1 To: From: Subject: Attendees: Rules Committee members Sam Stonerock Fall 2013 meeting minutes Held November 5 th and 6 th in Anaheim California and hosted by Josh Mathisen (ATT) See last page for list of attendees General Session November 5th Chairman Stonerock called the meeting to order at 8:15. Josh reviewed the emergency evacuation procedures. Sam provided an overview of the agenda and discussion items (Attached) Review of refreshed Rules Committee website Jeremy Harmon provided an overview of the new website. Website will house the RC calendar and recent documents; roster, agendas, meeting minutes, subcommittee minutes, working documents etc. Website address There will be a member-only page with login required and a public page. Website will require technical support and website liaison(s) e.g. a couple of committee representatives to upload documents, ensure website is current and gatekeeper for new members. Sam provided a short presentation on regulatory activities (Attached) Fire Safety OIR is currently in Phase 3 Track 3. Tracks 1 and 2 are complete. Track 1 and 2 workshop report was submitted in May but not received by the docket office as one of the parties was not a party to the proceeding. No action by the Commission on the Track 1 and 2 workshop report at this time. Track 3 panel report was filed in Sept 2013 Go Rc 2013 Fall Meeting Minutes_ /6/13

2 Break 9:45 High Speed Rail Rulemaking is open R Rail Authority filed a petition to open a rulemaking on new HSR GO in Oct Scoping memo was issued and technical panel meetings are ongoing. GO 174 Decision issued Oct Inspection GO First annual report due 2014 SED is preparing a resolution that will follow up on SB 291 ordering the CPUC to develop and implement a safety enforcement program including procedures for citations and fines. Currently does not apply to communication companies. Utilities will have the option to appeal. 3 Sam reviewed committees rule change proposal package Package is complete with rule change proposals and rationales Package has been held due to intense activities associated with Fire Safety OIR E-Board discussed when the Committee should file the package. SED wants a standalone rulemaking and not tied to fire safety OIR. SED recommends package be submitted in Dec 2013 or Jan Derek Fong has been designated as SED representative for the meet and confer process. SED comments will be incorporated into the package and then filed. Subcommittees should review package one last time. Jerome Candelaria will file the petition for rulemaking on behalf of the RC. Member representatives/companies are encouraged to support the change proposal package. 11:45 Lunch Break Doug reviewed action item list from Sub III. Reviewed rule 12.1, definition of reconstruction, elements and support elements Reviewed Table 1 case 10 and clearances from guys Subcommittee I and II meetings started after lunch at 1:00 p.m. and continued thru 5:00 p.m. November 6 8:00 a.m. Subcommittee meetings continue 10:50 Main committee closing Sub 1 Discussed a number of rules, primarily in Section V. 95/128 references to other standards and updating Climbing space rules Definition of cable doesn t include supply focused on communication Do we need rules for primary neutral systems that are part of common neutral systems th Go Rc 2013 Fall Meeting Minutes_ /6/13

4 Sub 2 Continue search for open wire references Review and discuss inspection and notification processes Sub 3 Committee needs to consider impacts of HS Rail system and whether additional rules are needed for communication and supply lines crossing the RR R/W. Jerome Candelaria described the process for the Rules Committee to submit rules to the Commission. The filing is being made by CCTA on behalf of the Rules Committee but does not represent the member companies. Member s companies should be comfortable with this process. It would be ideal if Ray Fugere or a representative from SED would accompany the Exec. Board in a pre-meeting with Commissioner Florio. Jeremy will contact Dave when payment is due for new website.
