore, he was disqualifíed from the candidate poal. Mr. Turlinksi is also not registered to vote and therefore he was disqualifíed from the candidate poal. lnterview of Candidates. The Council interviewed the eleven candidates on May 23rd and May 30 th. Candidates were interviewed as follows: May 23: Charles Turlinski 1 Keith Stoneking Susan Cleveland-Knowles 1 Mr. Turlinski was interviewed prior to staff determining he was ineligible Page 2 of 6
3 May 30: Nathan Scripps Robin Harris Kate Stohr Bill Werner Nathaniel Hastings Melissa Blaustein Terence Moran Isaac Lappert Patrick Cassidy Poo/ of Candidates. Due to the large number of applicants, the Council selected a subset of candidates to move forward in the appointment process at a special meeting on May 30. The following candidates were selected to be considered for appointment: Susan Cleveland-Knowles Kate Stohr Keith Stoneking Bill Werner Next Steps. The City Council has 60 days from the effective date of the resignation, that is until June 17, 2017, to either fill the vacancy by appointment or call for a special election. 1. Appointment. The Council may make an appointment at the June 6 City Council meeting. Staff would recommend that the Council employ the process for appointments to Boards and Commission in Sausalito Municipal Code Section when making the appointment, as outlined below: The Mayor shall announce his nomination The Mayor shall then solicit any additional nominations from the dais Following announcements of nominations, the Mayor shall then receive public comment, and proceed on to a roll call vote. Each Councilmember may vote for one nominee A nominee must receive at least three votes to be appointed The Council must make an appointment by June 17, 2017 or call for a special election by that date. 2. Special Election. The City Council may decide to call for a special November 7, 2017 election. A draft resolution calling for a special election is provided in Attachment 3. The Council must adopt a resolution calling for the election by June 17, 2017 or make an appointment to the Council by that date. Page 3 of 6
4 FISCAL IMPACT The cost of an election is based on the number of registered voters. Sausalito currently has 5,352 registered voters. The County Registrar of Voters has submitted revised estimates that the cost of the November 2017 election would be approximately $7.00- $7.50 per registered voter or $37,464-$40,140. Staff does not anticipate any costs associated with filling the Council vacancy by appointment, with the exception of the noticing cost which was approximately $2,000.
