4 Chesapeake Planning Commission December 11, 2013 Public Hearing Minutes 3 UP-08-32(Rev 10/13) PROJECT: Ballahack AirSoft APPLICANT: Christopher J. & Elizabeth M. Wratten AGENCY: Ballahack AirSoft PROPOSAL: To amend an existing use permit to allow an existing outdoor recreational facility (airsoft facility) to expand to include the addition of the retail sales of sporting goods; and, to allow for a structure to exceed the 35 foot maximum building height by 5 feet. ZONE: A-1 Agricultural SIC CODES: 799/5941 LOCATION: 2900 Ballahack Road TAX MAP SECTION/PARCEL: BOROUGH: Pleasant Grove PLANNING COMMISSION RECOMMENDATION: Planning Commission recommends that UP-08-32(Rev 10/13) be APPROVED with the following stipulations: (7-0: Williams/Small, Bell and Morris excused) 1. A revision to the final site plan (AC# ) is required including a representation of the proposed use, with location and dimensions of all existing and proposed improvements including: buildings (maximum footprint and height) and other structures; walkways; fences; walls; trash containers; outdoor lighting; landscaped areas and open space; recreational areas and facilities; parking lots and other paved areas; loading and service areas together with the proposed paving materials types for all walk, parking lots and entrances; and signs. 2. A building permit will be required for the barn alteration to include the sporting goods retail and rental counter use as well as other structures constructed on the property without permits. Hours of operations shall be restricted to game play hours. A Certificate of Occupancy is required for the change of use of the barn. Approval from the Health Department or DEQ is required prior to issuance of a building permit. 3. The structures must be assessed by a licensed structural engineer and a report must be submitted with the plans stating how the structure must be altered to meet the design loads of chapter 16 of the International Building code. Two (2) sets of plans must be submitted to this office for design approval using the guide lines in the International Building Code.

5 4 Chesapeake Planning Commission December 11, 2013 Public Hearing Minutes 4. There must be at least one fully accessible toilet room, one mop sink and one hi/lo drinking fountain supporting the commercial building. These features must be available to the customers. 5. Prior to the issuance of any land disturbing permits or building permits, the applicant must apply for and receive a valid Run-Off Control Permit from the Department of Public Utilities. 6. The hours of operation shall be from 9 a.m. to sunset daily. 7. The applicant/owner shall post and maintain a sign at the entrance to the facility that outlines safety rules for players, including the requirements that players must wear eye protection at all times. 8. The applicant/owner shall install a city standard commercial entrance within six (6) months of the approval of this conditional use permit or otherwise seek an extension through the Department of Public Works. 9. The applicant/owner agrees to dedicate one-half of the ultimate 120 right-of-way along the property s frontage with Ballahack Road in accordance with the 2050 Master Transportation Plan. This dedication shall be recorded or filed for recording before approval of a final site plan. 10. The applicant/owner agrees to allow only biodegradable pellets for use on the property. 11. Playing fields shall be at least 180 feet from all adjacent property lines and from Ballahack Road due to the projectile range of the pellets. Signs or flags shall be posted on the property identifying this area. 12. No trees shall be removed within the existing wooded area (15 foot minimum) along Ballahack Road. 13. The applicant/owner shall not permit the parking of more than 200 cars each day of operation. In no event shall cars be permitted to park along Ballahack Road or off-site. Mrs. Hanson read UP-08-32(Rev 10/13) into the record for Commission review and action. Staff Presentation: Mrs. Story stated that based on sound planning practices, Planning staff recommended that UP-08-32(Rev 10/13) be APPROVED with the stipulations as listed in the official agenda.

6 Chesapeake Planning Commission December 11, 2013 Public Hearing Minutes 5 Proponent: Chris Wratten, Applicant, 2900 Ballahack Road, Chesapeake, Virginia, appeared before the Commission on behalf of UP representing Ballahack AirSoft. COMMISSION DISCUSSION: Commissoner Williams made a motion to change stipulation #13 to read 200 cars instead of 100 cars. Commissioner Van Laethem questioned staff to verify whether or not the applicant had adequate space to park 200 vehicles on his property. Staff concurred. COMMISSION VOTE: Commissioner Williams moved that UP-08-32(Rev 10/13) be APPROVED with the stipulations as listed in the official agenda and as recommended by staff and with the amended stipulation #13. Commissioner Small seconded the motion. The motion was carried by a vote of 7-0. Commissioners Morris and Bell were excused.
