1 REPUBLIC OF KENYA THE COUNTY ASSEMBLY OF LAIKIPIA FIRST ASSEMBLY SECOND SESSION REPORT OF THE TRANSPORT AND PUBLIC WORKS COMMITTEE ON PLOT NO.131 JUA KALI, NANYUKI. Dated: 20 th March 2014
2 Preface Mr. Speaker sir, the Transport and public works Committee was constituted on 24 th April 2013 pursuant to provisions of Standing Order 191(1), it is my pleasure and duty to present to the County Assembly, the Committee report pursuant to a statement by Hon. Michael Kinyua. The membership of the committee is derived from S.O 191(1) and it comprises of the following; Hon.Francis Mukuria - Chairman Hon.Joseph Kabaci - Vice Chairman Hon.Catherine Waruguru - Member Hon.John Nderitu - Member Hon.Wilson Wakahiu - Member Committee Mandate Mr. Speaker sir, the Transport and public works committee is mandated to look into all matters related to county transport, including county roads, street lighting, traffic and parking, public transport and harbors, excluding the regulation of international and national shipping and matters related thereto county public works and services including storm water management systems in built up areas and sanitation services. The functions of the committee are as follows; a) To investigate, inquire into, and report on all matters relating to the mandate, management, activities, administration, operations and estimates of the assigned departments; (b) To study the programme and policy objectives of departments and the effectiveness of the implementation; (c) To study and review all county legislation referred to it; (d) To study, assess and analyze the relative success of the departments as measured by the results obtained as compared with their stated objectives;
3 (e) To investigate and inquire into all matters relating to the assigned departments as they may deem necessary, and as may be referred to them by the County Assembly; (f) To vet and report on all appointments where the Constitution or any law requires the County Assembly to approve, except those under Standing Order 184 (Committee on Appointments); and (g) To make reports and recommendations to the County Assembly as often as possible, including recommendation of proposed legislation. Report Methodology On 6 th March, 2014, a statement on plot No.131 on Jua kali Nanyuki was made before the County Assembly by Hon.Michael Kinyua, MCA Thingithu Ward. The statement was referred to the sectoral committee on Transport and public works for consideration. Mr. Speaker sir, the committee had a sitting which they invited the CEC, Transport and public works plus the technical team during which they deliberated on the matter. They also went on the ground where the subject plot is located and they made the following observation and recommendation. OBSERVATION 1. The Nanyuki Jua Kali is a surveyed area and registered under Jua Kali Association. 2. That plot No. 131 is in Jua Kali, which is a surveyed area. 3. The approval of development plan on plot No.131 was done in September 2013 and the meeting to stop any construction around and within the market was held on December 2012 and this is when the resolution was made and the plot which had been approved was not listed down to the members who were present during that meeting. 4. Some of the plots in the public land were illegally allocated.
4 RECOMMENDATIONS 1. All illegal buildings in the open air market area to be demolished. 2. The construction taking place in plot no.131 in Jua kali should stop immediately until further notice. 3. Pegging to be done on open air market. 4. The allotment process that was chaired by the clerk should be revoked. 5. An approval committee ought to be put in place. 6. The Members suggested due to self-interest between the physical planner, surveyor and the County Commissioner after they have allotted public land to individuals the same should be submitted to the County Assembly for approval. 7. The members also suggested that they want a copy of the minutes where this resolution was made as this Committee doesn t have evidence supporting the same. 8. Master plan shows that open air market is 6 acres. The members observed that inside the market there are private development which should be demolished after following the right procedure. 9. Some of the plots in the open air market have been leased out; these plots include plot No.8/258, , 649, and 586,589,591,592. And should be revoked. 10. Open air market to be demarcated, surveyed and beacons to be put in place and the CEC, for Transport and public works to facilitate this process. 11. Committee to be facilitated on finding out the root causes of the problem facing the open air market and the Jua kali.
