9 ORDINANCE Borough of Metuchen County of Middlesex State of New Jersey AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE ESTABLISHING SALARY RANGES [STATEMENT OF PURPOSE: TO AMEND THE MINIMUM AND MAXIMUM WAGE RANGES FOR CERTAIN BOROUGH EMPLOYEES] BE IT ORDAINED, by the Mayor and Council of the Borough of Metuchen that Ordinance No as amended and supplemented be further amended as follows: 5. Additional compensation by way of holiday pay, longevity, overtime, sick days, personal days, insurance benefits for full time employees not covered in collective bargaining agreements are fully set forth in the Personnel Resolution and amendments thereto previously adopted by the Borough Council and are hereby incorporated in this Ordinance. 7. No officer or employee shall be paid at a base rate which is above the maximum rate for any salary range in any of the aforementioned groups. Unless otherwise provided for all new employees or newly promoted employees shall be paid at the minimum rate of the salary range for the position to which they are hired. However, the Borough Administrator may hire a prospective employee who possesses qualifications that are greater than the minimum qualifications for the position at a

10 Ordinance 2017-XX April 3, 2017 rate above the minimum rate, but in no case shall a new employee be hired at a rate which is greater than that of a current employee in the same group. 8. If any portion of this ordinance is in conflict with any portion of a collective bargaining agreement, then the collective bargaining agreement shall take precedence. 9. All ordinances and parts of ordinances inconsistent with the provisions of this Ordinance are hereby repealed. 10. 12 ORDINANCE Borough of Metuchen County of Middlesex State of New Jersey ORDINANCE AMENDING CHAPTER 193 OF THE BOROUGH OF METUCHEN, ENTITLED, WRECKERS AND TOWERS WHEREAS, Chapter 193 of the Code of the Borough of Metuchen entitled Wreckers and Towers provides standards, regulations and rates for all police-requested towing and roadside repair services on roadways with the Borough of Metuchen; and WHEREAS, upon the recommendation of the Chief of Police of the Borough of Metuchen, the Council deems it in the best interest of the health, safety and welfare of the Borough and its residents to amend Chapter 193 of the Code of the Borough of Metuchen, entitled, Wreckers and Towers, specifically 193-7(R) and 193-8(C). NOW THEREFORE BE IT ORDAINED by the Mayor and Council of the Borough of Metuchen that it hereby amends Chapter 193 of the Code of the Borough of Metuchen, entitled, Wreckers and Towers, specifically 193-7(R) to state as follows: and Licensees shall arrive at the scene within twenty (20) minutes from a police request for service. BE IT FURTHER ORDAINED by the Mayor and Council of the Borough of Metuchen that it hereby amends 193-8(C) to state as follows Response times. Licensee shall arrive at the scene within twenty (20) minutes of the request made by the Police Department. If a licensee/tower does not respond within the allowed response time, the Police Department may call the next licensee/tower on the approved list and the first licensee/tower shall forfeit all rights to any fees or charges for their failure to meet the response time requirements of this Chapter. In addition, a licensee who fails to meet the response time requirement may also be subject to disciplinary action pursuant to Section 193-9, including not limited to a suspension for up to three (3) days or for repeat offenders license revocation and removal from the list set forth in Section BE IT FURTHER ORDAINED that the remaining sections and subparts of Chapter 193 not specifically referenced above shall remain in full force and effect; and BE IT FURTHER ORDAINED that all ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed or amended to the extent of such inconsistency; and BE IT FURTHER ORDAINED by the Council of the Borough of Metuchen that this ordinance shall take effect after passage and publication as required by law.

14 RESOLUTION Borough of Metuchen County of Middlesex State of New Jersey RESOLUTION SUPPORTING SUBMISSION OF APPLICATION FOR SUSTAINABLE JERSEY GRANT FOR PREPARATION OF A NATURAL RESOURCE INVENTORY WHEREAS, a sustainable community seeks to optimize quality of life for its residents by ensuring that its environmental, economic and social objectives are balanced and mutually supportive; and WHEREAS, Metuchen strives to save tax dollars, assure clean land, air and water, improve working and living environments; and WHEREAS, the project will help to continue and improve the promotion to sustain Metuchen Borough s Natural Resource Inventory; and WHEREAS, Metuchen is participating in the Sustainable Jersey Program; and WHEREAS, one of the purposes of the Sustainable Jersey Program is to provide resources to municipalities to make progress on sustainability issues, and they have created a grant program called the Sustainable Jersey Small Grants Program; THEREFORE, the Governing Body of Metuchen has determined that Metuchen should apply for the aforementioned Grant. THEREFORE, BE IT RESOLVED, that the Governing Body of Metuchen, County of Middlesex, State of New Jersey, authorize the submission of the aforementioned Sustainable Jersey Grant. 15 RESOLUTION Borough of Metuchen County of Middlesex State of New Jersey RESOLUTION AUTHORIZING RELEASE OF PERFORMANCE GUARANTEE FY 2014 NJDOT IMPROVEMENTS FOR MUNICIPAL AID PRO-2014 BRIDGE STREET RECONSTRUCTION SAFE STREETS TO TRANSIT JOSEPH DEFINO TRUCKING COMPANY WHEREAS, the Borough Engineer in a letter dated March 29, 2017 has reported that the contract has been completed in an acceptable manner; and WHEREAS, Maser Consulting, P.A. recommended the full release of the Performance Guarantee in the amount of a surety bond of $782, which had been posted on November 11, 2015; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Metuchen that the is hereby authorized and directed to release said Performance Bonds of a surety bond in the amount $782, as recommended and directed by the Borough Engineer to Joseph DeFino Trucking Company, 28 Industrial Drive, Cliffwood Beach, NJ BE IT FURTHER RESOLVED that Joseph DeFino has posted a maintenance bond in the amount of $73, on March 13, 2017 as recommended and directed by the Borough Engineer s letter dated March 29, 2017 for the term of one year. 16 RESOLUTION Borough of Metuchen County of Middlesex State of New Jersey RESOLUTION AUTHORIZING THE ENTRY INTO, AND THE EXECUTION OF, THE AMENDMENT TO THE SHARED SERVICE AGREEMENT BETWEEN THE BOROUGH OF METUCHEN AND THE PARKING AUTHORITY OF THE BOROUGH OF METUCHEN WHEREAS, the Borough of Metuchen, in the County of Middlesex, New Jersey (the "Borough") pursuant to the Parking Authority Law of the State of New Jersey, N.J.S.A. 40:11A-1 et seq. (the "Act") heretofore created a public body corporate and politic known as the "Parking Authority of the Borough of Metuchen " (the "Authority"); and WHEREAS, the purposes of the Authority are, among other things, the construction, provision or operation of off-street parking projects within the Borough, and the management and operation of on-street and other parking meters and related facilities; and WHEREAS, the Borough of Metuchen has enacted Ordinances and the Parking Authority has enacted regulations establishing parking regulations and enforcement within the Borough and upon Parking Authority property; and WHEREAS, representatives of the Borough and the Parking Authority have met and discussed the creation of the position of Parking Enforcement Officer to enforce the parking regulations of the Borough and to assist the Parking Authority in their enforcement operations on Parking Authority lots and property; and WHEREAS, the Borough of Metuchen is in the process of creating the position of Parking Enforcement Officer by way of Ordinance and anticipates employing two (2) part-time Parking Enforcement Officers; and WHEREAS, the Parking Authority deems it in the best interest of the Borough and the Authority to assist in the funding of the employment of the Parking Enforcement Officers of the Borough of Metuchen; and WHEREAS, the Borough and Parking Authority desire to amend its Shared Services Agreement for the sole purpose to include the employment and funding of the Parking Enforcement Officers of the Borough of Metuchen. The Parties have agreed as follows:

17 NOW THEREFORE BE IT RESOLVED that the Borough Council of the Borough of Metuchen hereby authorizes the Amendment to, and the execution of the Amendment to the Shared Services Agreement between the Borough of Metuchen and the Parking Authority of the Borough of Metuchen in the form consistent to the Amendment attached hereto subject to the final approval as to form and contents by the Mayor, Borough Administrator, Council President and legal counsel; and BE IT FURTHER RESOLVED that the Mayor and Borough officials and employees are hereby authorized to take all necessary actions in order to effectuate the terms and provisions of this Resolution, including but not limited to the final approval and execution of the Amendment to Shared Service Agreement in the form acceptable in contents by the Mayor, Borough Administrator, Council President and legal counsel; and. BE IT FURTHER RESOLVED that Borough officials and employees are hereby authorized to take all necessary actions in order to effectuate the terms and provisions of the authorized executed Amendment to the Shared Service Agreement between the Borough and Parking Authority. 19 RESOLUTION Borough of Metuchen County of Middlesex State of New Jersey RESOLUTION APPROVING HEALTH INSURANCE THIRD PARTY ADMINISTRATOR AND NETWORK WHEREAS, the Borough Council of Metuchen adopted a self-insurance program for the Borough's Group Medical, Reinsurance, and Prescription Coverage which shall renew effective on May 1, 2017; and WHEREAS, this self-insurance program shall require a renewal of Qualcare as the Third Party Administrator and the renewal of Qualcare as the Insurance Network for in-state members and Fairview Insurance Agency Associates, Inc. as Stop Loss Administrators and Symetra as Reinsurer and ProAct as Prescription Plan; and NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Council of the Borough of Metuchen do hereby authorize the appointment of the above stated for all currently existing medical, reinsurance and prescription programs offered for Borough employees and retirees. 20 RESOLUTION Borough of Metuchen County of Metuchen State of New Jersey RESOLUTION APPOINTING AND AUTHORIZING THE CONTINUATION OF AN AGREEMENT FOR SPECIALIZED CONSULTANT SERVICES FOR ADMINISTRATIVE AGENT SERVICES FOR THE AFFORDABILITY ASSISTANCE PROGRAM WHEREAS, there exists the need for specialized consultant services for Administrative Agent Services for the Affordability Assistance Program for 2017; and WHEREAS, Piazza and Associates sent their original proposal, dated August 11, 2016, for Administrative Agent services for the Affordability Assistance Programs for the year 2016; and WHEREAS, the original contract for consultant services, in an amount not to exceed $6,000 was awarded to Piazza and Associates by the Borough Council with funds available from the COAH Trust Fund for the balance of 2016 which could only be renewed upon further action of the Borough Council; and WHEREAS, no funds were disbursed in 2016 for Administrative Agent services for the Affordability Assistance Program, WHEREAS, there exists the need for specialized consultant services for Administrative Agent Services for the Affordability Assistance Program in 2017; and WHEREAS, the cost for the proposed services shall not exceed $2, without further approval by the Borough Council; and WHEREAS, funds for this purpose are available in the COAH Trust Fund and the Finance Officer has determined that sufficient funds will be available in the amount of $2, as evidenced by the Finance Officer's certification; and WHEREAS, this contract is awarded as a non-fair and open contract pursuant to and in accordance with the Local Unit Pay-to-Play Law. 21 RESOLUTION Borough of Metuchen County of Middlesex State of New Jersey CALENDAR YEAR 2017 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: ) WHEREAS, the Local Government Cap Law, N.J.S. 40A: et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget up to.5% unless authorized by ordinance to increase it to 3.5% over the previous year s final appropriations, subject to certain exceptions; and, WHEREAS, N.J.S.A. 40A: a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the Mayor and Council of the Borough of Metuchen in the County of Middlesex finds it advisable and necessary to increase its CY 2017 budget by up to 3.5% over the previous year s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the Mayor and Council hereby determines that a 3.0% increase in the budget for said year, amounting to $382, in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS the Mayor and Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years. NOW THEREFORE BE IT ORDAINED, by the Mayor & Council of the Borough of Metuchen, in the County of Middlesex, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2017 budget year, the final appropriations of the Borough of Metuchen shall, in accordance with this ordinance and N.J.S.A. 40A: , be increased by 3.0%, amounting to $ 382,471.47, and that the CY 2017 municipal budget for the Borough of Metuchen be approved and adopted in accordance with this ordinance; and, BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,

22 R BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption. 24 ORDINANCE Borough of Metuchen County of Middlesex State of New Jersey ORDINANCE CREATING THE POSITION OF PARKING ENFORCEMENT OFFICER WHEREAS, the Borough of Metuchen, in the County of Middlesex, New Jersey (the "Borough") pursuant to the Parking Authority Law of the State of New Jersey, N.J.S.A. 40:11A-1 et seq. (the "Act") heretofore created a public body corporate and politic known as the "Parking Authority of the Borough of Metuchen " (the "Authority"); and WHEREAS, the purposes of the Authority are, among other things, the construction, provision or operation of off-street parking projects within the Borough, and the management and operation of on-street and other parking meters and related facilities; and WHEREAS, the Borough of Metuchen has ordinances establishing parking regulations within the Borough; and WHEREAS, representatives of the Borough and the Parking Authority have met and discussed the creation of the position of Parking Enforcement Officer to enforce the parking regulations of the Borough and to assist the Parking Authority in their enforcement operations; and WHEREAS, the Borough desires to amend its ordinances to allow for the hiring of Parking Enforcement Officer/s that is/are empowered to enforce state, county, and local parking regulations within the Borough. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Metuchen, the County of Middlesex, that the Code of the Borough of Metuchen ( Code ) is hereby amended as follows: (1) to establish the position of Parking Enforcement Officer; (2) to empower such Parking Enforcement Officer/s to enforce the parking regulations of the Borough; A Section of the Code of the Borough of Metuchen entitled Parking Enforcement Officer is hereby created as follows: Section 1. Purpose The purpose of this ordinance is to create to create the position of Parking Enforcement Officer to enforce state, county, and municipal statutes, resolutions, ordinances or regulations relating to the parking of vehicles with the Borough of Metuchen pursuant to N.J.S.A. 40A: et seq. and on Parking Authority property pursuant to N.J.S.A. 40:11A Section 2. Authority. There is hereby created in the Borough of Metuchen the position of Parking Enforcement Officer. The position of Parking Enforcement Office shall be part-time and shall be limited to twenty-nine (29) per hours per week per Parking Enforcement Officer. There is hereby created up to two (2) positions of Parking Law Enforcement Officers.

25 Section 3. Definitions For purposes of this ordinance, a Parking Enforcement Officer is not a special law enforcement officer within the meaning of the Special Law Enforcement Officers Act N.J.S.A. 40A: et seq. and is not a member of the Borough of Metuchen Police Department. No parking enforcement officer may carry or use a firearm while on duty. A Parking Enforcement Officer is deemed to be on duty while the officer is performing the public safety functions enumerated in this ordinance and for which the officer is receiving compensation from the Borough. A Parking Enforcement Officer is not eligible for membership in the Police and Firemen s Retirement System established pursuant to N.J.S.A. 43:16A-1 et seq. Section 3. Qualifications A. The Parking Enforcement Officer shall: 1. Be a resident of New Jersey during the term of his or her appointment. 2. Be able to read, write and speak the English language well and intelligently. 3. Be of sound mind and in good health. 4. Be of good moral character. 5. Not have been convicted of any offense involving dishonesty or which would make the person unfit to perform the duties of his or her office. 6. Possess a good familiarity with the parking of vehicles ordinances and codes of the Borough of Metuchen. B. An applicant for the position of Parking Enforcement Officer appointed pursuant to this Ordinance shall have fingerprints taken, which fingerprints shall be filed with the Division of State Police and the Federal Bureau of Investigation. C. The Chief of Police and a representative of the Parking Authority shall interview candidates for the position of Parking Enforcement Officer and make recommendations to the Mayor regarding the appointment of Parking Enforcement Officer. Before any Parking Enforcement Officer is appointed pursuant to this Ordinance, the Chief of Police shall ascertain the eligibility and qualifications of the applicant and report these determinations in writing to the Mayor and Council. D. No person appointed as Parking Enforcement Officer may commence duties as a Parking Enforcement Officer unless that person has successfully completed a training course conducted or approved by the Chief of Police. The Mayor and Council may waive this training requirement for any person otherwise eligible to be appointed as a Parking Enforcement Officer under this ordinance if the person possesses substantially equivalent training and background, as determined by the Chief of Police or other chief law enforcement officer.

26 Section 4. Appointment; Removal; Term of Office; Compensation A. Parking Enforcement Officers shall be appointed by the Mayor upon the consent of the Council of the Borough of Metuchen. A Parking Enforcement Officer may be removed at will by the Mayor or by vote of the majority of Council, so voting. B. Parking Enforcement Officers shall be appointed for a term of one year, such term expiring on December 31 of the year of his or her appointment. If he or she shall be appointed after January 1 of any year, the appointment shall be deemed, for the purpose of calculating the term, to have commenced the January 1 immediately prior to his or her appointment. He or she shall serve at the pleasure of the Mayor and/or Borough Council and payment for such compensation shall set forth in the Salary Ordinance of the Borough. Section 5. Powers and Duties A. The Parking Enforcement Officer shall enforce State, County, Borough and Parking Authority, statutes, ordinances and/or regulations related to the parking of vehicles within the Borough of Metuchen. He or she shall possess the power and authority to: (1) Issue a parking ticket for a parking offense, as those two terms are defined in the "Parking Offenses Adjudication Act," P.L. 1985, c. 14 (N.J.S.A. 39: et seq.). (2) Serve and execute all process for any parking offenses issuing out of the court having jurisdiction over the complaint. (3) Issue warnings for violations of any State, County, Borough of Parking Authority statutes, ordinances, resolutions and/or regulations related to the parking of vehicles within the Borough of Metuchen. (4) Cause any vehicle parked, stored, or abandoned in the Borough in violation of a statute, resolution, ordinance or regulation to be towed away from the scene of the violation and to collect from the vehicle s owner or the owner's agent, on behalf of the Borough, the costs of the towing and subsequent storage of the vehicle before surrendering the vehicle to the owner or agent. (5) Issue a complaint, summons, or parking ticket for the failure to abide by any parking regulation or parking restriction promulgated by the Parking Authority of the Borough of Metuchen. (6) Attend participate, testify and assist in the prosecution,, if necessary, in any court proceedings relating to any actions taken by him or her. (7) Inspect the conditions of parking meters or other parking regulating devices, and if necessary, report to the appropriate individual responsible for the necessary repairs or replacement. B. The Parking Enforcement Officers shall be under the supervision and direction of the Chief of Police. Section 7. Training The Parking Enforcement Officer shall receive such training in the performance of his or her duties as may, from time to time, be required by law or recommended and authorized by the Chief of Police. Section 6. Uniform and Insignia

27 Prior to the commencement of duties, every Parking Enforcement Officer shall be furnished with a uniform which shall clearly identify the officer s function. The uniform shall include, but not be limited to, a hat and appropriate badges which shall bear an identification number or name tag and the name of the Borough of Metuchen in which the officer is employed. The uniform shall also include an insignia issued by the Borough which clearly indicates the officer s status as a Parking Enforcement Officer. The uniform shall be distinct in color from the uniform of a regular police officer or special law enforcement officer. The Borough shall issue a permanent insignia not later than 90 days following its first appointment of a Parking Enforcement Officer for persons designated as Parking Enforcement Officers under this ordinance The Borough may issue a temporary insignia for use prior to the issuance of permanent insignia. Section 7. Files and Reports The Parking Enforcement Officer shall maintain an accurate and complete file with respect to every alleged violation or other matter investigated by him or her. The Parking Enforcement Officer shall file a monthly report of his or her activities, including any warning, complaints or cases processed by him or her and the disposition thereof, with the Chief of Police. Section 8. Official Documents All files, books and records maintained by, and property provided to, the Parking Enforcement Officers are the property of the Borough of Metuchen. Every Parking Enforcement Officer, on the expiration of his or her term, shall forthwith deliver to his or her successor all files, books, records and property provided, which are in his or her possession or under his or her control or maintained by him or her to the Chief of Police. Section 9. Existing Ordinances The creation of the position of Parking Enforcement Officer, and the within Ordinance, shall not be interpreted or inferred to alter, change, effect, limit, restrict, or relieve any the authority and/or duties of a police officer of the Borough of Metuchen. Section 10. Effective Date This Ordinance shall take effect upon final passage and publication according to law.
