1 A REGULAR MEETING, TOWN OF AVON, JULY 27, 2017 PAGE 1 A regular meeting of the Town of Avon was held on Thursday, July 27, 2017 at 6:00 P.M. at the Avon Opera Block/Town Hall, 23 Genesee Street, Avon, New York 14414, with the following members present: PRESENT: Supervisor David LeFeber, Deputy Supervisor Thomas Mairs, Councilwoman Jeannie Michalski, Councilmen James Blye and Malachy Coyne OTHERS: Engineer Kurt Rapazzo, Attorney James Campbell, Highway/Water Superintendent Thomas Crye, Clean Energy Initiative Liaison Clara Mulligan, and Town Clerk Sharon Knight, MMC/RMC VISITORS: Judy Falzoi, Janet Manko and Chuck Morgan Supervisor LeFeber led those in attendance in the Pledge of Allegiance. Supervisor LeFeber asked for any public comments and Visitor Chuck Morgan shared the following by reading his prepared statement as shown below: I was not able to attend the public meeting regarding the moratorium on large-scale solar. I read the published minutes of this meeting, and since minutes of Town Board meetings are part of the record, my comment is to correct the record pertaining to a visitor comment. The comment as published in the minutes on page 7 was: Re-read the Comprehensive Plan to see developing of solar and it was not a part of it. This comment is not factual. In fact, the Comprehensive Plan includes solar development as documented in the Comprehensive Plan as follows: Page 19 of the plan s Appendix contains the data on the Community Survey s responses to the question do you encourage or discourage large scale solar? 45% of respondents encouraged it, 14% discouraged it, and 41% had no opinion. These results were noted and incorporated in the Comprehensive Plan as follows: Page 53 of the plan includes the plan s implementation tables. Item 4 states; Encourage renewable energy systems for residential, commercial and industrial where appropriate. The Town Board authorized a committee to research and review this issue and to make recommendations regarding this issue. Where appropriate is a central matter the committee is reviewing, among others. Thank you for the time to make this correction to the record. Chuck Morgan RESOLUTION #135 APPROVAL OF MINUTES On motion of Deputy Supervisor Mairs, seconded by Supervisor LeFeber, the following resolution was ADOPTED AYES 4 NAYS 0 ABSTAIN 1 (Councilwoman Michalski) RESOLVE to approve the minutes of July 13, 2017, as presented by and to request they be published on Town of Avon website at townofavon-ny.org. 2 A REGULAR MEETING, TOWN OF AVON, JULY 27, 2017 PAGE 2 DISCUSSION - ATTORNEY REPORT Attorney Campbell gave the following report: Verizon continues to be worked on. The implications of the new family leave benefits to employees and it s affect to the Town of Avon will be researched and guidance will be given in the future. A legal water update was giving and includes but was not limited to the following: Interior meter reads to establish a base line are needed and the Water Sewer Authority Board approved their Director to sign the agreement. Currently working on residential meter reads. We continue to encumber costs. Bills are schedule to be sent out. Recommendations were discussed on the amount to bill including average and high volume users. We have approximately fifty meters that do not work at all and its critical that they be fixed asap. Replacement meters are available and it would be necessary to expand the Livingston County Water & Sewer Authorities duties for the Town of Avon. Phase one of the audit was to identify the problem and this has been completed. Phase two will be to provide certification for risk abatement and reconciliation including: A. If we owe a refund B. Customers owe the Town or C. Billing was accurate and proper. High volume customers include Harper Park, H20 Joe, Coyne Farms, the Car Wash, etc. An update will be given on August 24th and additional items will be shared including the Towns ability to re-levy unpaid water bills. Meters that do not work will be tagged and stored at the Highway Barns. Call Attorney Campbell with questions so that each Board Member understands all of the steps. RESOLUTION #136 AUTHORIZE ATTORNEY CAMPBELL TO NOTIFY THE LIVINGSTON COUNTY WATER AUTHORITY On motion of Deputy Supervisor Mairs, seconded by Councilwoman Michalski, the following resolution was ADOPTED AYES 5 NAYS 0

3 A REGULAR MEETING, TOWN OF AVON, JULY 27, 2017 PAGE 3 RESOLUTION #136 AUTHORIZE ATTORNEY CAMPBELL TO NOTIFY THE LIVINGSTON COUNTY WATER AUTHORITY-continued RESOLVE to authorize the attorney to notify the Livingston County Water Authority that the Town has approved utilizing the Livingston County Water Authority pursuant to the previously adopted inter-municipal agreement to assist the Town in replacing approximately 50 nonfunctioning water meters. Vote of the Board: Councilwoman Michalski - Aye, Councilman Coyne- Aye, Councilman Blye - Aye, Deputy Supervisor Mairs - Aye, Supervisor LeFeber Aye DISCUSSION HIGHWAY/WATER REPORT Highway/Water Superintendent Thomas Crye reported on the following: Highway Water Touched up shoulders with the help of Caledonia Helped Caledonia and York Mowed County road sides and started on Town roadsides Kept up the Parks & Cemeteries Radio reads Work orders Every day rounds tank tower and pump house. May have a water leak on Ashantee Lane. Fire hydrant replacements were discussed. DISCUSSION ENGINEER S REPORT Engineer Rapazzo reported on the following: Inspection reports were received painting of the tanks is in good shape. OSHA regulations have been identified and need to be addressed. The Town needs to put a plan in place. OSHA continues to change their regulations. Estimates are being put together to bring the tanks up to OSHA standards. Also, the report noted that at the tower the cell equipment attached to the hand rail is causing stress to the cattle walk and hand rail. They are recommending that the equipment be removed as soon as possible. This becomes an additional issue to resolve Verizon. We might need to provide an OSHA safe environment for Verizon. A long term plan needs to be put in place and Engineer Rapazzo will have a recommendation during budget time. Verizon might have an argument that we are required to keep it up to OSHA standards. The tank is approximately sixty-four years old. $72,000 per year is received from renters when we have three contracts.

4 A REGULAR MEETING, TOWN OF AVON, JULY 27, 2017 PAGE 4 DISCUSSION ENGINEER S REPORT-continued We had three leases now we have two and it s unsure which lease is being used. The memory is that they left cabling conduit and the building. AT&T would like to start negotiations now due to changing technology. Code Enforcement Officer Glise has had some recent discussions with Supervisor LeFeber regarding these changes. How are we in the pit? Highway/Water Superintendent Crye stated that it s working better. The altitude valve and the money needed at the tower will be added to next year s budget. DISCUSSION CODE ENFORCEMENT REPORT Code Enforcement Officer (CEO) Glise was not in attendance. Fellow Clerks in Livingston County have had surprise visits by the New York State Department of Health regarding Workplace violence policy and procedures. It is for high impact plastic letters. He also stated that he is getting together with Kelly Cole regarding the Bero quote for the third floor of the Opera Block Building and is looking to find a design architectural person to look at our building space and make some recommendations for usage. Supervisor LeFeber talked about an generated by the Court Office regarding someone getting sick in the hall upstairs during court and not having the proper items to clean it up. DISCUSSION BRUCKEL DRIVE UPDATE Attorney Campbell suggested that a gentle reminder be sent out that the Town is to take dedication of the Road. If it is not dedicated this will affect the Town s ability to plow. A dedication package needs to be provided to our Attorney. DISCUSSION INTERVIEW UPDATE Supervisor LeFeber, Councilman Coyne and Highway/Water Superintendent Crye met with three candidates and an offer was made to one individual who has a CDL and seems interested. Possible start date would be August 14 th. A physical will be needed. There is a Possibility of hiring another person for snow and ice removal.

6 A REGULAR MEETING, TOWN OF AVON, JULY 27, 2017 PAGE 6 DISCUSSION 2018 BUDGET PREPARATIONS Supervisor LeFeber anticipates doing the budget similar to the past. Department heads will be sending in their requests shortly. The property tax cap percentage is a little higher than last year and we will still have a carry over for DISCUSSION CHANNEL 8 SUMMER TOUR AUGUST 16 TH The Town is working with the Village for a location. DISCUSSION SUPERVISOR REPORT Supervisor LeFeber and Mayor Freeman will meet with Senator Gallivan on August 9 th and they will also be meeting with School Superintendent Johnson on the same day to discuss the school resource officer agreement. OPEN ITEMS Supervisor LeFeber asked for any open items they are as follows: Councilwoman Michalski discussed training for Jeanette Cullinan for the benchmarking project and that it needs to be inspected. VISITOR COMMENTS Supervisor LeFeber asked for any public comments and Visitor Judy Falzoi stated that she is waiting for a speed sign on her road and a children playing sign was also discussed.
