1 REGULAR MEETING BOARD OF TRUSTEES, VILLAGE OF NILES 6: 00 p.m. Informal Consideration 7: 00 p. m. Regular Meeting A video recording of this meeting can be viewed on the Village ofniles website CALL TO ORDER The Board of Trustees was called to order at 6: 00 p. m. by President Andrew Przybylo in the Council Chambers, Village of Niles Municipal Building, on Tuesday,. ROLL CALL Board members present were President Andrew Przybylo, Trustees George D. Alpogianis, John C. Jekot, Joe LoVerde, Danette O' Donovan Matyas, Denise McCreery and Dean Strzelecki. INFORMAL CONSIDERATION On October 5, 2016, the Cook County Board of Commissioners adopted an ordinance that requires employers in Cook County to provide a minimum number of paid sick days commensurate with the number of hours employees worked and an ordinance creating Cook County Minimum a minimum wage for employers in Cook County beginning at $ 10 Wage and Paid Sick Leave per hour to be increased to $ 13 per hour by President Ordinances Przybylo called this informal consideration to hear testimony regarding these Cook County ordinances which go into effect on July 1, 2017, unless a municipality opts out. Only home-rule municipalities can opt out. This ordinance exempts government entities in Cook County from participation. Larry Suffredin, 13th District Cook County Commissioner Commissioner Suffredin stated that he was the principal sponsor of the Cook County minimum wage ordinance because many of the communities he represents border Chicago, where the minimum wage is $ His main purpose was to get Springfield to increase the minimum wage statewide. He read from a statement he distributed to the Board from Congresswoman Jan Schakowsky who strongly urged the Niles Board to not opt out of the minimum wage/ paid sick days ordinances. Jonathan Buckner, Director of External Affairs for Cook County Board President Toni Preckwinkle Mr. Buckner read a letter from President Preckwinkle supporting both ordinances, stating that a healthy workforce benefits all of us. Paying people fairly and allowing them a limited number of earned sick time supports economic growth. Mr. Buckner submitted the letter to the Clerk for the record. Page 1 of 19

2 Pam Gibson, Vice President of Human Resources for the Bradford Group and Hammacher Schlemmer Ms. Gibson stated that both the Bradford Group and Hammacher Schlemmer are headquartered in Niles. They are an employeeowned company with employees in Niles and over 900 employees in North America. She strongly urged and encouraged the Board to use its home rule powers and vote to opt out of the Cook County earned sick leave ordinance which would penalize their company and leave their employees with less paid time off, as the companies currently offer employees a more flexible, generous paid time off policy. Ted Smukler, Open Communities Manager for Organizing Mr. Smukler stated that opting out of these ordinances is taking away wages and benefits that workers are promised by Cook County. He gave local statistics supporting the Cook County ordinances and against opting out. Neda Nozari, Open Communities Attorney and Director of Fair Housing Ms. Nozari stated that there is a direct correlation between employment and housing and, in her experience, a living wage allows people to be more reliable employees, live near where they work and also makes them a part of a community. She quoted Nelson Mandela: " Poverty is manmade and can be removed by the actions of human beings" and with that she urged the Board to take the proper action. John Louis Bracich, Niles Mr. Bracich gave a perspective from a family living on minimum wages with the cost of living going up and the hardship to make ends meet. He begged the Board to reconsider opting out and keep the disabled and elderly in mind. Katie Schneider, Niles Chamber of Commerce Executive Director Ms. Schneider, on behalf of the Chamber members, strongly urged the Board to opt out of the minimum wage increase and paid sick leave ordinances. She stated that unless the minimum wage is statewide, it is ineffective and the businesses should be able to make that decision. It is our independent, small and family-owned businesses that make Niles so unique and those are the ones we risk losing. Minimum wage is usually paid to young people and builds a sense of responsibility, skills and stronger work ethics. The biggest criticism of the paid time off ordinance is the amount of hours of clerical, record- keeping which creates an added burden. Page 2 of 19

3 Steven Yasell, Niles Mr. Yasell agrees the Village should opt out of these ordinances and believes Cook County is trying to bring more Chicagoans into Niles and surrounding suburbs to get more work. Paul Prikos, President of X-L Engineering Corp Mr. Prikos stated that X-L employs 69 employees in Niles and 39 in Elk Grove Village. They manufacture precision components for medical devices and aerospace industries. He respectfully urged the Board to opt out of the Cook County minimum wage and paid sick leave ordinances as 39 other communities have already done. X-L' s long-term relationship with their employees shows that they listen to their needs and have tailored a benefits packet to those needs. Cook County is inserting itself in an area where it has no expertise and would be adding further regulation and compliance costs to his company. Collin Corbett, on behalf of Steve Rauschenberger, President of the Technology and Manufacturing Association ( TMA) Mr. Corbett stated that TMA has 1, 000 member companies throughout the state of Illinois, employing around 30, 000 people and their members include 462 businesses in Cook County. He read from a letter from Mr. Rauschenberger stating their association and its members are strongly opposed to the Cook County ordinances regulating minimum wage and employee personal time off and encouraged the Board to opt out. There is some question as to whether, constitutionally, counties or cities have the authority to regulate the employee/ employer relationship. If these new requirements are imposed on TMA members and other businesses in Cook County, they believe the actual results will be the opposite of those intended. Mary Suburbs Margaret Lane, Chair of Reclaim Chicago - Northwest Ms. Lane stated that Reclaim Chicago is an independent progressive organization that fights for workers' rights and have found no studies that support opting out of the Cook County ordinances. The research they have done shows that higher wages are put back into the economy. Additional comments on this topic can be found later in the meeting under Public Comments. Page 3 of 19

General Government/ IT Trustee Alpogianis reported that the General Government/ IT Committee Committee met on May 10 and finalized the online store items and discussed the Cook County minimum wage and paid sick leave ordinances and opting out. 6 Building and Zoning Trustee reported McCreery that the Building and Zoning Committee Committee met on April 27 and discussed an ordinance concerning hours of construction, eliminating permit bonds for contractors, sidewalk replacement for townhomes, Airbnb regulations and they received an update on the Community Development software. PUBLIC COMMENTS Steven Bright, Rico Industries Mr. Bright, Executive Vice President ofstrategic Development and General Counsel of Rico Industries in Niles, stated that they employ approximately SO people in their warehouse distribution facility. On behalf of Rico, he urged the Board to immediately opt out of both Cook County sick leave and living wage ordinances. He stated that as a business they operate under a plethora of federal and state laws concerning regulations regarding employees and to add another requirement is very time consuming, involves unnecessary costs and expenses, including outside legal expenses. He stated that if the Village does not opt out, there will be fewer Rico employees in Niles. William McDorman Warfield, Des Plaines and Member of the Peoples Lobby in Reclaim Chicago Mr. Warfield cited statistics from a Berkeley University study regarding San Francisco minimum wage and paid sick leave laws which raised pay without costing jobs. He stated that there is no research that shows that these two ordinances will jeopardize or hurtjobs in Niles and asked the Board to consider this. Mary Tipton- Green Ms. Tipton- Green read a statement on behalf of Joseph Persky, Professor of Economics at the University of Illinois Chicago. Professor Persky urged the Board not to opt out of the Cook County minimum wage and paid sick leave ordinances. Randy Kash, Niles Resident and Dear Franks Business Owner Mr. Kash commented that Dear Franks is located in Niles on the Chicago border. He stated that as a town, Niles bills itself as business friendly, and by not opting out of the Cook County minimum wage and paid sick leave ordinances is going against its business friendly reputation. As a resident, he commented that having businesses come to Niles helps offset residents' tax base. Chuck Hartogh, Niles Resident and President of the Niles Chamber of Commerce Mr. Hartogh asked the Board to opt out ofboth the minimum wage increase and paid sick days ordinances. He feels the County is overreaching its boundaries and these laws should be presented on Page 6 of 19

7 a federal or state level to be fair to all residents ofniles. He feels economically there shouldn' t be a minimum wage, but pay should be based on worker performance and supply and demand. OLD BUSINESS Ordinance Adding Chapter Trustee Strzelecki made a motion, seconded by Trustee LoVerde, 6 Alcoholic Beverages, to take off the table an ordinance adding Chapter 6 Alcoholic Article II. License, Sec Classification and Fees and Appendix D Fee Schedule to the Niles Code of Beverages, Article II. License, Sec Classification and Fees and Appendix D Fee Schedule to the Niles Code of Ordinances. On roll call, the vote was: Ordinances in Conformance Under Chapter 10 Amusements and Entertainments, Article IV. Regulations for Licensees Operating Video Gaming Terminals, Sec ( c) Trustee Strzelecki made a motion, seconded by Trustee Matyas, to adopt the ordinance adding Chapter 6 Alcoholic Beverages, Article Il. License, Sec Classification and Fees and Appendix D Fee Schedule to the Niles Code of Ordinances. This ordinance creates a Class S liquor license which allows for the retail sale of beer and wine only, for consumption only, where the primary and principal use is beauty services. The creation of the liquor license will meet the requirement under Chapter 10 Amusements and Entertainments, Article IV. Regulations for Licensees Operating Video Gaming Terminals, Sec ( c). On roll call, the vote was: CONSENT AGENDA- NEW BUSINESS President Przybylo stated that all items on the consent agenda are considered to be routine and will be enacted in one motion. There will be no individual discussion of these items unless a Trustee so requests. The requested item will then be removed from the consent agenda and considered at the end of New Business. Conflicts with Certain Article II. Conflicts with Certain Home Rule County Ordinances, Section 1-26 Minimum Hourly Wages and Paid Sick Leave to the Home Rule County Ordinances, Section 1-26 Niles Code of Ordinances. This ordinance allows the Village of Minimum Hourly Wages Niles to opt out of the Cook County minimum hourly wages and and Paid Sick Leave to the paid sick leave as adopted by the Cook County Board of Niles Code of Ordinances Commissioners in October President Przybylo commented that this is a symbolic vote because the market will create the true minimum wage. He stated that Niles Family Services has seen many more families come in for financial services and we know there is a need in our community. Lastly, the most important thing is the fact that Niles residents voted in a past election 65% for a higher minimum wage. Trustee Alpogianis commented that he is in favor of opting out of the Cook County ordinances and finds it hard to believe that the County has exempted themselves and other government entities from adhering to these ordinances, yet they are asking our businesses to do so. As a businessman himself, he pays his employees more than is being asked by Cook County. However, as a Trustee and Chairman of General Government, he finds his Page 9of19

10 responsibility to the Village of Niles is a good balance for our businesses and our citizens. As more than 60% of our budget lies on the backs of our businesses, he supports the businesses and their concerns. Trustee LoVerde firmly believes that business owners should determine what their needs are and how they want to pay their employees. Niles has many good businessmen that are paying their people very fair. We provide services that no other communities offer and we are able to continue these services because of our strong partnership with our business community, who provide annual revenues of 60% of our $ 47 million General Fund, while property taxes make up just 7%. He believes the Cook County ordinances are well intended but he fears they will have unintended consequences. The consequences of putting our businesses at a distinct disadvantage could result in a reduction or even elimination of the critical services which could only continue if we raise property taxes. He votes yes to opt out of the Cook County minimum wage ordinances. Trustee Matyas heard the pros and cons and is torn. She stated that she is proud of the businesses that pay over minimum wage. She also knows the struggle of a one income family and that some need to work two or three jobs to raise a family. Everyone deserves to have paid sick time and shouldn' t have to go to work sick. Trustee Matyas voted no to opting out. Trustee Strzelecki is very close with the Chamber of Commerce and has asked businesses how much they are paying their employees and the big majority pays over minimum wage. When asked why, business owners stated that government doesn' t need to dictate how to run their business, they let performance and the market dictate what the salary should be. Trustee Strzelecki' s two main concerns are that he believes government shouldn' t dictate to someone how to run their business and the other issue is that Cook County opted themselves and government entities out from adhering to the minimum wage and paid sick leave ordinances. He' s voting yes to opt out. Trustee Jekot stated this is a very difficult decision for all to make and he leans toward data presented to him to make a wellinformed decision. He agreed with the speakers from Reclaim Chicago and others stating that there were no studies or statistical support for the Village to opt out and indicating that higher minimum wages are good for the economy. He' s voting no to opting out. Page 10 of 19

11 Trustee McCreery looked at this issue from the consumer and residents position based on data from the voting pools. In her research, she found that if you have an increase in income, housing increases. She has seen examples by universities who talk about a single mother who makes minimum wage and then receives an increase and now her Federal assistance is cut and is worse off in that situation. Market determines our property values and has done well to drive salary levels for employees. Very few businesses in Niles are offering minimum wage here. There is data that talks about how these increases are teenage and unskilled labor job killers. In her opinion, we are making less money because government is directly reaching into our pocket on all levels. She is voting yes to opt out of Cook County minimum wage. On roll call, the vote to opt out of the Cook County minimum hourly wages and paid sick leave as adopted by the Cook County Board of Commissioners in October 2016 was: NAYS 4 Alpogianis, LoVerde, McCreery, Strzelecki 2 Jekot, Matyas There being 4 affirmative votes, the MOTION CARRIED. Ordinance Adding Chapter President Przybylo moved approval of an ordinance adding 1 General Provisions, Chapter 1 General Provisions, Section 1-24 Minimum Hourly Section 1-24 Minimum Wages and Section 1-25 Earned Sick Leave to the Niles Code of seconded by Trustee Matyas. This ordinance allows Ordinances, Hourly Wages and Section 1-25 Earned Sick Leave to the Village to adopt the Cook County ordinance for minimum the Niles Code of hourly wages and earned sick leave with certain modifications for Ordinances individuals under the age of 18 and requiring 80 hours to be worked before an earned sick leave is accumulated. President Przybylo made a friendly amendment, seconded by Trustee Jekot, to incorporate into this Niles minimum wage ordinance that any business that has 25 employees or less would not be subject to the higher minimum wage ordinance. On roll call, the vote was: 4 Jekot, Matyas, Przybylo, Strzelecki NAYS 3 Alpogianis, LoVerde, McCreery There being 4 affirmative votes, the MOTION CARRIED. Page 11 of 19

Danielle Grcic Trustee LoVerde made a motion to approve the appointments, seconded by Trustee Alpogianis. On roll call, the vote was: Appointments President Przybylo recommended Committee, Commission, Board of Village Committees, and Police Auxiliary Appointments for for a term of Commissions, Boards and one year, unless otherwise noted( attached as Exhibit 1). Police Auxiliary Trustee Strzelecki made a motion to approve the appointments as read into the record by President Przybylo, seconded by Trustee LoVerde. On roll call, the vote was: Ordinance Amending Trustee McCreery made a motion, seconded by Trustee Matyas, to Chapter 18 Buildings and adopt the ordinance amending Chapter 18 Buildings and Building Building Regulations, Article Regulations, Article XVII. Contractors, Division 1. Generally, Sec. XVII. Contractors, Division Hours of Construction Work of the Niles Code of 1. Generally, Sec Ordinances. This change is to allow the appropriate department Hours for Construction director to make recommendations to the Village Board to allow construction to occur outside of permitted construction hours. 14 Ordinance Providing an Trustee LoVerde made a motion, seconded by Trustee Matyas, to Appropriation for the adopt the ordinance providing an appropriation for the Village of Village of Niles for the Fiscal Niles, Cook County, for the fiscal year beginning May 1, 2017 and Year Beginning May 1, 2017 ending April 30, The total appropriation for all funds is and Ending April 30, 2018 $ 99,486, 699. On roll call, the vote was: Board Approval to Grant Permission for Relief to Allow Costco to Perform Trustee McCreery made a motion, seconded by Trustee LoVerde, for approval to grant relief to Costco, located at 7311 Melvina, to perform construction work beyond the allotted hours as per Sec. Construction Work Beyond of the Niles Code of Ordinances. The purpose for the the Allotted Hours as Per Sec of the Niles Code of Ordinances request is to allow the required construction work to occur while the store remains open to the public. On roll call, the vote was: Ordinance Approving a Trustee McCreery made a motion, seconded by Trustee Special Use Permit to Allow a Smoking Establishment Located at 8710 W. Golf Road 17-ZP-07 Alpogianis, to adopt the ordinance approving a special use permit as required in Appendix B, Section 8. 2( A) to allow a smoking establishment located at 8710 W. Golf Road with the condition that sale of drug paraphernalia, including but not limited to pipes, bongs or one- hits, is prohibited. The Planning and Zoning Board voted 4-1 to recommend approval at their public hearing on May 1, On roll call, the vote was: Page 14 of 19

15 Ordinance Approving a Special Use Permit to Trustee McCreery made a motion, seconded by Trustee Matyas, to adopt the ordinance approving a special use permit as required in Allow a Wireless Appendix B, Section 8. 2( A) and 8. 3( Y) to allow a wireless Telecommunications Tower telecommunications tower and antennae located at 7655 Dempster and Antennae Located at with the following conditions: 1) the tower must be painted to 7655 W. Dempster Street match the existing light poles around the Notre Dame football 17-ZP-08 field; 2) all cables and wires must be located inside the tower; 3) the applicant must paint the antennae panels, radio, satellite dish, COVP boxes and any exposed cabling to match the pole in order to minimize visual impact; 4) if there are any interferences by applicant' s facilities to frequencies used by the Village due to the existence of other Village communications antennae on the tower, the applicant will correct such interference at its own cost and not at a cost to the Village. The Planning and Zoning Board voted 5-0 to recommend approval at their public hearing on May 1, Bob Stapleton from National Wireless Ventures, LLC addressed the Board and gave specifics regarding the project. On roll call, the vote was: Ordinance Amending Trustee Strzelecki made a motion, seconded by Trustee Chapter 2 Administration, Alpogianis, to adopt the ordinance amending Chapter 2 Article M. Officers and Administration, Article III. Officers and Employees, Division 2. Employees, Division 2 Village Manager, Sec Qualifications to the Niles Code of Village Manager, Sec Ordinances. This amendment allows the Village Board of Qualifications to the Niles Trustees, at their discretion, to require the Village Manager to Code of Ordinances reside within the corporate limits of the Village. On roll call, the vote was: Resolution Appointing Trustee Alpogianis made a motion, seconded by Trustee Matyas, Village Manager Steven C. to approve the resolution appointing the Village Manager Steven Vinezeano to the Morton C. Vinezeano to the Morton Grove-Niles Water Commission. Grove-Niles Water Pursuant to the Intergovernmental Agreement for the establishment Page 15 of 19

16 Commission and operation of the Morton Grove-Niles Water Commission, the Village Manager is hereby appointed as a Commissioner.
