Motion made by Councilman Howard law, seconded by Councilman Marcus Blanck, to approve the regular monthly meeting minutes from January 10, 2018; passed by a vote of 4-0 (Councilman Gilchrest absent) from the following board members: Councilman Howard Law; Councilman Marcus Blanck; Councilman Bruce Ferguson; Supervisor Evera Sue Clary. Motion made by Councilman Howard Law, seconded by Councilman Marcus Blanck, to approve the regular monthly meeting minutes from February 14, 2018; passed by a vote of 4-0 (Councilman Gilchrest absent) from the following board members: Councilman Howard Law; Councilman Marcus Blanck; Councilman Bruce Ferguson; Supervisor Evera Sue Clary. Motion made by Councilman Marcus Blanck, seconded by Councilman Howard Law, to approve the minutes from the special meeting held on Saturday, February 24, 2018; passed by a vote of 4-0 (Councilman Gilchrest absent) from the following board members: Councilman Marcus Blanck; Councilman Howard Law; Councilman Bruce Ferguson; Supervisor Evera Sue Clary. Clerk to Supervisor Kathy Chambers presented Trial Balance information for both the Highway Dep t. & the Georgi Museum for the month of February, 2018, and reviewed the same with the board members. Trial balance reports were made available on all other accounts for review, also. After review of Warrants and Highway Abstract, motion made by Councilman Howard Law, seconded by Councilman Marcus Blanck, to pay Warrants #3 and Highway Abstract #3 of 2018 as presented; passed 4-0 (Councilman Gilchrest absent) from the following Board Members: Councilman Howard Law; Councilman Marcus Blanck; Councilman Bruce Ferguson; Supervisor-Evera Sue Clary SUPERVISOR S COMMENTS-Supervisor Clary reported that 240 locations were being looked at in the Town of Salem for increased broadband coverage, administered by NYS. Salem Fire Department- Chief Graham reported 9 calls for February, 2018: Salem 5 (2-carbon monoxide; 1-good intent; 1-transformer fire; 1-EMS assist); Jackson-1 (MVA); Mutual Aid Calls-3 (1-Cambridge-stand-by; 1-Rupert-stand-by; 1-White Creek-structure fire) Meetings- Fire Dep t. held monthly meeting; attended monthly Town Board mtg. Training-Monthly air packs & multi gas; quarterly air pack (2 times); ice water rescue; water supply; driver training Total hours for year-l, l79; report will be filed Water-Eric Rogers reported 311 meters in service. Samples taken for iron & manganese for 1 st quarter; regular upkeep & maintenance was performed; still working with Badger Meter on new read software (hope to get started on replacing meter heads for a better read percent). Badger did training on 03/13 & 03/14, which Rebecca Brown also attended. Training went well and Eric is anxious to give it a full run. Fixed one water meter that was leaking due to normal usage; eye wash & fire extinguisher checks were done; did
2 Page 2 March 14, 2018 Minutes monthly water sample required by the DOH & sample met the bacteriological requirements for a public water supply as set forth in subpart of the State Sanitary Code under Public Health Law 225. All fire hydrants are in service; working on spring-time to do list & up-coming projects; checking on new equipment that will be needed. Town updated the water page of their web site; it looks good & there is some good information there if anyone wants to see what is going on and what the water quality is. Up-coming water tests this year are: Coliform-Monthly; Iron + Manganese-Quarterly (March, June, September, December); Nitrate, Lead & Copper; Secondary Inorganic Chemicals; Principle Organic Chemicals (done around July). One application received for a new water hook-up. Saratoga water school is Wednesday, April 11, Report will be filed. Highway-Sup t. Travis Keys reported the two new pick-ups were ordered one for highway & one for water department. Grader is back & seems to be working fine, although it has not been used more than 10 hours. Been cold patching all black top roads; will need to be re-done once the weather gets back to normal. Took big maple tree down on Hanks Road that the wood pecker has been working on for over a month now before it fell on someone. The town needs to go out to bid for a tree person so the h way dep t. can get some of the dead trees down around town that they cannot do themselves. As far as Travis knows, Washington Co. has not had any bids for tree work yet. Motion made by Councilman Bruce Ferguson, seconded by Councilman Marcus Blanck, authorizing Highway Sup t. Travis Keys to go to bid for someone to take down trees. Roll Call Vote: Councilman Bruce Ferguson-Yes; Councilman Marcus Blanck-Yes; Councilman Howard Law-Yes; Supervisor Evera Sue Clary-Yes (Councilman Gilchrest absent); passed Western Star is now out of warranty as it is 5 years old; had to send 2002 International to Northern Truck to have transmission problem fixed. Have been able to fix all break downs but the 2002 truck in-house. There is still a lot of cost involved in part as most of the snowplow equipment has to come from the manufacturer. Started on the spring/summer project list; have a lot of culverts to put in & a lot of water issues that need addressing. Will be starting road sign inventory list soon & when it gets dry enough, will begin grading dirt roads & ditching. Grad-all needs to have the boom cylinder rebuilt, probably $2,000-$3,000; it is 14 long & it needs a new rod. Tried a fix last year that did not work; Councilman Law told Travis he had a contact person. Kingsbury will be getting a new box for their truck and we are going to get their old one for the 07 (that box is not worth fixing any more). Kingsbury also has an old one-ton asphalt roller that runs that the Town can have for $1.00! Have a need for a trailer to move the roller & the Kubota tractor with--any ideas?? Councilman Bruce Ferguson asked about the Cato Street issue with missing signs, wire down; broken pole, etc. Why is Courthouse being billed for three water units?? February 2018 report will be filed. 7:15 P.M.-PUBLIC HEARING-LOCAL LAW # 2 OF 2018-Supervisor Clary opened the Public Hearing on Local Law #2 of 2018, entitled A Local Law to provide for the residency status of the Deputy Town Highway Superintendent. Highway Sup t. Travis Keys wishes to appoint someone as his Deputy who does not live in the Town of Salem; this Local Law would provide for that. As required by law, Supervisor Clary asked if there was any comment from the public three (3) times regarding Local Law #2 of Having received no comments at any time from the public, the following was made a motion: Resolution #42-Motion made by Councilman Marcus Blanck, seconded by Councilman Howard Law, to adopt Local Law #2 of 2018 to provide for the residency status of the Deputy Town Highway Superintendent, allowing said person to be Deputy to reside outside the Town of Salem. Roll Call Vote: Councilman Howard Law-Yes; Councilman Bruce Ferguson-Yes; Councilman Marcus Blanck-Yes; Supervisor Evera Sue Clary-Yes; passed 4-0 (in absence of Councilman Gilchrest), duly adopted by the Salem Town Board on March 14, Public Hearing on Local Law #3 of 2018 closed. 7:20 P.M.-PUBLIC HEARING-LOCAL LAW #4 OF 2018-Supervisor Clary opened the Public Hearing on Local Law #4 of 2018, entitled A Local Law to amend Zoning Amendment #3 of 2017, regarding provisions relating to minimum yard dimensions and parking space requirements. As required by law, Supervisor Clary asked if there was any comment from the public three (3) times regarding this Local Law #4 of A member of the public asked if the wording on page 2 of the proposed law might be confusing and the front, side & rear yard footage still stated 50 in all three areas. Kimberly Erbe, Planning Board Clerk, responded that the wording just above the chart states Article IV S 4.31 is amended and shall repeal the following minimum yard dimensions for the Mixed Use District. Every zone in the former Village is 15 except Agriculture, Floodplain & Floodway, and Low Density Residential as stated in the original filed Zoning Law so the 50 will be removed and revert back to the original 15. The Short Environmental Assessment Form, consisting of four (4) pages, was read and answered by the Board members present. On a motion by Councilman Bruce Ferguson, seconded by Councilman Marcus Blanck, it was determined, based on the information and analysis given, and any supporting documentation that the proposed action will not result in any significant adverse environmental impacts. Roll Call Vote: Councilman Bruce Ferguson-Yes; Councilman Marcus Blanck-Yes; Councilman Howard Law-Yes; Supervisor Evera Sue Clary-Yes; passed 4-0 (in absence of Councilman Gilchrest). Resolution #44-Motion made by Councilman Howard Law, seconded by Councilman Marcus Blanck, to approve & adopt Local Law #4 of 2018 to amend Zoning Amendment #3 of 2017, regarding provisions relating to minimum yard dimensions and parking space requirements. Roll Call Vote: Councilman Howard Law-Yes; Councilman Marcus Blanck- Yes; Councilman Bruce Ferguson-Yes; Supervisor Evera Sue Clary-Yes; passed 4-0 (in absence of Councilman Gilchrest), duly adopted by the Salem Town Board on March 14, Public Hearing on Local Law #4 of 2018 closed. Historian-The Historic Preservation Commission is raising money for repairs to a monument in Gettysburg dedicated to the NY 123 rd (the only monument of a female), repair cost about $3,700. It is hopeful that the money can be raised locally for the repair to continue honoring the 123 rd Regiment. There are six people planning on making the trip to Georgia on May 17 th for the monument dedication. Washington County will be doing a Proclamation for Al to take with him, as well as the Town of Salem. Perhaps Carrie Woerner would see that one would be forthcoming from NYS? The book on the 123 rd Regiment should be coming out in May & the rights to the book are being turned over to the Historic Preservation Commission. Planning Board-Clerk Erbe reported one application for Salem Fire Dep t. for new fire pit. Georgi-Wendy Bordwell & Councilman Harold Gilchrest both absent. Recreation Committee-Approximately 13 members on the Committee currently, with Andy Erbe as Chairman. Alton Knapp-Flood Plain Manager-Alton left packets containing revised/replacement Local Law on flood plain management to include a rate map for the former Village. Already filed with DEC, FEMA & Washington County; first law was updated--changed Appeals Board to Floodplain Appeals Board. Contact Attorney Alan Wrigley re re-filing/amending the one that was filed. Alton still needs to meet w/wash. Co. Code Enforcement for all LRCC-1 s that need to be signed by the Supervisor before Code Enforcement can issue a building permit. Packet also included the new form for floodplain determination to be filed out & sent to Alton, as well as a new contract for the Town of Salem re Floodplain Management for Motion made by Councilman Bruce Ferguson, seconded by Councilman Marcus Blanck, for discussion of contract. Should attorney Alan Wrigley

Motion made by Councilman Bruce Ferguson, seconded by Councilman Marcus Blanck to accept the contract for floodplain management with Knapp Associates and to instruct Supervisor Clary to execute the same. Roll Call Vote: Councilman Bruce Ferguson-Yes; Councilman Marcus Blanck-Yes; Councilman Howard Law-Yes; Supervisor Evera Sue Clary-Yes; passed 4-0 (in absence of Councilman Gilchrest). Clerk Gilchrist will give the new application form to Planning Board Clerk, Kim Erbe. Bancroft Library-Susan Getty reported that the Library has received a grant for the purchase of a cart. The Salem Area Woman s Club will not be doing the front flower beds at the library this year; the library will take over this task. OLD BUSINESS Salem Food Pantry-Letter received from Lonnie Rasmussen, requesting $2,000 from the town to the pantry. The food pantry serves approximately 350 community members every month and this year alone the heating bills have exceeded $3, people were served just last Saturday alone. Resolution #45-Motion made by Councilman Marcus Blanck, seconded by Councilman Bruce Ferguson, to take $2, from the Community Assistance Fund to donate to the Salem Food Pantry. Roll Call Vote: Councilman Marcus Blanck- Yes; Councilman Bruce Ferguson-Yes; Councilman Howard Law-Yes; Supervisor Evera Sue Clary-Yes; passed 4-0 (in absence of Councilman Gilchrest). Sewer Study Update-There will be a meeting next Wednesday, March 21 6:00 p.m. The draft report is now available. Union Contract-Waiting to hear from Attorney Alan Wrigley Dissolution Update-Check should be forthcoming from NYS with rest of funds that were available. NEW BUSINESS Bancroft Trust-Need MOU between two boards Library Board & Town Board as Successor Trustees of the Bancroft Trust Tour of the Battenkill Bike Race-Clerk Gilchrist received an from Jaki Wang, who is helping to coordinate this year s cycling event, which will be held on April 28 th, They are requesting a Municipal Letter of Acknowledgement/No Objection from the Town of Salem for the use of whatever Town roads will be utilized that day. Motion made by Councilman Bruce Ferguson, seconded by Councilman Howard Law, instructing Clerk Gilchrist to send the Municipal Letter of Acknowledgement/No Objection that was provided, giving permission to use town roads only, with Tour of the Battenkill providing an Insurance Certificate for the one-day event, naming the Town of Salem as the insured. Roll Call Vote: Councilman Bruce Ferguson-Yes; Councilman Howard Law-Yes; Councilman Marcus Blanck-No; Supervisor Evera Sue Clary-Yes; passed 3-0 with Councilman Blanck voting no and Councilman Gilchrest absent. PUBLIC COMMENT Attorney Jeffrey Meyer-was present on behalf of the citizens on Brook Lane. Responded that he was disappointed that the Board had not adopted the former Village Nuisance Law as Town Law. Attorney Wrigley felt that the Village s law needed stiffer language and should be revised. Tina Fleming-Inquired about the Flood Mitigation Committee; authorization was already granted to form the same. She reported that Mike Bukowski did not want to head any committee so she will try to find people interested to serve on the committee. David Glover-Salem Central School-Mr. Glover, Salem Central School Superintendent, wanted to remind everyone about the vote for the $21.3 million capital improvement project. The vote will take place on Tuesday, March 27, 2018, in the lobby of the school. He will be doing a public presentation about the project
5 Page 5 March 14, 2018 Minutes at the Shushan Firehouse on Thursday, March 15 th & at the Courthouse on Monday, the 19 th. Please call him if you have any questions. Mail-outs were sent to homeowners in the district and Mr. Glover will leave some with Clerk Gilchrist. Mike Miller-Reported that there are large cats/mountain lions roaming the area around Blind Buck, Beattie Hollow and Chambers Roads. DEC has paid the area a visit as two horses have been killed by them. Just be aware and be careful! Jonathan McNamara-Introduced himself and said he lives next to John Lundgren s house and will be moving soon. He is currently looking for a place to live and would welcome anyone s input as to what is available. He currently does inspections and audits within a two-hour radius of Salem.
