7 G E N E R A L I N F O R M AT I O N PART I ELECTION SCHEDULE Effective December 1, 1980, Election Consolidation (ELCO) Statutes govern all elections in Illinois. Election Consolidation establishes four regular election dates within a two-year period. EVEN YEAR ELECTIONS GENERAL PRIMARY - third Tuesday in March Nomination of Federal, State and County candidates by an established political party GENERAL ELECTION - first Tuesday after the first Monday in November Election of Federal, State and County officials ODD YEAR ELECTIONS CONSOLIDATED PRIMARY - last Tuesday in February Nomination of Township and Municipal candidates CONSOLIDATED ELECTION - first Tuesday in April** Election of Township, Municipal, Park District, Library District, School District and Fire District officials ** Postponed whenever conflicts with celebration of Passover (10 ILCS 5/2A-1.1a) Consolidated Primary Elections may not require all precincts in the county to be open. -1-

8 RESPONSIBILITY In the polling place Judges of Election are responsible for the proper and lawful conduct of the election. They serve as officers of the Circuit Court and swear to uphold the Constitution of the United States and the Constitution of the State of Illinois in performing their duties. EQUAL AUTHORITY All Judges of Election have equal authority. All decisions regarding challenges to a voter s qualifications must be reached by a majority of the judges. NOTIFICATION Each Judge of Election assigned to work will be notified by mail approximately four (4) weeks prior to the date of the election. This notice includes the polling place information, the name and phone number of each judge assigned to work at the location, and information concerning changes in procedures which have occurred since the last election. QUESTIONS If a judge is uncertain of their duties, or if a situation arises which is not covered in this manual or in the special instructions, the Election Commission should be called for clarification. A special phone number is provided for Election Day calls (collect calls will be accepted). ROTATE Each judge should perform the duties associated with each station by rotating among the stations on Election Day. Rotating duties helps prevent errors and prohibits certain types of vote fraud. While rotating duties, two judges, one from each major political party, must be at the signature verification station. It is necessary to have bipartisan representation because voters are being qualified for a ballot at this station. -2-

9 JUDGES WORKING OUTSIDE THEIR VOTING PRECINCT Judges assigned to work outside their voting precinct may choose to vote early at one of the County s Early Voting locations, or by mail, prior to Election Day. Voting prior to Election Day alleviates potential problems arising from a judge leaving the polling place to vote on Election Day. LEAVING THE POLLING PLACE When necessary, one judge at a time may leave the polling place for a reasonable period of time. That judge must record departure and arrival times on the Judges of Election Time Sheet, found on the reverse side of the Payroll Sheet. Only one judge may be absent at a time, and this judge must authorize some member of their political party to act in their absence. -3-

10 TECHNICAL JUDGE The Technical Judge is equal in authority with the other judges in deciding voter challenges. The Technical Judge has proven efficiency working with the AccuVote Optical Scan Tabulator, AccuVote-TSX (touch screen) unit, Express Poll and AskED equipment and is responsible for the operation of the equipment throughout Election Day. The Technical Judge is also responsible for pick up of supplemental supplies; arranging for access to the polling location to set up the night before and on Election Day; contacting other judges to assure they are working and to advise time of set up the night before; set up of the polling place equipment with the assistance of other judges; and return of required supplies (together with a judge from the opposite party) on Election Night. NOTE: By law, only Judges of Election who are registered to vote in DuPage County may pick up or return election materials. ACCESS TO POLLING PLACE The Technical Judge is assigned the responsibility to make arrangements with the polling location to ensure access to the building for set up the night before and for Election Day. It is best to obtain a key to the polling place. When this is not possible, the Technical Judge should acquire the name and home telephone number of the person who will be responsible for opening the polling place on Election Day morning. This will enable the judges to contact this person directly if the need arises. REFRESHER SCHOOL Prior to each election, the Election Commission conducts a Technical Judge refresher course to apprise of recent changes and procedures warranting special attention. -4-

11 P R E P A R I N G P O L L I N G P L A C E ELECTION SUPPLY CABINET (ESC) PART II The blue metal ELECTION SUPPLY CABINET (ESC) will be delivered to the polling location by 5:00 p.m. the night before the election. A seal is placed on the ELECTION SUPPLY CABINET before it leaves the Election Commission warehouse. As an additional security measure, and to protect the seal placed on the ESC, a board is secured on the front of the ESC. The movers will remove the board upon delivery at the polling location and place it on top of the ESC. VERIFICATION OF SEAL The serial number of the seal placed on the ELECTION SUPPLY CABINET (ESC) before leaving the Election Commission warehouse will be printed on the Judge of Election supply pick up receipt. This number should be compared with the seal number on the ESC when it is opened during set up the night before the election. If the seal numbers do not match, contact the Election Commission. Break the seal located above the ESC door lock. Unlock and open the ESC From SUPPLY BOX A locate the AFTER POLLS CLOSE envelope and remove the ELECTION RESULTS ENVELOPE 1 Record seal number on ELECTION RESULTS ENVELOPE 1 in DELIVERY box Place the broken seal in ELECTION RESULTS ENVELOPE 1-5-

19 ARRANGE POLLING PLACE Whenever possible, the polling place should be set up the night before the election. The Technical Judge assigned to pick up election supplies contacts the polling location to arrange a time when all judges may be present to accomplish this task. Commercial movers deliver the blue ELECTION SUPPLY CABINET (ESC) and tables and chairs, when necessary, to the polling location by 5:00 p.m. the day before the election. Check with the polling location contact person regarding where these items will be stored so they will be accessible. 4. Ballot Box Voting Booths TSX START HERE 1. Voter Assistance / AskED POLLING PLACE SET UP Arrangement of the polling place should allow for an orderly flow of voters. The voting booths, AccuVote-TSX unit and the Ballot Box (with Optical Scan Tabulator) must be placed so they are within the view of the judges at all times. In order to allow the voter privacy, arrange the voting booths with the entrance to each booth facing a wall. 22 GREEN LABEL Voter May Not Vote A green label is printed for each voter who has applied for an absentee ballot or voted early after the preprinted Applications to Vote are generated. Green labels are delivered in the Supplemental Supplies Envelope. Additional labels may be delivered by the Election Commission on Election Day. 1. 25 PART III E L E C T I O N D AY - Before the Polls Open ARRIVAL To allow time to complete preparation of the polling place before voting starts, arrive by 5:15 a.m. on Election Day, or earlier if set up could not be done the night before. REPLACEMENT JUDGES If a Judge of Election fails to show up by 5:30 a.m., call the judge to verify he or she will be working. If a replacement judge is required, call the Election Commission. The Election Commission will attempt to find a replacement. If a replacement is not available, recruit a voter to serve as a Judge of Election. The voter should be of the same political party as the missing judge. If the original assigned judge arrives later, call the Election Commission for instructions. 31 BALLOT BOX INSTALL AccuVote OPTICAL SCAN TABULATOR If not already done, set up the Ballot Box using the stepby-step instructions provided on the side of the Ballot Box. Using the black key, one Judge of Election unlocks and opens the three (3) bottom compartment doors of the Ballot Box so all of the judges may verify all three (3) ballot compartments are empty. Judge then closes and locks all three (3) ballot compartment doors. Using the AccuVote Optical Scan - Opening the Polls instructions (found in the FOR SET UP envelope in SUPPLY BOX A) one judge reads the instructions while another judge or judges perform the following procedures: NIGHT BEFORE 1. Set up Ballot Box using instructions provided on side of Ballot Box. 2. Remove keys from the Blue Zippered Pouch. Use the black key to unlock and open three bottom ballot compartments to verify the Ballot Box is empty. Close and re-lock all three ballot compartment doors. -25-

32 ELECTION MORNING 3. Use black key to unlock front access gate (top lock on front) of the Ballot Box. Lift privacy shield and move out of the way. Place AccuVote Optical Scan Tabulator into position on Ballot Box leaving enough space to reach the red power switch on back of unit. Plug end of power cord into an electrical outlet, then feed the power cord through the chute (hole) in the Ballot Box. Plug power cord into back of the Optical Scan Tabulator. 4. Verify the Memory Card Security Seal is not broken. Use red key to unlock and remove the printer cover from the Tabulator. 5. Turn on Tabulator using the red switch located on the back of the unit. ZERO TOTAL REPORT tape will begin to print when unit is turned on. DO NOT TEAR OFF THE TAPE Slide the Tabulator unit into place on the Ballot Box, making sure the back connections are secure. After taking the Oath of Office, each judge must sign the tape on the lines provided. DO NOT TEAR OFF THE TAPE 1. Fold up the ZERO TOTAL REPORT tape and leave it in the printer compartment. Replace and lock the printer cover using the red key. When LCD display reads NEED ANOTHER COPY? Press the NO button. 2. Use the black key to lock the front access gate of the Ballot Box. Remove the key and store in the Blue Zippered Pouch. Verify the TOT COUNT is zero on the LCD display. 3. Privacy shield should be set in place on top of Ballot Box. REMINDER: The voter inserts the ballot into the AccuVote Optical Scan Tabulator unit. The Ballot Box Judge must remain 8-10 feet from the Ballot Box. If the AccuVote Optical Scan Tabulator does not operate as described: Check the procedures and refer to the LCD display The message will indicate the condition of the unit Verify the unit is plugged into the electrical outlet If the problem is not resolved - call the Election Commission -26-

33 If during the course of the day the Optical Scan Tabulator becomes inoperable: IMMEDIATELY open the Auxiliary Compartment door located in the front at the top of the Ballot Box just below the Tabulator; then call the Election Commission. Have each voter deposit his/her ballot into the Auxiliary Compartment of the Ballot Box until the problem with the Tabulator is resolved. REMINDER: At the end of the election, before inserting the ENDER CARD, check the Auxiliary Ballot Compartment and feed any ballots deposited during the day through the Tabulator. -27-

34 SET UP AccuVote-TSX and EXPRESS POLL Using the AccuVote-TSX Quick Reference Opening Poll instruction guide, one judge reads while two judges perform the procedures. NIGHT BEFORE 1. Two judges, one on each side of unit, place the TSX unit on a table with the privacy shield doors/touch screen face down and black handle away from you. While gripping the black handle at the top of the unit, pull the u-shaped leg away from the TSX unit. 2. Remove the keypad, headset and power cord from the cavities on the bottom of the base of unit and set aside. Lock keypad, headset and power cord in ESC until Election morning. 3. Pull the u-shaped leg up until you hear four safety pins snap into place. Check to make sure you see four safety pins. 4. Grip the two outside legs and pull up until the safety pin on each leg locks into place. Pull the outside legs away from the base. Make sure the leg bracket on each is fully extended and locked. 5. Two judges, one on either side of TSX unit, gently lift the unit and roll it off the table to set up on its legs. Before releasing unit, be sure the legs are firmly locked. 6. To adjust the angle of the unit, lift up on the handle while pressing the safety pin on the center support bar in back. ELECTION MORNING 7. Open the privacy shield doors. Press the black button at the top of the touch screen unit and pull the touch screen forward. 8. Plug the keypad into the port on the back of the touch screen. 9. Feed the cord through the mounting slot located to the right of touch screen. Place touch screen back in place on unit. Set the keypad out of the way on top of unit. Make sure the touch screen is securely in place. 10. Unlock and open the AccuVote printer lid. 11. Unpack AccuView Printer Module (AVPM) items from black canvas bag. 12. With the AVPM housing open, place the lip of the AVPM over the front of the TSX printer lid. 13. Where indicated at the back of AVPM housing, push down until it clicks into place. 14. Lift the metal plate, locate the blue locking bracket lever, then push it up (away from you) to lock the AVPM to the TSX base. -28-

35 15. Confirm the paper is on the spindle correctly (paper rolls from the bottom) or place the paper spindle through the hole in the paper roll. 16. Load paper roll into the AVPM housing so paper rolls from the bottom. 17. Open the AccuVote printer cover by pushing down on the gray paper release lever. Insert end of paper roll through the slot on the printer cover. Pull about a foot of paper through the slot. 18. Close the printer cover. Press to snap into place. Lower the metal plate over the printer. 19. Open the AVPM canister by squeezing under the lid. Place the open canister in the top slot of the AVPM. Remove the Take-Up Spool. 20. Slide the end of the paper roll into the slot on the side of the Take-Up Spool. Manually wind the paper up on the Take- Up Spool and insert into canister. Then close the canister. 21. Plug the female end of the power cord into the right side of the TSX unit and the male end of the cord into an electrical outlet or extension cord. 22. Close the left privacy shield door and unlock the top compartment door on the left side of unit. Push the red button to turn the TSX unit ON. Close and lock the compartment door. Open the left privacy shield door to view touch screen. 23. Touch the TEST PRINTER button on the screen. A test page prints on the paper. 24.Touch OK on message Printer test PASSED. Touch OK button to start ZERO TOTAL REPORT. 25.When ZERO TOTAL REPORT is finished message box will appear asking: NEED ANOTHER COPY? Select NO Judges should verify all races are 0 on the report. 26. Touch START TAKE UP button on touch screen (ZERO TOTAL REPORT will be pulled up into canister) When paper is tight, touch STOP TAKE UP button on touch screen. 27. Judges should sign ZERO TOTAL REPORT Then touch OK button on touch screen. (Signatures will be pulled into canister.) 28. Judges fill in all required information on the canister label and sign in the signature fields. Place a seal on canister and record seal number on canister label. 29. Close and lock the AccuView Printer Module (AVPM) lid. Place keypad into clips at the top of AVPM. 30. Plug the audio headphones into the jack on the front of the touch screen unit. Hang the headphones over the right privacy shield door. Once the AccuVote TSX unit is set up, unpack and prepare the Express Poll card writer. -29-

36 Unpack the Express Poll unit from the gray metal suitcase. You should have an Express Poll unit and its power cord. Plug female end of the power cord into the back of the unit and male end into an outlet. The memory card will already be loaded into the center compartment at the top of the Express Poll unit. There is a black rubber cover over the compartment. Push the slider button from STANDBY to ON. The button is located at the top of the Express Poll just to the left of the memory card compartment. A stylus to use with the Express Poll to touch the screen is located in the compartment to the right of the memory card. Slide the Battery ON/OFF switch button to ON. The button is located on the back of the Express Poll toward the bottom of the unit. -30-

37 TROUBLESHOOTING The Express Poll is already programmed for the polling place. However, if the memory card is removed and/or re-installed the Log In screen will appear. TO LOG IN TO EXPRESS POLL Using the on screen keypad: Tap on Poll ID box (field) Enter your Poll ID number Tap on User ID box (field) Enter your Poll ID number Tap on Password box (field) Enter the password (3141) Then tap the Log In button When the Express Poll is powered up and the first screen appears, touch the Launch Express Poll button. -31-

38 The next screen to appear will ask you to set the date and time. Click the - or + box in each section to set the date and correct time. Once the date and time are correct, click the Clock Time OK Continue button. As Express Poll launches, you will see other screens appear briefly until the MAIN SCREEN appears. When it is time to open poll, tap Open the Polls button. Then tap Issue Ballots tab. Then you will be ready to prepare a Voter Access Card for a voter. -32-

39 ADMINISTERING JUDGES OATH Oath or Affirmation of Judge of Election is printed at the top of the Payroll Sheet, which is located in the DURING ELECTION envelope. Before the start of voting, this Oath must be administered. All judges shall raise their right hand, one judge shall read the Oath, and then each judge must sign the Oath. If a judge arrives late, or a voter is recruited to fill a vacancy, he or she must also be sworn in and sign the Oath. OATH OR AFFIRMATION OF JUDGE OF ELECTION located at the top of the ELECTION JUDGE PAYROLL SHEET JUDGE OF ELECTION OFFICIAL NAME BADGE In order to indicate to the voters that each judge is a duly sworn Election Official, all judges must wear an official identification name badge supplied by the Election Commission. Each name badge contains the election date, election type, Poll ID number and location as well as the judge s name. Badges will be delivered in the Supplemental Supplies Envelope and should be returned on Election Night in the BLUE ROLLING CASE B. -33-

Separate the ballots by Township/Precinct ballot style (and political party in a Primary Election). Once all judges are satisfied the ballots are accounted for, each judge must sign the Certificate of Inspection, then place it with the AFTER POLLS CLOSE envelope. 43 PART IV T H E P O L L S A R E O P E N THE POLLS ARE OPEN Promptly at 6:00 a.m., one Judge of Election states in a loud, clear voice that the polls are open and allows voters to enter the polling place. WHO MAY BE IN THE POLLING PLACE Illinois Law requires that only authorized persons be allowed in the polling place. It is the responsibility of the Judges of Election to permit only the following individuals to remain: 1. Judges of Election assigned to the polling place 2. Authorized pollwatchers who have submitted valid credentials 3. Voters while voting 4. Law enforcement officials acting in their official capacities 5. Representatives of the DuPage County Election Commission 6. Representatives of the State Board of Elections 7. Representatives of the Office of the State s Attorney and/or the Illinois Attorney General s Office Proper identification is required to allow these individuals to remain in the polling place. Precinct committeemen and candidates have no official function in the polling place, unless they have valid pollwatcher credentials. If they do not, they cannot remain in the polling place. POLLWATCHERS Candidates, political parties, qualified organizations of citizens, organized groups of proponents for and opponents to a proposition on the ballot, and State nonpartisan civic organizations may appoint pollwatchers. All pollwatchers must be registered to vote in Illinois and must possess valid credentials. POLLWATCHER CREDENTIALS One pollwatcher credential, per pollwatcher, is required. The pollwatcher must surrender his/her credential to a judge upon entering the polling place. If a pollwatcher refuses, or if the credential is not valid, the pollwatcher must leave. -37-

44 Candidates and organizations obtain pollwatcher credentials from the Election Commission office. The credentials may not be photocopied or otherwise reproduced. Each organization shall have registered the names and addresses of its principal officers with the proper election authority at least 40 days before the election. One One -38-

45 STATE NONPARTISAN CIVIC ORGANIZATION State nonpartisan civic organization means any corporation, unincorporated association, or organization that: (i) as part of its written articles of incorporation, bylaws, or charter or by separate written declaration, has among its stated purposes the provision of voter information and education, the protection of individual voters rights, and the promotion of free and equal elections; (ii) is organized or primarily conducts its activities within the State of Illinois; and (iii) continuously maintains an office or business location within the State of Illinois, together with a current listed telephone number (a post office box number without a current listed telephone number is not sufficient). LIMITING THE NUMBER OF POLLWATCHERS If the polling place becomes overcrowded with pollwatchers, and the orderly conduct of the election is disrupted, a majority of the judges may determine to limit the number of pollwatchers. This is accomplished by drawing lots to determine which pollwatchers will be asked to leave. At least one pollwatcher for each candidate, each political party, nonpartisan civic organization and organized groups of proponents for and opponents to a proposition must be allowed to remain in the polling place. POLLWATCHER REGISTER All credentials remain in the possession of the Judges of Election and are placed in the POLLWATCHER REGISTER envelope as they are received. Each pollwatcher must sign in on the POLLWATCHER REGISTER. If a pollwatcher leaves the polling place, the departure time must be indicated on the POLLWATCHER REGISTER. 46 RIGHTS OF A POLLWATCHER All accredited pollwatchers are allowed to be present in the polling place before the polls open, throughout voting hours, and after the polls close. Pollwatchers may only observe. At no time may a pollwatcher interfere with the orderly conduct of the election. Pollwatchers are prohibited from touching any supplies or materials. The Judges of Election are permitted, but not required, to check off the names of individuals who have voted on a Polling Place List of Registered Voters or other lists provided by pollwatchers. This is only permissible as long as it does not interfere with the conduct of the election. If the judges decide to provide this courtesy, the list must be made available to any accredited pollwatcher. A pollwatcher may request from the Judges of Election a copy of the election results printed on the AccuVote Optical Tabulator and the AccuVote TSX. ELECTIONEERING Electioneering is defined as working for, against, or in the interest of a candidate, party, or proposition. Electioneering is not allowed within 100 feet of the polling room. No one is permitted to wear a campaign button, display political literature, or engage in any political discussion within the restricted area. A sign provided by the Election Commission stating NO ELECTIONEERING BEYOND THIS POINT is to be placed 100 horizontal feet from the entrance to the room used by voters to engage in voting. If the distance of 100 horizontal feet ends within the interior of the building, the sign shall be placed outside the building entrance. The criterion for establishing 100 horizontal feet is ascertained by counting off 35 paces. If a private entity (including churches or private schools) chooses to apply the campaign free zone to its entire property, the facility will display this sign and electioneering is prohibited anywhere on their property. -40-

47 MAINTAINING ORDER Throughout Election Day the Judges of Election must maintain order in the polling place. All persons present in the polling place or within 100 feet of the polling room entrance must behave in an orderly manner. All serious problems should be reported to the Election Commission. The judges have the authority to evict any person creating a disturbance. Persons in violation of the law may be arrested. The order of response to any problem should be: 1. Resolve problems and differences honestly, fairly and as quickly as possible 2. Contact the Election Commission for advice 3. Seek assistance from law enforcement officers IN AN EMERGENCY In the case of an emergency, such as fire, the first priority must be to get everyone safely out of the polling place. Judges should try to take the following items (in order of importance), if possible: 1. Voted ballots from the Ballot Box 2. Optical Scan Tabulator 3. Canister from AccuVote-TSX unit 4. Preprinted Applications to Vote a. Completed - signed b. Unused 5. Ballots (all unused ballots) In an emergency, supplies left behind are to be secured as thoroughly as possible. From a safe location, a judge should call the Election Commission for further instruction. -41-

48 REPORTS TO ELECTION AUTHORITY Judges of Election are asked to report the names of registered individuals who have moved, are deceased, or whose record requires correction due to typographical error or missing information. All such individuals are reported to the Election Commission on the REPORT TO ELECTION AUTHORITY BY JUDGES OF ELECTION. 49 VOTING PROCEDURES STEP 1: LOCATE VOTER S APPLICATION TO VOTE A preprinted Application to Vote is provided for every registered voter who has not requested an absentee ballot or early voted. The voter states his/her name and address so the Judge of Election may locate the voter s preprinted Application to Vote. The preprinted Application to Vote contains the voter s: (a) Poll ID number (b) Township/Precinct ballot style (c) Facsimile signature (d) Name and address information (e) Voter s ID number (f) Certificate of voter participation stub which also indicates voter s name and Township/Precinct ballot style (a) (b) (f) (e) (c) (d) The judge must request voter verify the name and address information printed on the Application to Vote is correct. If the voter does not reside at the address on the preprinted Application to Vote Direct individual to the VOTER ASSISTANCE/Ask ED station Once the voter verifies the preprinted application information is correct, the voter must sign in the space provided for voter s signature. In a Primary Election the voter must also place a check mark in the box indicating which party ballot (or Nonpartisan Ballot, if applicable) they wish to vote. -43-

50 For an individual who registered to vote by mail, but did not submit the required identification, the preprinted Application to Vote will be marked with CHECK ID. BEFORE A BALLOT IS ISSUED: The individual MUST show two (2) forms of identification - one showing current address. Acceptable forms of ID.. 51 STEP 2: SIGNATURE VERIFICATION The voter s signed Application to Vote is compared by two judges, one from each major political party. The two judges must compare the handwritten signature of the voter with the preprinted facsimile signature on the voter s Application to Vote. The signatures must match to qualify the voter to receive a ballot. Both judges who verified the voter s signature should initial the preprinted Application to Vote (in the area provided at the top). 53 STEP 3: ISSUE BALLOT AND PRIVACY COVER OR GENERATE VOTER ACCESS CARD Each voter should be given the choice to vote using the Optical Scan paper ballot or the AccuVote-TSX (touch screen). FOR AN OPTICAL SCAN PAPER BALLOT A. DETERMINE CORRECT BALLOT The Ballot Judge locates the voter s Township/Precinct ballot style information on the signed preprinted Application to Vote. INITIAL BALLOT Using the information printed on the Application to Vote, the Ballot Judge locates the appropriate ballot checking the Township/Precinct ballot style (and the political party requested in a Primary Election). Ballot Judge initials in upper right hand corner lmt Using a red pen, the Ballot Judge initials the ballot in the space provided. DO NOT PRE-INITIAL BALLOTS. C. ISSUE BALLOT AND BALLOT PRIVACY COVER Each voter is to be issued a ballot corresponding to the Township/Precinct ballot style indicated on the voter s preprinted Application to Vote. (In a Primary Election, the ballot should be for the political party voter requested.) Ballot Judge removes the certificate of voter participation stub from the Application to Vote and presents certificate to the voter. The certificate contains the voter s name and Township/Precinct ballot style information. Judge should advise voter to verify the Township/Precinct ballot style information indicated on his/her certificate of voter participation stub is the same as the Township/Precinct ballot style on the official ballot. Before giving the Official Ballot, Ballot Privacy Cover and marker to the voter, the Ballot Judge shows the voter how to cover the voted ballot to maintain secrecy of the ballot when placing into the Optical Scan Tabulator. The ballot is to be covered in such a manner so the Ballot Box Judge may see the judge s initials in the proper area. Voter should also be reminded to vote both sides of the ballot. Questions of public policy or referenda are located at the end of the ballot. John Q Public al kv Each voter should be offered instruction on the proper way of completing the ballot. Instructions are to be given in such a manner so others may observe them in the polling place. 55 D. CHECK BALLOT FOR JUDGE S INITIALS The Ballot Box Judge checks the voted ballot for initials. The voter should place the Ballot Privacy Cover over the ballot so only the judge s initials are visible to the Ballot Box Judge. lmt The Ballot Box Judge must allow the voter to insert the official ballot into the Ballot Box. The Ballot Box Judge stands 8 to 10 feet away from the Ballot Box. Any ballot not initialed by the Ballot Judge may not be inserted into the AccuVote Optical Scan Tabulator unit. Any voted ballot found not initialed by the Ballot Judge is to be considered a Spoiled Ballot. SEE: VOTER SPOILS A BALLOT page 50 E. INSERT BALLOT INTO OPTICAL SCAN TABULATOR The voter is responsible for inserting the ballot into the Optical Scan Tabulator located on the Ballot Box. If the ballot is not accepted by the Optical Scan Tabulator, voter should re-insert the ballot into the Optical Scan Tabulator in a different orientation. If the ballot becomes jammed in the Optical Scan Tabulator, judge checks the LCD Display If Display reads: BALLOT NOT READ - PLEASE RE-INSERT o With the black key, unlock the front access gate. o Carefully slide the Optical Scan Tabulator unit forward. o From the back of the unit, gently pull the ballot from the machine and return to voter. o Slide the unit back in place on the Ballot Box; then close and lock the front access door using the black key. o The voter should re-insert the ballot into the Tabulator. If Display reads: COUNTED BALLOT JAMMED IN READER o With the black key, unlock the front access gate. o Slide the Optical Scan Tabulator unit forward. o From the back of the unit, gently pull the ballot from the machine and drop the ballot into the Ballot Box. o Slide the unit back in place on the Ballot Box; then close and lock the front access door using the black key. -49-

56 VOTER OVERVOTES AN OFFICE If the voter overvotes an office, the Optical Scan Tabulator will eject the ballot and advise the voter of the error on the LCD screen. The voter may choose to override the ballot or spoil the ballot and receive another. If the voter chooses to override the ballot, the vote for the overvoted office will not count, but all other correct votes on the ballot will be counted. To override the ballot, the Ballot Box Judge depresses the Yes button on the front of the Optical Scan Tabulator at the same time as the voter inserts the ballot into the Optical Scan Tabulator VOTER SPOILS A BALLOT If a voter makes a mistake, or otherwise spoils the ballot, it may be returned to the judges and another ballot issued. Using the stylus provided, touch the Express Poll screen in the Voter s Precinct box matching the Township/Precinct ballot style for the voter according to the preprinted Application to Vote. 1. If necessary, choose the correct Precinct and Ballot Style 2. Tap on the Issue Voter Access Card button to issue a ballot Addison Addison 018-F06 Addison Addison 060-F06 If there are more than four ballot styles in the polling place, there will be a scroll bar. NOTE: If there is only one precinct in the polling place the Voter s Precinct box will not appear. Proceed to tap on the Issue Voter Access Card button. 2. 58 The next screen Select Ballot asks you to choose the type of ballot to create for the voter. The default setting is Normal ballot the ballot created will display on the touch screen without audio. Except in a Primary Election- Proceed to ISSUE BALLOT unless you are creating a Voter Access Card for a voter with a disability. TO CREATE A BALLOT FOR A VOTER WITH A DISABILITY See the options available below To create an Audio Ballot with ballot displayed on touch screen, click to fill in the circle in front of Audio ballot with display. To create an Audio Ballot with ballot hidden (not displayed on touch screen) click to fill in the circle in front of Audio ballot with no display. JUDGES: Ballot Party only appears on this screen if it is a Primary Election. For the No Display ballot, a box stating CANCEL appears on the touch screen while voter is voting using the keypad. Do not touch the CANCEL box unless voter requests assistance. -52-

59 IN A PRIMARY ELECTION: Using the stylus provided, touch the Express Poll screen in the box for the voter s Ballot Party choice: (REPUBLICAN, DEMOCRATIC, OR NON PARTISAN*). The party choice box should then be highlighted. Then touch the Issue Ballot button. *Non-Partisan will appear as a choice. However, the voter s precinct may not qualify for a Non-Partisan ballot. NOTE: In a Primary Election a Ballot Party choice must be made in order to proceed. Judge now verifies the correct Township/Precinct ballot style Voter Access Card is being creating for the voter by checking the information on the screen against the voter s signed preprinted Application to Vote. CHECK: Township/Precinct and ballot style as per voter s preprinted Application to Vote. Ballot Party will not appear unless it is a Primary Election. If a Primary, verify the correct party was chosen. Compare precinct and ballot style to voter s application. Insert card face up in the slot at the base. The card slides about half way in. Once inserted please wait for additional instructions. Precinct Addison Ballot Party Republican If everything is correct, insert the Voter Access Card into the slot in the front of the Express Poll unit. If everything is not correct - touch the Cancel Ballot NOT Issued button and create the correct ballot. -53-

60 When the card is prepared, a message will appear in the lower left corner of the screen: CARD WRITTEN OK REMOVE CARD FROM SLOT Precinct Addison Ballot Party Republican Remove Voter Access Card and hand to voter, along with voter s certificate of voter participation stub. Instruct voter how to insert card in the AccuVote-TSX unit to begin voting. Once the card is removed, the Express Poll refreshes to the MAIN SCREEN/ISSUE BALLOTS screen and you are ready for the next voter. Judge should advise voter to check the information on the touch screen after the Voter Access Card has been inserted into the AccuVote-TSX. Information regarding the Township/Precinct ballot style (as well as political party in a Primary Election) will appear at the top of the touch screen. Information should be the same as information indicated on voter s certificate of voter participation stub. If information is not the same, voter should request assistance from a Judge of Election to cancel the ballot on the touch screen and return to Ballot Judge to receive correct Township/Precinct ballot style Voter Access Card. After completing voting, voter returns the Voter Access Card to a Judge of Election before leaving the polling place. -54-

61 TO CANCEL A TOUCH SCREEN BALLOT If a voter has inserted the Voter Access Card into the AccuVote-TSX unit but realizes it is the wrong ballot style (or wrong party in a Primary Election) the ballot must be cancelled on the AccuVote TSX unit; it must not be cast. o Judge should verify the ballot style on the TSX (touch screen), found at the top of the ballot instructions page, with the ballot style information on the voter s certificate of voter participation stub. IF BALLOT ON TSX IS NOT THE CORRECT BALLOT: Judge instructs the voter to advance to the next page on touch screen and cancel the ballot by touching and holding for 30 seconds the square displaying Page 1 of at the bottom of the page A page will appear asking if you wish to CANCEL the ballot Voter touches the CANCEL box NOTE: The number of ballots cast on the machine will remain the same as it was prior to the card being inserted. o Judge should then prepare the correct Voter Access Card for the voter. Once the new Voter Access Card has been issued, judge directs voter to the AccuVote-TSX voting unit. After completing voting, voter returns the Voter Access Card to a Judge of Election before leaving the polling place. AUDIO BALLOT WITH NO DISPLAY When a voter requests an AUDIO BALLOT WITH NO DISPLAY, no ballot information is displayed on the touch screen. However, a box stating CANCEL will appear while voter is voting using the keypad. Do not touch the CANCEL box on the touch screen unless voter requests assistance and needs to cancel the ballot. REMINDER: A voter may only vote once. If a voter casts the ballot on the AccuVote-TSX, he/she may not vote again. If the voter indicates there is a problem, make sure to cancel the ballot on the AccuVote- TSX before attempting to create a new Voter Access Card. To verify ballot was cancelled/not cast, judge re-inserts Voter Access Card. The TSX screen will validate the status of the card. -55-

62 STEP 4: FILING SIGNED APPLICATIONS The Ballot Judge must consecutively number the valid (signed) Applications to Vote, beginning with number 1. The applications must then be filed into the Poll Record Binder. PRIMARY ELECTION For a Primary Election a separate Poll Record Binder is required for each political party and/or Nonpartisan applications. The Applications to Vote are numbered consecutively beginning with number 1 within each Poll Record Binder. PERIODIC CHECKS COMPARE TOTAL APPLICATIONS AND BALLOTS Periodically compare the total number of completed Applications to Vote against the total number of ballots tabulated on the Optical Scan Tabulator added to the number voted on the AccuVote-TSX touch screen unit. If the totals do not match, go through the completed Applications to Vote to make sure the consecutive numbering is correct. CHECK BALLOT BOX In order to avoid ballot box jamming, after approximately 800 ballots have been cast, it is recommended judges check the Ballot Box Main Compartment to see if ballots are stacking properly. Two judges (one from each political party): Using the black key, open the Main Compartment Access Door Organize ballots so they lay flat within the Main Compartment o If necessary, remove voted ballots to organize, then place back in Main Compartment of Ballot Box Close and lock Main Compartment Access Door -56-

63 AT 6:30 P.M. At 6:30 p.m., one judge announces in a loud, clear voice the polls will close in one half hour. AT 7:00 P.M. At precisely 7:00 p.m., one judge announces the polls are closed. Voters already in line to vote at 7:00 p.m. are permitted to vote. Anyone arriving after 7:00 p.m. shall not be permitted to vote. The door should be closed and locked at 7:00 p.m. Voters who have completed voting may leave. All judges must remain at the polling place until all the paperwork is completed. Retrieve the flag(s) and white plastic public roadway polling place sign(s). The Technical Judge and a judge from the opposite party must return the required supplies to the Receiving Center. REMINDER: Check the Auxiliary Ballot Compartment of the Ballot Box at the end of Election Day and process any ballots through the Optical Scan Tabulator before using the Ender Card. -57-

64 CHALLENGING A PERSON S RIGHT TO VOTE WHO MAY CHALLENGE Any Judge of Election is obligated to challenge a person s right to vote if he/she believes the person is not a qualified voter. A pollwatcher or any legal voter may also issue a challenge. REASONS FOR CHALLENGING The challenger must state a specific reason for challenging a person s right to vote. A challenge may be issued for the following reasons: The voter no longer resides at the given address The person attempting to vote is not the same person as registered The voter has already voted There is no record that the person is registered (except for Military personnel) DECIDING A CHALLENGE The Judges of Election determine by majority decision whether the challenged person may vote. If the majority of the judges sustain the challenge, the voter may be offered a Provisional Ballot. NO ONE SHOULD BE DENIED THE RIGHT TO VOTE. If the majority of the judges overrule the challenge (do not agree with the challenger), the voter is permitted to vote as though a challenge had not been issued -58-

When a preprinted Application to Vote cannot be found for an individual, but his/her name is on the Polling Place List of Registered Voters, the individual is referred to the VOTER ASSISTANCE/AskED station. In some instances an individual must complete an Affidavit in order to qualify to vote. AFFIDAVITS According to Election Law, an Affidavit is a sworn statement made in writing before an Election Judge. Under certain circumstances, a person may be required to sign an Affidavit in addition to the preprinted Application to Vote. Additional documentation may be required. The signed preprinted Application to Vote is given the next consecutive number and filed with the Affidavit of Assisted Voter in the Poll Record Binder (by political party in a Primary Election) AFFIDAVIT OF ASSISTED VOTER Only two (2) groups of voters may receive assistance: A disabled or blind voter who is physically unable to cast their ballot without assistance An illiterate voter who cannot read or write the English language well enough to understand voting procedures Who is permitted to assist a voter: Two Judges of Election (one from each political party) -or- Person of the voter s choice (may not be an agent of the voter s employer or union) When providing assistance the judges or the person of the voter s choice must cast the vote as directed by the voter and may not give information afterward as to how the vote was cast. -70-

77 BALLOT STYLE CORRECTION The address of each registered voter has been specifically coded to indicate the units of government for which he/she is entitled to vote. The Election Commission provides the Judges of Election with Sample ballots for each ballot style (and political party in a Primary Election) used within a polling place. If a voter disputes the units of government or districts listed on his/her preprinted Application to Vote, use the special judge s telephone number to call the Election Commission to investigate. 90 STEP 5: USE ENDER CARD TO CONCLUDE TABULATION CONCLUSION OF VOTING Using the AccuVote Optical Scan Closing the Polls instructions, found on the reverse side of the AccuVote Optical Scan Opening the Polls instructions sheet, one judge reads the instructions while another judge performs the procedures. A. Move the privacy shield out of the way. Using the black key, unlock and open the front access gate of the Ballot Box. A. Using the red key, unlock and remove the Optical Scan Tabulator printer cover. B. One judge inserts the ENDER CARD while another judge presses both the YES and NO buttons at the same time. Judge continues to hold in the buttons until the ENDER CARD is fed through the AccuVote Optical Scan Tabulator unit. -84-

91 STEP 6: PRINT OPTICAL SCAN TABULATOR RESULTS A. AccuVote Optical Scan Tabulator will begin printing a copy of the ELECTION RESULTS REPORT. When the first copy has printed, the LCD display will read: NEED ANOTHER COPY? Press YES to print next copy of the ELECTION RESULTS REPORT. Repeat until four (4) copies have printed. If requested, Judges of Election must print an additional copy of the ELECTION RESULTS REPORT tape for a pollwatcher. Once all required copies have printed, press NO to NEED ANOTHER COPY? All copies of the ELECTION RESULTS REPORT tape returned to the Election Commission must be signed, in the space provided, by all judges. B. The last copy of the ELECTION RESULTS REPORT must be posted in the polling place. C. Replace and lock the printer cover using the red key. The ZERO TOTAL REPORT tape and three signed ELECTION RESULTS REPORT copies are returned in the ELECTION RESULTS ENVELOPE 1 All copies of ELECTION RESULTS REPORT tape returned to Election Commission must be signed by all judges. -85-

92 STEP 7: REMOVE MEMORY CARD FROM AccuVote OPTICAL SCAN TABULATOR and COMPLETE DISASSEMBLY A. Slide the Tabulator forward on the Ballot Box. Make sure the Tabulator is turned off (flip the red power switch located on the back of the unit to turn it off). Unplug the power cord from the electrical outlet and the Tabulator. B. Remove the Memory Card Security Seal. Record the seal number on the front of ELECTION RESULTS ENVELOPE 1 and place seal in the envelope. C. Pull the metal bar forward until released from the screw and lift upward. Remove the Memory Card by pulling it out and place it in the Memory Card Pouch. D. Remove the Tabulator from the Ballot Box. Repack Tabulator and power cord in the black Tabulator case in the manner it was received. Place black Tabulator case containing AccuVote Optical Scan Tabulator in the ELECTION SUPPLY CABINET. STEP 8: OPEN THE BALLOT BOX Ballot Box must be opened with the full attention of all the Judges of Election. Remove all voted ballots from Main Ballot Compartment of the Ballot Box and place on table in preparation for hand count of ballots All Judges of Election must verify the Ballot Box is completely empty. Disassemble Ballot Box and place in the ELECTION SUPPLY CABINET in the manner it was received. DETERMINE IF YOUR POLLING LOCATION HAS WRITE-IN CANDIDATES The Write-In Tally Sheet lists the valid write-in candidates for each precinct in the polling place. The Write-In Tally Sheet is provided in the SUPPLEMENTAL SUPPLIES ENVELOPE. If there are no valid write-in candidates for a precinct, the word NONE will appear on the Tally Sheet. In that case, judges will not tally any write-in votes for that precinct only. -86-

Seal with filament tape by wrapping completely around each box both lengthwise and width. Minimum of one (1) judge per political party should sign on the filament tape. All judges must sign the Write-In Tally Sheet whether or not there were any valid write-ins. 94 STEP 9 PROCESS WRITE-IN VOTES The Judges of Election are required to record write-in votes only for those candidates who have filed a Declaration of Intent to be a Write- In Candidate not later than 61 days prior to the election. WRITE-IN BALLOTS MUST BE TALLIED BY PRECINCT FOR POLLING PLACES WITH MORE THAN ONE PRECINCT, FIRST SEPARATE THE WRITE-IN BALLOTS BY PRECINCT Process each ballot having a write-in vote in the following manner: NOTE: The spelling of the candidate s name need not be exact, as long as the intent of the voter can be determined. One judge reads the office and name of the write-in from the ballot. 2. Another judge verifies the write-in name appears on the preprinted Write-In Tally Sheet. 3. Judge verifies the write-in vote did not cause an overvote for the office (overvote may have been overridden on the Tabulator). 4. Once it is determined the write-in is valid, a hash mark is recorded for the write-in candidate. 5. After all valid write-in votes have been recorded, the hash marks are tallied and the NUMERICAL total is entered in the Total Votes column on the Write In-Tally Sheet. If a listed candidate did not receive any valid write-in votes, judge records a zero (0) in the Total Votes column. -88-

95 INVALID WRITE-IN VOTE IMPORTANT: AN INVALID WRITE-IN VOTE DOES NOT INVALIDATE THE REMAINDER OF THE BALLOT. If an oval is darkened next to the write-in vote, but no name is written on that line, this is an INVALID WRITE-IN VOTE, even if a write-in candidate filed in that office. The name must appear in order to count this vote. If a write-in vote is determined to be invalid by the majority of the judges, it is not tallied. Invalid Write-In Vote REMINDER: In a Primary Election, if a voter declares one political party, the voter cannot write-in a candidate from a different political party. This is considered an invalid write-in. All judges must sign the WRITE-IN TALLY SHEET whether or not there were valid write-ins and place in the ELECTION RESULTS ENVELOPE 1. SECURE WRITE-IN BALLOTS Place ballots containing Write-In votes in a separate emptied Official Ballot Delivery Case Box C Seal with filament tape by wrapping completely around box both lengthwise and width. Judges should indicate contents of box as ballots containing Write-In votes. Minimum of one (1) judge from each political party should sign on the filament tape. Place the sealed box containing WRITE-IN VOTES in the BLUE ROLLING CASE B for return to the Receiving Center. -89-

Locate red Supervisor Card and PIN (Security Code) from the backside of the Key Holder. Insert Supervisor Card Enter PIN number on touch screen Touch OK button Remove Supervisor Card Touch END VOTING button on touch screen At WARNING screen - Select YES Place keypad out of the way on top of unit. Unlock AVPM lid. Gently lift the lid until it clicks into an open position. 5. Select YES If a message appears asking: Print Write-in candidates? Select YES on touch screen For message asking: PRINT LONG REPORT? Select NO The totals report will begin to print When prompted on touch screen NEED ANOTHER COPY? Select YES When the first report is finished printing judges sign on the dotted lines. TEAR PAPER OFF BELOW SIGNATURES Grasp canister and gently lift it out of the unit. Manually wind signatures/end of report into canister. Place used/sealed canister(s) in the BLUE ROLLING CASE B for return to Election Commission. On touch screen, press OK to begin printing next copy of report. When NEED ANOTHER COPY? message appears, continue to select YES until you have three (3) copies outside of canister. If requested, Judges of Election must print an additional copy of the report tape for a pollwatcher. Once you have all required copies, select NO. Touch SHUTDOWN on touch screen. Touch YES to confirm you want to shutdown Judges should sign each copy of AccuVote-TSX ELECTION RESULTS REPORT tape in the area provided. Post one copy of tape in the polling place. 97 STEP 11: CONTINUE CLOSING AccuVote-TSX UNIT and REMOVE MEMORY CARD Using the AccuVote-TSX Quick Reference Closing Poll instructions continue from #13 to disassemble the AccuVote-TSX unit and remove the Memory Card Lift metal plate and remove the paper roll. Place paper roll in black canvas bag. Unlock the AVPM from TSX unit by pushing down on the blue lever. Pull the latch (located at back of AVPM) toward you to release AVPM from TSX unit. Gently remove the AVPM. Close and lock the TSX unit printer door. Place AVPM in the black canvas bag provided and zip closed. Extra unused canister will fit in bottom of the bag along with unused paper roll. 17. Disconnect keypad and headset from touch screen. Disconnect power cord. Set aside to be placed in cavities on bottom of base. Close privacy panels. NOTE: Touch screen should remain in the TSX unit. 18. Place TSX unit with privacy shield doors face down on a table. PEEL OFF SEAL FROM SIDE OF TSX UNIT Place seal on front of ELECTION RESULTS ENVELOPE UNLOCK AND OPEN LOWER COMPARTMENT PRESS EJECT BUTTON AND REMOVE THE MEMORY CARD RE-LOCK COMPARTMENT DOOR Place Memory Card in MEMORY CARD POUCH for return to Election Commission Replace cord, keypad and headset in their respective storage cavities in base of TSX unit. 21. Collapse u-shape leg by depressing both sets of safety pins and pushing down Collapse outside legs by depressing safety pins on each leg and pushing down. Carefully collapse the leg brackets by pushing down in the middle. Fold outer legs in until even with the u-shape leg. Collapse leg assembly by depressing safety pin on base support strut and pushing support bar down toward the base. Be sure outside legs are captured inside brackets on the base. 24. Place the AccuVote-TSX unit and black canvas bag (with AVPM) in the ELECTION SUPPLY CABINET -91-
