President Michael Schwab called the meeting to order at 7:30 p.m. Members Present: Trustees Malcolm, Olson, Emmrich, Kruepke, Lippold, and Kurtz. Members Absent: None. Hickory Lane Inclusive Playground Kelly Valentino gave a short presentation on the proposed Hickory Park Inclusive Playground. The Friends Group, Impact Fees, and Village Capital Expenditure fund are the three funding groups that will be used to pay for the project. The Friends Group raised $100,000 in one year of fundraising. The park impact fee account has over $130,000 to be spent, and the request is to have the Village Capital Expenditures account provide $100,000 to start the project. The Friends will continue fundraising until the project is completed. Tr. Lippold asked if anyone was hurt from the broken swing. Kelly Valentino stated no, and an incident report was filed. Tr. Emmrich asked who is installing the equipment. Kelly Valentino stated Northland Recreation will be installing the equipment. Motion by Pres. Schwab, second by Tr. Lippold to approve the installation and funding of the Hickory Lane Park Inclusive Playground as presented. Vote: 7 ayes, 0 nays. Motion carried. Resolution #18-15 Preliminary Assessment Stonehedge Drive Storm Sewer Project. Motion by Pres. Schwab, second by Tr. 5 Pay Request # Utility Improvements Project. Motion by Pres. Schwab, second by Tr. Olson to approve Pay Request #1 for 2018 Utility Improvements project in the amount of $189, Vote: 7 ayes, 0 nays. Motion carried. Development Agreement Bielinski Homes Inc. Laurel Springs Addition #1 Motion Pres. Schwab, Second by Tr. Olson to approve the estimated reimbursement in the amount of $234, in the Development Agreement for Laurel Springs Addition #1. Vote: 7 ayes, 0 nays. Motion carried. 7. Plan Commission No Items 8. Board of Public Works Review of Petition Creating a Truck Route for Northwest Business Park (and) Review of Traffic Study for Hickory Lane Tr. Olson explained both studies and the discussion that occurred at the Board of Public Works meeting. Police Chief Dolnick explained speeding is not the issue as noted in the study. The Police Department has written tickets for speeding the past week. Tr. Kruepke suggested signs would help after the reconstruction of CTH P. Motion by Pres. Schwab, second by Tr. Emmrich thanking the Police Department for the studies and continuing to monitor the traffic in each area, along with the Public Works Department. Vote: 7 ayes, 0 nays. Motion carried. 9. Ordinance #17-03 Annexation of Paloroma Farms, LLC. Motion by Pres. Schwab, second by Tr. Lippold to refer Ordinance #17-03 Annexation of Paloroma Farms, LLC to a future Village Board meeting. Vote: 7 ayes, 0 nays. Motion carried. 10. Ordinance #18-03 Adoption of Attachment Ordinance Pursuant to Cooperative Plan with Town of Jackson Attaching Paloroma Farms Attachment Territory. Village Attorney John St. Peter reviewed and recommended the approval tonight by suspending the rules and the second reading per the Department of Administration recommendation. Pres. Schwab read Ordinance # Motion by Tr. Olson, second by Tr. Lippold to introduce Ordinance # Vote: 7 ayes, 0 nays. Motion carried. Motion by Pres. Schwab, second by Tr. Schwab reviewed the survey deadline is June 18 th and encouraged all to fill out the survey. A new school superintendent has been hired. Tr. Lippold questioned why the survey has a two story school building? 12. Proposed Public Safety Building - Update. No Report. 13. Departmental Reports. Park and Recreation Director Kelly Valentino shared with the Board a letter from Scott Mittelsteadt President of Jackson Festivals, Inc. The fireworks were awesome, and thanks to John and Marian Kruepke for sponsoring the fireworks. Village Administrator introduced Jilline Dobratz as the new Village Clerk/Treasurer. 14. Mid-Moraine Municipal Association Report Tr. Kurtz reported the next Mid-Moraine Legislative Group meeting is September 12 th with the topic of phosphorus. The Mid-Moraine dinner meeting is on September 26 th and being hosted by Village of Newburg with the topic of investments. 15. Washington County Board Report No Report. 16. Greater Jackson Business Alliance Report. Brian Heckendorf announced the next meeting is Wednesday, June 20 th with State Representatives speaking. The committee is reviewing twenty applications for scholarships. 17. Citizens to Address the Village Board. None 18. Closed Session pursuant to Wis. Stats (1)(e) Deliberating or negotiating the purchase of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session; Regarding matters relating to the Cedar Creek Road Reconstruction project and other pending real estate topics. Motion by Pres. Schwab second by Tr. Lippold to convene into closed session at 8:05 p.m. and to include the Village Board, John Walther, John St. Peter, and Brian Kober. 17 RESOLUTION PRELIMINARY RESOLUTION DECLARING INTENT TO EXERCISE SPECIAL ASSESSMENT POLICE POWERS, UNDER SECTION OF THE WISCONSIN STATUTES WHEREAS, the Village Board of the Village of Jackson, Washington County, Wisconsin is pursuing the construction and reconstruction of public improvements consisting of water and sanitary sewer mains; storm sewers; pavement; curb and gutter; and sidewalks and the related improvements and expenses for the benefit of the properties described on Exhibit A hereto. BE IT RESOLVED, by the Village Board of the Village of Jackson, Washington County, Wisconsin: 1. The Village Board hereby declares its intention to exercise its police power under Section of the Wisconsin Statutes to levy special assessments upon the properties described in Exhibit A hereto, for special benefits conferred upon such property by the construction of public improvements consisting of water and sanitary sewer mains; storm sewers; pavement; curb and gutter; and sidewalks and the related improvements and expenses. 2. The Village Board hereby determines that the construction of such improvements is in the best interest of, and for the health and welfare of the municipality and the property benefited by the improvements, and therefore constitutes an exercise of the police power. 3. The amount of such assessments shall be determined and levied upon completion of the construction of public improvements consisting of water and sanitary sewer mains; storm sewers; pavement; curb and gutter; and sidewalks and the related improvements and expenses. 4. The number of installments, rate of interest, and the terms of payment will be included in the Final Resolution after the Public Hearing; which will be held upon completion of the project, when final costs have been determined. 5. Every Special Assessment levied under this Resolution, shall be a lien against the property assessed, from the date of the Final Resolution of the Village Board determining the levy. 6. The Village Engineer shall prepare a report consisting of the following: a. Preliminary of the final plans and specifications for the Public Works. b. An estimate of the entire cost of the proposed improvements. c. A schedule of the proposed properties against which the assessments are to benefit. d. A statement that each property against which the assessments are proposed, has been inspected and is benefited, setting forth the basis of such benefit. e. 24 ORDINANCE #18-02 AN ORDINANCE ANNEXING TERRITORY TO THE VILLAGE OF JACKSON, WASHINGTON COUNTY, WISCONSIN THE VILLAGE BOARD OF THE VILLAGE OF JACKSON, WASHINGTON COUNTY, WISCONSIN, does ordain as follows: SECTION 1. Territory Annexed In accordance with Wis. Stat., (2) and the Petition for Direct Unanimous Annexation filed with the Village of Jackson and signed by all the owners of the land described below; and the Village Board having determined that there are no electors residing in such territory, the following described territory in the Town of Jackson, Washington County, Wisconsin, is annexed to the Village of Jackson, Washington County, Wisconsin. Annexation Description Being a part of the Southwest ¼ of the Southeast ¼ of Section 7, Town 10 North, Range 20 East, Washington County, Wisconsin, now being more particularly bounded and described as follows: See Attached Exhibits A and B SECTION 2. Effect of Annexation. From and after the date of this ordinance, the territory described in Section 1 shall be a part of the Village of Jackson for any and all purposes provided by law, and all persons coming or residing within such territory shall be subject to all ordinances, rules, and regulations governing the Village of Jackson. SECTION 3. Temporary Zoning Classification. The territory annexed to the Village ofjackson by this ordinance is temporarily zoned PUD, Planned Unit Development, pursuant to Wis. Stat., (8)(a), this temporary zoning having been recommended by the Village of Jackson Plan Commission. SECTION 4. Ward Designation. The territory described in Section 1 of this ordinance is hereby designated the 12 th Ward of the Village of Jackson, subject to the ordinances, rules, and regulations of the Village of Jackson governing wards. 25 SECTION 5. Population of Annexed Area. The population of the territory described in Section 1 of this ordinance is zero (0). SECTION 6. Severability. If any provision of this ordinance is invalid or unconstitutional, or if the application of this ordinance to any person or circumstances is invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the provisions or applications of this ordinance which can be given effect without the invalid or unconstitutional provision or application. SECTION 7. Payment to the Town. Pursuant to Wis. Stat., (14)(a)l, the Village agrees to pay annually to the Town of Jackson, for five (5) years, an amount equal to the amount of property taxes that the Town levied on the annexed territory, as shown by the tax roll under Wis. Stat., 70.65, in the year in which the annexation is final. SECTION 8. Effective Date. This ordinance shall take effect upon its enactment. The Village Administrator is hereby authorized and directed to take such further action necessary to give effect to this ordinance. 29 ORDINANCE #18-04 AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES OF THE VILLAGE OF JACKSON THE VILLAGE BOARD OF THE VILLAGE OF JACKSON, WASHINGTON COUNTY, WISCONSIN, does hereby ordain the following changes to the Village Code: SECTION I. Amending Chapter 2 Article IX. Elections of the Code of Ordinances of the Village of Jackson, Wisconsin, to add Ward 11. Sec WARDS AND POLLING PLACE. Ward 11: Ward 11 has an approximate voter total of 0 (zero) and was attached by Ordinance #18-03 on June 12, Ward 11 is comprised of: State Senate District 20, State Assembly District 60, Washington County Supervisory District 14, Germantown School District, and Milwaukee Area Technical College District. Trustee Malcolm called the meeting to order at 7:10 p.m. Members present: Brian Heckendorf, Gloria Teifke, Tr. Malcolm and Tr. Lippold. Members excused: Chair Olson and Linda Granec Members absent: Scott Thielmann Staff present: Brian Kober and Jilline Dobratz. 2. Approval of Minutes for May 29, 2018, meeting. Motion by Tr. Lippold, second by Brian Heckendorf to approve the minutes of the May 29, 2018 Board of Public Works meeting. Vote: 4 ayes, 0 nays. Motion carried. 3. Review of final Pay Request Chateau Drive Reconstruction Project. Brian Kober reported a final walk through was conducted on June 7, 2018 and no major items were found. Motion by Tr. Lippold, second by Tr. Malcolm to recommend approval to pay $19, to Buteyn-Peterson Construction Co., Inc. Vote: 4 ayes, 0 nays. Motion carried. 4. Review of Resolution # Adopting 2017 CMAR Jackson Wastewater Plant. Brian Kober reviewed the annual report submitted to the DNR for discharges and performances for the plant. He stated last year we went into a new permit for 5 years. He reported six different leaks on the utility side were repaired, tightening up the system. The overall rating is above average. Motion by Tr. Malcolm, second by Gloria Teifke to recommend approval of Resolution #18-16 Adopting the 2017 Compliance Maintenance Annual Report for the Jackson Wastewater Plant. Vote: 4 ayes, 0 nays. Motion carried. 5. Review of Resolution # Preliminary Assessment TID #6 (Rosewood Lane) Project. Brian Kober reviewed the preliminary assessment for the Rosewood Lane Project. It is a total road improvement, a brand new road. The TID will pay for half, and the property owners on the south side of Rosewood Lane will pay for the other half of the improvements. Brian gave cost estimates associated with the assessments. Motion by Tr. Malcolm, second by Brian Heckendorf to recommend approval of Resolution #18-17 Preliminary Assessment for the Rosewood Lane Project as presented. 34 6. Review of Pay Request # Utility Improvements Project. Brian Kober reviewed pay request #2 for the 2018 Utility Improvement Project. Paving has been finished and Sherman Road has been landscaped. Motion by Brian Heckendorf, second by Tr. Lippold to recommend to Budget & Finance and Village Board approval of Pay Request #2 from Vinton Construction Company for 2018 Utility Improvements Project in the amount not to exceed $110, Vote: 4 ayes, 0 nays. Motion carried. 7. Review of Resolution # Preliminary Assessment Highland Road Water Main Project. Brian Kober explained that the development, Exhibit A, will be special assessed along with the property on the corner of English Oaks Drive. Single family homes are intended to be constructed on lots, but have not yet been built. Motion by Tr. Malcolm, second by Tr. Lippold to recommend approval of Resolution #18-18 Preliminary Assessment Highland Road Water Main Project. Vote: 4 ayes, 0 nays. Motion carried. 8. Director of Public Works report. Brian Kober gave the report. Discussion on the old Park and Ride. The County will be reopening it for the duration of the CTH P reconstruction project. Motion by Tr. Concept Plan Stonewall Ridge Site Plan Revisions/Density Reduction Kurt Henning was present to explain the project. This project was approved 12 years ago and he is now proposing to reduce the 12-family units to 8-family units. The driveways would remain the same, but the buildings would be smaller and will have more green space. The 4-family units would be changed to 2-family units and have 2 garages instead of 4. Also, they would possibly like to make 1 or 2 commercial spaces and a storage garage for the use of the condo association. Jim Micech stated the original plan was approved for more commercial space and it is now being reduced; it s a concept plan right now. Motion by Pres. Schwab, second by Peter Habel to recommend the Village Board approve the concept plan for Stonewall Ridge as presented and per staff comments. Vote: 7 ayes, 0 nays. Motion carried. 5. Citizens to Address the Plan Commission There were no citizens to address the Commission. 6. Adjourn Motion by Peter Habel, second by Brian Emmrich to adjourn. Vote: 7 ayes, 0 nays.
