3 1 THE IDLO VISION A world free of poverty, in which justice and respect for each human being is ensured, and which is built on the rule of law. MISSION IDLO works to strengthen the rule of law and good governance in developing countries, in countries in economic transition and in those emerging from armed conflict. The rule of law is essential in order to provide security and reduce poverty by protecting individual rights and economic activity and by strengthening judicial and local institutions that guarantee a legal framework for trade and investment. IDLO s assistance is always enabling rather than directive or prescriptive, acting consistently with the notion of national ownership of development strategies as called for in the Paris Declaration. IDLO brings together diverse stakeholders at local, national and international levels to enable reform agendas and build on its alumni base to create active networks of legal experts in order to generate and diffuse knowledge. 4 Who We Are 2 IDLO is an international inter-governmental organization dedicated to promoting the rule of law and good governance in developing countries, countries in economic transition and in those emerging from armed conflict. The Organization was created first as a Dutch foundation in 1983 by lawyers working on development cooperation matters. They were concerned by the lack of balance in international negotiations and were convinced that there was a strong link between the rule of law and development. Their initiative won immediate international support. In 1988, IDLO was re-founded as an inter-governmental organization through a multilateral convention. In 2001, the United Nations General Assembly granted IDLO Observer Status, thereby enabling the Organization to establish a permanent liaison office at UN Headquarters in New York. To date, IDLO has worked with over 20,000 legal professionals in 175 countries. We support 46 legally established IDLO Alumni Associations around the world, which contribute to the overall impact and long-term sustainability of the Organization s work. Our Headquarters is in Rome, Italy, and we currently operate Project Offices in Afghanistan, Kyrgyzstan and Southern Sudan. IDLO also has a permanent observer office at the United Nations in New York and a resource development office in Seattle. Our Staff IDLO brings together some of the best development law specialists from around the world. At the center of IDLO is a team of highly experienced international jurists, specializing in core subjects such as legal and judicial reform, international trade law and procurement, health, intellectual property law, environmental law and social development. Through its Visiting Instructor Program, IDLO draws on the diverse expertise of over 2,500 legal experts. The Organization maintains an extensive database of relevant specialists, which includes legal advisors to governments and business, private legal practitioners and professionals from the United Nations and other multilateral bodies. 5 What We Do 3 IDLO works with people and institutions at all levels of society to build effective and fair legal frameworks and processes that create social and economic opportunity for all. In line with the OECD s Paris Declaration on Aid Effectiveness and the Accra Agenda, IDLO encourages its country partners to take charge of their own development agendas. The Organization works directly with lawyers, jurists, policymakers, regulators, civil society representatives, universities, research centers, public and private institutions and government ministries to empower them to actively contribute to their country s development. In 2008, IDLO underwent a transformation to Results-Based Management (RBM) and developed its Strategic Plan. This Plan marks a turning point for IDLO. It builds on IDLO s strengths as a convener, trainer, and technical assistance provider, to augment and extend its impact as a thought leader and implementation partner of choice. Why we need your support Each month, IDLO receives dozens of requests for assistance from state institutions, bar associations, women s groups, development organizations, training institutes and our own Alumni Associations. However, IDLO is supported through voluntary contributions from governments, multilateral organizations, private foundations, international businesses and individuals. As an inter-governmental organization, IDLO does not receive assessed contributions from its Member Parties. With its current level of financial support, IDLO can address only a small fraction of the many worthwhile requests it receives. A PARTNER OF CHOICE UN Photo by Marco Dormino (...) 6 IDLO s Strategy 4 IDLO s status as the only intergovernmental organization whose sole focus is fostering economic and social development through the rule of law gives it direct access to government leaders in the developing world, and also permits it to partner effectively with other multilateral organizations. IDLO is trusted by people of different backgrounds at all levels of society because it has a deep expertise in most legal systems and emerging global issues. IDLO achieves enduring results by using its vast alumni network to mobilize stakeholders at all levels of society and applying its comprehensive methodology to drive institutional change. IDLO s five Strategic Objectives, which are the foundation of its Strategic Plan, specify how IDLO works to create positive, sustainable development outcomes. law IDLO development 1. 7 IDLO Programs 5 IDLO works on legal and regulatory change in three main areas. Within each area, the Organization works on specific program themes, prioritized by their potential to achieve development aims. The cross-cutting themes of Gender and Human Rights are built into all of IDLO s programming. Photo Sheila McKinnon SUBSTANTIAL CONTRIBUTION IN ACHIEVING DEVELOPMENT GOAL We must remember that two high-level officials of the Ministry of Trade, Promotion of Small Businesses and Crafts of Burkina Faso have benefitted from IDLO training programs. The knowledge and capacities acquired during those programs have increased their effectiveness in the work they perform at the Ministry. They have also shared much information with economic actors to create business and to make investments grow. 8 Our Successes and Future Goals 6 Strategic Objective One, National Strategies and Frameworks, embodies IDLO s enabling, non-prescriptive approach. It is a philosophy that lies at the heart of the Organization s approach to development. IDLO has been working with the Government of Afghanistan since 2002, within the framework of its National Justice Program, to achieve the country s desired judicial reform goals. By partnering with key Afghan institutions, IDLO has provided basic legal skills training for over 2,000 judicial staff, who have gone on to extend IDLO s program impact by training their peers to become better judges and lawyers, something that would have seemed an unattainable prospect a few years ago. IDLO s current Afghanistan program, sponsored by the Italian Ministry of Foreign Affairs, is addressing the systemic challenges for girls and women to achieve protection and justice from, and participation in, the Afghan legal system. The Ministry of Women s Affairs primary database recorded 1,940 cases of violence against women from 26 (out of 34) provinces between October 2006 and mid offences outlined in the August 2009 Presidential Decree on the Elimination of Violence against Women (EVAW law). As its primary partner, IDLO has been providing technical and expert support to the Unit. Recently, two scholars from Al Azhar University in Cairo have joined efforts with IDLO to train prosecutors, defense lawyers, and judges to accurately interpret Shari a law, including the prohibition against forced marriage and imprisoning girls and women for running away from home. Multiple opportunities exist to reinforce the Afghan justice sector. At IDLO we believe in the sustainable enhancement of the justice system to increase the capacity of Afghan legal and justice professionals - one professional at a time. The Afghan Young Leaders Forum during a discussion (June 2010) In early 2010, the Attorney General launched a dedicated Violence Against Women (VAW) Unit to prosecute and investigate such cases and to enforce the 22 criminal IDLO played an instrumental role in the establishment of the VAW unit, and is working with us to enable victims to come forward and seek justice for crimes committed against them. We will promote prompt justice and accountability by upholding women's rights according to both Islamic Shari a and the general laws of the country. Ms. Qudsia Niazi, Head of the VAW Unit

9 7 IDLO s response to the 2004 tsunami disaster presents a compelling example of how legal expertise can assist vulnerable communities in crisis secure their rights - something encompassed by Strategic Objective Two, Legal Empowerment. In seemingly hopeless conditions, IDLO generated lasting social improvements by helping to make legal issues on guardianship, inheritance, and land rights widely understandable. Through educational films, radio and newspapers, IDLO s program reached people the law often overlooks. We similarly reached out to traditional institutions at the village level by enabling village leaders to mediate tsunamirelated legal disputes both fairly and efficiently. IDLO s substantial experience in Indonesia and Sri Lanka led to the publication of a manual on International Law and Standards Applicable in Natural Disaster Situations. Issued at the beginning of 2009, the Manual is an important reference tool for all actors concerned with post-disaster relief and recovery. Thorough research in the field of natural disasters, along with field experience, also led to an agreement, signed in 2010, between the United Nations High Commissioner for Refugees and IDLO. The Cooperation Agreement entrusts IDLO with the lead and coordination of the activities of the UN Task Force on Protection in Natural Disaster Situations. (The book can be found at A THOUGHT LEADER TO FIGHT EMERGENCIES HUMAN TRAFFICKING In India and Nepal, with thousands of children affected by human trafficking, sold by their own families or kidnapped by criminal organizations, the dimension of this tragic exploitation of human beings has attained the realm of a world emergency. IDLO is piloting a two-pronged innovative approach in the India-Nepal border area to prevent and combat the trafficking of girls for sexual exploitation. In partnership with a local organization, Sanlaap, IDLO s project offers victims and potential victims of human trafficking direct and easy access to legal and paralegal services. These services are provided at the first and most likely entry point for girls looking to be rescued from trafficking situations, typically in shelters or similar rescue points. In addition, IDLO s project features a training component focused on peers and mothers, aimed at making girls and their families aware of their rights and of how to realize them, either as victims of trafficking or in situations of vulnerability to trafficking.

10 8 The legal challenges posed by the HIV/AIDS pandemic help to illustrate the specific meaning of Strategic Objective Three, Global Challenges. The international community recognizes that a country s legal and policy environment is of paramount importance to its response to the HIV epidemic. UNAIDS has established a monitoring system to measure states progress in meeting their 2001 commitments. Yet, by 2007, few countries had taken steps to reform their legal frameworks consistent with international guidelines and best practice, and 64 percent of countries responding to a survey reported that they still have one or more laws in place that impede access to prevention, treatment and support services. In 2009, IDLO launched a three-year program to improve the legal and policy environment (laws, policies, practices, and implementation) for health, with a focus on HIV, as set out in Millennium Development Goal 6. Financial support for this Program is provided from IDLO core funds, and by the OPEC Fund for International Development (OFID), AusAID, the Ford Foundation, UNAIDS and UNDP. Within the framework of this program, IDLO has developed, in partnership with UNAIDS and UNDP, a practical guide to help lawyers, judges, police, government legal aid services, and non-government legal service providers to better provide accessible, affordable legal services. The Toolkit: Scaling Up HIV-Related Legal Services (available at is currently published in English, French and Chinese and has been distributed widely by UNAIDS. With support from UNAIDS, IDLO research on HIV-related legal services in Kenya, India, and Ukraine was published in September In 2010, IDLO also launched pilot projects to strengthen and expand legal services for people living with HIV in Benin, Burkina Faso, Egypt, Indonesia, Nepal, and Papua New Guinea. In China, IDLO published a survey of HIV-related legal initiatives (with Peking University), and the mid-term review of the HIV-related legal services project in Yunnan Province will be issued in December Photo Sheila McKinnon A THOUGHT LEADER TO FIGHT EMERGENCIES CLIMATE CHANGE Floods, heat waves, hurricanes, melting glaciers, forest fires these are all familiar headlines. For developing countries, who are the least equipped to adapt to climate change, these headlines mean lives lost and development delayed or denied. At IDLO, we recognize that the international response to climate change as well as national climate strategies will ultimately depend upon the legal tools available in developing countries to ensure their implementation. In response IDLO has initiated the Legal Preparedness for Climate Change Initiative (LPCCI). The LPCCI is a unique methodology that systematically identifies legal and governance barriers and implements solutions tailored for each recipient country to: adapt to climate impacts; to mitigate greenhouse gases by participating in the carbon market; and to access international climate funding. IDLO has received a number of requests for the LPCCI, including an endorsement from the Alliance of Small Island States representing the most vulnerable nations on the planet. IDLO, in partnership with the United Nations Environment Program, will begin implementing the first LPCCI in Vietnam in late 2010 with the support of the government of the Netherlands.

11 9 IDLO knows from experience that there are untold numbers of professionals and concerned citizens seeking to advance legal reform in their countries, including dedicated civil servants, law professors and civil society participants. Strategic Objective Four, Networks, enables the synergistic interaction of these people to spark greater change and sustainable reform than can be achieved within the confines of a development program. IDLO s three year world-wide Microfinance program, sponsored by the Omidyar network, has not only trained legal professionals in developing countries on the legal aspects of microfinance, it has connected them to each other - their peers - and given them the legal and regulatory tools they need in this specialist field to create access to financial services and other innovative benefits for very poor people. IDLO is uniquely positioned to identify best practices in appropriate and sustainable reform to domestic legal and regulatory systems. By undertaking this work, IDLO improves its own program delivery and informs program design and implementation by other international actors. As a lead player in the rule of law development sector, IDLO is advancing its ability to measure accurately the performance of its programs and larger projects. 13 IDLO s Partnerships 11 Recent experience with the economic globalization process has demonstrated the continued relevance of IDLO s historical focus helping to redress the imbalance between international actors and counterparts in developing countries, leading to more sustainable development. Nonetheless, demand for the Organization s assistance has expanded and IDLO has entered new areas of activities, including the provision of legal technical assistance in postconflict countries and in confronting climate change, food security and public health issues; the use of legal empowerment approaches; and research and publications. IDLO is promoting partnerships to respond better and more effectively to these growing needs. New partnership agreements include: A Memorandum of Understanding with the African Union aimed at providing legal support in the implementation of the African Peace and Security Architecture. A Memorandum of Understanding with the United Nations Development Program regarding operational aspects of the Peace Building Fund. A Memorandum of Understanding with the United Nations Food and Agriculture Organization (FAO) to address world hunger and improve food security. A Partnership Agreement with the United Nations Environment Program (UNEP) to join forces in promoting the Legal Preparedness for Climate Change Initiative A Cooperation Agreement with the United Nations High Commissioner for Refugees in which IDLO serves as lead and coordinates the activities of the Task Force on Protection in Natural Disaster Situations. ASSISTANCE IN PUBLIC HEALTH ISSUES IDLO's HIV and Health Law Program is an excellent example of development law in action, and its discussion of the program enabled session participants to clearly see the challenges and potential solutions that underlie international pro bono projects, as well as seeing the operation of one particular development law model in action. 14 A Few Facts and Figures 12 Since its inception, IDLO has been a nonprofit organization. It receives voluntary contributions both for specific projects and for the Organization s general operations. Support is provided by a variety of donors, including states and multilateral organizations, as well as private foundations, corporations and individuals. Unlike most intergovernmental organizations, IDLO s member parties are not obligated to make annual contributions. While this facilitates membership by the poorest countries, it places increased emphasis on raising sufficient funds to support basic institutional development and management functions, unrelated to assistance programs. These funds come in the form of unrestricted grants. Funding Figure 1 below illustrates IDLO s actual funding sources in The figure demonstrates the disparity between program specific funding and general donations. The implication of this funding structure is an organizational output primarily oriented towards action and results. Cost The majority of IDLO s funding is intended to achieve specific goals, and the nature of the expenditure shown in Figure 2 demonstrates that the largest expenditure is on program direct costs. With a large share of revenue going directly to programming, institutional expenses are low as compared to larger organizations. The office expenses, which are a small portion of total expenditure, are kept to a minimum. 16 IDLO s Governance Structure 14 THE ASSEMBLY OF PARTIES is composed of all Member Parties of IDLO, which are signatories to the Establishment Agreement of IDLO. The Assembly is IDLO s highest decision-making body and it convenes in Rome at least once a year. The role of the Assembly is to determine the Organization s policies and oversee the work of the Director-General. Its duties include the adoption of the budget, the annual management plans and the by-laws for the governance of the Organization and the appointment of the Director-General and members of the Board of Advisers. All Board Members are selected on the basis of their expertise in the fields of development or law or their experience in the management of international organizations. They serve in their personal capacities and not as representatives of their governments or organizations. Meetings of the Board are normally convened once a year prior to the regular meeting of the Assembly. The Board provides advisory opinions to the Assembly on a number of matters and contributes through its expertise to the fulfillment of the objectives of the Organization.

THE STANDING COMMITTEE provides the link between the Assembly, the Board of Advisers and the Director- General. It includes the President and Vice-Presidents of the Assembly, the Chairman and Vice-Chairman of the Board, and on a rotational basis, a Representative of a Party (ad hoc member), for a one year term. Its main functions are to monitor the proper implementation of the budget and oversee management and report on these items to the Assembly. The Standing Committee normally meets every two months and prepares the meetings of the Assembly. THE AUDIT AND FINANCE COMMITTEE assists the Assembly of Parties and the Standing Committee in its oversight responsibilities with respect to audit and compliance, financial reporting and maintenance of effective and efficient financial procedures. It includes Representatives of five IDLO Parties that serve the Committee on a rotational basis. THE DIRECTOR-GENERAL is tasked with the daily administration of the Organization and is responsible to the Assembly for the management of the Organization.
