Alberino (Departed at 8:15 p.m. and Returned at 8:57 p.m.), M. Carr, C. Goupil, P. Fritz (Arrived at 7:05 p.m.), T. Guerra, M. Rapuano, G. Bousquet and M.E. Dahlgren Absent: Also Present: P. Sullivan Eric Knapp, Zoning Enforcement Officer Chairman Anselmo Delia called the meeting to order at 7:01 p.m. Alternate Mary Ellen Dahlgren was seated for Pamela Fritz. Secretary Michael Knudsen read the Legal Notice of Public Hearing into the record. Pamela Fritz arrived at 7:05 p.m. and Dahlgren was unseated. 1. SE : 224 East Main Street, Giovanni Lawn Care, LLC/Ciro Landscaping, LLC: Change of use to contractor s business and storage yard. Map 78, Block 70, Lot 159A. Zone B-4. Chuck Mandel, agent for the applicant, gave a brief presentation. There was no testimony from the public. Alberino inquired about the type of wood that would be brought in. Mandel stated that it would be processed off-site and brought in for storage. Carr inquired about the owner of the property. ALICE LLC is the owner of the property. Delia inquired if there was a longterm lease for the property. The applicant stated that there is a month to month lease. There was a discussion regarding the 14 fence. Rapuano moved to close the public hearing for SE : 224 East Main Street, Giovanni Lawn Care LLC/Ciro Landscaping, LLC. Alberino seconded the motion.

2 Page 2 2. SE : John Street, David A. Mack Properties, LLC: Change of use to Commercial Indoor Recreation Facility, Type A. Map 44, Block 26, Lot 19. [Former Unilever facility] Zone I-1. Secretary Knudsen read the June 1, 2014 letter from JH Torrance Downes, RiverCOG. Marjorie Shansky, agent for the applicant, gave a brief presentation and distributed a letter dated with an attachment Construction Phase Management Plan, Addendum to Special Exception Application. Ronald Nault, engineer, gave an overview of the changes made to the plans since the opening of the public hearing. David Sullivan, Milone & MacBroom, Traffic Engineer, discussed the findings of the peer review of James Bubaris and the letter from JH Torrance Downes, RiverCOG. Shansky noted that the traffic study is based on the full use of the building and noted that the peer review agreed with the study. Testimony Margaret Wright, 61 Commerce Street, in favor. Goupil inquired about the environmental remediation timeframe. David Mack stated that it would be ongoing while the construction is being done. Fritz inquired about the contaminated materials which will need to be removed. Mack noted that there are soils and asbestos and there will be ground water monitoring. Some materials will be removed from the site and some will be capped with asphalt. Carr inquired if there were any contingencies for the sale. Mack noted that there are some environmental contingencies. Carr inquired about average daily counts for the surrounding roads. Sullivan responded. Kravitz inquired if any alternatives had been looked at for the stop signs at Route 81 and Central Avenue. Sullivan responded. Alberino discussed the stop signs at the Route 81/Central Avenue intersection and North High Street. There was some discussion regarding the comments from RiverCOG.

3 Page 3 Dahlgren inquired about the future plans for the septic system. Nault discussed the plans. Goupil inquired about a right turn only from Central Avenue. Sullivan stated that it wouldn t be an improvement. Goupil discussed the speed limit and the potential for reducing it. Sullivan responded. Alberino moved to close the public hearing for SE : John Street, David A. Mack Properties, LLC. Knudsen seconded the motion. Knudsen, Alberino, Carr, Fritz, Goupil, Guerra and Rapuano Abstentions: Kravitz The motion carried: SE/CAM : Bluff Avenue/Butternut Road/9 Robin Lane, Bluff Properties, LLC: Contractor s business and storage yard. Map 85, Block 69, Lot 111/100. Zone R-10. The hearing for this application was not opened and is postponed to June 29, SE : 112 Pratt Road, Omar Francis: Change of use from two-family home to a singlefamily home with an accessory apartment. Map 34, Block 15, Lot 94A2. Zone R-10. Omar Francis, applicant, gave a brief presentation. There was no testimony from the public. Carr confirmed that an accessory apartment is a permitted use in the R-10 zone while a two-family house was not. Alberino moved to close the public hearing for SE : 112 Pratt Road, Omar Francis. Kravitz seconded the motion. 5. SE/CAM : 12 Nod Place, New England Road, Inc.: Contractor s business and storage yard; deposit and stockpiling of earth materials. Map 21, Block 9, Lot 3. Zone I-2. The hearing for this application was not opened and is postponed to June 29, 2015.

Carr moved to continue the public hearing for AR : Petition to Amend the Zoning Regulations, Founders Village Homeowners Association, Inc. on Monday, June 29, 2015 at 7:00 p.m. in the Green Room. Guerra seconded the motion. Knudsen, Carr, Fritz, Goupil, Guerra and Rapuano In Opposition: Dahlgren Abstentions: Kravitz Not Voting: Delia (Chairman) and Bousquet (Not Seated) The motion carried: The hearing recessed until 8:55 p.m. 7. SE : 36 Cream Pot Road, Bonnie Finkeldey: Legalize existing accessory apartment and farm use. Map 40, Block 39, Lot 83A. Zone R-80.

5 Page 5 Bonnie Finkeldey gave a brief presentation. There was no testimony from the public and the Commission had no questions. Kravitz moved to close the public hearing for SE : 36 Cream Pot Road, Bonnie Finkeldey. Knudsen seconded the amendment. Kravitz, Knudsen, Carr, Fritz, Goupil, Guerra, Rapuano and Dahlgren Not Voting: Delia (Chairman) and Bousquet (Not Seated) The motion carried: SE : 350 East Main Street, Paul Orsini: Outside seating for food service establishment. Map 88, Block 71, Lot 51A. Zone B-4. Paul Orsini gave a brief presentation. Jerri Case, 348 East Main Street, requested a fence is erected along the property line. [Alberino returned at 8:57 p.m. Dahlgren unseated] A stockade fence is proposed on the plans, as amended. Carr moved to close the public hearing for SE : 350 East Main Street, Paul Orsini. Kravitz seconded the motion. 9. AR : Proposed Amendment to the Zoning Regulations: Addition of Section 33: Vendors; Addition of Section : Vendors; Addition of Section : Vendors. Eric Knapp, Zoning Enforcement Officer, gave a brief presentation. Amandeep Singh, representing the Economic Development Commission, discussed the comments submitted. There was a lengthy discussion among the Commission members.

AR : Proposed Amendment to the Zoning Regulations: Accessory apartments. Eric Knapp, Zoning Enforcement Officer, gave a brief presentation. There was no testimony from the public. There was a lengthy discussion regarding the changes. Alberino moved to close the public hearing for AR : Proposed Amendment to the Zoning Regulations. Carr seconded the motion.
