1 At a Town Board Meeting of the Waterford Town Board held on Tuesday, September 2, 2014 at 7 P.M. at Waterford Town Hall, 65 Broad Street, Waterford, NY the following transpired: There were present: Councilman Ball Councilman Boudreau Councilman Marble Councilman McClement Supervisor Lawler COMMUNICATIONS AND PETITIONS Town Clerk Dziarcak read a letter of resignation from Police Officer Jeremy Connors ACTION ON MINUTES OF PREVIOUS MEETINGS AS FOLLOWS A motion was made by Councilman Boudreau and seconded by Councilman McClement to accept the minutes of August 5, 2014 and August 26, 2014 as distributed. All in favor. COMMITTEE REPORTS FINANCIAL REPORT AND SUBMISSION OF BILLS AND PETTY CASH The Supervisor read the Supervisor s cash report for the month of August There was no petty cash distributed. The payments in advance of audit totaled $115, and the audited vouchers totaled $151, A motion was made by Councilman McClement to accept the cash report and pay the bills. Motion seconded by Councilman Boudreau. All in favor. COMMITTEE ON HIGHWAY, WASTEWATER TREATMENT, WATER AUTHORITY AND CEMETERY Councilman Boudreau read the Highway Department report for the month of August as reported by Harry Martel, Highway Superintendent. Trash drop off program resumes on September 13 th through the end of October and the Household Hazardous Waste Day is October 4 th from 8 A.M. to 1 P.M. Councilman Boudreau then read the Wastewater Treatment Plant report for the month of August as submitted by Richard Thyrring, Chief Operator. COMMITTEE ON PUBLIC SAFETY, EMERGENCY SERVICES, VETERANS AFFAIRS Councilman Ball had no Police Department report for the month. He thanked all the agencies involved who responded to a hostage situation in Town yesterday, including the NYS Police, the Cohoes Police Department, the Saratoga Sheriff s Department, the Waterford Rescue Squad, the Fire Departments and the Clifton Park ambulance. COMMITTEE ON CANAL DEVELOPMENT, GRANTS AND PROGRAM FUNDING, COMMUNITY GROUPS AND VILLAGE GOVERNMENT LIAISON
2 Councilman McClement read the Visitor s Center report for the month including a thank you to the volunteers; he stated we couldn t do this without them. The Farmer s Market continues as well as a boater safety course. The Tug Boat Round Up will be this weekend with HUGE fireworks on Saturday night at dusk. This year there is also a boat show at Lock 2. The Councilman further welcomed a new Museum Director, Mr. Paul Archambeault. The Museum is hosting a trip to Kinderhook and they will be holding a 50 th anniversary Gala on October 18 th at Chrome Restaurant. COMMITTEE ON YOUTH, SENIORS, PARKS AND PLAYGROUNDS, POOL AND FESTIVALS Councilman Marble read the pool and Park report for the year and thanked everyone involved for a successful year. She also announced we would be sponsoring Coats for Kids this year with more info to follow. Councilman Marble read the Senior Van report as submitted by Neil Quantock. She read the Senior Activity report for the month as submitted by Mike Mahoney, Director. Neil Quantock also thanked the men of the highway department for all the repairs they do for the seniors. SUPERVISOR S REPORT Supervisor Lawler thanked everyone who was involved in the Police emergency on Monday. GENERAL ORDERS RESOLUTION # 105 RESOLVED, that the annual estimate of funds needed to be raised and levied for calendar year 2015 to pay principal and interest on obligations issued for capital expenses for Sewer District No. 1 is $168,258.00, and be it further RESOLVED, that the amount of the estimate of funds needed for calendar year 2015 as above determined shall be assessed on the properties in the district benefitted by the sewer improvement in accord with the laws governing such assessments, and further RESOLVED, that the assessment roll for Sewer District No. 1 for 2015 benefits assessment shall be comprised of an assessment for the year for each property based on (a) A so called benefit charge to consist of an ad-valorem assessment upon which each $ of assessed value of each property at a rate of $.2603 per thousand, and (b) A so-called basic benefit charge of $25.00 which shall be levied against all property in the district having access to an operating sewer line and which basic benefit charge shall be computed as follows: 1. For residential property there shall be one charge for each family unit, and 2. For non-residential property there shall be one charge for each estimated flow equivalent to a single family dwelling unit. The ordinary measure of an estimated sewage flow equivalent of a single family dwelling shall be water consumption in the last 12 months computation of 80,000
3 computing assessments may use an alternate estimated flow equivalent of a single family dwelling, if, in its judgment (a) The users ration of a sewage contribution in water consumption is substantially different from that of a domestic household, or (b) The user has not been a consumer of public water for the entire twelve month period proceeding its assessment, it being understood any such alternative measure shall be calculated to equitably reflect the user s benefit in relation to the benefit to a single family unit. Seconded by Councilman Boudreau RESOLUTION # 106 RESOLVED, that the proposed assessment roll for Sewer District No. 1 for the calendar year 2015 to pay principal and interest on obligations issued and capital improvements to cover financing of the district improvements in the amount of the estimate for funds needed for such year, which has been reviewed at this meeting is considered complete and the same having been prepared by the Board shall be filed with the Town Clerk, and be it further RESOLVED, that the Board shall meet to consider objections to the assessment roll for Sewer District Number One filed with the Town Clerk this date at 6:55 P.M. on the 7nd day of October 2014 at the Town Hall, and be it further, RESOLVED, that the Town Clerk is directed to cause notice of completion of said assessment roll and the date of the hearing etc to hear objections, etc., to be published in the Gazette Newspaper and the Saratogian Newspaper, the latter being published in Saratoga County, in accord with requirements of section 239 of Town Law and other applicable statutes, such notice shall be published at least ten days and not more than twenty days before the date of said hearing and it is further RESOLVED, that Notice to the Comptroller of the State of New York before with provided the comptroller and be provided at least three weeks prior to October 7th, the date of the hearing.
4 RESOLUTION # 107 RESOLVED, that Edmund Huneau be and he is hereby reappointed as a member of the Board of Assessment review at a salary of $66.55 per meeting to be paid in quarterly installments by the Supervisor without the necessity of pre-audit by the Town Board. Seconded by Councilman McClement RESOLUTION #108 RESOLVED, that the Supervisor be and he is hereby authorized to sign change order #4 CHA project # in an amount of $13, RESOLUTION # 109 RESOLVED, that the Supervisor be and he is hereby authorized to sign change order # 5 CHA project # in an amount of $11, Seconded by Councilman McClement RESOLUTION # 110 RESOLVED, that the following places be designated polling places for the Town of Waterford for the year 2014:
5 District #1- Civic Center District #2- Kavanaugh Fire House District #3- Ford Hose District #4 Northside Fire House District #5 Emergency Team Building District #6 United Methodist Church District #7 Waterford Halfmoon High School District #8 Waterford Halfmoon High school Seconded by Councilman Boudreau RESOLUTION # 111 WHEREAS, the Town s current garbage contract ends on December 31, 2014; and WHEREAS, the Town Board desires to solicit bids for a new contract: NOW, THEREFORE BE IT RESOLVED that the Town Board hereby calls for bid proposals, in conformance with the bid specifications and Notice To Bidders available at the Town Clerk s office on September 11, 2014, which are to be received and considered publically on the 2 nd day of October, 2014 at 2:00 P.M. at Waterford Town Hall, Town Clerk s office, 65 Broad Street, Waterford, NY RESOLUTION # 112 WHEREAS, filed in Town Court is the proceeding: Town of Waterford v. Frank H. Jourdanais Jr. a matter related to various alleged Town Code violations; and WHEREAS, the attorneys for the Town have recused themselves from this matter;
6 NOW, THEREFORE BE IT RESOLVED that the law firm of Girvin and Ferlazzo, PC is hereby retained at their usual rates to handle said matter. Seconded by Councilman McClement RESOLUTION # 113 RESOLVED, that the Town Board will hold a Public Hearing on October 7, 2014 at 7:00 P.M. at Waterford Town Hall for the purpose of receiving comments from the public on the proposed PHA Plan for 2015 for the Section 8 Housing Choice Voucher Program. RESOLUTION # 114 RESOLVED, that the correct amount for payments in advance of audit for the July, 2014 Town Board is $106, for the abstract report for the month ending June Seconded by Councilman Boudreau RESOLUTION # 115 RESOLUTION OF THE TOWN BOARD OF THE TOWN OF WATERFORD, SARATOGA COUNTY, NEW YORK (THE TOWN ) AUTHORIZING AND ADOPTING POST ISSUANCE COMPLIANCE POLICIES AND PROCEDURES RELATED TO THE TOWN S TAX-EXEMPT OBLIGATIONS, SUCH POLICIES AND PROCEDURES INTENDED TO ENSURE THAT THE REQUIREMENTS IMPOSED UPON THE TOWN PURSUANT TO THE INTERNAL REVENUE CODE OF 1986, AS AMENDED, WILL BE SATISFIED
7 WHEREAS, the Town of Waterford, Saratoga County, New York (the Town ) previously has issued bond and notes (the Tax-Exempt Obligations ), the interest on which is excluded from gross income of the owners thereof pursuant to Section 103 of the Internal Revenue Code of 1986, as amended (the Code ); and WHEREAS, the Town intends to issue additional series of Tax-Exempt Obligations in the future; and WHEREAS, in order to ensure that that interest on Town s Tax-Exempt Obligations will continue to be excluded from gross income of the owners thereof for purposes of federal income taxation, and that the Town complies with its tax certifications relating to the Tax-Exempt Obligations, the Town Board has determined, based on the advice of the Town s Bond Counsel, to adopt certain written Post-Issuance Compliance Policies and Procedures in the form attached hereto as Exhibit A and made a part hereof (the Post-Issuance Compliance Procedures ). NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Waterford, Saratoga County, New York (the Board ), as follows: Section 1. The Board hereby approves and adopts the Post-Issuance Compliance Procedures. Section 2. The Board hereby appoints the Town Supervisor to serve as the Designated Tax Compliance Official under the Post-Issuance Compliance Procedures and hereby authorizes and directs the Town Supervisor, acting in such capacity, to take such actions, after appropriate consultation with Bond Counsel to the Town, as the Town Supervisor deems necessary, appropriate or desirable to effect the implementation of the Post Issuance Compliance Procedures, and hereby further authorizes the Town Supervisor, as such Designated Tax Compliance Official, to delegate to such other Town officials or employees as the Town Supervisor shall determine is necessary or appropriate, the responsibility to take certain specific actions called for by the Post-Issuance Compliance Procedures. Section 3. This Resolution shall take effect immediately. The question of the adoption of the foregoing resolution was duly put to vote on a roll call, which resulted as follows.
