A big thank-you to the cub scouts (and their Moms) for coming to our Town meeting to perform this service. You all did a wonderful job! Motion made by Councilman Harold Gilchrest, seconded by Councilman Marcus Blanck, to approve the Organizational Meeting Minutes from January 03, 2018; passed by unanimous vote of 5-0 from the following board members: Councilman Harold Gilchrest; Councilman Marcus Blanck; Councilman Bruce Ferguson; Councilman Howard Law; Supervisor Evera Sue Clary. (Due to tax collection and computer problems, the minutes from the January 10, 2018 regular monthly meeting will be approved at the February mtg.) After review of Warrants and Highway Abstract, motion made by Councilman Marcus Blanck, seconded by Councilman Howard Law, to pay Warrants #2 and Highway Abstract #2 of 2018 as presented; passed unanimously 5-0 from the following Board Members: Councilman Marcus Blanck-Yes; Councilman Howard Law-Yes; Councilman Bruce Ferguson-Yes; Councilman Harold Gilchrest-Yes; Supervisor- Evera Sue Clary-Yes. Salem Fire Department- Chief Graham reported 8 calls for January, 2018: Salem 7 (2-carbon monoxide); 1- EMS lift assist; 2-MVA s); 1-good intent; 1-structure fire) Mutual Aid Calls-1 Hebron (MVA) Training: Air pack; cold water rescue; multi gas; ladder; first aid (CPR & AED) Meetings- Fire Dep t. monthly mtg; 12 chief meetings; Chief & Officers mtg. in Rupert, VT Total hours for year-538; report will be filed Water-Eric Rogers reported 311 meters in service. General Controls fixed the auto dealer in water office; need to look for updated system for the dealer. It took almost 6 weeks to get the needed parts to fix the same; the dealer was new in 2003, is now outdated and parts are getting harder to come by. Regular upkeep/maintenance was performed; still working with Badger Meter on new read software (hope to get started on replacing meter heads for a better read percent). Training is set for 03/13 & 03/14. Eye wash & fire extinguisher checks were done; did monthly water sample required by the DOH & sample met the bacteriological requirements for a public water supply as set forth in subpart of the State Sanitary Code under Public Health Law 225. All fire hydrants have been winterized so if used, please notify the Water Dep t. Due to below zero temps for a week or so, there was a spike in water usage; began checking to find problems to fix them before they became big issues. Two fire hydrants are running so a couple of water mains that have had issues in the past will not freeze using around 5-6 gallons/minute. Do not want to turn off as I don t know how deep the frost level is and do not want the main to freeze up like it did in The hose on Blind Buck froze, causing the hydrant to freeze; working on melting the ice from around it. (Hydrant #45 is out of service.) Working on gathering info for updating the town s web page in the water area. Planning on doing

2 Page 2 February 14, 2018 Minutes spring time fire hydrant flushing April 2-6. The notice will need to be put in the paper. A tube is needed by Albert Sheldon s property going up County Route 64 (formerly Mike Sheldon property). Report will be filed Motion made by Councilman Harold Gilchrest, seconded by Councilman Marcus Blanck, authorizing Eric Rogers to attend water school. Highway-Sup t. Travis Keys reported to the board that the bids through Auctions International were now closed on the 2003 Ford F250 pick-up & the 2014 Ford F 250 pick-up. The minimum bid on the 2003 Ford F250 was $2,300.00; bid was $2, Minimum bid on the 2014 Ford F250 was $19,400.00; bid was $19, Travis was hoping for $21,000 on the 2014 Ford F250, but if he counteroffers and the bid is not accepted, he s right back to square one again. The cost to drive the same is about $.18/mile; he could try Gov Deals if that is the board s pleasure. After much discussion, the following was decided: Resolution #28-Motion made by Councilman Marcus Blanck, seconded by Councilman Bruce Ferguson, to accept the bid of $2, on the 2003 Ford F250 pick-up. Resolution #29-Motion made by Councilman Harold Gilchrest, seconded by Councilman Howard Law, to accept the bid of $19, on the 2014 Ford F250 pick-up. Roll Call Vote: Councilman Harold Gilchrest-Yes; Councilman Howard Law-Yes; Councilman Bruce Ferguson-Yes; Councilman Marcus Blanck-Yes; Supervisor Evera Sue Clary-Yes; passed unanimously 5-0. Travis will notify Auctions International that both bids were accepted. Snow removal has been done by Salem School, parking areas around Proudfit and the Glens Falls Health Center. Difficult to plow out as they have to go around vehicles in all places. Two men have been out sick for the last two weeks so there are only three men left to plow. Changes up routes somewhat to make sure trucks are ahead of the school buses. Have had breakdowns on radiators, sander s bed chains & air valves; grader Northern getting head gasket fixed) is on its way back together & hope to have it back in the next week or two. Town Barn has run out of fuel more than once this winter; G. A. Bove fuel will meet state contract price if the Town wants to go out to bid for fuel for 2019 & Travis will also check with Braymer Fuel about a price. One of the major repairs to the grad-all did not work so Travis is trying to reach Yacano s Grad-all to see what the best fix would be. White Chambers Rd. will become a big issue is the creek gets across Chambers Rd. DEC will issue no permits to get into the Creek to do anything. The quick fix is riprap along the bank w/about of stone. Could get stone from Champlain Stone in Whitehall or at least check on pricing. Travis had pictures he showed the board one from 05/05/2015 showing a much bigger erosion problem than what was being fixed. If this is left as is, another flood even will take the road out. After Irene, a project was done to stabilize the creek from eroding into the field with 100 s of yards of material and rockvains. It would appear that the water velocity & the armoring of the old railroad bed were not considered when the project was done. Travis met with Ken Lusken from Peckham to measure/price out some of the blacktop roads for paving in the spring. Considering Eagleville to Cutlers; 100 Butcher & 100 Kaufman; Upper Camden from Bob Thomas to Leigh Morrison s; do intersections from Roberson to Binninger Rd. Within the next 5 years, the sand pile is supposed to be on an inoperable pad. A 200 x 200 pad of black top would cost about $30,000; this should be done this year. The pile is getting smaller because of so many storms & the pile needs to be moved back and over (possibly a building w/roof over it) so we are taking from a southern face & it will be easier to access. Currently working w/washington County & CHA Design/Construction solutions on the culvert NY program. Salem can put in for 6 culverts--there are about 8 that would be good candidates. Will put in for the 6 that best meet the requirements & have the best chance of getting funding. Paperwork on the first phase of the project needs to be in by 03/15/2018. Half way through the salt contract, having used about 300 tons so far. Hoping to have about 100 ton left for mixing

3 Page 3 February 14, 2018 Minutes w/sand for next year. Need to think about increasing salt contract from 500 tons to 600 a cost of $65.82/ton; contract ends in August. Will be meeting w/dec in the next two months about the gravel pit as we have overextended the boundaries on two sides. Permit needs amending to figure out how much more can be mined. Highway Report from 01/11-02/04/18 will be filed. After reviewing bid specks provided by Travis to the board and commenting/asking questions the following was made a motion: Resolution #30-Motion made by Councilman Bruce Ferguson, seconded by Councilman Howard Law, to go out to bid for the two (2) pick-up trucks needed--one for the Water Dep t. and one for the Highway Dep t. for half-ton, small V-8 engine w/8 box, full 4-door crew cab, 4-wheel drive vehicles (cost is approximately $1,500 more for one-ton 2-door to 4-door). Roll Call Vote: Councilman Bruce Ferguson-Yes; Councilman Howard Law-Yes; Councilman Marcus Blanck-Yes; Councilman Harold Gilchrest-Yes; Supervisor Evera Sue Clary-Yes; passed unanimously 5-0. Councilman Bruce Ferguson brought up the fact that Cary Lane was never on any map or list as a former Village Road (there is a bridge on the road). Don t know if a formal abandonment would need to occur as it was never listed in the first place, but he feels that SAW might be interested in taking over the same. Courthouse-Janice Quartararo was absent but sent in an update report and end of January report for the board s review; reports will be filed. Historian-Al Cormier reported that there was an article in the NYS History Review, entitled No Man s Land Re-Visited. The book written by two men in Georgia about the 123 rd Regiment should be out in May. The Historic Preservation Commission is raising money for repairs to a monument in Gettysburg dedicated to the NY 123 rd (the only monument of a female), repair cost about $3,700. It is hopeful that the money can be raised locally for the repair to continue honoring the 123 rd Regiment. There are six people planning on making the trip to Georgia in May for the monument dedication. A battle re-enactment will take place at that time, also. Steve Butz has written a book about St. John Honeywood, who was the second principal of Washington Academy and an attorney and will be doing one of the history lectures at the Courthouse on the his book. The Historic District Preservation Law needs to be filed at a Local Law with the Department of State. More stone cleaning in the Revolutionary Cemetery will commence in the spring when weather permits. Planning Board-Clerk Erbe reported that there was nothing to review so far but the meeting would still be held to review zoning amendment for mixed use district re the 50 front, side and back yard footage and the parking issue. Georgi-Councilman Harold Gilchrest reported that grant work was continuing and more rental money should be coming in for One wedding is a definite & hopefully there will be several more scheduled. The Washington County Band will perform, as well as Shakespeare in the Park, the Metowee Players and Fairies in the Hamlet. Expenses will continue to be looked at and dropped where necessary. Bancroft Library-Supervisor Clary asked Rebecca Brown to be the second authorized user with the State Comptroller s Office re the 2% tax cap. Proudfit Trust-No determination was made on the Trust by the Surrogate s Court in NY City; it was sent back to the attorneys to make a determination. The Proudfit Trust has nothing to do with the building (An easy way to remember is Proudfit is poor fund money; Bancroft Trust is books). Judge Baylor still has the $17,000 grant from OCA that can be used for Courtroom renovations. Communications-Supervisor Clary reported that she had finally received communication from Washington County re the bill for $1,700, which ended up being Worker s Comp that was billed to the former Village in 2016, paid two years prior to the assessment in Unified Court System Audit-Audit was done by Supervisor Evera Sue Clary and Councilman Bruce Ferguson; books are in excellent shape and everything was fine. (Resolution needs to be sent to the Unified Court System according to letter rec d.--see under later resolutions from this meeting).

4 Page 4 February 14, 2018 Minutes Salem Food Pantry-Letter received from Lonnie Rasmussen, requesting $2,000 from the town to the pantry. The food pantry serves approximately 350 community members every month and this year alone the heating bills have exceeded $3,500. No action was taken by the board at this time. Citizens Empowerment Tax Credit-NYS Department of State says the real property tax bills printed in 2018 were an issue as the tax savings listed was a percentage--not a dollar amount saved; the bills should have shown the dollar amount saved on every bill printed. Laura Chadwick, director of Washington County Real Property, reported that this could not be done by Real Property with the current software program available. She met or has been in touch with Robert Roeckel from the NYS Department of State so he knows the problem. We are finally O.K. with what was done as there is no other way to state the savings on the bills only as a percentage. Meyer & Fuller Letter-Letter rec d. from attorney Jeffrey R. Meyer, Esq. regarding the Brook Lane matter, providing greater detail on the violations that have and continue to 43 Brook Lane from May- December of 2016 & February-summer of Attorney Meyer feels that it is safe to assume that there were probably violations that occurred that were not included in the timeline as they all were probably not documented. Slate Valley Rail Trail-Supervisor Evera Sue Clary told the board that while at a Washington County meeting a hand-out was given on the Slate Valley Rail Trail that included Salem. She showed the board the hand-out and Councilman Bruce Ferguson remembered that Granville had requested a resolution from neighboring towns in support of the same. Clerk Gilchrist responded that while it was voted on at the meeting to support this project, there was a short time frame to file the supporting resolution and it was never done by the Town of Salem as she never received the copy of what was supposed to be drawn up. Hence, the resolution was never sent to the Town of Granville. OLD BUSINESS Shushan Volunteer Fire Dep t. Banquet-Was held Saturday night, 02/10/2018, at the American Legion Hall in Cambridge. Supervisor Clary and husband, Bill, attended and she presented the Town s Proclamation and one from the Washington County Board of Supervisor s to 50-year member, Raymond West. The lease between the Fire Dep t. and the USPS is in possession of the fire dep t. and they are having it reviewed. Sewer Study Update-Third round of funding is beginning; committee needs to meet and contact Laberge for paperwork/report. Union Contract-Working w/attorney Alan Wrigley Dissolution Update-Need to review Village Local Laws regarding the nuisance law, parking during snow removal and the sign ordinance. Will probably have to have a special meeting to address these issues sooner rather than later! NEW BUSINESS Braymer Fuel Proposal-The cost to install three (3) programmable thermostats at Proudfit Hall/Bancroft Library would be $ Motion made by Councilman Howard Law, seconded by Councilman Harold Gilchrest, to have Supervisor Clary contact Braymer Fuels to go ahead with the project of installation of the three programmable thermostats in an effort to keep heating costs down. Roll Call Vote: Councilman Howard Law-Yes; Councilman Harold Gilchrest-Yes; Councilman Marcus Blanck-Yes; Councilman Bruce Ferguson-Yes; Supervisor Evera Sue Clary-Yes; passed unanimously 5-0 Justice Court Resolution-Resolution #31-Motion made by Councilman Bruce Ferguson, seconded by Councilman Harold Gilchrest, stating that the NYS Uniform Justice Court Act, town examination/audit of the Town Justice Court records & dockets be audited/examined; that said audit/examination was completed by Town Supervisor Evera Sue Clary and Town Councilman Bruce Ferguson on January 15, 2018, and that by this Resolution the Town of Salem is in compliance with the State of New York Unified Court System. (Said

Roll Call Vote: Councilman Bruce Ferguson-Yes; Councilman Marcus Blanck-Yes; Councilman Howard Law-Yes; Councilman Harold Gilchrest-Yes; Supervisor Evera Sue Clary-Yes; passed unanimously 5-0 Justice Clerk-Salary Increase-It was brought to the attention of the board that the Justice Clerk s salary was supposed to show an increase to $400/month in the 2018 budget, or $4,800/year. This was not explained that way during budget workshop meetings; it was explained as an increase of $400/year. After much discussion, it was decided not to act on another budget amendment at this time. No action taken by the board. Resolution #34-Motion made by Councilman Harold Gilchrest, seconded by Councilman Howard Law, to appoint Attorney Alan Wrigley as the Town of Salem attorney for matters coming before the board for (This will finalize Resolution #10 C from the Organizational Meeting Minutes of 01/03/2018, as this was not acted upon that night.) Roll Call Vote: Councilman Harold Gilchrest-Yes; Councilman Howard Law-Yes; Councilman Bruce Ferguson-Yes; Councilman Marcus Blanck-Yes; Supervisor Evera Sue Clary-Yes; passed unanimously 5-0 Resolution #35-Motion made by Councilman Harold Gilchrest, seconded by Councilman Howard Law, to create the position of $14.56/hour (presently have PTE person/driver for one-ton) and to amend the 2018 budget to reflect the same. Roll Call Vote: Councilman Harold Gilchrest-Yes; Councilman Bruce Ferguson-Yes; Councilman Marcus Blanck-Yes; Councilman Howard law-yes; Supervisor Evera Sue Clary- Yes; passed unanimously 5-0 PUBLIC COMMENT Supervisor Clary reported that she had responded with a letter in the required amount of time, said letter having been approved by Attorney Alan Wrigley. Compliance Office Scott McNeil paid a visit to the DiDimenico residence, reviewed the various problems the neighbors had with issues occurring on the

6 Page 6 February 14, 2018 Minutes property, and the neighbors were pushing the public nuisance local law that was still in effect through the Village until 03/3l/2018 with their attorney. He could find no violations on that visit. Mike Bukowski-asked if there were an Emergency Mitigation/Local Hazard Plan in place. Supervisor Clary asked for a motion to create a Flood Mitigation/Local Hazard Plan. Motion made by Councilman Harold Gilchrest, seconded by Councilman Howard Law, to authorize the formation of a Flood Mitigation/Local Hazard Plan committee, asking Mike to be willing to contact interested members to serve. Roll Call Vote: Councilman Harold Gilchrest-Yes; Councilman Howard Law-Yes; Councilman Marcus Blanck-Yes; Councilman Bruce Ferguson-Yes; Supervisor Evera Sue Clary-Yes; passed unanimously 5-0 Parks & Recreation Committee-Supervisor Clary informed the board that several people were interested on serving on such a committee, looking to form a Salem Youth Commission, if possible, after having one or two meetings to see what the interest was and to find interested committee members. She requested that the board vote on the formation of a Parks & Recreation Committee, with Andy Erbe being the Chairman. Current committee members interested on serving are Stacy Riche, Jason & Heidi McCauliffe, Janice Quartararo (L, L & P), Bob Sullivan, Jenny & Mark Cary & Zack Dupuis. (Others may join as word spreads or other coaches are contacted). Motion made by Councilman Howard Law, seconded by Councilman Marcus Blanck, giving permission to form a Parks & Recreation Committee with the above named individuals as long as the Committee keeps the board informed as to what they are doing. Highway Sup t. Travis Keys will try to clean them tomorrow, Thursday, 02/15. Cemetery-Georgi Lawn Mowing Bids-Councilman Gilchrest brought up the fact that even though it keeps snowing every weekend, it will be the summer mowing season soon and the bids should go in the paper as soon as possible for the Moravian/Camden Valley & Eagleville cemeteries and the Georgi Museum & Park Center. Motion made by Councilman Bruce Ferguson, seconded by Councilman Harold Gilchrest, to put the bids in the Journal Press & the Eagle newspapers for the mowing of the Moravian/Camden Valley & Eagleville cemeteries, as well as the Georgi Museum & Park Center. Clerk Gilchrist will put last year s bid notices and follow the same format. They should run for at least three (3) weeks to allow enough time for bidders to submit their paperwork. They will be drafting a new contract and using the new forms, which Alton will supply to Supervisor Clary for the Board s review. The new forms will be mailed to another location now and not to Greenwich as in the past; not too many changes from the way things were before except a better handle on QD s being done before the Building Permit is furnished to the County. The price will remain the same at $ for their services. Mr. Knapp informed the board that he had worked on the Solar Farm on Rte. 153, SAW and property along the Battenkill in Shushan, as well as the Georgi Museum in Shushan, which were all more than Quick Determinations. Both Supervisor Clary and Clerk Gilchrist informed Mr. Knapp that issues would be monitored more carefully than in the past and Mr. Knapp will continue to work with Kimberly Erbe as Clerk to the Planning Board. The Board thanked Mr. Knapp and his son for their presentation and for staying on as Flood Plain Managers. Courthouse-Three new board members will begin this January: Judy Bardin, Courtney Carlton & Scott Rishell (who will also serve as Treasurer). Janice reported the LARAC funding has been approved for 2018 in the amount of $4, Part of that money will go towards funding a new program for LL&P and will be open to entering 7 th graders. Partnering with SAW for this program entitled Junior High Hands on Studio Art with Profesionals ; $1,000 will go towards Music in the Courtroom series w/daniel Shulman & Kaori Washiyama; many more grants have been applied for continued funding for LLP program. Preliminary application submitted for a NYS grant through Carrie Woerner s office on restoration work to the building through the Dormitory Authority State of NY (DASNY). The courthouse kitchen had burst pipes on 12/15/17 that created quite a mess for the kitchen area. Braymer Fuels helped repair the pipes and addressed the heating issue; currently working with insurance company now to work out issues, file claim when bill is rec d., etc. Weight Watchers meets every 3:30 p.m. & new members can join at any time. The Courthouse is still in the midst of their annual appeal so feel free to donate and/or join as a member! Georgi Museum-Wendy Bordwell reported that Laura Dunham was now on the Georgi Committee, along with Butch Gilchrest and Anita Witten. She gave a big thank-you to Councilman Ferguson for his many years of service to the Georgi Committee and his continued behind the scenes support. Have been notified that the LARAC Grant will be forthcoming for the Fairies in the Hamlet exhibit on 06/16/2018. Volunteers are needed so if you would like to help, please contact Wendy. $ was received from Stewart s for programs in 2018, as well as a $ donation from the Salem Area Chamber of Commerce. Need to form a Friends of the Georgi support group to establish a 501 C-3 organization, with a board of 3-5 committed people. An area Eagle Scout is planning a project at the Georgi building picnic table(s) w/handicapped access at either end, with the possibility that he will donate 2-3 tables depending on what it will cost to do the project. No expense will be borne by either the Town or the Georgi. If anyone wishes to donate to the Georgi, please feel free to

Planning Board-Mo Patrick reported 2 applications for January, meeting to be the 4 th Thursday. An issue at Battenkill Woods was brought to Moe attention and that is currently being reviewed. Mo reported that the planning board will be reviewing Site Plan and Sub-division regulations and will be addressing solar issues in the site plan review process. Zoning also needs to be changed from 50 setbacks to 15. Historian-Al Cormier reported that there would be a Historic Preservation Meeting on January 15, A $4,000 Alfred Solomon grant was received by the Salem Rotary to continue stone cleaning in the Revolutionary War Cemetery; there are approximately 800 more to do. The Records Management Grant Application for storage of both the Village & Town records and shared w/the Salem Volunteer Fire Dep t., Inc., has been filed w/nys and Al probably won t hear anything before July of Just an FYI, the Lamplighter story appeared in the newspaper this past week. Report on the grant paperwork will be filed.
