The regular meeting of the Artesia City Council was called to order at 7:05 p.m., Monday, September 9, 2013 in the Artesia City Council Chamber by Mayor Sally Flowers. RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARTESIA AUTHORIZING THE ADMINISTRATION OF PROGRAM SUPPLEMENT NO. 017-N TO AGENCY-STATE AGREEMENT NO R FOR UPGRADE OF EXISTING OBSOLETE TRAFFIC SIGNAL EQUIPMENT AND SYNCHRONIZATION OF TRAFFIC SIGNALS ON MAJOR HIGHWAYS IN THE CITY VIA MASTER SIGNAL COMPUTER (ADOPTION) Councilmember Canales stated that he was very happy that this grant is being received and requested that Hui Lai, Traffic Engineer explain to the public what this grant is about. Report received and filed. 14. A REQUEST FOR APPROVAL OF AWARD OF CONSULTANT CONTRACT TO YOUTH EDUCATIONAL SPORTS, INC. 15. FISCAL YEAR 2013 NATIONAL TRANSIT DATABASE MEMORANDUM OF UNDERSTANDING (MOU) 16. RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARTESIA, CALIFORNIA, APPROVING A LATE NIGHT/EARLY MORNING PERMIT FOR RESTAURANT KNOWN AS FLYING CHICKEN AT ARTESIA BOULEVARD (ADOPTION) Councilmember Canales inquired as to the location of this business. APPROVAL OF APPLICATION FOR SUPERVISOR DON KNABE 2013 COMPETITIVE TRAILS GRANT AND RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARTESIA APPROVING THE APPLICATION FOR COMPETITIVE EXCESS FUNDS FROM THE LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE DISTRICT FOR FOURTH SUPERVISORIAL DISTRICT EXCESS FUNDING FOR NEW BIKE AND PEDESTRIAN TRAILS AND OPEN RECREATION SPACE (ADOPTION) Councilmember Canales requested explanation of this project. Melissa Gobas, Parks and Recreation Superintendent explained the project. Mayor Flowers stated that there is possibly three councilmembers who should abstain from this item because of proximity of the councilmembers properties. Kevin Ennis, City Attorney suggested continuing item until later in the meeting until the radius of each property can be verified. Item was continued after last item on agenda. Kevin Ennis, City Attorney stated that staff has identified and calculated that portions of the right a way are five hundred feet from the residences of three council members. He said they are Mayor Flowers, Mayor Pro Tem Lima and Council member Manalo. He said in these types of situations where there is a conflict an announcement needs to be made explaining the conflict and a random selection process will take place to determine who be selected to form a quorum. He announced that this is a grant application which requires an adoption of a Resolution by the City Council. He said that there is no other entity that can adopt this Resolution. He said that one of the councilmembers should be selected randomly to participate. He said that he had three pieces of paper. He said one piece of paper said participate and two said abstain. He randomly mixed the pieces of paper and had each councilmember pick a piece of paper. Mayor Flowers picked the piece of paper that said participate. Mayor Pro Tem Lima and Councilmember Manalo picked pieces of paper that said abstain. Ms. Gobas finished her presentation on this item. CASE NO VARIANCE PIONEER BOULEVARD A REQUEST TO MODIFY THE CONDITIONS OF APPROVAL CONTAINED IN A PARKING VARIANCE MODIFICATION AND DESIGN REVIEW APPROVAL (CASE NO /PLANNING COMMISSION FOR AN EXISTING COMMERCIAL GENERAL (C-G) ZONE BY AFFIRMING PLANNING COMMISSION RESOLUTION NO P. PUBLIC HEARING Kevin Ennis, City Attorney administered the oath. 20. CASE NO CODE AMENDMENT (CITY WIDE) PIONEER BLVD VENKATESH KOKA, PIONEER BOULEVARD, ARTESIA CA A REQUEST FOR A CODE AMENDMENT TO ALLOW LED ELECTRONIC MOVING BOARD SIGNS IN THE COMMERCIAL GENERAL (C-G) ZONE. THE PLANNING COMMISSION RECOMMENDED DENIAL BY RESOLUTION NO P Mayor Pro Tem Lima abstained Jose Hernandez, Assistant Planner presented the staff report for this item. SECONDED BY COUNCILMEMBER MANALO TO CLOSE THE PUBLIC HEARING. COUNCILMEMBERS: Canales, Lyon, Manalo and Flowers COUNCILMEMBERS: Lima Councilmember Canales stated that the City Council has been working on the downtown to make it look attractive and classy. He said portable LED signs will take some of the classiness away. He said he agrees with the recommendation of the Planning Commission and staff. Councilmember Manalo stated that he was not in favor of LED signs. He said there is a lot that can be down with lighting but not with LED signs. Page 5

6 Councilmember Lyon concurred. Mayor Flowers stated that she is not ready to move forward with LED signs. She said she doesn t know that Artesia is ready for this currently but should be open to looking at it in the future. She said that restrictions could be imposed. COUNCILMEMBER VICTOR MANALO S APPOINTMENT TO THE PUBLIC SAFETY COMMISSION Item continued 22. DISCUSSION REGARDING SB 556 (CORBETT) PUBLIC SECTOR CONTRACTING LIABILITY City Council opposed SB 556 with direction for Mayor to prepare letter of opposition. DEPARTMENT HEAD AND INTERIM CITY MANAGER INFORMATION BRIEFS William Rawlings, Interim City Manager stated the following: 1. Housing Rehabilitation program process has started. Currently working with residence on Horst Street. 2. Started process on Business Rehabilitation Program. Currently work with two businesses. 3. Reached tentative joint agreement with the school district for use of several facilities. 4. Parking ad hoc committee met and solved several outstanding items. 5. Parking Permit Program will come back to the City Council for their consideration. 6. Assisting business with off-site parking 7. Implementing validation and token program 8. The City is a finalist for the LA County Award for the Most Business Friendly City in the county. ADDITIONAL CITIZEN COMMENTS There were no additional citizen comments. COUNCILMEMBER REPORTING ON EXTERNAL COMMITTEE MEETINGS ATTENDED None to report COUNCILMEMBER COMMENTS Councilmember Lyon stated that he attended the grand opening at Primerica. He said he is excited about the new developments in the city. Councilmember Canales stated that he met with the ad hoc committee August 14th regarding the Diwali Festival. He said since no application has been received a correct assessment cannot be determined. He said without understanding the parameters and with only four weeks left it would make it difficult to approve the festival. He inquired if it would be possible to get help from traffic enforcement for parking problems at the schools in the mornings and after school. He said that he had mentioned to Hui Lai, Traffic Engineer about a bike lane on Gridley Road going towards Gahr High School. He said on August 21st he attended a program on safety at the Los Angeles Arboretum. Page 6

7 He said that on September 1st and 2nd schools started. He said that he attended on September 7th a Patriot Award Banquet in Whittier and a grand opening at Primerica. He said that he would like to congratulate Gahr High School on their academic index that passed a score of 801. He said that he would like to invite the principal of Gahr High School to a council meeting and congratulate them for this achievement. Councilmember Manalo thanked the ad hoc committee for the parking permit program because the residents on Corby Avenue are having trouble parking in front of their homes. He said that he agreed that there were safety issues around the schools. He suggested people walk instead of driving to school. He said that he will be working with the PTA at Burbank Elementary School and will try to encourage people walking to school. He said that he was speaking with the Interim City Manager regarding the spring Contract Cities event and one of the things they discussed was innovation in cities and if the City Council knew of other cities that were doing innovative things and to let him know. He said that he is enthusiastic about the great things going on in the city. Mayor Pro Tem Lima stated that beginning October 1st a newspaper will be located in Artesia. He said that he would like Andrew Perry to engage with the newspaper. He said that he attended the Philippino Chamber of Commerce meeting. He said that he attended the Primerica grand opening. He said that the Supervisor from the ABC School District was very happy with her interaction with the Interim City Manager. Mayor Flowers stated that she went to the Mirage which is a Pakistan clothing store on Pioneer Boulevard. She said there were designers at the store from Pakistan, UK, New Jersey and New York. She said they have glamorous clothes. She said she will send some photos to Andrew Perry so he could highlight what is happening in Artesia. She said she was happy to see the signal countdowns installed on the signals. She stated that her direction on the Diwali event was to model it after the event that occurred four years ago. She stated a meeting is scheduled to discuss the Diwali event on September 18th and that would be too late. She mentioned that Chuck Burkhardt had experience with this type of event. She said that things are happening in regards to the Diwali event. She inquired if the ad hoc committee could move up their meeting. She also stated that staff worked very hard to come up with a date because the downtown work will be starting. COUNCILMEMBER ATTENDANCE AT UPCOMING CONFERENCES This is the time for the City Council to consider and select up to three Council members to attend conferences. - CALENDAR OF CONFERENCES Councilmember Canales stated that he wouldn t be attending the League of California Cities Conference. Councilmember Manalo stated that he would be attending the fall Contract Cities seminar. COUNCILMEMBER REPORTS ON MEETINGS ATTENDED AT PUBLIC EXPENSE None to report.
