2 MOTION -REPORT OF THE COMMITTEE ON APPOINTMENT ON THE VETTING OF THE NOMINEE FOR COUNTY EXECUTIVE COMMITTEE MEMBER FOR TOURISM, TRADE. COOPERATIVE AND ENTERPRISE DEVELOPMENT (BY THE LEADER OF MAJORITY) Hon. Fayo: Thank you Mr. Speaker Sir. I rise to present the Motion; THAT, Pursuant to the provisions of standing Order No.182 of the County Assembly of Isiolo Standing Orders, this County Assembly debates and adopts the Report of the Committee on Appointments on the Appointment of Tiyah Galgalo Ali as County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise development as contained in the Report. I now read the report of the Committee on Appointment of vetting of the nominee for position of County Executive Committee Member for Tourism, Member for Tourism, Trade, Cooperative and Enterprise development dated 19 th October, The Committee on Appointments is established pursuant to the provisions of Standing Order No. 187 of the County Assembly of Isiolo Standing Orders which gives the committee mandate that, the Committee on Appointments shall consider, for approval by the County Assembly, appointments under Article 179(2) of the Constitution (County Executive Committee Members). Committee Membership The Committee was constituted by the County Assembly on Friday, 8 th September, 2017 and further recommitted to the County Assembly on Wednesday 4 th October, 2017 for approval as previously constituted comprising of the following Members: -

Abdi Sora - Member Message from His Excellency the Governor Pursuant to Article 179(2)(b) of the Constitution, H.E. the Governor, forwarded to the Clerk of the County Assembly, the nomination of Ms. Tiyah Galgalo Ali vide letter dated 11 th October, 2017 for vetting by the Committee on Appointments and consideration for approval by the County Assembly for appointment as County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development. Committal to Committee on Appointments Pursuant to the provisions of Standing Order No. 43 of the County Assembly of Isiolo Standing Orders, the Honourable Speaker informed the County Assembly on Thursday 12 th October, 2017 that he had received the notification of the nomination. The notification of nomination was therefore referred to the Committee on Appointments pursuant to Standing Order 43 (2) on the 12 th October, 2017 for vetting and reporting to the County Assembly within 14 days in accordance with Standing Order 43 (4). Committee Meetings The nominee appeared before the Committee on Thursday, 19 th October, 2017 at 9.00 am and was vetted in accordance with the provisions of the County Governments Act, No. 17 of 2012, the Public Appointments (County Assemblies Approval) Act, No. 5 of 2017 and the County Assembly Standing Orders on her suitability for appointment to the position of County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development.

4 The Committee held several Sittings in consideration of this matter from the scrutiny of documents to the day of oral vetting of the nominee. Acknowledgement May I take this opportunity to thank all Members of the Committee for their input and valuable contributions during the deliberations and vetting exercise. The Committee also takes this opportunity to thank the Offices of the Speaker and of the Clerk of the County Assembly for the support accorded to it during the vetting exercise. On behalf of the Committee on Appointments and pursuant to the provisions of Standing Order No. 182, it is my pleasure and duty to present to the County Assembly, the Committee s Report on the vetting of the nominee for appointment to the position of County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development. Thank you. BACKGROUND Establishment of the Committee The Committee on Appointments is established under Standing Order No. 187(1) with the mandate to consider for approval by the County Assembly, appointments of County Executive Committee Members pursuant to Article 179(2)(b) of the Constitution. The said Article requires H.E. the Governor to nominate and with the approval of the County Assembly, appoint County Executive Committee Members. Appointment Process of County Executive Committee Nominee In accordance with the provisions of Article 179(2) (b) of the Constitution, H.E. the Governor, forwarded to the Clerk of the County Assembly, the nomination the vide a letter dated 11 th October, 2017 for vetting by the Committee on Appointments and consideration for approval by the County Assembly for appointment as County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development.

5 A report of the committee on appointments approved by the County Assembly in a Special sitting on 6 th October, 2017 had identified a lack of the gender rule compliance as provided for in Section 35(2)(a) of the County Governments Act, No. 17 of The committee on appointments and county assembly was guided by a letter from the Governor dated 25 th September, 2017 ref ISL/CG/GVN/A.1VOL.1/2 identifying a shortfall in the nominations and that assured there will be a female nominee to the County Executive. Article 179(3)(a) provides that the number of members appointed under clause (2)(b) shall not exceed one-third of the number of members of the county assembly, if the assembly has less than thirty members. This provision of Article 179(3)(a) therefore limited the number of the Isiolo County Executive Committee Members to be appointed under Article 179(2)(b) to six (6) and hence to be within the requirements of the law, the Governor had to revoke one of the male nominees as previously approved by the County Assembly to nominate a female nominee for approval. This therefore resulted to the nomination of Ms. Tiyah Galgalo Ali as the nominee for Tourism, Trade, Cooperative and Enterprise Development. Notification to the Public Section 7(4) of the Public Appointments (County Assemblies Approval) Act, No. 5 of 2017 provides that the candidate should be informed of the time and place of the approval hearing. The Clerk of the County Assembly placed a notice in the print media on Friday, 13 th October, 2017 informing the candidate and the public of the time and place of the approval hearing and also inviting the public to submit memoranda by way of written statements on oath (sworn affidavits) on the suitability or otherwise of the nominee in conformity with section 7(10) of the Public Appointments (County Assemblies Approval) Act, No. 5 of The submissions were to be received latest by 18 th October, 2017 at 5.00 pm. Clearance Requirements The public notice circulated by the clerk through the print media on Friday, 13 th October, 2017 informed the nominee of the required documents on the vetting day as follows; i. Filled questionnaires giving background information and touching on the experiences of the candidates;

6 ii. National ID or Passport; iii. Original academic and professional certificates, Curriculum Vitae and any other relevant testimonials; and iv. Bring letters/ certificates of Clearance from the following institutions:- a. Kenya Revenue Authority (K.R.A); b. Ethics and Anti-Corruption Commission (E.A.C.C); c. Criminal Investigation Department (C.I.D) Certificate of Good Conduct; and d. Higher Education Loans Board (H.E.L.B). VETTING OF THE NOMINEE In conducting the vetting process, the Committee on Appointments examined the nominee against the following criteria, amongst others, as set out in the Public Appointments (County Assemblies Approval) Act, No. 5 of 2017: - (i) Academic qualifications (ii) Employment record (iii) Professional affiliations (iv) Potential conflict of interest (v) Knowledge of the relevant subject (vi) Overall suitability for the position (vii) Integrity (viii) Vision and leadership (ix) Expectations and key priorities MS. TIYAH GALGALO ALI TOURISM, TRADE, COOPERATIVE AND ENTERPRISE DEVELOPMENT Ms. Tiyah Galgalo Ali, County Executive Committee Member nominee for Tourism, Trade and Enterprise Development appeared before the Committee on Thursday, 19 th October, 2017 at 9.00 a.m. and was orally interviewed under Oath pursuant to the provisions of the Constitution of Kenya, the Public

7 Appointments (County Assemblies Approvals) Act, No. 5 of 2017 and the Standing Orders of the County Assembly. The nominee presented as follows, both orally and in writing: - Date and Place of Birth 1. She is a Kenyan citizen born on 12 th November, 1966 in Chari Ward, Merti Sub-county. Academic and Professional Qualifications 2. She graduated with a Master of Education (in Educational Administration and Planning) from the University of Nairobi on 7 th May, 2004; and 3. Graduated with Bachelor of Education (Arts) from Kenyatta University on 21 st August, Employment Record 4. County Member of Parliament Isiolo County (4 th March, th August, 2017); 5. Worked as Commissioner of the defunct Interim Independent Electoral Commission between 11 th May, 2009 to 14 th November, 2011; 6. Commissioner, Poverty Eradication Commission (15 th August, th May, 2009); 7. A Programme Officer Pastoralist Development Network; 8. Principal, Isiolo Girls High School (Teachers Service Commission) (from October 1992 December, 2004); 9. Ms Kenya: Assistant Consultant: Baseline assessment on Peace Building in Isiolo, Laikipia and Marsabit (December 2007 March 2008); 10. Ministry of Education, Somaliland: Assistant Consultant: Development of National Draft Policy and Female Participation in Education and training manual for gender resource persons (November December, 2007) 11. CCSMKE and Tear Fund UK Assistant consultant: Baseline survey of Marsabit District for disaster management programme. Areas covered: humanitarian assistance, water and sanitation, Peace building and conflict resolution (August September, 2007);

COSPE and UNDP Somalia: Lead Consultant: Trainer on Women and local governance under Somali Women in peace building and reconciliation in Gedo region of Somalia (December, 2006 February 2007); 13. UNICEF KCO Leader consultant: UNICEF, Research on impact of cash susidy on OVC in Kibera, Korogocho and Kangemi; 14. UNICEF Research assistant: Child Domestic Labour in Nairobi and Garissa for UNICEF Country office (August October, 2004); 15. World Food Programme Consultant/ Trainer for HIV/Aids at workplace for staff in Kenya and Somaliland (November, 2004 May, 2005). Net Worth: 16. The nominee s net worth is Kenya shillings 250 Million as indicated in her written submissions. Potential Conflict of Interest 17. She declared that she does not have any persons or matter that would present a potential conflict of interest should she assume the position of County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development. Pro-bono/Charity Work 18. The nominee was involved in offering volunteer work, mentorship programs, donations of books, girl s education sponsorship/ scholarship, women economic empowerment and support, medical camps and gifts for exemplary performers among others. Integrity: 19. The nominee has neither been charged in a court of law nor been mentioned in any investigatory report in the last three years. She has also never been dismissed or otherwise removed from office for contravention of the provisions of Article 75 of the Constitution. 20. She has fully complied with her tax obligations with Certificate No. KRAWON dated 27 th February, 2017 from the Kenya Revenue Authority.

She is fully cleared by the Higher Education Loans Board with certificate No dated 14 th June, The Director of Criminal Investigations issued the nominee with a Police Clearance Certificate Ref No. PCC-AAAASYH6 dated 3 rd March, The Ethics and Anti-Corruption Commission cleared her on 24 th February, 2017 confirming that there are no outstanding issues or ongoing investigations against the nominee. 24. The nominee has been cleared by MetroPol Credit Reference Bureau via CRB Certificate No. MCRB/C General and Sector Specific Questions to the Nominee on her suitability, vision and expectations in the sector The Committee posed several questions to the nominee on her past work experience and knowledge on the Tourism, Trade, Cooperative and Enterprise Development sector and she responded effectively to the satisfaction of the Committee. The nominee, being the immediate Member of Parliament (Woman Representative) for Isiolo County and a local person, is conversant with the challenges facing Tourism sector in the county and the trade and cooperative challenges as a result of the Sacco and cooperatives being a new concept in a larger part of the County. The Committee learnt the positive spirit of work from the nominee for her urge to empower the community first through her efforts to sponsor a bill on disaster management in parliament, spearheading the introduction and success of the NYS Programme in the County, ensuring that a substantial budget was allocated for the completion of the Gotu bridge and through the commitment to get a certificate for the disabled to be exempted from paying taxes. The nominee recognizes the diverse cultures within the County that she assured the committee on her commitment to exploit the Counties tourism potential by empowering these diverse cultures. The nominee assured the committee of her commitment to introduce legislations and policies to guide the operations of the Sector. She has a great urge to

10 improve the human resource in the sector and identify the loopholes causing low revenue collections in the County. On corruption, the nominee identified poor systems as a major cause and is therefore committed to ensure the systems are working and are easy to audit for proper accountability in the use and collection of public resources. The nominee also identified the urgent need to put staff/ public officers on integrity tests to improve on the integrity levels to seal the corruption loopholes. The nominee displayed her vast experience, educational qualifications and expertise and therefore is suitable to serve as the County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development. COMMITTEE OBSERVATIONS The Committee having considered the nominee s filled Questionnaire pursuant to Section 7(8) of Public Appointments (County Assemblies Approval) Act No. 5 of 2017, her Curriculum Vitae and having heard her oral submission during the vetting exercise/interview, made the following observations on her suitability for appointment as County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development: - 1. THAT, she satisfies the requirements of Chapter 6 of the Constitution of Kenya on leadership and integrity having been cleared by the Kenya Revenue Authority, Higher Education Loans Board (HELB), Ethics and Anti-Corruption Commission and the Credit Reference Bureau. 2. THAT, shehas no potential conflict of interest. 3. THAT, she has never been dismissed from office for contravention of the provisions of Article 75 of the Constitution which deals with conduct of state officers. 4. THAT, she exhibited impressive knowledge of topical issues touching on the docket of Tourism, Trade, Cooperative and Enterprise Development and has the requisite abilities, qualifications and experience. Therefore, the Committee found the nominee suitable for appointment as the County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development.

11 COMMITTEE RECOMMENDATION Pursuant to the provisions of Article 179(2)(b) of the Constitution of Kenya, 2010, Section 35 of the County Governments Act No. 17 of 2012 and Standing Order No. 43(4), the Committee recommends that the County Assembly approves the nomination of Ms. Tiyah Galgalo Ali for appointment by His Excellency the Governoras the County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development. Hon. Abdi: Thank you Mr. Speaker Sir. I stand to support the Motion. As a Member of the Vetting Appointment Committee, we have followed due procedure to vet the nominee, and we have found that she has vast experience; that is a value addition to this County and she can perform. So, mine is to urge Members of County Assembly to adopt the report as it is. Thank you. Hon. Kunune: Thank you Mr. Speaker Sir. I stand to support the report of the nominee of Tourism, Trade, Cooperative and Enterprise Development, Ms. Tiyah Galgalo; that she is a vibrant, hard working, and she was a leader before. Once a leader, always a leader. So, I support. Thank you. Hon. Dekha: Thank you Mr. Speaker Sir. I stand to support the Motion. I appreciate the Committee for the good job. Mr. Speaker, I welcome and support the appointment of Ms. Tiyah Galgalo as CEC for Tourism. She has all that it takes for the position she is a appointed to. To be brief, I agree with the report of the Committee on Appointment. I therefore leave a note to the report and congratulate Ms. Tiyah Galgalo on her appointment as a CEC. Thank you Mr. Speaker Sir. Hon. Lemantille: Thank you Mr. Speaker Sir. I also support the Motion and I appreciate Hon. Konso. Once in this House we notice the imbalances of gender. She is here to fight for the right of the gender. I really appreciate that you give us the notice on the same Mr. Speaker. I think she is the most honest and I respect all that she does. She stood up for the position of Ms. Tiyah to stand for gender and, Mr. Speaker that day and supported this issue particularly on not

12 having the gender balance. So, thank you Honourable Member and continue doing that. Mr. Speaker, as for the nominee, I think this is the right person for this. She is a politician and very conversant with the County, and we have the problems of Tourism and I think she is going to change this Ministry. In terms of Trade, we know, we have the problems with it and the funds for the special groups, especially for youth, women and persons with disability, I think the CECMs. Tiyah Galgalo is going to look into these issues as part of her docket and make sure those vulnerable people get their right. I know Mr. Speaker, in the former Government we had the same funds and these special groups have not got anything in this docket. So, I think she will look at these and ensure they get the funds. I support the Motion and the appointment of the CEC. Thank you. Hon. Nura: Thank you Mr. Speaker. I stand to support the Motion. Mr. Speaker Sir, the Governor promised us, a gender balance in his last appointment, and here we have Hon. Tiyah for that purpose; and if you check experience, she has all the experience required to serve in the docket, and she has vast work experience. She is connected to several UN departments, so she can even source funds for development of this County through her networks. She has also served as Women Representative for the last five years, so she has the legislative experience to even assist in this House, Mr. Speaker. So, I say the nominee is qualified for the position and I beg the House to approve. Hon. Sumeiya: Mr. Speaker Sir. I also stand to support the appointment of Hon. Tiyah Galgalo to be the CEC Member of Tourism, Trade and Cooperative Society. Mr. Speaker Sir, failure doesn t come from falling down, but failure comes from not getting up. Yourselves and Hon. Tiyah are living proof. Tough situations build strong people. We all know what she went through during the campaigns, it was vigorous, and we are all aware that Hon. Tiyah Galgalo was our Women Representative once, for the period of five years. During her tenure, she did very well in serving the people of Isiolo. It will be good for us to have her around, since she is tried, tested and trusted. Thank you Mr. Speaker. Hon. Speaker: I now put the question. Sorry, the Mover can you reply to the Motion? Hon. I wish to thank the Committee on Appointment which includes, the Speaker and the Clerk of the House for the commendable job they did in the morning, at the time of vetting of the nominee. And I also thank the House for supporting the Motion on this appointment and

13 for approving this nominee for the position of County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise Development. Thank you Mr. Speaker. Hon. Speaker: I now put the question;that, Pursuant to the provisions of standing Order No.182 of the County Assembly of Isiolo Standing Orders, this County Assembly debates and adopts the Report of the Committee on Appointments on the Appointment of Tiyah Galgalo Ali as County Executive Committee Member for Tourism, Trade, Cooperative and Enterprise development as contained in the Report. (Question put and agreed to) POINT OF ORDER. Hon. Lemantille: Mr. Speaker Sir, I stand on point of Order on Standing Order number 183. I think the Leader of Majority should give us the Business for the coming week, which we skipped, which we have in the second session. The point of Order on 183 is that I would like to give the progressive report of the Ad hoc Committee and also our expertise. Mr. Speaker, the County Assembly during its sittings on Wednesday afternoon through a resolution on a motion established an Ad-Hoc Committee on Emergency with the following mandates Terms of reference Comprehensively assess the drought and famine situation; Inquire into distribution of emergency relief supplies from the National Government and recommend ways to create synergy on the interventions initiatives of both levels of government; Monitor on the provisions of other emergency efforts by both levels of Government; and Bring a Report to the County Assembly giving recommendations on ways to improve the food security in the county in two weeks.

14 Mr. Speaker, the formations of the Ad-Hoc committee was informed by findings of the Members of the County Assembly visits to parts of the County and neighbouring Counties to assess the drought and security situation for the pastoralists who have migrated to other Counties and remained within the County. Mr. Speaker, the drought situation remains critical in most parts of County and is currently on a worsening trend, with most part in the severe deficit in terms of pasture and water for livestock threatening the main source of livelihood of the local people. Mr. Speaker, since its establishment the Committee has made tremendous progress towards the achievement of the tasks assigned. Mr. Speaker, the Ad-Hoc Committee has held meetings with the following officers from the National Government and County Governments; 1. Deputy President The deliberations centred on the drought situations in the County and mitigations effort from the National Government. 2. Cabinet Secretary and Principal Secretary Ministry of Livestock Development the deliberations centred on three main issues a) Livestock off take programme - under the programme the County will be given 2500 cattle and 2000 shoats. each cattle will be bought at kshs. 18,000 each shoat will be bought at kshs. 3,000 the shoats will be slaughtered and meat donated to the local people b) Animal Feed Supplement - The Department will also provide animal feed supplements and deliver to the beneficiaries. However, the County Government may be called upon to support incase of logistical challenge and need arises.

15 c) Compensation for victims of Harr- Korr cattle rustling incident The Department plans to spend ksh.20m for compensation for the victims of cattle rustling at Harr- Korr in Cherab Ward which will be implemented under the Off-take programme. The Department was categorical that the compensation will target only those who lost their livestock during the specific raid. d) Water trucking The National Government through the Department Defence has given four water bowsers to support water trucking in some Wards. Mr. Speaker, implementation of these programmes from the National Government have already begun in most Wards. 3. County Commissioner The Committee discussed with the County Commissioner a) the availability of relief food supplies and modalities of distribution and how to overcome the challenges of distribution in the County. b). formalities of Off-take programme promised by the National Government c). compensation lists of victims of cattle rustling at Harr Korr in Cherab Ward 4. The Governor The Committee deliberations with the Governor centred on the release of emergency funds agreed upon during the Members of the County Assembly meeting at Samburu Simba Hotel as follows;

The Committee still expects a brief from the relevant CECs on any tangible progress. 5. National Drought Management Authority (NDMA) The committee discussion with NDMA revolved around the status of drought situation and mitigation effort from the agency as far as the current drought is concerned. Mr. Speaker, the timeline of 14 days given to the Committee by the County Assembly lapses today. But from this brief report it is clear the Committee has covered the bigger part concerning delivery on its mandate as tasked by the County Assembly. However, the Committee is yet to compile its comprehensive Report as required by the County Assembly. Mr. Speaker Sir, the Committee thus request for an extension of its timeline by 10 sittings from today 19 th October, 2017 to 30 th October, 2017 to deliver its report once the County Assembly resumes after the short recess.

It will be a Motion or Bill by Hon. Mumina Konso 2. The Management and protection for grazing blocks and patterns, so as to have reserves for pasture and water during dry seasons by Hon. Fayo 3. The County Government to hire rangers from local communities within the County to tackle security issues, such as road banditries, cross boarder conflicts and cattle rustling by Hon. Ali Dima 4. The County Government to re-open and equip the Almasi Children Home, which will greatly help those parents who struggle with their children with special needs at home and has burden them by Hon. Ann Stella. Thank you Mr. Speaker. Hon. Speaker: I think I will read the communication from the Chair, because the document was not ready. Now, I can read it. COMMUNICATION FROM THE CHAIR Honourable Members, today marks the culmination of the County Assembly s first part of the First Session of the Second County Assembly. As the County Assembly goes on the short recess, I wish to take this opportunity to thank and congratulate all the Members for their exemplary work and contributions towards the execution of the constitutional mandates of the County Assembly in the three key areas of representation, legislation and oversight. Honourable Members, I once again wish to commend the Members for the diligence and commitment to the business of the County Assembly both in plenary and in its Committees. Despite being new, the Members have displayed vibrancy and valued contributions to the businesses that came before the County Assembly both in plenary and the Committees. Just to highlight tremendous work done by the Second County Assembly since its inception, the County Assembly has transacted business as follows: -

Vetting of Nominees for the County Executive Committees- Honourable Members, the Committee on Appointment worked tirelessly under strict timeliness to ensure the conclusion of all the CEC vetting as required under the Constitution. ii. Motions a total of 27 Motions were introduced. Of these, 18 were ordinary Motions raised by individual Members while 9 are Procedural Motions. iii. Statements a total of 3 Statements were requested by Members from the Chairperson of various Committees. These statements are still awaiting responses from the concerned Chairpersons. iv. Reports the County Assembly deliberated and approved 3 Reports during the session. Honourable Members, as the County Assembly proceeds on the short recess, I wish to make the following communications 1. Committees all Committees take a deserved break from their busy sitting Schedule to give the Honourable Members time to meet with their electorate and get an opportunity to campaign for the presidential candidates of their choice. However, the Ad-Hoc Committee on Emergency is exempted from the break considering the important matter they are handling and the Liaison Committee to conclude on the matters of Committee budget. 2. Training Honourable Members, cognizant of the fact that the Second County Assembly is composed of mainly of newly elected and nominated Members, there is need for consistent and continuous training programme to capacitate Members to enable the County Assembly effectively executes its constitutional mandates. The staff of the County Assembly provides technical advice and facilitates the Members of the County Assembly to carry out their mandates. Thus the staff equally requires training to further enhance their capacity to support the Members in the effective discharge of their mandates. In view of the above, we have planned for a three days training for Members and legislative staff on county budgeting and related procedures; County

22 revenue and Budget implementations and reporting tentatively from 30 th October, Address by the Senator Honourable Members, Standing Order 22 provides for the address by the Senator. Honourable Members, I received a requests from the Senator on her desire to address the County Assembly.
