ORDINANCES a) Final Reading: Consider an ordinance providing for the extension of the boundaries and corporate limits of the City of Orange, Texas, by the annexation of a acre tract of land lying in the Claiborne West Survey, Abstract No. 27, Orange County, Texas, being out of and a part of that called 2.50 acre tract of land described in an instrument to JMJR Investments, LLC, of record in Clerk s File No of the Official Public Records of Orange County, Texas. APPROVAL OF MINUTES Council Member Pernell moved to approve the minutes of the January 15, 2019 Special Call Meeting of the Planning and Zoning Commission and the City Council. Second to the motion was made by Council Member Burch which carried unanimously. Council Member Pernell moved to approve the minutes of the January 22, 2019 Orange Economic Development Corporation Meeting. Second to the motion was made by Council Member Childs which carried unanimously. Council Member Salter moved to approve the minutes of the February 26, 2019 Regular City Council Meeting. Second to the motion was made by Council Member Burch which carried unanimously. CITIZEN COMMENTS Mr. Trahan invited the citizens to the 17 th Annual Art in the Park, Saturday, April 6, 2019 from 9:00 a.m. until 4:00 p.m. Katie Krantz, Shangri La/Stark Foundation, thanked the City for its support for the 24 th Community Wide Trash-Off. Alan Mesecher, th Street, advised there are concerns regarding speeding and trash on 10 th Street. Robbie Hood, City Manager of Pinehurst, advised there is a state of emergency for economic development. He also advised there needs to be unity among all the area entities. He encouraged citizens to attend the Orange County Commissioners Meeting tomorrow to stand up and voice their opinion regarding Chevron/Phillips coming to this community. Capital Advisors LLC, financial advisors to the City as to Tax & Revenue Certificates of Obligation, Series 2019 (the Certificates ). James Gilley, U.S. Capital Advisors, LLC, congratulated the City on a successful sale of the Certificates. Mr. Gilley advised six bids were received and the best bid was submitted by The Baker Group. He advised the City received a AA- rating from Standard & Poor s. He gave an overview of a handout entitled, Competitive Sale Summary, Tax and Revenue Certificates of Obligation, Series 2019, $7,785,000. (A copy of this handout is included in and being made a part of these minutes) Page 11 of 115

12 Regular Meeting 4 March 12, 2019 DISCUSSION/ACTION Consideration and possible action to award sale of Certificates as provided for in the Notice of Sale of the Certificates. Mr. Knauf stated that staff will bring a list of streets and a project schedule to the City Council for their approval. He also stated that some projects maybe affected by proposed legislation currently being discussed in the Texas Legislature. Mayor Spears read the following projects that are intended to be funded by the Certificates: Street Improvements, Recreation Center, Pavilion at the Boat Ramp, Fire Truck, Generator for the new City Hall and Street Improvements. Mayor Pro - Tem moved to award the sale of Certificates to The Baker Group. Second to the motion was made by Council Member Childs which carried unanimously. ORDINANCES ORDINANCE AUTHORIZING THE ISSUANCE OF THE CITY OF ORANGE, TEXAS, TAX & REVENUE CERTIFICATES OF OBLIGATION, SERIES 2019"; SPECIFYING THE TERMS AND FEATURES OF SAID CERTIFICATES; PROVIDING FOR THE PAYMENT OF SAID CERTIFICATES OF OBLIGATION BY THE LEVY OF AN AD VALOREM TAX UPON ALL TAXABLE PROPERTY WITHIN THE CITY; AND A PLEDGE OF SURPLUS REVENUES OF THE CITY S SANITATION SYSTEM; AND RESOLVING OTHER MATTERS INCIDENT AND RELATING TO THE ISSUANCE, PAYMENT, SECURITY, SALE AND DELIVERY OF SAID CERTIFICATES, INCLUDING THE APPROVAL AND EXECUTION OF A PAYING AGENT/ REGISTRAR AGREEMENT AND AUTHORIZING AN OFFICIAL STATEMENT AND DISTRIBUTION THEREOF; AND PROVIDING AN EFFECTIVE DATE. DISCUSSION/ACTION MOTION APPROVING ACTION TAKEN BY THE ORANGE ECONOMIC DEVELOPMENT CORPORATION TO ENTER INTO AN AGREEMENT WITH REAL SOUTHERN COOKING FOR THE EXPENDITURE OF FUNDS FOR INFRASTRUCTURE IMPROVEMENTS AT 1111 GREEN AVENUE, ORANGE, TEXAS IN AN AMOUNT NOT TO EXCEED $55,000 FOR THE PURPOSE OF ECONOMIC DEVELOPMENT. This item was TABLED. MOTION AMENDING RESOLUTION TO AUTHORIZE THE INTERIM CITY MANGER TO ENTER INTO A JOINT ELECTION AGREEMENT WITH THE BRIDGE CITY ISD FOR THE CITY OF ORANGE MAY 4, 2019 ELECTION. Mayor Spears moved to approve the motion. Second to the motion was made by Council Member Pernell which carried unanimously. DISCUSSION AND POSSIBLE ACTION REGARDING DECLARING CITY-OWNED PROPERTY LOCATED AT 1705 MACARTHUR DRIVE AS SURPLUS PROPERTY. After discussion, Mayor Pro - Tem Pullen moved to declare the property as surplus and to explore other options on what to do with the property. Second to the motion was made by Council Member Pernell which carried unanimously. DISCUSSION AND POSSIBLE ACTION REGARDING NECESSARY BUSINESS RESULTING FROM HURRICANE HARVEY. No report was given. INTERIM CITY MANAGER REPORT Mr. Knauf advised there will be two Home Owners Assistance Workshops held; one held on Tuesday, March 19, 2019 from 4:00 p.m. until 7:00 p.m. at the Orange Public Library and one held on Saturday, March 23, 2019 from 10:30 a.m. until 1:30 p.m. at the Orange Public Library. He also advised the demonstration on how to use the new voting machines is on the City s website. CITY COUNCIL REPORT Council Member Pernell advised the Historical Dedication of the Orange Train Depot was amazing. She advised Judge Pennington and Mayor Spears gave touching speeches. 14 Regular Meeting 6 March 12, 2019 Council Member Childs advised Council Member Mello has started his treatments and is looking good. He encouraged citizens to attend the Orange County Commissioners Court tomorrow to voice their opinions regarding the Chevron/Phillips project. He asked that the comments be positive and to let them know we want them in the City. Mayor Pro - Tem Pullen advised the Orange Economic Development Corporation has helped the City and thanked Mr. Trahan for all he has done for the City. Mayor Spears thanked the following individuals: Ms. Zeto and Staff, Mr Hood, Mr. Gilley and Mr. Goodson. 15 roclamation OFFICE OF THE MAYOR City of Orange WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS the Gift of Life is hosting the 14 th Annual Champagne & Ribs event benefiting its Men s Health and Prostate Cancer Program that provides vital healthcare for Southeast Texas men who cannot afford insurance or high deductibles; and the Survivor-themed event will be held on Thursday, April 4 th at the Beaumont Civic Center and recognize four outstanding program advocates; physician, Todd Clarke, MD; attorney, The Honorable Jimmy Mehaffy; Jefferson County Commissioner, Michael Shane Sinegal; and business leader, Tim Sudela; and the Gift of Life annually screens nearly 600 medically at-risk men and augments its initiatives through regional healthcare and disaster recovery partnerships to provide free prostate cancer screenings, a battery of vital primary care tests and essential educational outreach at designated strategic sites in Beaumont, Port Arthur and Orange; and the Gift of Life pays for all medical costs including prostate cancer screenings, diagnostic tests and cancer treatment; and statistics reflect that early detection is the best protection against prostate cancer, with the five-year survival rate for men who are diagnosed early with localized prostate cancer being nearly 100 percent; and the Gift of Life, through its Health Consortium stakeholders that include local physicians and medical entities, along with other dedicated program ambassadors ensures comprehensive resources and direct care are made available to advance the health and well-being of Southeast Texas men and their families; and since 2000, the Gift of Life has made available nearly 10,000 free prostate cancer screenings and helped extend the lives of 77 men who have been diagnosed with prostate cancer; NOW THEREFORE I, Larry Spears, Jr., Mayor of the City of Orange, Texas, do hereby proclaim March 26, 2019 as the GIFT OF LIFE MEN S HEALTH AWARENESS DAY in Orange, and I also urge all men in our community to pursue preventive health practices and early detection efforts. 16 roclamation OFFICE OF THE MAYOR City of Orange WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS in Federal Fiscal Year 2018, the Texas Department of Family & Protective Services confirmed 66,382 victims of child abuse or neglect, including 280 in Orange County; and child abuse and neglect is a serious problem affecting every segment of our community, and finding solutions requires input and action from everyone in our community; and our children are our most valuable resources and will shape the future of Texas; and child abuse can have long-term psychological, emotional, and physical effects that can have lifelong consequences for victims of abuse; and protective factors are conditions that reduce or eliminate risk and promote the social, emotional, and development well-being of children; and effective child abuse prevention activities succeed because of the meaningful connections and partnerships created between child welfare, education, health, community and faith-based organizations, businesses and law enforcement agencies; and communities must make every effort to promote programs and activities that benefit children and their families; and we acknowledge that we must work together as a community to increase awareness about child abuse and contribute to promote the social and emotional well-being of children and families in a safe, stable, nurturing environment; and prevention remains the best defense for our children and families; and the impact of abuse and neglect has long-term personal, economic and social costs; therefore, hurting Texas future; and we acknowledge that we must work together as a community to increase awareness about child abuse and contribute to promote the social and emotional well-being of children and families in a safe, stable, nurturing environment; and Court Appointed Special Advocates - CASA volunteers - are assigned by the court to speak up for a child s best interest and be a voice for a child in the courts; and every child in care deserves a CASA volunteer, but roughly less than half the children in care do not have a CASA volunteer; and Page 16 of 115

17 WHEREAS WHEREAS 10,424 CASA volunteers spoke up for the best interest of 29,747 children in Texas last year; and CASA of the Sabine Neches Region, Child Protective Services, foster parents, teachers and others work to ensure that children in our community have the opportunity to grow up in safe, loving permanent homes; NOW THEREFORE I, Larry Spears Jr., Mayor of the City of Orange, Texas, do hereby proclaim April 2019 as NATIONAL CHILD ABUSE PREVENTIVE MONTH in the City of Orange, Texas, and urge all citizens to recognize this month by dedicating ourselves to the task of improving the quality of life for all children and families. 92 DATE: March 18, 2019 TO: FROM: RE: Kelvin Knauf, Interim City Manager Sergeant Jana Bernard, Code Enforcement Resolution authorizing the interim city manager to enter into a contract with Southeast Texas Lawn and Maintenance for mowing vacant property that is in violation of the Code of Ordinances On March 18, 2019 the City opened bids for mowing of private property that is in violation of City ordinances. The bids were sent to three vendors and published in the Orange Leader and on the Associated General Contractors website. The only bid received was from South East Texas Lawn and Maintenance. Their bid is as follows: This bid Previous contract Mowing of vacant property lots over 7,500 $.0085 $.004 square feet and less than one (1) acre (per square foot) Mowing of vacant property 7,500 square $25.00 $29.00 or less (per lot) Staff is recommending that the City Council award the contract of South East Texas Lawn and Maintenance for one year. The bid specifications also provide for a one year option at the same rate if the City so chooses. South East Texas Lawn and Maintenance has performed mowing services for the city over the past years. Please place the attached resolution on the City Council agenda for their consideration. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE, TEXAS AUTHORIZING THE INTERIM CITY MANAGER TO ENTER INTO A CONTRACT WITH SOUTH EAST TEXAS LAWN & MAINTENANCE FOR MOWING VACANT PROPERTIES THAT ARE IN VIOLATION OF THE CODE OF ORDINANCES WHEREAS, the City of Orange solicited bids for the mowing of vacant properties that are in violation of the City Code of Ordinances; and WHEREAS, the bids were publicly opened and read aloud at 10:00 AM on March 18, 2019; and WHEREAS, South East Texas Lawn and Maintenance submitted the only bid; and WHEREAS, South East Texas Lawn and Maintenance has performed mowing services for the City of Orange in the past and the City finds their performance to be satisfactory; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ORANGE, TEXAS: Section 1. That the City Council hereby authorizes the interim city manager to enter into a mowing contract with South East Texas Lawn & Maintenance for one year at the rate of $.0085 per square foot for vacant lots over 7,500 square feet and less than 1 acre and at the rate of $25.00 per lot for each vacant lot of less than 7,500 square feet. The City Council also approves an optional one year extension to this contract with no change to rates, if the city manager or his/her designee is satisfied with the performance of South East Lawn and Maintenance.
