General Provisions The purpose of this Rezoning Petition is to obtain approval of Optional provisions allowing deviations from ertain provisions of the Zoning Ordinane (the Ordinane ) as allowed by setion of the Ordinane to provide additional development flexibility whih will failitate the development of a 3 +/- are property bounded by Tryon Street, Stonewall Street, College Street and Hill Street in the omprised of Meklenburg County Tax Parel numbers , and (the Site ). If the Petitioner seeks to take advantage of any of the Optional provisions approved as part of the Rezoning Petition, development of the Site will be governed by the aompanying Tehnial Data Sheet, these Development Standards (inluding any Optional provisions utilized) and the appliable provisions Ordinane. The development depited on the Tehnial Data Sheet is intended to reflet in general terms, the arrangement, loation and design of the omponent parts and street improvements for the Site as if the Optional provisions requested in these Development Standards are implemented. However, any deviations from the UMUD minimum standards are Optional in nature and relate only to the development and street improvements proposed by the aompanying Tehnial Data Sheet and these Development Standards. The Site may also be developed in aordane with the standard UMUD requirements and other appliable minimum standards established by other odes, ordinanes and poliies. Aordingly, the Petitioner expressly reserves the right to develop the Site and/or portions thereof in a manner wholly different from the development depited on the Tehnial Data Sheet in any manner permitted by the Ordinane and other City of Charlotte odes, ordinanes and poliies as if no Optional provision had been appliable. Exept as otherwise provided under the UMUD-Optional provisions set forth under Paragraph 2 of these Development Standards and unless the aompanying Tehnial Data Sheet or these Development Standards establish more stringent standards, the regulations established under the Ordinane for the UMUD Zoning Distrit shall govern all development taking plae on the Site. Alterations or modifiations whih, in the opinion of the Planning Diretor, substantially alter the harater of the development or signifiantly alter the aompanying Tehnial Data Sheet or its respetive onditions shall not be deemed to be minor and may only be made in aordane with the provisions of subsetions 6.207(1) or (2) of the Ordinane, as appliable. 2. UMUD Optional Provisions Pursuant to the Optional provisions of Setion of the Ordinane, the Petitioner seeks approval of the following UMUD Optional provisions to allow deviations from speifi provisions of the Ordinane in order to aommodate the development depited on the Tehnial Data Sheet: (a) (b) () (d) (e) (f) (g) (h) (i) (j) (k) (l) Deviations from the paving system requirements established under Setion 9.906(2)(a) of the Ordinane to allow the use of pavers and/or other materials within right-of-ways and along all street frontages to reate onsistent streetsape design throughout the Site, subjet to the approval of a related Enroahment Agreement. Deviations from the signage standards established under Setion 9.906(e) of the Ordinane to allow up to two attahed eletroni signs (video or LED sreen) with a maximum size of 300 square feet eah. Design and loation of these signs shall be reviewed and approved by the Planning Department prior to appliation for sign permits. Deviations from the signage standards established under Setion 9.906(e) of the Ordinane to allow up to 3,000 square feet of wall signage per street frontage (in addition to any approved eletroni signs (video or LED)). Design and loation of a master sign plan shall be reviewed and approved by the Planning Department prior to appliation for sign permits. Deviations from the streetsape requirements for walking surfaes, street furniture, trees, landsaping, lighting fixtures, information signs, and kiosks within the right-of-way or setbak established under Setion 9.906(2)(f) of the Ordinane in order to aommodate a unified treatment along all street frontages that will work in harmony with the Site's urban open spaes. Deviations from the street tree standards established under Setion 9.906(2)(g) of the Ordinane due to lak of onsisteny of speies on properties adjaent to the Site and on opposite sides of adjaent streets. Deviations from the street right-of-way requirements established under Setion 9.906(i) of the Ordinane in order to aommodate the design and onstrution of the street ross-setions shown on the Street Cross Setion Exhibits, inorporated herein as RZ-03 and RZ-04, subjet to the approval of any neessary Enroahment Agreements. Deviations from the building entrane requirements established under Setion 9.906(2)(j) of the Ordinane in to allow non-reessed building entranes at loations where the building fae is loated beyond the minimum setbak requirement. Deviations from the base of high rise building requirements established under Setion 9.906(2)(k) of the Ordinane to allow an average height of three stories to be used when alulating requirements related to arhitetural design provisions regarding the base of high rise buildings. Deviations from the urban open spae seating and tree requirements established under Setions 9.906(4)(d) and (e) of the Ordinane to remove presribed seating and tree requirements within any non-required open spaes areas. Standard seating and tree requirements shall be met within portions of the urban open spae areas required to meet the minimum UMUD urban open spae requirement. Deviations from the urban open spae tree requirement provision established under Setions 9.906(4)(e) of the Ordinane to allow required urban open spae trees to be planted with moveable planters. Deviations from the urban open spae amenity provision established under Setions 9.906(4)(g) of the Ordinane to allow open fire pits as a permitted amenity. Deviations from the loading standards established under Setion 9.907(2)() of the Ordinane to allow a 50% redution in the number required of loading spaes. 3. Permitted Uses and Maximum Development The Site may be developed with any uses allowed in the UMUD zoning distrit, subjet to any maximum density or intensity standards of the UMUD zoning distrit. The plaement and onfiguration of the vehiular aess points shown on the Tehnial Data Sheet are subjet to any modifiations required to aommodate final site and onstrution plans and designs and to any adjustments required by CDOT for approval. As indiated in Paragraph 2, Petitioner seeks deviations from the street right-of-way requirements established under Setion 9.906(i) of the Ordinane in order to aommodate the design and onstrution of the street ross-setions shown on the Street Cross Setion Exhibits, inorporated herein as RZ-03 and RZ-04, subjet to the approval of any neessary Enroahment Agreements. 5. Arhitetural Standards Petitioner shall meet or exeed UMUD requirements, subjet to any deviations approved as part of the Optional provisions desribed in Paragraph 2 above. 6. Streetsape and Landsaping Petitioner shall omply with the Streetsape and Landsaping requirements of the Ordinane, subjet to any deviations approved as part of the Optional provisions desribed in Paragraph 2 above. 7. Environmental Features Development on the Site shall omply with the Post Constrution Controls Ordinane. 8. Open Spae Open Spaes will be provided as required by the UMUD distrit. 9. Fire Protetion Fire protetion shall be provided in onformity with the speifiations of the Fire Marshall. 10. Signage Petitioner shall omply with the signage requirements of the Ordinane, subjet to any deviations approved as part of the Optional provisions desribed in Paragraph 2 above. 11. Lighting Petitioner shall omply with the lighting requirements of the Ordinane, subjet to any deviations approved as part of the Optional provisions desribed in Paragraph 2 above. 12. Other Throughout these development standards, the term Petitioner shall be deemed to inlude the heirs, devisees, personal representatives, suessors in interest and assigns of the Petitioner or the owner or owners of the Site from time to time who may be involved in any future development thereof.
