11 CITY OF GRAIN VALLEY BOARD OF ALDERMEN MEETING MINUTES Regular Session 06/26/2017 PAGE 3 OF 14 Motion to Approve Consent Agenda was voted on with the following voice vote: o Aye: Arnold, Bamman, Coleman, Headley, Totton, West o Nay: None o Abstain: None -MOTION APPROVED: 6-0- ITEM X: PREVIOUS BUSINESS Cannon Street Discussion o Mr. Switzer addressed the Board, reminding them of the discussion to add curb to Cannon Street; Mr. Switzer handed out a copy of Public Works project #5; Mr. Switzer stated the project description overviews overlaying streets and adding curbs; the street has been overlayed but curbs have not been completed o Mr. Switzer stated he has been waiting since 2006 to finish his driveway as he wants the roadwork to be completed; city staff has referred to the need to put in water lines and sewer when completing the project; Mr. Switzer noted this wasn t described in the scope of work in the document and he wasn t asking for the city to complete all this work o Alderman Totton asked when this was scheduled to be completed; Mr. Switzer stated two years ago; Alderman Totton reminded the Board that Front Street was scheduled to be completed first o Mr. Murphy reminded the Board that last year the overlay plan was approved which overlayed every road in the older part of Grain Valley; the next phase is 2B which is Front Street; in the current CIP, the remaining downtown projects are not even in the 5 year plan due to funding being unidentified; all downtown projects had curb, gutter, and sidewalk upgrades in the plans; water/sewer is listed in the document under costs o Mayor Todd reminded the Board that if improvements were made, they needed to be completed well and in whole; Mr. Switzer asked for 150 feet of curb; Mr. Murphy stated that the roads weren t complete, the overlay is not a permanent fix and there is still more work to do o Alderman Arnold felt that it wouldn t be that much expense to put in the curb; Alderman Totton shared that Front street was having structural issues; Mr. Arroyo shared the overlays from last year were for maintenance and the road is not complete; if curbs are put in then they will have to be torn out when roads are fully completed; Mr. Arroyo noted essentially a drive approach is the main point of discussion and the city typically does not provide drive approaches o Mayor Todd recapped the options: curb, which can t be done without changing the profile of the road or concrete approach which the city could not justify; Mr. Murphy shared a property owner can put an approach in at any time; parking in ELECTED OFFICIALS PRESENT Mayor Mike Todd Alderman Dale Arnold Alderman Chris Bamman Alderman Jeff Coleman Alderman Bob Headley Alderman Nancy Totton Alderman Yolanda West ELECTED OFFICIALS ABSENT STAFF OFFICIALS PRESENT City Attorney Jim Cook City Administrator Ryan Hunt Assistant City Administrator Ken Murphy City Clerk Theresa Osenbaugh Community Development Director Rick Arroyo Chief David Starbuck

12 CITY OF GRAIN VALLEY BOARD OF ALDERMEN MEETING MINUTES Regular Session 06/26/2017 PAGE 4 OF 14 yards is an enforcement issue, even on roads with curbs parking in yards still occurs o Alderman Bamman asked for a timeline; no timeline is in place; project is related to reimbursement o Alderman Arnold stated the City generally would like businesses to have a concrete approach, Mr. Switzer has been held up 10 years and the City doesn t know when they will be able to finish the road; Mr. Hunt clarified that this can be done at any point but the City will not pay for the approach; if an approach is completed and the City later tears it up, then the City would fix the approach; Mr. Switzer shared the ask was for the City to do the curbs o Alderman Totton asked if the dumpster was always in the front of the property in discussion; Alderman Totton shared dumpsters should be in the back unless they are being picked up within 24 hours o Mr. Hunt summarized that an approach can be put in at any time; Mr. Arroyo s professional option stated that the profile of the road would need to be changed, including the elevation; the City should not spend money on something that will be torn up and reworked in the future Solid Waste Collection: o Ms. Osenbaugh provided a spreadsheet summarizing other local municipalities fees and processes regarding trash collection; most cities have various approaches to trash collection and there is not a standard way that the majority of cities are operating o Mayor Todd asked for clarification on the business license cost; this is the cost for any business operating in each city; any charges specific to trash haulers were noted in a separate column o Mayor Todd pointed out that delivery days don t seem to be regulated by the city in most situations ITEM XI: NEW BUSINESS Liquor License Renewals o Mayor Todd asked that the Board discuss the liquor license EIE, LLC dba Whiskey Tango separate from the rest of the renewal applications o Ms. Osenbaugh shared the initial paperwork has been received for all applications; applicants will be asked to provide a copy of their state and county licenses before the city license is issued; Chief Starbuck has approved the applications currently discussed, noting that Whiskey Tango is not part of the discussion o Mayor Todd read the list of liquor license renewals and opened the floor for a ELECTED OFFICIALS PRESENT Mayor Mike Todd Alderman Dale Arnold Alderman Chris Bamman Alderman Jeff Coleman Alderman Bob Headley Alderman Nancy Totton Alderman Yolanda West ELECTED OFFICIALS ABSENT STAFF OFFICIALS PRESENT City Attorney Jim Cook City Administrator Ryan Hunt Assistant City Administrator Ken Murphy City Clerk Theresa Osenbaugh Community Development Director Rick Arroyo Chief David Starbuck

13 CITY OF GRAIN VALLEY BOARD OF ALDERMEN MEETING MINUTES Regular Session 06/26/2017 PAGE 5 OF 14 motion to approve the liquor license renewals for : - Burgess Renovations, LLC dba Valley Pub & Patio - Casey s General Store # Casey s General Store # Casey s General Store # The Crow s Nest Saloon, LLC dba Charley s Roadhouse - Discount Liquor & Smokes - Dollar General Store # Grain Valley Chamber of Commerce - Grain Valley Market, LLC - Grain Valley Truck Stop & Food Center dba Conoco Travel Center - Impact Motor Sports, LLC dba Valley Speedway - JY Amigos, Inc, dba El Maguey Alderman Arnold made a Motion to Approve Liquor License Renewals The Motion was Seconded by Alderman Totton o No Discussion Motion to Approve Liquor License Renewals was voted on with the following voice vote: o Aye: Arnold, Bamman, Coleman, Headley, Totton, West o Nay: None o Abstain: None -MOTION APPROVED: 6-0- EIE, LLC dba Whiskey Tango o Chief Starbuck provided information regarding police response to Whiskey Tango; Grain Valley Police Department and Shawn Brown, owner of Whiskey Tango, met in March, 2016 to discuss incidents occurring at or in relation to Whiskey Tango; strain is put on officers when responding to multiple calls in one location; Chief Starbuck shared that at the March meeting, he noted if things did not improve in a year s time, a recommendation of denial for a 3AM license would be made to the Board; concerns regarding firearms inside the premises were discussed; majority of police calls at the establishment happen after 1AM;large scale incidence often require response from neighboring departments; police officers responding have been injured and are at risk for injury; Chief Starbuck recommends that the Class M, 3AM license is not renewed for Whiskey Tango o Shawn Brown, owner of Whiskey Tango, addressed the Board; no citations of violations have been received from the City, State, or County; incidents after 3AM are not occurring inside the bar, possibly in the parking lot; Mr. Brown thought concerns were resolved and has not been contacted since the meeting in ELECTED OFFICIALS PRESENT Mayor Mike Todd Alderman Dale Arnold Alderman Chris Bamman Alderman Jeff Coleman Alderman Bob Headley Alderman Nancy Totton Alderman Yolanda West ELECTED OFFICIALS ABSENT STAFF OFFICIALS PRESENT City Attorney Jim Cook City Administrator Ryan Hunt Assistant City Administrator Ken Murphy City Clerk Theresa Osenbaugh Community Development Director Rick Arroyo Chief David Starbuck

14 CITY OF GRAIN VALLEY BOARD OF ALDERMEN MEETING MINUTES Regular Session 06/26/2017 PAGE 6 OF 14 March; Mr. Brown is more than willing to work with the police department to correct any incidents; Whiskey Tango will go out of business without the Class M license approval; revenue to the City is significant; there is a lot of information to consider in this situation o Mayor Todd asked what type of training is given to the staff of Whiskey Tango; Mr. Brown shared that staff are trained when hired; Mayor Todd asked if screening procedures are place to determine if someone is intoxicated before being let into the bar; staff are trained to not let patrons in who are already heavily intoxicated o Mayor Todd stated the Board doesn t want to take action that will shut Whiskey Tango down but also wants to support the City s police officers; Mayor Todd asked if setting up a committee and an action plan would be an agreeable option; Chief Starbuck agreed and clarified he has no interest in putting anyone out of business o Chief Starbuck shared knowledge of patrons in the bar after 3AM and also allowing firearms in the building; any taskforce created would need to come up with specific measurements for improvement o Mayor Todd asked City Attorney Jim Cook for clarification on a 6 month review; if a review is conducted at 6 months and warrants a revocation of a 3 AM license, all liquor licenses will need to be revoked for the establishment; the reports and statistics being discussed today would be considered in addition to the statistics over the 6 month period; Chief Starbuck clarified that he does not expect business owners to keep track of the number of DUI s coming from their business but that those statistics were shared in an effort to show the level of intoxication occurring at Whiskey Tango o Alderman Totton would like to see a committee created with civilians; Mayor Todd didn t think the board in discussion would be a citizen board; Alderman Totton thanked Harley at Charley s Roadhouse for allowing her in the bar and answering all her questions; Alderman Totton also visited Whiskey Tango and had her ID checked and was wanded ; Alderman Totton shared that she didn t see any problems o Mayor Todd asked for a motion to approve the liquor license application for EIE, LLC dba Whiskey Tango Classes F, G, H, I, and M with an understanding that in 6 months, the status will be reviewed and if at that time, conditions and outcomes are deemed unfavorable, the process for revocation of all licenses will begin Alderman Bamman made a Motion to Approve EIE, LLC dba Whiskey Tango s Liquor License Renewal ELECTED OFFICIALS PRESENT Mayor Mike Todd Alderman Dale Arnold Alderman Chris Bamman Alderman Jeff Coleman Alderman Bob Headley Alderman Nancy Totton Alderman Yolanda West ELECTED OFFICIALS ABSENT STAFF OFFICIALS PRESENT City Attorney Jim Cook City Administrator Ryan Hunt Assistant City Administrator Ken Murphy City Clerk Theresa Osenbaugh Community Development Director Rick Arroyo Chief David Starbuck

15 CITY OF GRAIN VALLEY BOARD OF ALDERMEN MEETING MINUTES Regular Session 06/26/2017 PAGE 7 OF 14 The Motion was Seconded by Alderman Arnold o Alderman Coleman asked for clarification on who would set the expectations; Mayor Todd stated the appointed committee would set expectations; Alderman Coleman voiced concerns on both parties being agreeable to the expectations after the license has been approved; Mr. Hunt shared it is very important to select the right committee members as expectations will be left in their hands; Alderman Coleman emphasized the need for this to be a team approach as the consequences of not meeting the expectations are great; Mr. Hunt reminded the Board that in 6 months, the Board of Aldermen would have the final say if the license is revoked; Mr. Cook shared regardless if expectations are met, exceeded, or not obtained, if a continuing pattern of incidents and officer s being put at risk occurs, that is a separate track for revocation; guidelines can be met (better training, etc.) but if ongoing problems still occur, the recommendations may not be enough and discussions may need to continue; Alderman Headley asked to be considered for the committee Motion to Approve EIE, LLC dba Whiskey Tango s Liquor License Renewal was voted on with the following voice vote: o Aye: Arnold, Bamman, Coleman, Headley, Totton, West o Nay: None o Abstain: None Pathways of Honor o Mr. Combs and Mr. Switzer provided an update on the tribute to veterans in Butterfly Park; the Board approved the location of the tribute at a past meeting; the location will be being move slightly for easier ADA access; Mr. Arroyo and the Parks Board have reviewed the plans and are ok with the location; work on the tribute may begin as early as next month 2017 Fireworks Discharge Regulations o 4 th of July falls on Tuesday; current City ordinance allows for fireworks to be discharged on Monday, Tuesday and Wednesday; this eliminates the weekend; the ordinance can be adjusted to include the weekend or the ordinance can remain and be nearly unenforceable; this is a situation where the decision will be unable to please everyone; Alderman Headley does not have an issue with allowing fireworks on Friday, Saturday and Sunday; there is really is no way to stop discharge of fireworks due to the number of those participating o Mayor Todd asked for a motion to extend fireworks discharging to June 30, July 1 st, and July 2 nd with the last day still being on July 5 th ; times will remain the same ELECTED OFFICIALS PRESENT Mayor Mike Todd Alderman Dale Arnold Alderman Chris Bamman Alderman Jeff Coleman Alderman Bob Headley Alderman Nancy Totton Alderman Yolanda West ELECTED OFFICIALS ABSENT STAFF OFFICIALS PRESENT City Attorney Jim Cook City Administrator Ryan Hunt Assistant City Administrator Ken Murphy City Clerk Theresa Osenbaugh Community Development Director Rick Arroyo Chief David Starbuck

16 CITY OF GRAIN VALLEY BOARD OF ALDERMEN MEETING MINUTES Regular Session 06/26/2017 PAGE 8 OF 14 Alderman Headley made a Motion to extend the fireworks discharge dates The Motion was Seconded by Alderman Coleman o No Discussion Motion to Approve extension of fireworks discharge dates was voted on with the following voice vote: o Aye: Arnold, Bamman, Coleman, Headley, Totton, West o Nay: None o Abstain: None Police Academy Sponsorships o Mayor Todd opened a discussion on police academy sponsorships; there have been times when the police department is not fully staffed; recruitment has been difficult; several police departments identify candidates before they go to the academy; cities sponsoring academy recruits often use a 3 year contract (or similar) in exchange for the city paying for the academy cost; recruits are also provided a salary while in the academy o Alderman Totton asked where funding would come from; the money would come from the general fund o Mayor Todd asked if the department was fully staffed currently; two newest hires are on field training and doing well; this leaves the department one officer short; recruitment has been extended outside of Blue River to get qualified candidates o Alderman Headley suggested the money could initially come from attrition and then be budgeted in future years o Mr. Hunt shared this could be set as a personnel policy or a special program; a new position would be created, police recruit so the compensation plan would need to be updated as well as a legal contract for a 3 year term; policies and procedures would need to be created; next steps are to put a plan together and bring it back to the Board for consideration o Mayor Todd asked for clarification on the 3 year contract; this is 3 years from the start date on the road o Alderman Totton asked how many sponsorships were being considered; sponsorships would be available whenever a position is open; Chief Starbuck would recommend that recruits go through the Kansas City Regional Academy; classes start on a specific schedule; total cost would be approximately $6,500; some recruits do not make it through the academy so that needs to be considered; contracts could be written to address this o Mayor Todd suggested that when positions are available, certified officers are still considered before sending someone through the academy; Chief Starbuck shared that often prospective candidates have degrees, are suitable candidates but for one ELECTED OFFICIALS PRESENT Mayor Mike Todd Alderman Dale Arnold Alderman Chris Bamman Alderman Jeff Coleman Alderman Bob Headley Alderman Nancy Totton Alderman Yolanda West ELECTED OFFICIALS ABSENT STAFF OFFICIALS PRESENT City Attorney Jim Cook City Administrator Ryan Hunt Assistant City Administrator Ken Murphy City Clerk Theresa Osenbaugh Community Development Director Rick Arroyo Chief David Starbuck
