PETITION ON PENDING BILLS Speaker: Yes, Member for Kanjuiri Ridge and Chairperson Committee on Finance and Economic Planning, Hon. Suleiman Kihika Kimani. Hon. Suleiman Kimani: Thank you, Mr Speaker. There is a report from the Committee on Finance and Economic planning on consideration of the petition on pending bills by the Nyandarua County Contractors. (Hon. Gathungu Kamau rises on a point of information) Speaker: What is it Member for Leshau Pondo, Hon. Peter Kamau Gathungu? Gathungu Kamau: Mr Speaker, I want to know if it is in order for a Member to remain seated in their normal position when tabling documents or shouldn t one move to the dispatch box? Speaker: I think the reason the Member did not leave his seat is because I have not seen the report. I can see the Member for Kanjuiri-Ridge holding the order paper. However, I can t see the report which must be filed by the clerk from the dispatch box. Proceed, member for Kanjuiri-Ridge. Hon. Suleiman Kimani: Thank you, Mr Speaker. This paper is a report of a petition by the Nyandarua County Contractors Association on the unpaid claims and the pending bills of the Nyandarua County Government. Mr Speaker, The Finance and Economic Planning Committee is still considering the petition by the Nyandarua County Contractors Association on the unpaid claims and bills at the Nyandarua County Government. Speaker: Mr Chairman, Finance and Economic Planning, I can see I have been given a preliminary report on the response to the statement by Hon. Simon Sambigi, MCA Githioro ward on the surplus by the 3 rd of January So, is what you are giving a preliminary report? I believe you would want to table the preliminary report as you highlight on it.

2 14 November, 2018 COUNTY ASSEMBLY DEBATES 2 Oh! I am sorry. I have been given two preliminary reports. I have read one that has not been called out. The one at hand is on the contractors association s petition on unpaid claims and pending bills in the Nyandarua County Government. I think you should first table the preliminary report and then highlight on it. Hon. Suleiman Kimani: Mr Speaker, We do not have the report on the petition by the Nyandarua County Contractors Association and here is the reason why. Speaker: Is that the preliminary report? Hon. Suleiman Kimani: Yes. Speaker: Table the preliminary report. Hon. Suleiman Kimani: Mr Speaker, I table this preliminary report on the petition by the Nyandarua Contractors Association on the unpaid claims and pending bills in Nyandarua County. Speaker: You can now highlight on the same. Hon. Suleiman Kimani: Mr Speaker, the Finance and Economic Planning Committee is still considering the petition by the Nyandarua County Contractors Association on the unpaid claims and pending bills in the Nyandarua County Government. The Committee has engaged with the petitioners and there are several grave allegations that require the attention of certain officers who have been mentioned adversely before the committee. The committee had therefore requested the attendance of the said officers from the department of roads, and we were also planning to invite the Director of Supply Chain Management and the Director of Internal Audit. This would give them a chance to refute the said allegations in accordance with the rules of natural justice. However, due to the extraordinary happenings in the House and the unanticipated declaration that Eid al-adha would be a national holiday which was when they were to appear before the committee, they were not able to appear. The KICOSCA games in Kisii County and CASA games in Nairobi County did also by extension affect the attendance of the said officers. It has therefore not been possible to get their submissions. Further, the committee has sought more information from petitioners via the chairman of Nyandarua County Contactors Association. Critical information is yet to be availed to the office of the Clerk for transmission to the committee. Mr Speaker, those are the reasons why we have not compiled the report concerning the petition from the contractors. We, however, have managed to compile a preliminary report and I hope that now that we have resumed, we will not have any hiccups and we are going to have a complete report concerning the same. Thank you, Mr Speaker. Speaker: Okay. Before I give directions, are there any comments from the Hon. Members? The chair has explained why they do not have the report ready. If you remember Members, this report was supposed to be ready within 60 days which are long gone. I think after we get your comments, the chair will have to sit down with his Committee and consider moving a motion for the extension of time as we are already past the 60 days limit. Yes, Member for Njabini/Kiburu, James Kiiru Gachomba. Hon. James Gachomba: Thank you, Mr Speaker. I wish to take this opportunity to thank the Chair of the Finance and Economic Planning Committee for the preliminary report concerning the pending bills. I think this report has delayed the business of this House. The supply of goods and services through contracts, to the county government has been delayed for quite some time because of this report. Now, the Chairman is highlighting that there are officers who were summoned by the committee to give details on what transpired in relation to the pending bills but they went for KICOSCA games. A chief officer being summoned and explaining that he/she is in KICOSCA is taking this House for granted! This House has been taken for granted for far too long. We are here to serve our people and a committee s Chairperson is like a High Court judge. They should have appeared so that these contractors

3 14 November, 2018 COUNTY ASSEMBLY DEBATES 3 are paid. Mr Speaker, we are aware they are suffering. Some of their property is still being held in the banks they borrowed from to supply the goods and services to the county. They have not yet repaid the loans and are about to have the property auctioned. We shall not bury our heads in the sand and pretend that things are going very well. We need to give the Committee some more time to bring a conclusive report to this House. We need to deal with those officers either ruthlessly or in any other necessary manner. Thank you, Mr Speaker. Speaker: Yes, Member for Central, Hon. David Mwangi Maitai. Hon. David Maitai: Thank you, Mr Speaker, Sir. I would like to take this opportunity to thank our chair of Finance for the report although it was not as conclusive as we had hoped but we have been working on it. This is due to some of the challenges that we have been facing here and there. It is worth noting that we faced a lot of challenges: we had the KICOSCA games and some hiccups in the Assembly. The officers from the executive were also not quite cooperative. We summoned them but they did not show up. It is high time the Assembly took charge and actually did something in relation to that. There is no way we can continue inviting them so that we hear from them and they remain reluctant. We would like to have your guidance, Mr Speaker, on the way forward. When we met those petitioners for the first time, some of them were very worried as they had taken out loans from the banks and interest had accumulated. Some of them even had pending bills dating back to It is the high time for us to conduct a comprehensive analysis so that we know those who should be paid. Also, we need cooperation from the executive as we cannot go any further without it. We would therefore like to request you, Mr Speaker Sir, to allow us more sitting days within the week so that we are able to finish our work on time. Thank you, Mr Speaker Sir. Speaker: Yes, Deputy Speaker and the Member for Nyakio, Hon. Zachary Mwangi Njeru. Hon. Zachary Njeru: Thank you Mr Speaker Sir; although I do commend the Chairman of the Committee for this preliminary report, I am concerned about the time the Committee is taking bearing in mind that the supplementary budget is on its way. It is not my intention to come across as pushy but indeed, there are some contractors and suppliers who haven t been paid for the last two financial years. This is really unbecoming. Look at the number of contractors whose property has been auctioned due to their inability to pay their loans. I wish to make a humble request to the Committee to make sure that these issues are resolved. Further, I don t see why the pending bills were not considered in the supplementary budget. Going forward I would like to urge the Committee to incorporate such bills in the budget since that is the only way we can help our contractors and at the same time implement our projects in good time. Thank you Mr Speaker. Speaker: Yes Member for Wanjohi, Hon. Isaac Kung u. Hon. Isaac Kung u: Thank you Mr Speaker, I stand as a member of the said committee and I wish to bring the members of this Hon. House to speed; we are in a crisis. I have heard my colleague from Nyakio talk of timelines and even urging the committee to hurry up and I wish to paint the real scenario for the House. We are living at a time when the committee requests members of the Executive to appear before the committee and they fail. We ask them to furnish us with information but they don t. When we ask questions, we are accused of interfering with the executive s functions. I want to lay it out frankly, and this should go to the Hansard, that the Finance Committee shall not be able to operate like this. We are supposed to tackle very serious finance issues affecting our county today and we don t know how we are going to operate. Some of us are seriously demoralized; we are not sure how to go forward with this issue because we might come here and promise things we might not be able to deliver. Some of the members of the Executive, when invited to appear before the Committee, claim

4 14 November, 2018 COUNTY ASSEMBLY DEBATES 4 that they have to be invited through the County Secretary. You ask them to come report what they are planning about the pending bills and no one seems to care. When we met the contractors at the Royal Garden, we learnt that some are in hospital while others are having their property auctioned. There are cases where these contractors took out commercial loans, they did the work and were duly awarded the completion certificate three four years ago but are yet to be paid. When we invite the Executive to give us the way forward, no one appears. It seems there is a misconception on how we are supposed to conduct our business as an Assembly. We need a high level intervention. The committee of Finance cannot possibly handle this issue alone. The Chair may not be in a position to address this but we need to know; what are the policies governing such issues. The supplementary budget is coming but it has no provision for these bills and when we ask about it we are told to wait for a forensic audit. If a road was done for 2015 and you want to audit today, what do you expect to find, bearing in mind the kind of rains experienced in this County? As the chair makes a ruling on this very grave issue, I think we need an intervention. We need to sit with the treasury and chart a way forward in regard to these pending bills. Some of the contractors names do not even exist in the list we have been given by the executive. Thank you Mr Speaker. Speaker: Yes Member for Gathaara, Hon. Andrew Kamau Kariuki Hon. Kamau Kariuki: Thank you Mr Speaker, I think as a House, we need to take this issue very seriously. When we were campaigning, we promised our youth that we would give them contracts. Now everything for them is a struggle. They have to struggle to access the loan, get the contract and now, when they have completed the work, it is a struggle for them to get paid. We are discouraging the youth from applying for these contracts, Mr Speaker. Although the Assembly s role of oversight is constantly being undermined, we must stand strong and help our people. Thank you Mr Speaker, Sir. Speaker: Yes Member for Kipipiri, Hon. Paul Ngeche Hon. Paul Ngeche: Thank you Mr Speaker, Sir. As is, the Committee on Finance does not inspire hope in our people. It is high time we invoked our powers, which are equal to those of the High Court. If people do not honour summons, we want to see them arrested. If our committees are unable to do this, maybe they should be retrained and urged to up their game. Thank you Mr Speaker. Speaker: Members, I wish to express my reservations with regard to what has been happening. If I am not wrong, Chairman, you are reporting for the second time that you are unable to proceed with this matter and report back to this House. We can remember that when this report came to the House, the members agreed that the most time they can give to the Committee is only 60 days because we know the kind of pain our contractors are going through. These are people that did their work and money had already been allocated in the Budget. Further, some of these contractors were awarded certificates of completion by qualified engineers and are therefore supposed to be paid. We have not heard that any officer has been sacked or penalized because he/she awarded a false certificate. So, there is no question on whether the due process of issuing completion certificates to these contractors was followed yet we, as government officers, are still getting our salaries while our contractors are dying in hospitals; their property is being auctioned. We are not taking this issue kindly but we also understand and have seen what happens when we summon officers from the executive. Our powers, under Article 185 and Article 195 and the Powers and Privileges Act, are clearly stipulated. It is unfortunate that this matter has never been reported to this House. As the member for Wanjohi has said, I think it is important that the Committee reports to this House what happens and takes the appropriate measures. If we shall have to arrest somebody and bring him to the committee, so be it. We have those powers. We are not going to look for these powers as they are clearly stipulated by law. You

5 14 November, 2018 COUNTY ASSEMBLY DEBATES 5 can only refuse to come if it was in your own interest to come. If you are charged before this House and you are given an opportunity to come and defend yourself and you turn it down, that is on you. If, on the other hand, you are called to come and give information to this House; to answer questions to this House to conclude its inquiry, you have no option. You will either come here voluntarily, through summons or by a warrant of arrest. There is no fourth option. We expect the Committee to provide the House with these things. We have to do away with the issue of pending bills. It is a black-spot for all of us in this and the previous government. This is an issue that our people feel we are not able to help with yet money was allocated, work was done and certificates were issued. Chair I expect you to liaise with the Clerk s office to have a motion of extension, sit with the Committee and let us have a report here. Let us, for example, know that you summoned a certain officer and he/she responded that they were attending the games in Kisii. That will be in contempt of the Committee and by extension contempt of this House. If we can allow these things to happen, there is no need of this House. This House is here to ask questions on behalf of our people. If we are not able to do that, I do not think there is much we are doing in this House. Let us have that motion extended and report to this House the difficulties you are going through. The House shall take the necessary measures. Next order. 2. STATUS OF THE HEALTH FACILITIES IN THE COUNTY Speaker: Very well, Yes, Member for Leshau Pondo, Hon. Peter Gathungu Kamau. Hon. Gathungu Kamau: Thank you, Mr Speaker. The duties have been delegated to me. The last time I was here it was claimed that I threw a document because I did it with very high speed due to the prevailing circumstances. Today I am going to properly table the document, Mr Speaker. The Chair for the Committee on Health is not around and he has therefore delegated his duties to me. This is in regard to the report of the Committee on Health Services on the Status of the Health Facilities in the County. Mr Speaker, I table the document. Thank you. Speaker: Very well, the report of the Committee of Health Services on the Status of the Health facilities in the County is duly tabled. The House Business Committee shall give directions on how the same shall be processed. Next order. NOTICE OF MOTION STATUS OF HEALTH FACILITIES IN THE COUNTY Speaker: Very well, Yes Member for Leshau Pondo, on behalf of the chair, Hon. Ngumo Ngamau. Hon. Gathungu Kamau: Thank you, Mr Speaker. I can see the Committee s Chairperson has come but he has not settled. I, therefore, will continue. I beg to give notice of the following motion; THAT this House does adopt the report of the Committee on Health Services on the Status of health facilities in the County as a report of this House and the recommendations therein as the resolutions of the House. STATEMENT(S) RESPONSE TO A STATEMENT SOUGHT ON COUNTY SUPPLIERS PREQUALIFICATION Speaker: Yes, Member for Kanjuiri-Ridge and the Chairman Finance and Economic Planning, Hon. Suleiman Kihika Kimani.

6 14 November, 2018 COUNTY ASSEMBLY DEBATES 6 Hon. Suleiman Kimani: Thank you, Mr Speaker. The circumstances surrounding this report are not different from what I said earlier. And, to add on what you have said, I have heard the Speaker of the National Assembly say that cabinet secretaries are supposed to appear before the committees and if they fail, they should delegate the duty to junior officers in their offices so that they can respond to what is being asked by the different committees. So, Mr Speaker, we have a problem here. I did not mention this before as I knew we have many members in my committee and I knew one would mention it. I also did not want to mention it as the Chairman, as it would have appeared as if I was intending to intimidate them. Members, you have therefore done a good job by reacting to that. We are not at war; we are just doing our work and we have to do it as we are mandated to by the constitution. Mr Speaker, I have a preliminary report in response to a statement sought by Hon. Sambigi Mukuriah, M.C.A Githioro, on the suppliers pre-qualified by the 3 rd of July It is just a repeat of what I have said from the other response. Speaker: Have you tabled the preliminary report? Hon. Suleiman Kimani: I already tabled the preliminary report. Let me go through the report so that the members can see where I am coming from. The committee has not been able to adequately respond to the statement sought by Hon, Sambigi Mukuriah, M.C.A. Githioro ward on the suppliers pre-qualified by the 3 rd of July 2018 due to the following reasons stated below: The committee via a letter dated 27 th June 2018 with reference that sought information with regard to the prequalification on the suppliers of goods and services including public works. The information sought included the following: i. A list of suppliers of goods services and works prequalified following the advertisement that closed on the 27 th of April 2017, the category for which they were prequalified and the awarded tenders thereof. ii. A list of suppliers of goods, services and works prequalified following the advertisement that closed on the 3 rd of January 2018, the category for which they were prequalified and the award of tenders thereof. iii. A list of all contractors awarded by the respective departments in the financial year 17/18 and the dates that the awarded contractors were prequalified. After a lengthy and undue delay the CECM finance and economic planning forwarded to the committee these two bunches of files. The files contain lists of prequalified suppliers of Nyandarua county government. The committee noted that there is an omission of a list of contractors awarded by the respective departments in the financial year 2017/2018 and the date that they the awarded contractors were prequalified. This means that the documents were not updated as per the requests of the committee and the requests of the statements that was sought by Hon. Sambigi. The list thus omitted was to be submitted to the Office of the Clerk by 13 th August 2018 but we have received no response to date. The committee is currently considering summoning the relevant CECM in order that the statement sought can be adequately responded to. Those are the challenges we have and we need a way forward because our work is becoming harder by day. It is upon this House to decide what we are going to do. Nowadays we do not see the need of holding committee meetings because we are not able to do what is supposed to be done. We need a way forward so that we can do our work as stipulated in the constitution. That is the preliminary report on how the committee has done its work on this. Thank you Mr Speaker. Speaker: Were there timelines on that? Hon. Suleiman Kimani: Mr Speaker we do not have timelines.

7 14 November, 2018 COUNTY ASSEMBLY DEBATES 7 Speaker: Does anyone have any contribution to make towards that preliminary report by the committee on Finance and Economic Planning? Yes, member for Gathaara Hon. Andrew Kamau Kariuki Hon. Kamau Kariuki: Thank you, Mr Speaker. I am aware that this task has no timelines, but can the Assembly set timelines? That is the only way we can assist the Committee in its work. Thank you Mr Speaker. Speaker: Yes Member for Njabini Kiburu Hon. James Kiiru Gachomba. Hon. James Gachomba: Thank you Mr Speaker. I want to comment on the prequalification of contractors and suppliers in the county. It expected that the chairperson is expected to respond to the statement but the chief officers cannot even cooperate. They are not handing in the requested documents. We have a problem with that department. He has said that soon they will be summoning the CECM Finance to elaborate more on this. I think you should have concluded we need to deal with these people ruthlessly if they will not supply any information that this Hon. House requires. We also need to know the criteria that was used to award those tenders. Mr Speaker I am in agreement with the chair that they even dated when they were supposed to submit these documents to the committee were not honoured. We need to move fast and make sure this Committee is empowered to perform its mandate in accordance with the law. Thank you, Mr Speaker. Speaker: Yes, Member for Weru Hon. Mbogo Mburu Hon. Mbogo Mburu: Thank you Mr Speaker for giving me an opportunity to contribute to this statement. Mr Speaker, it is embarrassing when we have two statements sought and the response is that information was not delivered. It is evident that the issues of pending bills and new prequalified companies are revolving around the procurement process. That is one office. Mr Speaker I suggest that whenever a chairperson brings a response and claims that information was not forthcoming, as Hon. Ngeche had suggested, we need to know the specific office that failed. Our work in this institution is strictly, as you have said, to ask questions on behalf of our people and we should not be here if we are not questioning anything. I have been going through the same challenge with the Roads Department and the chairpersons need to point out the office that failed and the particular officer s name and when we deal with two or three then things will be streamlined. It is shameful to come to this Assembly and say that information was not forthcoming. That will be routine. Speaker: Yes Deputy Speaker and the Member for Nyakio Hon. Zachary Mwangi Njeru. Hon. Zachary Njeru: Thank you, Mr Speaker. I think the statement s response is a very urgent matter and ought to be treated as such. In my ward, for instance, there are four projects that were supposed to have been done during the last financial year but the contractors have never reported. Some reported and graded the roads and went away. I wonder whether these contractors had the capacity to do that work. Do they feel protected? I enquired from the departments concerned and I was told that they were given termination letters and they have not yet responded to. Do we have not timelines for these works? What is difficult for a contract to be given to someone else if one is awarded a contract and time for that contract elapses? Let us stick to the timelines. We had elections that were difficult which were followed by unpredicted heavy rainfall. (Hon. Paul Ngeche rises a point of order) Speaker: What is it Member for Kipipiri Hon. Paul Ngeche?

Paul Ngeche: Mr Speaker, is it in order for the Member to anticipate debate on contracts awarded for works of financial 2018/2019 while we are dealing with the issue of pending bills. Speaker: Member for Kipipiri, I said that it is good to be adventurous in a debating chamber. Hon. Paul Ngeche: Is it in order for the Deputy Speaker to anticipate the debate about the pending bills. Speaker: Hon. Ngeche, it is good to be adventurous sometimes in the debating chambers, he actually cannot be judged to be out of the debate because he is talking about the source of this pending bills which are contracts. When this contracts are not done on time ten they end up becoming pending bills or they are reverted back to treasury. I think he is in order from the line he is coming through. Proceed member for Nyakio. (Hon. Isaac Kung u rises on a point if information) Speaker: Do you need the information from the Member of Wanjohi? Hon. Zachary Njeru: Yes he can go ahead. Speaker: Hon. Isaac Kung u, proceed. Hon. Isaac Kung u: I think the Hon. Deputy Speaker is in order because what we are discussing here is the pre-qualification of contractors for the year 2017/2018, which the work is going on. I think he is in order in what he is discussing. Speaker: Actually the Member for Wanjohi was just being diplomatic, he wanted to tell the Speaker that his directions were not correct because I gave directions on pending bills while the subject matter is pre-qualification. We are actually at the centre of dealing with the issue at hand. Proceed. Hon. Zachary Njeru: Thank you Mr Speaker. That was actually the only way, owing to the fact that those who have completed their work will be paid possibly in the upcoming supplementary budget. I however tend to wonder how we are going to go about it because the work has not been done and the allocations had already been done. With this in mind we can all see we need to allocate them again in the upcoming budget and this will bring a lot of problems, because as the member for Nyakio, there is no way I will agree to lose some allocations that had been set aside for a road in lump sum. It is therefore a high time that the committee moves with speed to respond to the same. Thank you. Speaker: Yes, Member for Gathanji Hon. Ngumo Ngamau. Hon. Ngumo Ngamau: Thank you Mr Speaker, I also want to give my contributions on this issue and particularly because I have an ECDE class in my ward that was awarded to contractors early this year and the work has never began. On enquiring about it, I was told that the contract was terminated. I again want to, know who approved the fabricated materials for constructing the ECDE classes? This is another tall order! We know we were supposed to approve the changes in the event we were moving from the blocks to the fabricated materials which is not very good. As somebody else also said, we have become toothless, what do we do to make sure that the CECMs are on toes? This people are just full of PR. Like Hon. Mbogo has said, go to the roads department, health department and you will find the same thing. Lastly, I did talk to the Chief Officer for Health and he told me that we are not supposed to write to them directly if we need anything. We need to go through the County Secretary, is this really in order? I would like to know that. Thank you.

9 14 November, 2018 COUNTY ASSEMBLY DEBATES 9 Speaker: Members, I am actually becoming very worried. In essence and as a matter of fact, we are being reduced below the people we are representing and this cannot inspire any hope to our people at all. Under article 35 of the Constitution, access to information it reads Every citizen has the right of access to: a. Information held by the state. And under Access to information act, it is very clear, elaborating even the timelines on when somebody asks for information. If you want more information on this article, you can go to the Access to information act. b. Which reads, information held by another person and required for the exercise or protection of any right or fundamental freedom. This are the fundamental rights of the contractor and our people who want to do business with the County Government of Nyandarua. I believe when the Member for Githioro asked for this information, it is because the talk of the people in this County is that they are not awarded contracts. They have come to this House asking and wanting to know who the people who have been given contracts are. When we do not give this information, what do you expect the people to do? The people will actually conclude that this list is not being taken to the House because the people of Nyandarua do not even benefit from this contracts. But if the response from the finance committee was timely done, and we get to be given the list of all the prequalified persons, then we can tell for example that Mheshimiwa Ngeche was given this contract and he comes from Kipipiri. When this kind of information is not even submitted to the House, what do you expect the people of this County will conclude? This are kind of positions that put us in very awkward positions. I hope all this things will be questioned. That the clerkship is supposed to write to the County Secretary, the law is very clear. This House can summon anyone. And we do not have to pass through any medium. If the Executive has its own administrative issues, that is its business. We are not even interested to know how they have done it. What we are interested in is to see that the person we have summoned has come. Whether he has to go to Nairobi and come in reverse, we do not care, we just want to see them here.
