1 MINUTES CITY OF DELANO CITY COUNCIL REGULAR MEETING June 5, 2017 CALL TO ORDER Mayor Morris called the meeting to order at 5:30 p.m. in the City Hall Council Chambers, th Avenue. Councilman Aguirre offered the invocation. Councilman Hill led the flag salute. INVOCATION FLAG SALUTE ROLL CALL Council members present: Joe Aguirre, Ruben Hill, Liz Morris, Rueben Pascual, Grace Vallejo Council members absent: none OFFICIALS PRESENT City Manager Reyna, Deputy City Clerk Castellanos, Police Chief DeRosia, City Engineer Dowling, Human Resources Director Zamudio, Finance Director Rios No items PRESENTATIONS AND AWARDS ITEMS FROM THE PUBLIC Roberto Ibarra stated that City alleys have a lot of trash and noted that a mattress was left in front of the hospital. He requested clean city signs be installed. Richard Markman stated that there is a lot of trash in alleys; the street in front of Pacific Tires is confusing and something needs to be done with that intersection; the Delano Police Department and the Chief of Police is corrupt. Ms. Herrera asked why the bus shelter on Albany and 11 th Ave was taken out. Ralph Markman commented that the Delano Police Department and Chief of Police are making sure that all Delano residents are safe and protected. CONSENT AGENDA 1) Authorization to waive the reading of any ordinance or resolution in its entirety and consenting to the reading of such ordinances or resolutions by title only 2) Warrant Register in the amount of $3,692, ) Minutes of regular City Council meeting of May 15, ) Approval of service agreement with Correctional Consulting Services LLC to provide a Prison Rape Elimination Act (PREA) audit of the Delano Modified Community Correctional Facility and authorize the City Manager to execute the agreement Agreement No ) Authorization for Kern County to submit to CalRecycle a regional application for the Used Oil Payment Program (OPP) fiscal year

2 6) Approval of Subdivision Agreement with LeOra, LLC for Tract 6327 Phases A & B located on Del Sol Avenue, one quarter mile east of Albany Street Agreement No (Phase A) Agreement No (Phase B) 7) Award the franchise contract for Multi-Family Residential and Commercial Recycling Collection Services to South Tulare-Richgrove Refuse Inc. (Six Year Term, beginning July, 2017 Agreement No ) Approval of agreement with Safe Moves to provide school traffic safety education and public outreach services for the ATP Safe Routes to School (SRTS) project # APTL (053) at various schools in Delano and authorize the City Manager to sign the agreement Agreement No ) Release funds from developer escrow account to the Vineyard Retail Center (Delano Market Place II) per the Memorandum of Understanding No for the required offsite improvements in the amount of $129, for payment application no ) Approve the revised employment contract for the City Manager effective June 5, 2017 CM Agreement No ) Approval of temporary easement agreement with Southern San Joaquin Municipal Utility District to carry out the 2017 Groundwater recharge pilot project at the Woollomes & Stradley storm drain sump Agreement No ) Approve the Memorandum of Understanding between the City and miscellaneous employee unit and adopt Resolution No of the City Council of the City of Delano adopting the miscellaneous unit salary schedule and authorize the Finance Director to appropriate funds Agreement No ) Approve the Memorandum of Understanding between the City and the management employees group and adopt Resolution No of the City Council of the City of Delano adopting the new department head salary schedule and authorize the Finance Director to appropriate funds Agreement No ) Resolution No approving the revised Department Director personnel salary schedule to reflect the equity adjustments; and adopt Resolution No approving the revised format for Department head contracts and authorize the City Manager to negotiate terms and conditions, effective June 10, ) Resolution No approving the lease agreement between the City of Delano and Mr. Ross Ferguson at the Delano Municipal Airport Agreement No ) Resolution No of the City Council of the City of Delano approving the donation of one surplused sideloader refuse truck and a decommissioned van to Sister City in Tangancicuaro Mexico 17) Resolution No approving the extension of water service to County Line Road Members of the public asked that items #8 and #17 be pulled for discussion. Moved by Councilwoman Vallejo, seconded by Councilman Pascual, and unanimously carried to approve the consent agenda with items #8 and #17 pulled for discussion.

3 Item #8) Jose Ramos stated that he resides at Lytle Road and addressed his concerns regarding the safety of the children walking a mile to the bus stop between Casey and County Line Road to Cecil Ave. He asked for help on providing safety for the children. Councilwoman noted that Safe Routes to School item is not an infrastructure project; it s for safety education and public outreach. She mentioned that Mr. Ramos can meet with Mr. Dowling, Public Works Director regarding the possible improvements in that area. Mr. Dowling noted that this location is Kern County s jurisdiction. Ms. Reyna stated that staff can meet with Mr. Ramos and contact Kern County to discuss the issue. Moved by Councilwoman Vallejo, seconded by Councilman Pascual and unanimously carried to approve item #8. Item #17 Lupe Martinez asked if the water service provided is metered or a flat rate. Mr. Dowling replied that the water service will be metered with a 30 percent surcharge. Moved by Councilman Pascual seconded by Councilman Hill, and unanimously carried to approve item #17. 18) Public Hearing No : Resolution No of the City Council of the City of Delano confirming the benefit assessment of all maintenance districts within the City of Delano for fiscal year and authorizing the County of Kern to make collections of same Mr. Dowling presented the staff report. He stated that this is to establish the annual assessment of maintenance districts within the City. He noted that the only change is the addition of Tract 6326 Phase A and a portion of Phase B. Mayor Morris asked for public comments. Richard Markham asked is this for alleys or streets. Mr. Dowling stated that it includes the maintenance of block walls, lighting, and storm drain systems in the district areas. Mayor Morris closed the public hearing. Moved by Councilman Pascual, seconded by Councilwoman Vallejo, and unanimously carried by all those present to adopt Resolution No confirming the benefit assessment of all maintenance districts within the City of Delano for fiscal year and authorizing the County of Kern to make collections of same REGULAR AGENDA 19) Designation of voting delegate and alternate for the 2017 League of California Cities Annual Conference September 13-15, 2017, in Sacramento Ms. Reyna presented the staff report. It was the consensus of the City Council to designate Councilman Aguirre the voting delegate and Councilman Pascual as alternate. 20) Discussion and direction on opposition or support of Assembly Bills 176, 188, 290, 326, 463, 763, 1147, and 1374

4 Moved by Councilwoman Vallejo, seconded by Councilman Pascual, and unanimously carried to table this item to receive clarification on Assembly Bills from Assemblymember Rudy Salas or his representative. 21) Discussion on the possible cancellation of regular City Council meeting scheduled for July 3, 2017 Moved by Councilwoman Vallejo, seconded by Councilman Hill and unanimously carried to cancel July 3, 2017 regular City Council meeting. No items. DEPARTMENTAL REPORTS COUNCIL STATEMENTS AND REPORTS Councilman Hill noted that alleys, front yards, and business frontages have a lot of trash. He mentioned that business owners think that the City is responsible to clean the frontage area. Businesses need to be informed that they are responsible. Direction was given to staff to bring back item to discuss the cleanup of alleys, fronts yards, and business frontages. Councilwoman Vallejo announced that the water parks will be open and invited everyone to bring their children. Councilman Aguirre none Councilman Pascual none Mayor Morris none CLOSED SESSION Moved by Councilwoman Vallejo, seconded by Councilman Hill, and unanimously carried that the City Council adjourn to Closed Session at 6:08 p.m. The City Clerk was excused. Mayor Morris was appointed Acting City Clerk.
