1 BOROUGH OF METUCHEN COUNCIL MINUTES 7:30 PM The Regular Meeting of the Borough Council was held in the Council Chambers of Borough Hall on Monday, The Meeting was called to order at 7:30 p.m. by Mayor Cammarano. Adequate notice of this meeting has been given in accordance with the Open Public Meeting Act, pursuant to Public Law 1975, Chapter 231. Said notice was sent to the Home News Tribune and Star Ledger on January 5, 2017, posted in Borough Hall and on file in the Clerk s Office. All requirements of the Open Public Meetings Act have been satisfied. Mayor Cammarano asked that all stand for the Invocation and Pledge of Allegiance. Present were Councilmembers Inserro, Leibfried, Koskoski, Muldoon, Rasmussen, Council President Grayzel and Mayor Cammarano. Also present were Jennifer Maier, Borough Administrator, Denis Murphy, Esq. and Susan Jackson, Borough Clerk. Agenda Session Council President Grayzel made a motion to open the Agenda Session, second by Councilwoman Rasmussen, with all in favor, motion carried, 6-0. Councilwoman Rasmussen mentioned that the councilmembers need to speak into the microphones because the public is having a tough time hearing the councils conversation. With no further actions taken Mayor Cammarano asked for a motion to close the agenda session. Council President Grayzel made a motion to close the Agenda Session, second by Councilman Leibfried, with all in favor, motion carried, 6-0. Regular Meeting Metuchen Downtown Alliance MDA Minute Report Isaac Kremer Isaac Kramer, Executive Director of MDA, presented the following items that were worked on last month: Many were on hand for the opening of ArteVino. It is a nice addition to the downtown and it is nice to walk downtown and see all the storefronts filled and a lot of activity happening; Task forces are starting to meet, especially on the Design Team. They are working on different things including design guidelines, place making and public art and sidewalk plantings; Love It Metuchen promotion is concluding. The hearts are all around town and a local business wants to reproduce them as a t-shirt; They have expanded their database to include 1126 contacts including 746 new contacts and 256 had information updated. He thanked Councilwoman Rasmussen for her efforts in bringing about 125 contacts in. The four items for this month are:

2 A volunteer training will be held on April 22 at 10:00am. They are currently preparing for that training; They are working on a Small Business Saturday Retail Promotion with work being done to prepare radio, television and print ads for the promotion; They are looking to hire a Public Arts Consultant to facilitate the process to bring public art to the downtown; They are working to set up task forces, including one to handle business prospects. One big thing being worked on: 100% of people eat. Restaurant Week is running starting March 12 through March 19 th. There are 28 restaurants participating and offering special deals. He also commented on the MDA Budget that is on the agenda tonight. It is the same one that was presented in December and MDA thanks the Council for their consideration and urge their support. Metuchen EMT Report Peter Fairclough Mayor stated that there was a meeting recently between EMT and the Borough and it was decided to introduce a monthly report from the EMT to keep the public up to date. Peter Fairclough, 3 Goodwill Place, President of the First Aid Squad and Crew Chief on Thursday night provided the call volume for January there were 17 calls in which 16 different participants responding. The participants included students home from the universities, 1 cadet, 12 EMTs and 2 Senior First Aiders and 1 other. The other is from a new program called Ride Along. It gives new potential members a chance to ride along and learn what happens during a call. Two of the people in the program, applied to become members of the First Aid Squad. In February there were 18 calls with 12 participants responding. There are four adult applications in February, which has been the most interviews in one night since he has been a member. Mayor Cammarano asked how a person who might be interested in volunteering go about signing up. Mr. Fairclough said the easiest way to it is to go to the First Aid website and/or Facebook page. Councilman Leibfried as how many EMT squads are still has volunteer members. Mr. Fairclough stated that most of the bigger municipalities are paid EMT squads but that there are still a few volunteer squads around. Councilman Muldoon asked about the fundraising campaign that goes out to all the residents. What is the timing of it annually? Mr. Fairclough stated that it goes out the first week of December and they are anticipating another fundraising campaign to go out mid-2017 as they are starting to fundraise for a new ambulance. Councilman Muldoon asked the residents to go through their paperwork and find the fundraising paperwork and encouraged the residents to mail a check to the EMT Squad. They will take money all year long. Council President Grayzel abstained from making a motion to accept the minutes as he was absent from the last meeting. Councilwoman Inserro made a motion to accept the Borough Council Minutes of February 21, 2017, second by Councilman Leibfried, with all in favor, motion carried, Public Hearing MDA 2017 Budget Page 2 of 14

3 Mayor Cammarano opened the Public Hearing on the Metuchen Downtown Alliance 2017 Budget. If there are any comments from members of the public please come forward. Daniel Lebar, 581 Middlesex Avenue, Metuchen asked for clarification on how much of the Parking Authority revenue is giving toward the budget. Councilman Muldoon responded that the total budget for MDA is $286,500 and $150,000 is coming from Metuchen Borough. The Parking Authority revenue is part of the budget and there will be a special improvement district assessment starting in the 3 rd quarter taxes. The assessment will be divided quarterly in the taxes so that the full amount isn t being paid all at once. There was further discussion on how the special assessment was going to be imposed. Seeing no one else wishing to comment, Mayor Cammarano closed the public hearing. Councilwoman Inserro made a motion to finalize the adoption of the Metuchen Downtown Alliance 2017 budget, second by Councilwoman Koskoski. Mayor Cammarano asked for a Roll Call: Roll Call: Inserro, Leibfried, Koskoski, Muldoon, Rasmussen and Grayzel voted yes. Motion carried, 6-0. Public Comment Mayor Cammarano opened Public Comment to any members of the public wishing to speak. Elliot Jarmin, 20 Rose Street, Metuchen asked if the split rail fence, beside the creek on Kentnor and Essex Ave., is ever going to be replaced. Mayor Cammarano stated that the Borough is in the process preparing plans for Kentnor Park which will include the replacement of the rail fence. Mr. Jarmin also asked about his request to turn Memorial Parkway into a one way from Rose Street to the JFK building driveway. It is a hazard for trucks and large vehicles to navigate the road and two cars cannot pass each other safely with cars parked on the street. Mayor Cammarano stated that it would be beneficial to ban truck from Memorial Parkway all together. He did speak to the police initially but he will inquire again and get back to him. Daniel Lebar, 581 Middlesex Avenue, Metuchen asked about the MDA and the interplay with the upcoming Ordinance , Abolishing the Development Commission. He believes that if the municipalities don t put attention into the marketing municipalities you end up with a ghost town. He feels that if Metuchen isn t careful they could become a ghost town and property values will go down if effort isn t put into the marketing. He feels that the appeal of the Development Commission isn t a good idea since they still have a role to fulfill in the Borough. Seeing no one else wishing to speak, Mayor Cammarano closed the Public Comment. Ordinance Public Hearing Ordinance Council President Grayzel asked for the presentation of Affidavit of Publication for Ordinance Page 3 of 14

4 The affidavit of publication was presented stating that said Ordinance has been published one time in the Home News Tribune according to Law on February 24, Council President Grayzel moved that the affidavit of publication be received and filed, second by Councilman Leibfried, with all favor, motion carried, 6-0. Council President Grayzel asked Borough Clerk to read Ordinance by title. Ordinance was read by title only Ordinance An Ordinance to Amend the Code of the Borough of Metuchen, Chapter 185, Entitled Vehicles and Traffic, Section Parking Prohibited at all Times on Certain Streets Mayor Cammarano opened the Public Hearing on Ordinance Seeing no one wishing to speak, Mayor Cammarano closed the Public Hearing. Council President Grayzel made a motion to pass Ordinance on second reading and be published according to law, second by Councilman Leibfried. Mayor Cammarano asked for a roll call vote. Roll Call: Inserro, Leibfried, Koskoski, Muldoon, Rasmussen and Grayzel voted yes. Ordinance was adopted, 6-0 ORDINANCE AN ORDINANCE TO AMEND THE CODE OF THE BOROUGH OF METUCHEN, CHAPTER 185, ENTITLED VEHICLES AND TRAFFIC, SECTION PARKING PROHIBITED AT ALL TIMES ON CERTAIN STREETS BE IT ORDAINED by the Mayor and Council of the that the Police Department Code of the be amended as follows: SECTION 1. Chapter 185 of the Code of the is hereby amended to add the following to Section Parking Prohibited at all times on Certain Streets: Street Side Location Hillside Avenue North From Main Street (C.R. 531) to Inn Place SECTION 2. accordance with law. Ordinance was read by title only Ordinance An Ordinance of the Authorizing the Sale and Conveyance of a Portion of Block 102, Lot 25 (Containing Approximately 15 Square Feet) on the Tax Map of the Borough of Metuchen to the, Department of Transportation for $ in Consideration Mayor Cammarano opened the Public Hearing on Ordinance Daniel Lebar, 581 Middlesex Avenue, Metuchen, asked for clarification on what this transaction facilitates. Is it part of Renaissance? Ms. Maier responded that this is part of the NJDOT resurfacing program of Route 27 and need to install a new handicap accessible ramp on the corner of Route 27 and Main Street and in order to do that they need to take a small portion of the property. Mr. Lebar asked how much of Route 27 will be resurfaced during the project. Ms. Maier responded that it would be going from Frederick Street in Edison all the way to Bridge Street. It goes all the way through Metuchen. Seeing no one else wishing to speak, Mayor Cammarano closed the Public Hearing. Council President Grayzel made a motion to pass Ordinance on second reading and be published according to law, second by Councilwoman Rasmussen. Mayor Cammarano asked for a roll call vote. Ordinance was adopted, 6-0 ORDINANCE AN ORDINANCE OF THE BOROUGH OF METUCHEN AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF BLOCK 102, LOT 25 (CONTAINING APPROXIMATELY Page 5 of 14

6 15 SQUARE FEET) ON THE TAX MAP OF THE BOROUGH OF METUCHEN TO THE STATE OF NEW JERSEY, DEPARTMENT OF TRANSPORTATION FOR $ IN CONSIDERATION. WHEREAS, by letter dated December 16, 2016, the New Jersey Department of Transportation ( NJDOT ) advised the that a portion of Block 102, Lot 25, owned by the Borough of Metuchen, is located within the proposed site of planned construction and is being acquired by NJDOT in accordance with the Eminent Doman Act; and WHEREAS, the NJDOT provided the Borough with, inter alia, a Fair Market Value Offer Letter, a Fair Market Value Appraisal Report, proposed Agreement of Sale and an Individual Property Parcel Map; and WHEREAS, said parcel contains approximately fifteen (15) square feet and NJDOT s Fair Market Value Offer Letter set forth $ as the Total Fair Market Value for the parcel; and WHEREAS, the has proposed a form of Agreement of Sale to purchase the Property from the with certain terms and conditions; and WHEREAS, the Borough Council of the has determined that it is in the best interests of the Borough to sell and convey said portion of Block 102, Lot 25 at the purchase price of $ to the. NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Metuchen, Middlesex County, New Jersey, they being the governing body thereof, as follows: Section 1: The Borough Council hereby authorizes and approves the sale and conveyance of a portion of Block 102, Lot 25, as specifically described in Schedule A hereto (Approximately fifteen (15) square feet) to the in exchange for the payment of $ subject to the terms and conditions set forth in Agreement of Sale between the and the. Section 2: The Borough Council hereby authorizes and approves a temporary construction easement to the Department of Transportation, as specifically described in Schedule A hereto. Section 3: The appropriate Borough officials are hereby authorized to take all necessary and proper steps to effectuate and finalize the sale and conveyance of the Property. Ordinance was read by title only Ordinance Ordinance Abolishing the Development Commission and Rescinding Article 6 of Chapter 10, Specifically 10-25, and 10-27, of the Code of the Mayor Cammarano opened the Public Hearing on Ordinance Daniel Lebar, 581 Middlesex Avenue, Metuchen, has two concerns. One is the gradual professionalization of what were formally all volunteer activities in the Borough. He feels there is still a need for the Development Commission because there are other areas of the Borough that is not under the MDA District. The Councilman Muldoon responded to Mr. Lebar s concerns. Councilwoman Inserro commented and explained that the Development Commission has worked diligently for many years to help improve Metuchen and this ordinance is a testament to their success. As stated last year one of the reasons for the Borough to move forward with the formation of the MDA, was that there wasn t any framework, funding or structure for the volunteer commission to make things happen. In the beginning of the meeting, the MDA Director stated there are Task Forces that carry out the work of the MDA. Her hope is that any of the Development members would come out and consider joining the Task Forces, to keep volunteering and working for the Borough. Councilwoman Rasmussen added that most of members of the Development Commission have already joined the Task Forces with the MDA. Mr. Lebar asked if South Main Street will be considered in the future as part of the Main Street Corridor. Mayor Cammarano said at this time it is not known what will happen. The boundaries are governed by the Ordinance which is set by the Borough Council. The MDA is charged to work with the area within the boundaries and will continue to work to make the area a success. A discussion ensued. Seeing no one else wishing to speak, Mayor Cammarano closed the Public Hearing. Council President Grayzel made a motion to pass Ordinance on second reading and be published according to law, second by Councilwoman Koskoski. Mayor Cammarano asked for a roll call vote. Roll Call: Inserro, Leibfried, Koskoski, Muldoon and Grayzel voted yes. Councilwoman Rasmussen voted no. Page 7 of 14

ORDINANCE ORDINANCE ABOLISHING THE DEVELOPMENT COMMISSION AND RESCINDING ARTICLE 6 OF CHAPTER 10, SPECIFICALLY 10-25, AND 10-27, OF THE CODE OF THE BOROUGH OF METUCHEN WHEREAS, the Mayor and the Borough Council of the deem it in the best interest of the Borough to abolish the Development Commission; and WHEREAS, the Mayor and the Borough Council of the express their gratitude to all of the current and former members of the Development Commission for all of their time and efforts. NOW, THEREFORE BE IT ORDAINED by the Council of the that the Metuchen Development Commission is hereby abolished; and BE IT FURTHER ORDAINED that Article 6 of Chapter 10, specifically 10-25, and 10-27, of the Code of the, is hereby rescinded, repealed and deleted; and BE IT FURTHER ORDAINED that the within Ordinance shall take effect immediately after passage and publication as required by law. Mayor Cammarano asked that R , No Truck Zone, be pulled from tonight s New Business Consent Agenda. There is some tweaking that needs to be done and would like to entertain a motion to hold the resolution until a later meeting. Council President Grayzel made a motion to remove R from the agenda, second by Councilman Muldoon, with all in favor, the motion passed, 6-0. 9 Councilman Muldoon Has no report at this time. Councilwoman Inserro - The Metuchen Municipal Alliance had their annual Fundraising Magic Show last Friday. She would thank everyone that came out for it and all the volunteers that help to make the show a success. - The Strengthening Families Program starts this Wednesday at the High School for adolescences, ages 10 to The Metuchen Library Director is holding a Meet & Greet this Saturday at 2:00pm followed by a concert for young children, ages 2-5. Councilman Leibfried - He gave a report regarding an issue that has been brought to him from the members of the community who have expressed concerns over the amount and size of new construction homes that are currently being built in Metuchen. There is concern that the homes do not fit the historical character of some of the neighborhoods as well as the Borough s personality is being compromised by the new developments. He explained that other municipalities have passed ordinances relating to the floor area ration of new construction. He has talked with the Borough Attorney and Planner to examine any and all possibilities about ordinances that relate to this issue as well as design standard input, limiting the size of new construction on specific lots and gaining additional input from the community. The Borough will continue to explore the policies, strategies and tools and continue to make Metuchen a desirable place to live. (The entire report is available on Video-on-Demand) Councilwoman Koskoski - Traffic & Transportation Commission will be meeting on Wednesday. - Arts Council is very busy. The Singer-Songwriter Series is back under the tutelage of Sharon Goldman. They opened this past Saturday and the next Series is on April 29 th at the Old Franklin School House. - The NJ Symphony Orchestra Chamber Players will be presenting an evening of classic Italian music at First Presbyterian Church in Metuchen, NJ on Saturday, March 18, 2017 at 8 pm. - Mud Making Magic is in full swing. You can join in the fun of creating a tile every weekend in March at the Senior Center. Visit the Art Council website to find out more information and registration. - Snowflake Series Children Concert is scheduled for March 12, 2017 at Old Franklin School House at 4:00 PM. The cost is $5.00 per person. - On May 9, 2017, The Arts Council is sponsoring a bus trip to see the Chihuly Show at the New York Botanical Gardens. For more information contact Nancy Goldberg at Currently the Senior Art Class Show is being shown. It concludes at the end of March. - The Library Gallery just opened for a local artist, Joan Arbieter, yesterday. Councilman Muldoon - This Thursday, the Borough s nomination to create a and place Middlesex Avenue-Woodwild Park Historic District on the New Jersey & National Register of historic places will be heard by the New Jersey State Review Board on Thursday at 10:00 AM at the NJDEP Building. New Business Consent Agenda Resolutions R through R and R through R Council President Grayzel moved New Business Consent Agenda Resolutions R through R and R through R , second by Councilman Leibfried, with all in favor, motion carried, 6-0 RESOLUTION RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT FOR 2017 SENIOR BUS ROHRER SCHOOL & COMMERCIAL BUS SALES WHEREAS, bids were received by the Borough Administrator on February 15, 2017 for the 2017 Senior Bus for the ; and WHEREAS, the funds will be available in Capital Fund Ordinance and the Trust Reserve for Donations; and WHEREAS, the Finance Officer has determined that sufficient funds will be available in the amount of $59, as evidenced by the Finance Officer's certification, NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the,, that the contract for 2017 Senior Bus be and the same is hereby awarded to Rohrer School & Commercial Bus Sales, 20 Irven Street, Ewing Township, NJ BE IT FURTHER RESOLVED, that the Mayor and the Borough Clerk are hereby authorized and directed to execute the contract for the same. RESOLUTION RESOLUTION TO AMEND THE 2017 TEMPORARY BUDGET WHEREAS, N.J.S.A. 40A:4-19 of the Local Budget Act provides that temporary appropriations shall be made for the purposes and amounts required in the manner and time therein provided; NOW, THEREFORE BE IT RESOLVED that the following additional temporary emergency Page 10 of 14

12 RESOLUTION AUTHORIZING THE RELEASE OF THE MAINTENANCE BOND FOR THE RETAINING WALL IMPROVEMENTS FOR AMERICAN PROPERTIES REALTY (WHITFIELD, AYERS COURT) BLOCKS 29, LOTS & WHEREAS, American Properties Realty, Inc. Appointments Mayor Cammarano made the recommendation that Sharon Goldman to be appointment to Metuchen Arts Council for the term to expire on 12/31/2019 Council President Grayzel made a motion to move the Mayor s recommendation of Sharon Goldman to the Metuchen Arts Council, second by Councilwoman Koskoski, with all in favor, motion carries, 6-0 Public Session New Matters Mayor Cammarano opened Public Session to anyone wishing to speak on new business matters only. Daniel Lebar, 581 Middlesex Avenue, Metuchen is wondering if there has been any thought made into alternative fuels for the senior bus. Ms. Maier responded to his question that the Borough has taken alternative fuels into consideration but the Borough has limitations when ordering maintain vehicles with alternative fuels and currently this vehicle is not available in any of the alternative fuels. Mr. Lebar also spoke on any future paving. He has observed portions of no-man land strips of pavement where local streets meet the higher sovereignty roadway. On Middlesex Avenue this problem exists on Pearl Street and Center Street where the roadway is in severe need of repaving. Councilman Muldoon asked if the DPW could go out and patch those two areas temporarily until the roadway is repaved. Seeing no one else wishing to speak, Mayor Cammarano closed the Public Session. Adjournment Council President Grayzel made a motion to adjourn the meeting, second by Councilman Leibfried, with all in favor; the meeting was adjourned at 8:28pm, 6-0.
