Samuel Tonui) in the Chair] PRAYERS COMMUNICATION FROM THE CHAIR MEMBERS TRAINING The Deputy Speaker (Hon. Samuel Tonui): I would like to communicate to you that tomorrow we will go for training at Weston Hotel, in Nairobi so get prepared. REPLY TO STATEMENT NUMBER OF NGOS OPERATING IN THE COUNTY Hon. Wilbur Amara: Thank you Mr. Deputy Speaker, on behalf of the Chairperson Hon. Eddy Kiragu, I would like to give a reply on the number of NGOs. It was requested by the Leader of Majority. This Report came from the Ministry of Youth, Gender, Culture, Sports and Social Services. The number of NGOs that we have is 40. And I will read each one of them, the activities it does and the area they operate in. 1. Love and Hope: Activities: - HIV/AIDS - prevention and care of survivors in the community. - Gender Based Violence Care of survivors through psychosocial support. They are in Nakuru East and Nakuru West 2. Jamii Thabiti: Activities; - Urban Violence Mitigation - Gender Based Violence intervention - Capacity Building especially on security issues They are in Naivasha, Gilgil, Nakuru East and Nakuru West. 3. Kenya Council of Islam and Ujamaa; Activities; - HIV Awareness - Care of orphans and vulnerable children

2 They are in all sub-counties 4. Centre for Democracy and Good Governance (CEDGG): Activities; - Governance - Capacity building for organizations - Gender issues They are in Nakuru East and West, Molo and Naivasha. 5. Centre for Transformational Leadership: Activities; - Leadership and Good Governance - Advocacy and Trainings They are in Nakuru East and West. Also in Naivasha 6. Flamingo NET: Activities; - Environmental Conservation - Climate Change and Mitigation They are in Nakuru County 7. Gap Link International: Activities; - Health issues - Environmental conservation. They are in Nakuru County. 8. Repacked: Activities; - Health - HIV Awareness and prevention They are in Nakuru East and West 9. Resource Conflict Institute and Reconciliation: Activities; - Land and Natural Resources Management They are in Nakuru East and West. 10. Centre for Social Development and Governance: Activities; - Governance and Advocacy issues. They are in Subukia. 11. APDK Association of Physically Disabled Persons Kenya: Activities; - Mainstreaming disability in development. They are in all sub Counties.

Samuel Tonui): Honourable Chair, I think this list is too long. The best thing is to table it and copies should be made for Members to see later on to save time. Hon. Wilbur Amara: Thank you Mr. Deputy Speaker for your guidance so I beg to table the Report and you can get it from the office. Thank you. (The Report was laid on the Table) The Leader of Majority (Hon. Stanley Karanja): Thank you Mr. Deputy Speaker, I really congratulate the Committee because this is one question that was to be researched like for two months. But we have heard that they have managed to get 40 and where they operate from and what they deal with, as you have already directed that the Members to make sure that they get the copies so as to know which organizations operate in their areas and what it deals with, some of

5 this institutions and NGO are amorphous, they are briefcase organizations in the sense that it is there but it is not operating. We need to come up with regulations that if an NGO is there and is doing nothing then why should it remain soliciting money and yet it is doing nothing, I urge the Members to make sure that they read so that next time they should know who are the directors of this NGOs. May be they are owned by a single person and that is the thing we shall be asking. As we go on, yesterday we had some business in the House that was left hanging, I thought there should have been a communication and may be you can give us the way forward for there was some pending business. The Deputy Speaker (Hon. Samuel Tonui): I think you will be briefed, for the NGOs you have said each and every Member should have the list for you to know if you have an NGO which is registered in your area, you should know the activities of that NGO, are they really assisting the communities or they are only after the money as the Majority Leader has said. REPLY TO STATEMENT FUNDS FOR SUPPLY OF VACCINES IN THE DEPARTMENT OF AGRICULTURE The Deputy Speaker (Hon. Samuel Tonui): Let us go to the second response of the Statements by the Chairperson of the Committee on Agriculture to respond to Honorable Palang a concerning the money allocated for the supply of vaccines in the department of Agriculture, any report from the Committee? This the third time this reply fails to be given The Leader of Majority (Hon. Stanley Karanja): We have been saying that this is a House of rules and regulations, I do not see why we should call for a reply of a statement three times and Members of the Committee concerned are not here and it is in bad faith, there is not even a Member to say that we did not get the answers, I think there is something terribly wrong and the Chairperson for the Liaison Committee should whip the Members so as to work in tandem with the work they were given. I reading bad faith, I am also reading incompetence and something should be done, questions should not be asked always as if it is the only one, I do not see this as right. The Deputy Speaker (Hon. Samuel Tonui): Thank you the Leader of Majority, I am sending honorable Rotich because he is a Member of the Committee on Agriculture and I am giving them the last warning that, the first week after the recess we need the answer. Hon. Anthony Rotich: Thank you honorable Deputy Speaker, I will take the report. The Deputy Speaker (Hon. Samuel Tonui): The third response is from the Chairperson of the Committee of Early Childhood Education and Vocational Training to issue a statement requested

6 by honorable Karuri concerning the number of public ECDs in the county, is honorable Ayabei around?, the Vice Chairperson or a Member? REPLY TO STATEMENT NUMBER OF ECDS IN THE COUNTY Hon. Richard Kurgat: Thank you honorable Speaker, I am a Member of the Committee and we request that we bring the report on the first week after the recess. The Deputy Speaker (Hon. Samuel Tonui): Order Members, Thursdays is for requests and response to statements and each Chairperson and every Member should know this, I wonder why most of the Chairpersons, the Vice Chairpersons and the Members are not in, then how do we move and this is a serious business, take note of this for we are not taking it lightly. Hon. John Njenga: Thank you Honorable Deputy Speaker, I am following the proceedings and I am very happy the Leader of Majority Leader is talking about competency and I am concerned on the same and I do not want to take you back to yesterday s proceedings but I want to say that the word competency should be underlined, bold and in capital letters in this House so that we do not contradict in other areas where we say some people are competent and other are incompetent and when we discuss competency there is inconsistency, thank you. The Deputy Speaker (Hon. Samuel Tonui): I do not understand what you mean but I will get it latter, Hon. Peter Maina: (On a point of information) forgive me for I came in a little bit late and I do not know what happened to yesterday s Motion because we came to this Assembly this morning ready to engage and tear that Motion apart and we would like to know what happened because we were prepared to have that Motion this morning, thank you The Deputy Speaker (Hon. Samuel Tonui): Honorable Members, forgive me, I was not there yesterday but I have been briefed and I have the communication here from the Clerk. Before I continue concerning the same. Sit down and let me finish, I will answer you. COMMUNICATION FROM THE CHAIR REMOVAL OF CEC FINANCE AND ECONOMIC PLANNING The Deputy Speaker (Hon. Samuel Tonui): The Motion of the removal of CEC Finance and economic planning was adjourned due to lack of power, as you are all aware every proceedings of the Assembly must be recorded through the HANSARD and the equipment rely on electricity. According to our Standing Orders the Motion must be allotted time again by the House Business Committee for it to appear on the Order Paper.

7 I think that this is the right communication because if there was no power nothing would have gone on. The House business should now sit and allocate time for the same Motion for it to be discussed, so we can do nothing much about it. Hon. Wilbur sit down. We now go to the request of Statements Yes Honorable Whip. (Hon. Wilbur Amara stood in his place) (Laughter) The Chief Whip (Hon. Irene Chebichi): Mr. Deputy Speaker sir, according to the Temporary Speaker who presided yesterday, he communicated that the Motion has been forwarded to today s morning session. I am now wondering why there is a different version today. And if you can read the mood of the House, that is what the Members want to debate. The Deputy Speaker (Hon. Samuel Tonui): Thank you, I think you are not a new Member and you know if such things happen the procedure should be followed and there is no shortcuts. Maybe the Speaker who was seated consulted later on and discovered how it should be done. You know sometimes we are not conversant with rules and Standing Orders but I can now tell you, it has to be allocated time again. The Speaker who presided also agrees with me and the Whole House. Okey, you sit please, we are not discussing that now we are on other business. We shall allocate time and that is all. Order! Order Members (Loud consultations) STATEMENT GRABBED PUBLIC LAND AT MARAN SUSWA IN WASEGES WARD Let us have Hon. Kiriethe to request a statement Hon. Isabella Makori: Thank you Mr. Speaker sir, on behalf of Hon. Daniel Kiriethe and pursuant to Standing Order 47 (2) (c) I am requesting a Statement from the Chairperson Committee on Lands, Housing and Physical Planning concerning alleged grabbed public land at Maran Suswa border in Waseges Ward. Thank you. The Deputy Speaker (Hon. Samuel Tonui): Thank you. Hon. Chairperson Ng ethe. You want to inform? Concerning this? The Leader of Majority (Hon. Stanley Karanja): Yes

8 The Deputy Speaker (Hon. Samuel Tonui): This is a request of Statement and it is directed to the Committee. Let us just listen to you maybe you have a point The Leader of Majority (Hon. Stanley Karanja): Mr. Deputy Speaker we have been asking Hon. Kiriethe questions but he does not answer but he is busy asking questions... The Deputy Speaker (Hon. Samuel Tonui): Order! Order we have noted your concern. Get seated. And that is why I said you are out of order. You cannot judge, this is another request.now proceed Hon. Isabella Makori: Hon. Deputy Speaker, the land under reference measures 20 acres, it should be noted that the land was initially reserved for construction of a market and a public school including ECD. It is surprising a known person have since been reallocated the parcel of land. As a result the residents of Waseges Ward have been deprived of their Constitutional rights to access the social amenities which the land was meant to cater for. This is just one of the existing many cases of land grabbing in the county. Am afraid that, if the county government in corroboration with the relevant department and institutions doesn t address this critical matter, we stand to lose big parcels of land through unscrupulous allocations. Honorable Deputy Speaker I request the Chairperson of the Committee on Lands Housing and Physical Planning to as soon as practicable issue a Statement on the status of the land under reference and whether the matter is being addressed by the county government. Details of the parcel of land is as follows, Waseges Nyamamithi block 1/149 thuthu Subukia west block 1/123 Lari Wendani. Thank you. The Deputy Speaker (Hon. Samuel Tonui): Thank you honorable Makori on behalf of honorable Kiriethe. Now, this stand committed to the chairperson on Lands Housing and Physical Planning that is honorable Ng ethe. And now may I give you around three weeks or may be the first week after recess or the first Thursday when will be sitting in this House, you give us the report because you have got time now to go and find out about all those allegations. The next one, now chairperson can you respond to that? Where is the mic? Hon. Stephen Ng ethe: Okay Mr. Deputy Speaker. Honorable Wasusi has just informed the House to use the word competence and incompetence well. We are competent enough and Mr. Speaker I oblige. The Deputy Speaker (Hon. Samuel Tonui): Thank you honorable chair, now the next request of the statement is from honorable Jackson Murage. He is requesting of a Statement from the chairperson Committee on Transport and Public Works concerning constructions of Kasarani road in Malewa West Ward. Now Josphat Murage come forward. REQUEST FOR STATEMENT CONSTRUCTION OF KASARANI ROAD IN MALEWA WEST

9 Hon. Josphat Murage: Thank you Mr. Speaker sir, pursuant to Standing Order 47(2) I rise to request a Statement from the chairperson Committee on Transport and Public Works concerning construction of Kasarani road in Malewa west ward funded by World Bank. Honorable Speaker appreciating that Malewa ward was a beneficiary of the program, construction of the said road commenced in early 2017 and is expected to be completed in May 2018, despite the works having commenced there is visible cracks. Further it is worth noting that, prior to the commencement of the construction, the county government of Nakuru entered into the MOU with the members of the community to allow the contractor to use marram from within the ward and in return the contractor would tarmac more roads within the ward. However the contractor has failed to honor the arrangements. Honorable Deputy Speaker, it is on this premises that I request the chairperson on Transport and Public Works to furnish the House with comprehensive report on the approval, sketch of the layout map of the road, the number of kilometers to be tarmacked, modalities of relocating the electric poles interfering with the drainage system, provisions of footpaths, and mitigation of emerging cracks. Thank you. The Deputy Speaker (Hon. Samuel Tonui): Thank you honorable Murage. Now this one stand committed to the chairperson on Transport and Public Works who is honorable Machembu Chege. Where is Machembu Chege?... Yes vice chair? Come in front or you can stand there and maybe say something. Hon. Samuel Mugi: Thank you Mr. Speaker, am honorable Samuel Mugi, and am the vice chair Committee on Transport and Public works. I promise that we are going to look into that and also prepare a Statement as requested. Thank you The Deputy Speaker (Hon. Samuel Tonui): Thank you. You have to come with the response on the first Thursday after the recess. Thank you. MOTION THE HOUSE TO ADJOURN FOR RECESS IN LINE WITH ASSEMBLY CALENDAR The Leader of Majority (Hon. Stanley Karanja): Thank you Mr. Speaker sir, I beg to move a Motion;- THAT pursuant to the provisions of the Standing Order 31(3), this House adjourns from today 3 rd may 2018 and resumes on 5 th June 2018 n line with the Assembly Calendar. Mr. Deputy Speaker, I hope Members will remember that we have a calendar that we did pass in this House. As agreed, we are supposed to break for our recess which is one month as indicated. That recess will be for us to train the committees. The Committees ought to be trained on their mandate and responsibilities and it is in that spirit that I hope that the recess will be fully utilized. All Committees have been lined and I think the Committee training schedule will be issued such that every Committee will know when, how and what its engagement will be. As you have also

10 mentioned, we still have training that is to deal with House issues that will be starting from today. I think that this recess will be fully utilized. I think from what we have been doing, it is also a time for reflection, we can be able to see as a House where are we headed to what our objectives are and what we have achieved so far. As we go for our training, we will be able to know what regulations we have to come up with. Members will engage themselves especially in bursary and the chairman Education will reengage on that. When we go for training we need regulations on Boresha Barabara and we will brainstorm on that. Therefore I feel that this recess will be used well and we will come here better than we were. (Question proposed) Hon John Macharia: I arise to support the Motion. The recess starts today until 5 th of June. The recess is important if we are going to have an opportunity whereby every Committee will have an opportunity to go for training where we will be equipped with skills to deliver and achieve in our Committee mandate. Thank you The Deputy Speaker (Hon Samuel Tonui) Thank you honorable Member from Turi; chairperson for environment Hon Joseph Kamanu: Thank you Mr. Deputy Speaker, I also arise to support the adjournment. I request this House to engage the Executive more and as we leave for recess, we have a number of pending projects in our respective wards. It is good and prudent to use that duration very well but also in conjunction with the Executive to ensure we offer service to Wanjiku. So kindly ensure that the House leadership engages the Executive so that pending business can be accomplished. Thank you. Hon. Kibet Kurgat: Thank you Mr. Deputy Speaker, I stand to support the adjournment of the House because we have a lot of issues in our wards. It is also prudent that we engage in foreign trips and it is a plea of honorable Members that we do benchmarking. I hope you concur with me to do benchmarking. The Deputy Speaker (Hon Samuel Tonui) Order Honorable Member! Are you sure you are contributing, do not ask me questions Hon. Kibet Kurgat: Yes, I am supporting the Motion because if there are foreign trips, it is this period that the honorable Members should go and do benchmarking. For example Members of Environment Committee through the chairperson we gave a request to the Executive that we can

11 do benchmarking. Some of us we want to come up with regulations as the Majority Leader has pointed out concerning Boresha Barabara. So Members left behind to come up with regulations, I will be among those to be left behind to come up with those regulations. So it is a prayer of honorable Members that we engage the Executive and if there is foreign trip we shall be grateful. The Deputy Speaker (Hon Samuel Tonui) Thank you hon Kurgat ; hon chairperson Lands Hon Stephen Ng ethe: I support the same and owing to prevailing torrential rains, despite the immense destruction it has caused. We can request Members to go and plant trees and encourage their electorates to do the same. The Deputy Speaker (Hon Samuel Tonui) Thank you honorable Member.
