Ndegwa Wahome) in the Chair] PRAYER QUORUM CALL (The clerk-at-the-table confirms that there is no quorum) Speaker: Okay. Hon. Members, quorum having not been recognized, I invoke the provisions of Standing Order No. 35, and direct that the bell be rung for an initial ten minutes, or for such time within the ten minutes that quorum will have been achieved. (Quorum bell is rung two minutes and quorum is achieved as confirmed by the clerk-at-the-table) Very members. Quorum having been recognized, we shall proceed with the business for this sitting, that is, Wednesday the 22 nd day of August 2018, at 2.30pm. First order. STATEMENTS 1. RESPONSE TO THE STATEMENT ON TIMBER HARVESTING Speaker: Yes, Member for Mirangine and the Chair, committee on Water, Environment and Natural Resources, Hon. Samuel Mathu Wainaina. Hon. Samuel Mathu: Thank you Mr Speaker, Sir. We have the response to the statement sought by Hon. Paul Ngeche Wambaire, MCA Kipipiri ward Speaker: Very. I will invite the member for Kipipiri who sought for the statement to indicate your satisfaction and also maybe make some comments. Hon. Paul Ngeche: Thank you Mr Speaker Sir. The report is good only that this is exactly what was happening at that particular time. You find that they have the procedure and the ward level committee but up to date the ward administrators are not signing these forms and that is the problem we are having. They have it and have outlined the way it should be done but when you approach the ward administrator, they are saying they are not mandated or we are not supposed to sign. This leaves the Nyandarua people in a quagmire because some ward administrators are signing.

2 An example is that in Kipipiri, somebody came with a letter from Rurii, another one from North Kinangop but this is not even original, it is just a photocopy. When you approach several ward administrators, they are saying they are not authorized to sign and sending our people back to the Ecosystem Conservator (EC). I think this is a policy that we need to have in place such that even the county government will be able to raise revenue. I can attest here that these people are being exploited and the county government is not benefiting from the same. So I think what we need is to walk the talk as it is. Thank you. Speaker: Any other issue on that statement? Yes county member from Magumu, Hon. Salome Gathoni Kamau. Hon. Salome Gathoni: Thank you Mr Speaker Sir. I would like to commend the committee on led by Hon. Mathu Wainaina because the report is articulated. My concern is, since I wanted to hear the status of the stakeholders of the Tiber when the ban was issued. We know very that these people had paid for the logs in forest. They had given money to the forest department. We also know that they had invested in heavy machines through loans. When the banning was done, they incurred a loss. So I wanted to know the status of these stakeholders. They had gotten their licenses from the government and the same government had allowed them to invest very heavily in it. Then after the banning, there was no compensation and the logs are lotting in the forest. So I want to know how they are going to continue with their lives since we know that they are suffering dese investing. Thank you. Speaker: Alright. Hon. Members, mine is to commend the committee on for a job done, although I found the chair indicating that they would want the CEC to provide information on the progress made in establishment of ward committees and the decision of the cabinet within 30 days. I think it is important chair and your committee, you follow up on the same, whether the cabinet adopted the proposal made by the committee that had been established for both county and national governments, chaired by the county commissioner. This is a proposal that was to be taken and subjected to the cabinet and on approval, the circulars were to be issued to the ward administrators as the chairs of the ward committees. That is very critical. We want to see it and these circulars as the Member for Kipipiri has said, you will find that some wards are issuing those letters and even certificates of origin but other wards like Kipipiri are not. So let us know if there are lying circulars or these ward administrators are giving them at their whims. Another pertinent issue that has been raised is whether any fees is being paid when this application is being made to the ward administrator. When the chief is required to go to the home and confirm that the tree is there together with the forester, are they paid anything? Who pays them? We can do circulars that are only meant to be there as infrastructural issues that re not intended to be implemented. If I am a chief or a forester, if you don t pay me, how will I use resources to go and see trees in homes? So we need to know how they are facilitated and whether the persons applying for the certificates of origin and movement are paying for them. Those who had paid to the forest, the first arm I have talked about is those who are cutting trees in private homes. Those who had paid for trees in the government forest and were denied entry into it, some of them as the county member from Magumu has said because am aware, they had borrowed money from the banks. The government cannot deny our people access to the forest and it is not returning their money.

3 So what is the infrastructure they have put in place to ensure that those who are not allowed to go to the forest and they had paid for these trees, that they are refunded their money within the shortest time possible. So those issues chair, handle them. Come back here so that as we go to our people out there, we are able to explain to them what exactly is happening in that sector. Next order. 2. STATUS OF COUNTY ABATTOIRS AND THE ANNUAL FINANCIAL TURNOVER AND EMPLOYEES Speaker: Yes, Member for Gathaara and the chair, committee on Agriculture, Livestock Development and Fisheries, Hon. Andrew Kamau. Hon. Kamau Kariuki: Thank you Mr Speaker. I hereby respond to the statement sought by Hon. Wambaire Paul Ngeche on status of county abattoirs, the annual financial turnover and employees. We were supposed to respond last week but because the member was not present, we are responding today. I think he is still a member in this committee. We will start with chapter one: Mr. Speaker Sir, Pursuant to the provisions of the Standing Order no 45 (2) (c), on the 10 th day of July, 2018 Hon. Wambaire Paul Ngeche sought a statement from the Chairperson of the committee on Agriculture, Livestock and Fisheries on the status of county abattoirs, the annual financial turnover and the employees. The statement was in the following terms; Mr Speaker, Sir, I hereby seek a statement from the Chairperson, Committee on Agriculture, Livestock and Fisheries on the above stated subject matter addressing the following concerns Aware that the Part II of the Fourth Schedule of the Constitution of Kenya mandates the Counties with the function of County abattoirs; refuse removal, refuse dumps and solid waste disposal; and care and burial of animals; Further aware that article 43 of the Constitution guarantees every person a right to the highest attainable standard of health; Concerned of the deplorable state of most of the abattoirs within the county due to lack of adequate and poor disposal of refuse and dead animals which includes disposal of inconsumable meat; Further Concerned of the poor infrastructure or lack thereof including lack of fencing structures, ablution blocks and services among others; Arising from the foregoing, I seek that the Chairperson of the Committee on Agriculture, Livestock and Fisheries Development provides the following information: The statement was sought. Mwangi Nyambura Esther - Member Secretariat; Ms. Joyce Gathura - Committee Clerk Mr Speaker, I wish to thank your office and that of the Clerk to the County Assembly for the support accorded to that committee in their pursuit to respond to the statement. Allow me to also salute the members of the committee and staff of the Assembly for the commitment exhibited during the committee meeting that culminated to the completion of the statement response. Finally, on behalf of the members of the committee, it is my distinguished duty with pleasure to present to the house the committee response, on status of county abattoirs, the annual financial turnover and employees for adoption. Mr. Speaker, Sir, the Committee held a meeting to deliberate on the matter on the 12 th Day of July 2018 and resolved that the information be requested from the County Executive Committee Member for Agriculture, Livestock and Fisheries. The Committee through the office of the Clerk vide a letter reference NCA/ADM/2/73 wrote to the County Executive Committee Member for Agriculture, Livestock and Fisheries requesting for the following information: I. A list of all public and private abattoirs in the county and the state of each abattoir in reference to the structures, availability of and means of disposal of refuse and inconsumable products; II. A list of all public officers (County employees) dealing with abattoirs and their duty stations; III. The amount of revenue collected for the last two financial years per abattoir; IV. The status of the county abattoirs land holding and acreage thereof; and V. The status of Miharati abattoir. On 19 th July, 2018, the information was received in the Office of the Clerk vide a letter reference ALF/NYA/CEC/ASSEMBLY BILLS /Cir.13/Vol.11/36 (See attached). On the status of County abattoirs and the same conveyed to the Committee on Agriculture, Livestock and Fisheries for the purpose of preparing a statement response. CHAPTER TWO: RESPONSE TO THE STATEMENT All public and private abattoirs in the county and the state of each abattoir in reference to the structures, availability of and means of disposal of refuse and inconsumable products; Mr. Speaker Sir, Nyandarua County has a total of 70 slaughter slabs. 5 Speaker: The documents were supplied on Thursday for every seat, but I asked the response not be read because Hon. Ngeche was not present, but the sergeant at arms will get you a copy. Proceed. Disposal of waste Condemnation s for condemned meat and simple for effluent. c) The Status of Miharati Abattoir Miharati Slaughter House Mr. Speaker, Sir, the slaughter house is situated in Miharati t. It is ed by the County Government of Nyandarua. It is situated on a quarter acre land. It serves Miharati t and its environs. (Hon. Suleiman Kimani rises on appoint of information) Speaker: Do you need the information chairman from the member for Kanjuiri Ridge? Hon. Kamau Kariuki: Yes. Speaker: Proceed.

12 Hon. Suleiman Kimani: Mr Speaker, the document I have is reading Miharati and not Mirangine. So, does he have a different document? Speaker: You have given good information member for Kanjuiri but now your qualification erodes it. When you ask the chair whether he is reading a different document. So proceed chair and I hope the information is useful. Hon. Kamau Kariuki: Thank you Mr Speaker. Thank you for correction. It is Miharati slaughter house. Due to the heavy rains experienced this year the facility has experienced logging leading to filling, and other effluent disposal structures. For the facility to operate effectively it requires the following repairs; Lairage repair Perimeter fence and Repair of killing floor Repair of loading bay Construction of manure shed Construction of holding pen Repair of evisceration table Replacement of insect proof wire gauze Emptying of and Some funds for the maintenance of the County ed slaughter houses have been factored in this F/Y budget. Recommendations The Committee made the following recommendations 1. That the County Government should ensure that the abattoirs meets the required specifications. 2. That the retired staff should be replaced to allow for smooth flow of service 3. That there should be policies for privatization and mechanisms to cushion against revenue loss in the abattoirs. As you can see, each and every sub county should have abattoir. Only three out of seventy abattoirs in the whole county are ed by the government. If you go through the report, there is no piped in most of them. An abattoir requires a lot of and only a few have piped for example the one in Engineer. So as a county, we should make sure all abattoirs have piped. Another issue is that, you can see most are private abattoirs. The county government s only three and this can also be a source of employment if each sub county had one. The youths employed in the private abattoirs are misused. The ers want to only make money. We also have the technology. If you visit our abattoirs, there should be new methods of doing things so that our county can develop and be able to export meat to other counties. If we increase the abattoirs in our county, we will also increase the revenue since there is corruption in the private abattoirs. They call the meat inspector and he inspects maybe two and then report that they have inspected one. So, it is high time as a county we develop our abattoirs to high standards so that we can be able to give our people what they require. The other thing is about management. If you visit those abattoirs, they are not fenced and sometimes you cannot even be able to go and ask for a nyama choma because of their status.

13 With those few remarks, I thank the committee members, your office and that of the Clerk for your support. Thank you. Speaker: Very. Again I will give priority to the member for Kipipiri Hon. Paul Ngeche who sought the statement so that he can comment on the response, whether it is satisfactory or not, or whether there are any issues in the statement that were left out. Hon. Paul Ngeche: Thank you, Mr Speaker Sir. I commend the chair Agriculture as as the committee in which I am a member. In brevity, you find that the situation that the county abattoirs issue is a devolved function and the conditions they are in is wanting. You will find that even the Health department itself is relenting to close d some of these county abattoirs because they lack the requisite equipment. This needs to be addressed because it is a loophole in the County Government where we are losing revenue. There are those fees that are being charged but we do not know to whose hands these fees are going to. This is as, a clear indication that maybe the County Government is willing to privatise the county abattoir. If we only have three county abattoirs and we cannot be able to manage them as a county, then this shows that they are in the verge of being privatised. If that is the way, then it should be resolved as so. As, for the being of Kipipiri, there is a question that is arising from the report, that they have allocated some money in this financial year but I cannot tell what the amount is from the budget. So, I will also need to get the finer details if they are saying that they have allocated some money so that I can be able to interpret. Thank you. Speaker: Very. Any other comment from that statement? Yes, member for Wanjohi, Hon. Isaac Kung u. Hon Isaac Kung u: Thank you, Mr Speaker. First, I want to applaud the seeker of the statement and also the response that we have received from the committee, but I have happened to visit a few abattoirs in my ward and one thing I noted is that these abattoirs are a major source of revenue. The schedules that have been provided here indicate much more than I even expected in terms of income for this county. It is generating enough money for this county. However, even though we only have three and the rest are privately ed, I do not think there is a model that these abattoirs should emulate. Some of them are in very deplorable conditions and hygiene is of utmost importance when it comes to food matters. The way slaughtering of animals is done in those abattoirs is very surprising. I think we should come up with a mechanism like the way private partners come up with a standard in which the abattoirs carry out their work. Our animals are suffering due to the way the process is done using axes. I was there ones when they were slaughtering a bull and I felt so sympathetic. We need to come up with a model and acquire better equipment for doing this work. The hygiene of the people doing this work is very poor. After slaughtering, there are dogs that are present all over. Actually, even though they are privately ed, we should be able, through the ministry of Health, move forward and be able to make sure that they are in a certain standard and good work is done. We should also take care of our animals. They should not suffer in those abattoirs. Thank you. Speaker: Yes, Member for Weru, Hon. Mbogo Mburu. Hon Mbogo Mburu: Thank you Mr Speaker Sir, for giving me this opportunity to contribute a little to the statement. This is a health issue whereby we find that a lot of issues and work that is done the slaughter houses especially, is not conducive to our people. On the issue of quarantine, whereby animals are restricted from movement, you find that the issuance of licences to bring animals from other areas is not strictly adhered to. This, in particular, is in relation to the premises that are in the northern areas of the county, animals are brought from Laikipia.

14 It is of paramount importance that these premises are looked into because we know the issues that follow when we have outbreaks of diseases and the issues that follow when meat is affected. So, I congratulate the committee for coming up with a very strategic report and it should be adhered to. It should also be applied to other areas where issues of slaughtering and meat are handled. Thank you. Speaker: Okay, very. I think I will also thank the committee on agriculture for a job done and I am happy to hear that there are some allocations in the budget for improvement of our abattoirs, because I think it has never happened before. Also, at the end of the day when we are talking about the employment of our youth and we have so many veterinary doctors that I know about. I think we have one abattoir and that is a recommendation chair. Your committee will see that we have an abattoir at every provincial sub-county, Ol Kalou two, Kinangop two, and the other ones to have one. Also, as it has been said I did not know that we are still using axes up to now, to slaughter. The guns are very cheap. It is put on the head, then released and it kills promptly. It does not cost much. We are using Stone Age techniques and we are in the age of computers. I think those are recommendations that we can make for immediate implementation. Also there are those abattoirs, chair, that have reduced. I think we are growing in terms of population and business. You will find that the Wanyika, in my village, where all the cattle that are taken to Nairobi are slaughtered, the revenue has reduced by Ksh 15, 000. Clearly, there must be something very wrong. If the slaughter house in t is raising over half a million, the privately-ed one in my area is raising only Ksh 80,000. There must be something wrong. Clearly, there is need for a lot of monitoring. There is drastic reductions in revenue in Mufau, Demi and Gatha. They should be growing not becoming redundant. Those are areas that we should still pursue to ensure our abattoirs are a source of food. We are going to direct the clerk to send this report to the Department of Health with a caveat that they must do their work on these abattoirs. Otherwise, we cannot have a department of health and these are the reports that we are receiving about the state of sanitation of our abattoirs. Next order. ADJOURNMENT Very, honourable members.
