1 MINUTES Council Meeting March 2, 2015 City of Palmetto PRESENT: ABSENT: ALSO PRESENT: Mayor J. Clark Boddie, Councilmembers Michael Arnold, Tara Miller, Laura Mullis, Larry Parrott, Leon Sumlin and Patty Willey None Bill Shell, City Administrator Henry Argo, Chief of Fire Allen Robinson, Police Lieutenant Dennis Davenport, City Attorney Debbie Edwards, Recorder 1) Call to Order by Mayor Boddie PUBLIC HEARING 2) Public Hearing to consider the request of Willow Oak Landfill, LLC, which owns and operates the Willow Oak Landfill at 7395 Roosevelt Highway, to annex the below listed property into the City Limits of the City of Palmetto and to rezone the same property to M-2 Heavy Industrial. The said tract containing acres bordering current Willow Oak property. TRACT Acres Property ID This property is located in land lot 134 of the 7 th district of Fulton County. The Mayor opened the floor for comment from the public. Tantalous Smith of Wilkerson Mill Rd. stated he was not standing up for or against the landfill but had concerns about smells and steps to reduce odors. He stated concerns about trash on the road near the landfill. Fred Jones of 7998 Wilkerson Mill Lane expressed concerns of water safety and if steps are followed to make sure there is no contamination of the water. Gabe Gribble of Waste Management answered concerns. He stated the EPD does regular routine inspections. This includes stormwater as well as drinking water testing. Waste Management has to provide data on dust records, submit archived data and extensive records as well as on site inspections. He stated Waste Management has always scored at least 95% out of 100% on each test. Page 1 of 6

2 He stated air quality samples are done by a 3 rd party engineering firm and they submit directly to EPD the results. 3) Public Hearing to consider the request of Aneet Kaur, LLC d/b/a Shell, a gas and convenience store located at 400 Carlton Road, Suite B, Palmetto, GA 30268, has applied to the Mayor and Council for a license to sell beer and wine. The Mayor opened the floor for comment from the public. There was no comment from the public. Mayor ask Lt Robinson if the investigation was completed. Lt Robinson said it was completed and was ok. ADJOURNMENT Council Meeting 1) Call to Order by Mayor Boddie 2) Invocation given by Charles Slaughter 3) Pledge of Allegiance to the Flag led by Lieutenant Robinson 4) Approval of Minutes: Work Session January 29 th, 2015 Council Meeting February 2 nd, 2015 Motion and action: Councilmember Mullis made a motion to approve the minutes as presented and Councilmember Willey seconded the motion. It passed with a unanimous vote. 5) Approval of Annexation of acres Willow Oak Landfill LLC 7395 Roosevelt Hwy. Motion and action: Councilmember Willey made a motion to approve the Annexation and Councilmember Parrott seconded the motion. It passed with a unanimous vote. Page 2 of 6

3 6) Approval of Rezoning of acres Willow Oak Landfill LLC 7395 Roosevelt Hwy to M-2 Heavy Industrial Motion and action: Councilmember Parrott made a motion to approve the Rezoning and Councilmember Sumlin seconded the motion. It passed with a unanimous vote. 7) Approval of License to sell beer and wine by Aneet Kaur, LLC d/b/a Shell, a gas and convenience store located at 400 Carlton Rd. Suite B. Motion and action: Councilmember Sumlin made a motion to approve the License and Councilmember Mullis seconded the motion. It passed with a unanimous vote. 8) Ordinance No: nd Reading Regulatory Fees Motion and action: Councilmember Mullis made a motion to approve the Ordinance and Councilmember Willey seconded the motion. It passed with a unanimous vote. 9) Resolution No: nd Reading Regulatory Fees Motion and action: Councilmember Parrott made a motion to approve the Resolution and Councilmember Arnold seconded the motion. It passed with a unanimous vote. 10) Open Bids for 2005 Crown Vic #85, 2006 Ford Crown Vic #86 and Ransomes Lawn Mower. Mr. Shell opened the bids from sealed envelopes and the results are as follows: 2005 Crown Vic #85 John Evans $1, Kermit Bell $ Lewis Valdez $ Chicago Motors Inc $ Keith Morgan $ Motion and action: Councilmember Arnold made a motion to approve the sale to John Evans and Councilmember Mullis seconded the motion. 4 2006 Crown Vic #86 John Evans $1, Chicago Motors Inc $1, Michael Arnold $ Kermit Bell $ Lewis Valdez $ Keith Morgan $ Motion and action: Councilmember Sumlin made a motion to approve the sale to John Evans and Councilmember Arnold seconded the motion. It passed with a unanimous vote. Ransomes Lawn Mower Allen Robinson $ Larry Tidwell $ Motion and action: Councilmember Mullis made a motion to approve the sale to Allen Robinson and Councilmember Arnold seconded the motion. It passed with a unanimous vote. 11) Mayor, Council and Department Heads Reports and Comments Councilmember Miller none Councilmember Mullis Thanks to everyone for coming out. It was good to see citizens turn out for the council meeting. Councilmember Parrott Repeated thanks to everyone for coming to the meeting. City Administrator William Shell Gave the following report from the Code Enforcement Department: Abandoned Vehicles 4 (Removed) Sign Ordinance 15(Removed) Sign Permits 4 Soil Erosion Control 12 (Inspections) Courtesy Notices 13 Certified Letters 3 Stop Work Orders 2 Citations: 0 Follow Ups 12 Page 4 of 6

5 Mayor Boddie thanked everyone for attending the meeting and told everyone that the council meeting is the first Monday of every month to be sure to come back. Dennis Davenport none Councilmember Sumlin none Councilmember Willey thanks for coming out and invited everyone to Golden Circle at the Senior Center on Thursday, March 5 th. Councilmember Arnold thanked everyone for attending and ask that everyone come back again. Lt Robinson gave the following report: 235 Calls for service Feb Reports filed vs 122 in Feb Misdemeanor Arrest vs 5 in Feb Felony Arrest vs 2 in Feb Citations vs 33 in Feb Lt reported a burglary at Shaggy Hickory Trail and the officers caught the suspects as they came out of the house. The suspects were 5 juveniles. Chief Henry Argo gave his report as follows: Fires (all types) 5 Rescue/EMS 35 Hazardous Conditions 2 Service Calls 10 Good Intent 3 False Alarm 2 Misc. 0 The average response time was 4.07 minutes. Chief Argo stated that Fire/Rescue personnel arrived on the scene of all service requests in the City in 8 minutes or less 100% of the time. Palmetto provided Mutual Aid to the City of Fairburn on 1 occasion, and to Chattahoochee Hills on 1 occasion. Palmetto received aid from Fairburn on 2 occasions, Chattahoochee Hills on 1 occasion and Union City on 1 occasion. Coweta County provided backfill on 2 occasions. Chief Argo stated the Fire Inspector has conducted 8 sessions of the Learn Not To Burn Curriculum for Pre-K and Kindergarten students at Palmetto Elementary School. This resulted in 680 contacts with the children. There were 2 significant alarms this month. One at the Walker Concrete Plant and the other was a residence at 909 Carlton Point Terr. There were 13 people living at the residence and Red Cross was contacted to help assist with temporary housing. Page 5 of 6

6 12) Public Comment Citizens are allowed to voice City-related requests, concerns, opinions, etc. during the Public Comment portion of the Council meeting. Speakers will be granted up to two minutes each, and Public Comment will not exceed 30 minutes. Mabel Reid of 219 Blossom Street ask if Code Enforcement Officer Frank West was still employed by the city and what has he been doing. She stated Thornton Rd. has problems that need to be addressed. Mayor told her Frank is at city hall all week and he responds to whatever needs to be addressed. She ask what are the duties of the city council. Mayor answered the Council make ordinances and regulations of the city, which is the laws and rules of the city. 13) Adjournment A motion was made to adjourn by Councilmember Parrott and seconded by Councilmember Sumlin.
