1 MINUTES OF OCTOBER 16, 2018 REGULAR MEETING OF THE CORTE MADERA TOWN COUNCIL AND THE BOARD OF SANITARY DISTRICT NO. 2, A SUBSIDIARY DISTRICT TO THE TOWN OF CORTE MADERA Mayor Ravasio called the Regular Meetings to order at Town Hall Council Chambers, 300 Tamalpais Drive, Corte Madera, CA on at 6:32 p.m. 1. CALL TO ORDER, SALUTE TO THE FLAG, ROLL CALL Councilmembers Present: Councilmember Absent: Staff Present: Mayor Ravasio; Vice Mayor Andrews and Councilmembers Bailey, Beckman and Kunhardt None Town Manager Todd Cusimano Town Attorney Teresa Stricker Director of Planning Adam Wolff Civil Engineer Fernanda Stefanick Fire Chief Scott Shurtz Town Clerk/Assistant to the Town Manager Rebecca Vaughn SALUTE TO THE FLAG Mayor Ravasio led in the Pledge of Allegiance. 2. OPEN TIME FOR PUBLIC COMMENT DAVID HYAMS, Enterprise Drive, recommended a future agenda item relating to the recent report and its findings on climate change. PETER POSERTY, Novato, introduced himself to the Council, stating he was hired by Solar Craft and spoke of their goal to convert homes to zero carbon. 3. PRESENTATIONS 3.I Celebration and Presentation of Awards in Honor of Pauline Angleman s 110 th Birthday Awards will be presented and cake will be served The Town Council recognized Pauline Angleman in honor of her 110 th birthday. Mayor Ravasio commented that Ms. Angleman was featured in the Marin Independent Journal a couple of times, she grew up in Oklahoma, which only become a state the year before her birth, her father was a homesteader and when asked what it was like, she said she grew up with Indians and outlaws. She moved to Marin in 1958 and retired as President of the Ladies Auxiliary for Twin Cities Post 313 of the American Legion at the age of 104. Her advice to people is to take care of themselves to the best of their ability, watch what you eat and above all, be nice to people. Mayor Ravasio presented letters and accolades from Governor Jerry Brown, Lt. Governor Gavin Newsom, Senator Dianne Feinstein, Senator Kamala Harris, Congressman Jared Huffman and Assemblymember Marc Levine. From the County of Marin Board of Supervisors, Supervisor Dennis Rodoni was present and shared happy birthday wishes and congratulated her on her 110 th birthday. Pauline Angleman likened this to a habit, one of which she very much enjoys. She said if people wonder as to why she is 110 and still getting around she said she is just as confused as most people are and thanked everybody. Mayor Ravasio presented Ms. Angleman with a card from the entire Town. He also
2 2 announced Councilmember Beckman s birthday, as well. RECESS Mayor Ravasio called for a brief recess to celebrate with cake and refreshments, and thereafter, reconvened the regular meeting. 4. CONSENT CALENDAR 4.I TOWN ITEMS Councilmember Kunhardt commented on Item 4.I.ii, stating this afternoon he and Councilmember Beckman attended an event at the Civic Center, along with several local officials in attendance to celebrate the acquisition of 2 all-electric buses by Marin Transit Authority, which he briefly described. 4.I.i Authorize Introduction and/or Adoption of Resolutions and Ordinances by Title Only. BUSINESS ITEMS 6.I TOWN BUSINESS ITEMS: 6.I.i Consideration and Possible Action to Approve Resolution No. 57/2018, Adopting Proposed Amendments to Central Marin Fire Joint Powers Authority Agreement Between the Town of Corte Madera and the City of Larkspur (Report from Todd Cusimano, Town Manager) Town Manager Todd Cusimano stated this has been an on-going work in progress since 2012 with the City of Larkspur and the Town of Corte Madera. They adopted the JPA on August 15, 2017 creating the Central Marin Fire Authority and a statewide issue occurred with CalPERS which put a halt on all future JPAs until they worked through a legislative issue. They worked through it and now the Town has their name on the issue of solving it for this JPA and future JPAs. The Internal Revenue Service (IRS) and CalPERS had an understanding with an IRS regulation dating back to Since then, the CMPA was the last JPA formed in the state for a CalPERS contract. They came back trying to consolidate with Larkspur and after staff testified at a CalPERS Board meeting, it became clear that they had to solve the IRS issue and Teresa Stricker, the Town Attorney, problem-solved this issue. They now have come to a verbal agreement with CalPERS which the JPA Amendment reflects. There is minor clean-up language beginning on page 2 and the Fire Authority Secretary will be Town Clerk Rebecca Vaughn, Fire Authority Director will be Finance Director Daria Carrillo and he will be the Executive Manager Year 1 of the Authority. Sections 4.3, 8.1 through 8.5 are the amendments on pages 2 and 3 with CalPERS and he summarized that previous unfunded liabilities stay with the member agencies. As they move forward, they are sharing all costs 50/50 unless the Council votes to change that. This mirrors CMPA and he contemplated making some of the same revisions for that JPA, as well. He recognized Fire Chief Shurtz and his staff for working through many human resource issues and as a result, the Town and City have better service. He confirmed that next steps are for Larkspur to approve the JPA amendments at their meeting tomorrow evening, the paperwork will be submitted to CalPERS and they plan on being operational by January 1, 2019 or before. Mayor Ravasio opened the public comment period, and there were no speakers. Councilmembers recognized the work and voiced their support. Mayor Ravasio recognized that this work began long ago when they met with Larkspur Councilmembers with the goal of achieving better service and cost savings. He recognized all fire personnel, the Town Manager, Larkspur City Manager and Ms. Stricker. Moved by Bailey, seconded by Andrews, and approved unanimously To Approve Resolution No. 57/2018, Adopting Proposed Amendments to Central Marin Fire Joint Powers Authority Agreement Between the Town of Corte Madera and the City of Larkspur 6.I.ii Consideration and Possible Action to Approve (1) Resolution No. 58/2018 Authorizing the Town Manager to Negotiate and Execute an Agreement with Hinderliter, de Llamas and Associates (HdL) for
4 4 Transactions and Use Tax Audit and Information Services for the Base Amount of $6,600 Per Year Plus Additional Contingency Fees; and (2) Resolution No. 59/2018 Authorizing Examination of Sales, Use and Transactions Tax Records (Report from Todd Cusimano, Town Manager and Daria Carrillo, Finance Director) Town Manager Cusimano said HdL provides services to over 390 public entities, many in California and in Marin County. San Rafael and Vallejo were cities staff reached out to conduct a reference check. The Town seeks to review and audit its sales tax revenues to ensure the Town is getting everything they should receive and HdL provides this for $6,600 and they receive a percentage for any revenues found which the Town is not receiving. The Town also plans for its future infrastructure with sales tax monies and he believes the analysis is important. The Town will receive a quarterly report of broken down sales tax revenues, and noted Ken Nordoff is a retired City Manager for San Rafael and Walnut Creek and is part of this team. They also provide analysis to Town Managers and Finance Directors of where their vulnerabilities exist and what to think about moving forward, and they believe the Town could see as much as $30,000 to $100,000 in revenues potentially due to the Town and he recommended the Council consider the agreement. Councilmember Kunhardt said having acquired an electric vehicle, he noted sales tax was calculated for it based upon where he lives at 9.0%. He asked and confirmed with Mr. Cusimano that this tax makes its way through the State and onto the Town. Some of the mistakes may be found by car dealers, and HdL tracks this and determines any errors which may result in additional monies to the Town. Councilmember Beckman asked and confirmed that HdL would audit what is coming into the Town, capturing any losses, and the Citizens Oversight Sales Tax Committee will ensure the Town uses those sales taxes properly. Moved by Bailey, seconded by Beckman, and approved unanimously To Approve (1) Resolution No. 58/2018 Authorizing the Town Manager to Negotiate and Execute an Agreement with Hinderliter, de Llamas and Associates (HdL) for Transactions and Use Tax Audit and Information Services for the Base Amount of $6,600 Per Year Plus Additional Contingency Fees Moved by Bailey, seconded by Beckman, and approved unanimously To approve Resolution No. 59/2018 Authorizing Examination of Sales, Use and Transactions Tax Records. 6.I.iii Consideration and Possible Action to Expand Composition of the Ad Hoc Finance Committee to Include Up to Three Community Members and Appoint Annette DiSano, Laurence Reed and Karl Spurzem to Serve on the Committee (Report from Rebecca Vaughn, Town Clerk/Assistant to the Town Manager and Todd Cusimano, Town Manager) Mr. Cusimano recognized Town Clerk Rebecca Vaughn for preparing the staff report and researching the matter. He said last year, the ad hoc committee was formed to review the audit and the difficult, high level, financial issues and then present those items to the
5 5 Council. The direction of the Council at that time was to add one more member and the Town received three applications, met with all three candidates, and staff recommends accepting all three to have an ad hoc committee composed of the Vice Mayor, the Finance Director, Town Manager and the three applicants to review and problem-solve all financial matters of the Town and then vet issues with other committees and then present them to the Council. Councilmembers thanked the three applicants for their future service with the Town. Mayor Ravasio opened the public comment period, and there were no speakers. Moved by Beckman, seconded by Bailey, and approved unanimously To Expand Composition of the Ad Hoc Finance Committee to Include Up to Three Community Members. Moved by Beckman, seconded by Bailey, and approved unanimously To Appoint Annette DiSano, Laurence Reed and Karl Spurzem to Serve on the Committee on an as-needed basis until the ad hoc committee is dissolved. 6.II SANITARY DISTRICT BUSINESS ITEMS: None 7. COUNCIL AND TOWN MANAGER REPORTS - Town Manager Report He thanked the Fire Department for their specialized training with Councilmembers Beckman and Kunhardt. An Open House was held at CMFA this Saturday with tours of the station and it was a well-attended event. The Oktoberfest was held on Saturday also and put on by the Beautification Committee. They had increased revenues from the previous year. They are continuing efforts on notifications of Red Flag Warnings in the area and working closely with PG&E to inform the community of their efforts moving forward. The RFP for the Climate Adaptation Plan is in process. They are expanding Wood Chipping Day by bringing the wood chipper to neighborhoods. Meadowcrest will be the first neighborhood to use the chipper and if successful, it will be expanded to other neighborhoods. He recognized Marla and Peter Orth for the idea. A staff training will be held in November followed by free training for the community for CPR and First Aid. Vice Mayor Andrews stated one document mentioned the original formation of the sewer district would include who is responsible for what and he asked if he could obtain a copy of this, to which Mr. Cusimano agreed. - Council Reports Councilmember Kunhardt reported that the Christmas Tree Hill NRG is planning an evacuation drill on November 4 th at 10AM, evacuating to Menke Park. He and Councilmember Beckman attended Fire Ops 101 Day which was very memorable. He reported that the letter to MTC and the Planning Group for Hwy 37 rebuild did go forward requesting $15 million for planning
6 6 work to raise the western portion which is near the Petaluma Creek which flooded last year. Councilmember Beckman also reported attending the Fire Ops 101 and thanked those who put on the training. He also toured Central Marin Sanitation Agency s (CMSA) plant on Andersen Drive which was informative. General Manager Jason Dow provided him with a thorough history and overview of the plant s operations. Yesterday he attended a planning meeting for the Age-Friendly Intergenerational Center to discuss present and future programming and a possible public/private partnership and he presented and distributed their program catalog to Councilmembers. Councilmember Bailey congratulated the Corte Madera Lions Club and Community Foundation for an excellent Oktober Fest this weekend, as well as for Councilmember Kunhardt s attendance for him at the MCE meeting. Vice Mayor Andrews had no report. Mayor Ravasio reported attending a meeting of the MCCMC Homeless Committee last Wednesday and recent statistics showed they have provided 1,053 showers in San Rafael and Novato. Amazingly, of those they have gotten 7 people fully employed, 3 people into full-time housing, 7 people into medical care, and reunited a person with his family back in Mississippi. They also had a presentation regarding Whole Person Care where people are being brought into the system, getting everything electronically registered through County programs so their resources are identified, resulting in ongoing progress. 8. REVIEW OF DRAFT AGENDA FOR UPCOMING TOWN COUNCIL MEETING 8.I Review of Draft Agenda for November 6, 2018 Town Council Meeting (Note Change of Meeting Date from Tuesday, November 6, 2018 to Monday, November 5, 2018) Mr. Cusimano commented there is a public hearing scheduled to introduce amendments to the social host ordinance. The County adopted an ordinance and the Town s ordinance has been reviewed by the CMPA Police Council and their recommendation is to amend 4 items and mirror Corte Madera, San Anselmo and Larkspur, with Corte Madera being the first to review it. He said Business Item 1 will be removed relating to an additional full-time employee in Public Works. He said first, goals and accomplishments will be presented. Staff met with Councilmember Kunhardt to discuss climate action items and in 2016 the Corte Madera Climate Action Plan was accepted but not approved by the Council. Staff and Councilmember Kunhardt have reviewed it and he confirmed this would be brought back in December for the Council to consider. 9. ADJOURNMENT The meeting was adjourned at 7:33 p.m. to the next regular Town Council meeting on November 5, 2018 at Town Hall Council Chambers.
