1 BOROUGH OF METUCHEN COUNCIL MINUTES 7:30 PM The Regular Meeting of the Borough Council was held in the Council Chambers of Borough Hall on Monday, The Meeting was called to order at 7:30 P.M. by Acting Mayor Grayzel. Adequate notice of this meeting has been given in accordance with the Open Public Meeting Act, pursuant to Public Law 1975, Chapter 231. Said notice was sent to the Home News Tribune and Star Ledger on January 5, 2017, posted in Borough Hall and on file in the Clerk s Office. All requirements of the Open Public Meeting Act have been satisfied. Acting Mayor Grayzel asked that all stand for the Invocation, followed by the Pledge of Allegiance. Present were Councilmembers Inserro, Leibfried, Koskoski, Pagel, Rasmussen, Council President Grayzel. Also present were Jay Muldoon, Administrator, Denis Murphy, Esq. and Susan Jackson, Borough Clerk. Election of Interim Mayor Acting Mayor Grayzel gave a brief explanation of events with the resignation of Mayor Cammarano and the regulations on appointing an Interim Mayor. Nomination to appoint Jonathan Busch as Interim Mayor was made by Councilwoman Koskoski, second by Councilman Leibfried, with no other nominations, Acting Mayor Grayzel closed the nominations and asked for a roll call of the Council. Roll Call: Yes: Inserro, Leibfried, Koskoski, Pagel, Rasmussen and Grayzel Nays: None R Resolution Appointing the Mayor of the Borough of Metuchen RESOLUTION RESOLUTION APPOINTING THE MAYOR OF THE BOROUGH OF METUCHEN WHEREAS, due to the resignation of the Honorable Peter F. Cammarano, a vacancy was created in the Office of Mayor of the ; and WHEREAS, pursuant to N.J.S.A. 40A:16-5(b), the vacancy in the Office of Mayor shall be filled for the unexpired term (December 31, 2019) at the next general election scheduled in November, 2018, and, until such time, the Borough Council may fill the vacancy temporarily by appointment; and

2 WHEREAS, pursuant to N.J.S.A. 40A:16:11, the Metuchen Democratic Committee has presented the names of three (3) nominees to the Borough Council for the selection of a Mayor to serve the until such time as the results of the next general election scheduled in November, 2018 are certified and a successor is sworn in for the remainder of the unexpired term; and WHEREAS, the Council of the have determined that it is in the best interest of the Borough to appoint a Mayor to temporarily fill the vacancy in the Office of the Mayor of the until such time as the results of the next general election scheduled in November, 2018 are certified and a successor is sworn in for the remainder of the unexpired term; and WHEREAS, the Council of the Borough deem it in the best interest of the Borough to appoint Jonathan Busch as the Mayor of the to temporarily fill said vacancy. NOW THEREFORE BE IT RESOLVED by the Council of the that Jonathan Busch is hereby appointed to fill the vacancy in the Office of Mayor of the Borough of Metuchen until such time as the results of the next general election scheduled in November, 2018 are certified and a successor is sworn in for the remainder of the unexpired term December 31, 2019; and BE IT FURTHER RESOLVED that a copy of this Resolution shall be filed with the Municipal Clerk of the. Oath of Interim Mayor Council President Grayzel administered the Oath of Office to Jonathan M. Busch Mayor Busch took his seat as Mayor with the Councilmembers. He thanked the Councilmembers, his family and all the dignitaries for their support and all those came tonight to support his nomination and swearing in as Mayor and delivered his speech as follows: When people ask residents about the best things in Metuchen, we are tempted to say our downtown, our neighborhoods, the arts, the programming at the BIL or the Senior Center, historic preservation, our youth sports leagues, our schools. But when we answer that way, in my opinion, we overlook the more obvious answer the pride of Metuchen is our residents. Without your extraordinary efforts, none of the Borough s unique characteristics would distinguish themselves. The collective efforts of the 13,871 Metuchen residents and the way we all interact maks this community a truly special place. It is such a great honor and privilege that I be trusted with the opportunity to continue to help move this incredible community forward with you. I look forward to laying out our plans for the upcoming year during the Council re-organization on January 1. I know that following Mayor Cammarano will be difficult in that I have massive shoes to fill and I am humbled to be given this opportunity and look forward to serving our hometown. Agenda Session Council President Grayzel made a motion to open the Agenda Session, second by Councilman Leibfried, with all in favor, motion carried, 6-0. With no further actions taken Mayor Busch asked for a motion to close the agenda session. Page 2 of 17

Regular Meeting Council President Grayzel made a motion to approve the Borough Council Meeting Minutes of December 4, 2017, second by Councilwoman Koskoski, with all in favor, motion carried, 6-0. Public Comment Mayor Busch opened Public Comment to any members of the public wishing to speak. Donald Kuenseler, 57 Prospect Street, Metuchen asked whether the Council is still considering to adopt the two hour parking time limit on Prospect. Mr. Muldoon responded by stating that the Police Chief and Mr. Muldoon went back out to the area and have made the following recommendations: Prospect Street to have two hour parking the entire length from 8 AM to 6 PM and residents would need to get a sticker that would allow them to park on the street and on High Street on the south side that there is to be no parking at all from 8:00 AM to 6:00 PM Monday through Friday except for holidays and on the north side that there is to be a two hour parking from 8:00 AM to 6:00 PM with residents allowed to have parking permits. Parking will be allowed on week nights and weekends. Seeing no one else wishing to speak, Mayor Busch closed the Public Comment. Ordinance Public Hearing and Adoption Council President Grayzel asked for the presentation of Affidavit of Publication for Ordinance The affidavit of publication was presented stating that said Ordinance has been published one time in the Home News Tribune according to Law on December 7, Council President Grayzel moved that the affidavit of publication be received and filed, second by Councilwoman Rasmussen, with all favor, motion carried, 6-0. Council President Grayzel asked Borough Clerk to read Ordinance by title. Ordinance was read by title only Ordinance An Ordinance Amending the Code of the Borough of Metuchen, Chapter 185, Vehicles and Traffic, Section 23, Multiway Stop Intersections Mayor Busch opened the Public Hearing on Ordinance Seeing no one wishing to speak, Mayor Busch closed the Public Hearing. Mr. Muldoon explained the reason for the multistep intersection on Brunswick and Lake Avenues Page 3 of 17

Roll Call: Yes: Inserro, Leibfried, Koskoski, Pagel, Rasmussen and Grayzel Nays: None Ordinance was adopted, 6-0 ORDINANCE BOROUGH OF METUCHEN COUNTY OF MIDDLESEX STATE OF NEW JERSEY AN ORDINANCE AMENDING THE CODE OF THE BOROUGH OF METUCHEN, CHAPTER 185, VEHICLES AND TRAFFIC, SECTION 23, MULTIWAY STOP INTERSECTIONS BE IT ORDAINED, by the Mayor and Council of the, County of Middlesex,, that: SECTION 1. Section is hereby supplemented, amended and revised to reflect: Lake Avenue and Brunswick Avenue: stop signs shall be installed on all approaches SECTION 2. In accordance with N.J.S.A. 39:4-197(1)j., the Borough Engineer has certified (attached hereto and made a part thereof) the following information regarding the Lake Avenue & Brunswick Avenue: (i) that all intersecting streets are under municipal jurisdiction; (ii) that the intersection is within 500 feet of a school, or a playground or a youth recreational facility as defined therein; and (iii) the intersections are on streets contiguous to a school, or playground or youth recreational facility. SECTION 3. The provisions of this Ordinance shall be severable. In the event that any portion of this Ordinance is found to be invalid for any reason by any court of competent jurisdiction, such judgment shall be limited in its effect only to that portion of the Ordinance actually adjudged invalid and shall not be deemed to effect the operation of any other portion thereof, which shall remain in full force and effect. SECTION 4. All other Ordinances or parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency. SECTION 5. This Ordinance shall take effect immediately upon final passage and publication according to law. Council President Grayzel - Provided the Fire Department report for November 2017 Page 5 of 17

6 Councilwoman Inserro - Don t miss New Year s Eve in Metuchen, which is going to be a spectacular event for all ages is centered around the grand reopening of the Plaza at the corner of New and Pearl Streets. New Street between Center and Pearl will be closed for the night and parking is free in the deck. At 7:00 PM the Metuchen Fire Department will host a special event for the children with the New Year s Eve ball drop with a surprise finale. At 8:00 PM there will be a special opening ceremony as the evening gets kicked off with live chainsaw ice sculpture, DJ dance party, cotton candy bar, vintage photo booth, MDA Glam Station and a special visit from Mystic Mike Regan and he predicts a hilarious future for There will be a spectacular fire dancing and LED light show throughout the night. The event is free and made possible by the sponsors of Looney Ricks Kiss, Metuchen Savings Bank, Nexus Parking Systems, the District of Metuchen, the Josell and Rosamalia families, Whole Foods Metuchen and Woodmont Metro. Restaurants throughout Metuchen will be open to help celebrate. For more information please visit - The Metuchen Public Library has been awarded another Middlesex County History Grant to expand its digital archives, in the amount of $6,000 for The funds will be used to expand our digital archives to include more issues of the Metuchen Recorder and Metuchen Review. Special thanks to Hsihsi Chung and Mary Beth Mulligan, who both took charge of the grant proposal. - The Library has also applied for additional grant funding for another ESL program for next year. - Metuchen Municipal Alliance held the Hidden in Plain Sight program at Edgar Middle School. It was well attended and generated a lot of discussion about drugs and teens. She thanked Municipal Alliance Coordinator Jodi Kopac, all the volunteers and the school district s SAC coordinator Judi Cheung for arranging the evening. - On January 11 th there is a Narcan training session at the Metuchen Senior Center at 7:00 PM. The event is open to the public but is limited to the first 30 people who arrive. Councilwoman Koskoski - The Human Relations Commission held its first event on December 10 th to help commemorate Human Rights Day. It was well attending with a candlelight walk event on Main Street. There were many activities for children of all ages. She acknowledged all those involved for putting on such a great event and is looking forward to many more events hosted by the Human Rights Commission. Councilman Leibfried - The Pool and Recreation Commissions are meeting this month and a full report will be given at the next Council meeting. - He gave a brief report on the eventual improvement of the traffic signals and synchronization with the Borough. He has been working with Mr. Muldoon, the Borough Engineer and Linda Koskoski as the Liaison of Traffic & Transportation Commission on identifying potential funding sources for improving traffic flow in accordance with the previous traffic study and circulation reports. Due to Metuchen s designation as a Transit Village the Borough is able to apply for grant monies on an annual basis. All aspects and opportunities are being researched to move forward with this issue. Councilman Pagel - Congratulations to Mayor Busch - The Historic Preservation Committee has been awarded a history grant awarded by the Middlesex Country Freeholders and the County Office of Arts and History in the amount of $4,200. 7 Councilwoman Rasmussen - Senior Center will be closed from December 25 th through January 1, The Seniors video movie will be on Wednesday at 12:00 noon and they will be seeing Heaven Sent 16 - The foot doctor will be there on Wednesday and the cost is $10.00 if you have Medicare. - The Environmental Commission will not be meeting on the 20 th. - The Environmental Commission will be holding its first Annual Environmental Film Festival Series starting on January showing Chasing Coral ; February 23 rd showing The True Cost ; and March 23 rd showing Hometown Habitat. Doors open at 7:00 P.M. at Cai s Café. Screenings will begin at 7:30 P.M. Wine, Coffee and snacks will be available for purchase. - The Dismal Swamp Preservation Commission has been awarded a $200,000 grant for the Commission to pay for metes and bounds, environmental studies, access trails, signage, restoration, initiatives and educational and national heritage programs. There is continued talks with Conrail for the extension of the Green Way into the Dismal Swamp is moving forward very well. Reports of Officers Jay Muldoon, Interim Borough Administrator - He attended the NJDOT pre-construction informational meeting for the paving of Route 27. The project is potentially to start as early as March and likely to go through September. - The Borough Engineer and Mr. Muldoon are meeting with the County Engineer tomorrow to discuss the ban of trucks on Main Street. It will be a height ban and not a weight ban. - He thanked the County representatives present tonight for the upcoming dedication of the Plaza on New Year s Eve. You all have been invited to the dedication. - He also talked about the pedestrian safety and traffic calming issues of Metuchen. He asked the County representatives to continue with their support in making pedestrian safety and traffic calming issues happen faster and that Metuchen looks forward to working with the County more closely in order to achieve these goals. There was a brief discussion on the sharrows on Amboy Avenue. Denis Murphy, Esq. Has no report at this time. Report of the Mayor - Mayor Busch spoke about the three parent deaths of present and past Metuchen Residents To the families of Roland Naranjo, William Delgado and David Lepak he gave his condolences. 10 RESOLUTION RESOLUTION AUTHORIZING THE REDUCTION OF THE PERFORMANCE GUARANTY FOR PEARL STREET PIAZZA BLOCK 115, LOT WOODMONT PROPERTIES WHEREAS, Woodmont Properties has requested a reduction in the performance guaranty for various site improvements for Block 115, Lot Pearl Street Piazza; and WHEREAS, the Borough Engineer has reviewed the status of the site improvements and in a letter dated December 12, 2017 has agreed and recommended a partial reduction of the original performance guaranty amount as the improvements performed have been completed in an acceptable manner; and WHEREAS, on January 28, 2016, Woodmont Properties posted a Letter of Credit in the amount of $938, as a Performance Guaranty for certain site improvements; and WHEREAS, based upon the above, the Borough Engineer recommends a 62% reduction of the original letter of credit, to be reduced by $486, for a new remaining balance Performance Guaranty of $356,646.49; and WHEREAS, Woodmont Properties, LLC shall post a revised/update or new Letter of Credit in the amount of $356, NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Metuchen that it hereby authorizes, pursuant to the recommendations of the Borough Engineer, the reduction of the Performance Guaranty for various site improvements for Block 115, Lot Pearl Street Piazza from $938, to $356,646.49, and the Borough Clerk is hereby authorized and directed to accept a revised/updated or new Letter of Credit or other acceptable performance guaranty which shall be in a form suitable to the Borough Attorney and Borough Clerk. RESOLUTION RESOLUTION AUTHORIZING THE RELEASE OF THE PERFORMANCE BOND AND GUARANTEE FOR THE 2017 OAKLAND PARK IMPROVEMENTS FOR WHIRL CONSTRUCTION UPON THE POSTING OF A MAINTENANCE BOND WHEREAS, Whirl Construction has posted, pursuant to the requirements of the Borough of Metuchen a Performance Bond Guarantee, guaranteeing the site improvements in conjunction with the improvements at the location; and WHEREAS, Whirl Construction has complete said improvements and has requested the release of said performance guarantees posted; and Page 10 of 17

11 WHEREAS, the Borough Engineer has made an inspection of the improvements and the Borough Engineer by letter dated October 2, 2017, a copy of which is attached hereto, and made part hereof, made a determination that all bonded improvements have been completed and are satisfactory and recommended the release of the performance guarantee in the amount of $349, (Surety Bond) upon the posting of a maintenance guarantee in the amount of $32, for a period of one year from the date of October 6, 2017 to insure against the defects in the bonded improvements acceptable in form by the Borough Attorney. NOW THEREFORE BE IT RESOLVED by the Council of the that it hereby authorizes the release of the aforementioned performance guarantees in the amount of $349, (Surety Bond) to Whirl Construction, 194 Main Street, Port Monmouth, New Jersey, upon satisfaction October 2, 2017, including but not limited to the posting of a one (1) year maintenance guarantee in the amount of $32, to insure against defects in the bonded site improvements in the form acceptable by the Borough Attorney; and BE IT FURTHER RESOLVED that the Borough officials and employees are hereby authorized to take all necessary actions in order to effectuate the terms and provisions of this Resolution. 13 WHEREAS, Requests for Qualifications were received and reviewed by the Borough Administrator; and, WHEREAS, the Chief Financial Officer has determined and certified in writing that the value of the acquisition will exceed $15,000; and, WHEREAS, the anticipated term of this contract is the calendar year 2017; and, WHEREAS, the original agreement stipulated that the maximum amount of the contract shall not exceed $20,000 and funds shall be available in the 2017 budget as evidenced by the Chief Financial Officer's Certification; WHEREAS, the Borough deemed it necessary to dedicate an additional $10,000 for continued services; and, WHEREAS, the Chief Financial Officer's Certification of Funds is made authorizing the additional funds for Labor Relations Attorney from the 2017 budget line , not to exceed a grand total of $30,000.00; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Metuchen as follows: 1.
