1 (Amendment) Order 2017 Artile 1 Statutory Doument No. 2017/0159 European Communities (Isle of Man) At 1973 EUROPEAN UNION (CENTRAL AFRICAN REPUBLIC SANCTIONS) (AMENDMENT) ORDER 2017 Approved by Tynwald: 16 May 2017 Coming into operation in aordane with artile 2 The Counil of Ministers makes the following Order under setions 2A and 2C of the European Communities (Isle of Man) At Title This Order is the (Amendment) Order Commenement This Order omes into operation immediately after it is made. 3 Appliation of EU instrument Counil Regulation (EU) 2017/400 1 of 7 Marh 2017 amending Regulation (EU) No 224/ onerning restritive measures in view of the situation in the Central Afrian Republi applies as part of the law of the Island, subjet to the modifiations set out in the Shedule to this Order. 1 OJ L 63, , p. 1 2 OJ l 70, , p. 1. Regulation (EU) No 224/2014 was applied to the Island with ertain modifiations by SD No. 2014/0116 previous amendments were applied to the Island by SD 2015/0201 and SD 2016/0153. As it has effet in the Island, any referene in Regulation (EU) No 224/2014 to an Annex to that Regulation is to be onstrued as a referene to the Annex as amended from time to time. 3 (Amendment) Order 2017 SCHEDULE SCHEDULE [Artile 3] MODIFICATIONS TO THE APPLIED EU INSTRUMENT COUNCIL REGULATION (EU) 2017/400 of 7 Marh 2017 amending Regulation (EU) No 224/2014 onerning restritive measures in view of the situation in the Central Afrian Republi (1) Exept where otherwise provided below, referenes in the Regulation to Member States and the Union shall be read as if the Island were itself a Member State, its territory were inluded within the Union territory and for the purposes of European Union law were a separate ountry from the United Kingdom. (2) The referene to the Union does not inlude the Island in the term High Representative of the Union for Foreign Affairs and Seurity Poliy. (3) Omit Artile 2. (4) After Artile 2, omit the statement of appliation and effet. SD No.2017/0159 Page 3

4 Explanatory Note (Amendment) Order 2017 EXPLANATORY NOTE (This note is not part of the Order) This Order applies the provisions of Counil Regulation (EU) 2017/400, as amended by the Shedule to the Order, as part of the law of the Island. This EU Regulation amends Counil Regulation (EU) No 224/2014 onerning restritive measures in view of the situation in the Central Afrian Republi whih was applied to the Island with ertain modifiations by SD 2014/0116. On 27 January 2017 the United Nations Seurity Counil adopted Resolution 2339 (2017) amending the designation riteria for the asset freeze. This Order gives effet to the amendments. 5 Annex COUNCIL REGULATION (EU) 2017/400 of 7 Marh 2017 amending Regulation (EU) No 224/2014 onerning restritive measures in view of the situation in the Central Afrian Republi THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Funtioning of the European Union, and in partiular Artile 215 thereof, Having regard to Counil Deision 2013/798/CFSP of 23 Deember 2013 onerning restritive measures against the Central Afrian Republi 1, Having regard to the joint proposal from the High Representative of the Union for Foreign Affairs and Seurity Poliy and of the European Commission, Whereas: (1) Counil Regulation (EU) No 224/ gives effet to ertain measures provided for in Deision 2013/798/CFSP. (2) Deision 2013/798/CFSP provides for an arms embargo against the Central Afrian Republi and the freezing of funds and eonomi resoures of ertain persons engaging in or providing support for ats that undermine the peae, stability or seurity of the Central Afrian Republi. (3) On 27 January 2017 the United Nations Seurity Counil adopted Resolution 2339 (2017) amending the designation riteria for the asset freeze. The Counil adopted Deision (CFSP) 2017/412 3 amending Deision 2013/798/CFSP to give effet to UNSCR 2339 (2017). (4) This measure falls within the sope of the Treaty and regulatory ation at the level of the Union is therefore neessary in order to implement it, in partiular with a view to ensuring its uniform appliation by eonomi operators in all Member States. (5) Regulation (EU) No 224/2014 should therefore be amended aordingly, HAS ADOPTED THIS REGULATION: Artile 1 Regulation (EU) No 224/2014 is amended as follows: (1) in Artile 3, point () is replaed by the following: () related to supplies of non-lethal equipment and provision of assistane, inluding operational and nonoperational training to the Central Afrian Republi seurity fores, inluding State ivilian law enforement institutions, intended solely for support of or use in the Central Afrian Republi proess of Seurity Setor Reform ( SSR ), in oordination with Minusa, provided that they have been notified in advane to the Santions Committee. ; (2) Artile 5(3) is replaed by the following: 3. Annex I shall inlude natural or legal persons, entities and bodies identified by the Santions Committee as: (a) engaging in or providing support for ats that undermine the peae, stability or seurity of the Central Afrian Republi, inluding ats that threaten or impede the stabilization and reoniliation proess or that fuel violene; (b) ating in violation of the arms embargo established in paragraph 54 of UNSCR 2127 (2013), or having diretly or indiretly supplied, sold, or transferred to armed groups or riminal networks in the Central Afrian Republi, or having been the reipient of arms or any related materiel, or any tehnial advie, training, or assistane, inluding finaning and finanial assistane, related to violent ativities of armed groups or riminal networks in the Central Afrian Republi; () being involved in planning, direting, or ommitting ats that violate international human rights law or 1 OJ L 352, , p Counil Regulation (EU) No 224/2014 of 10 Marh 2014 onerning restritive measures in view of the situation in the Central Afrian Republi (OJ L 70, , p. 1). 3 Counil Deision (CFSP) 2017/412 of 7 Marh 2017 amending Deision 2013/798/CFSP onerning restritive measures against the Central Afrian Republi (see page 102 of this Offiial Journal).

6 international humanitarian law, as appliable, or that onstitute human rights abuses or violations, in the Central Afrian Republi, inluding, targeting of ivilians, ethni- or religious-based attaks, attaks on shools and hospitals, and abdution and fored displaement; (d) being involved in planning, direting, or ommitting ats involving sexual and gender-based violene in the Central Afrian Republi; (e) reruiting or using hildren in armed onflit in the Central Afrian Republi, in violation of appliable international law; (f) providing support for armed groups or riminal networks through the illiit exploitation or trade of natural resoures, inluding diamonds, gold and wildlife, as well as wildlife produts, in or from the Central Afrian Republi; (g) obstruting the delivery of humanitarian assistane to the Central Afrian Republi, or aess to, or distribution of, humanitarian assistane in the Central Afrian Republi; (h) being involved in planning, direting, sponsoring, or onduting attaks against United Nations missions or international seurity presenes, inluding Minusa, the Union missions and the Frenh operations whih support them; (i) being leaders of an entity designated by the Santions Committee, or having provided support to, or having ated for or on behalf of or at the diretion of, a person, entity or body designated by the Santions Committee, or an entity owned or ontrolled by a designated person, entity or body.. Artile 2 This Regulation shall enter into fore on the day following that of its publiation in the Offiial Journal of the European Union.
