1 European Union (Yemen Santions) (Amendment) Order 2015 Artile 1 Statutory Doument No. 2015/0244 European Communities (Isle of Man) At 1973 EUROPEAN UNION (YEMEN SANCTIONS) (AMENDMENT) ORDER 2015 Approved by Tynwald: 22 July 2015 Coming into operation in aordane with artile 2 The Counil of Ministers makes the following Order under setion 2A and 2C of the European Communities (Isle of Man) At Title This Order is the European Union (Yemen Santions) (Amendment) Order Commenement This Order omes into operation immediately after it is made. 3 Appliation of EU instrument Subjet to the modifiations set out in the Shedule, Counil Regulation (EU) 2015/878 1 of 8 June 2015 amending Regulation (EU) No 1352/ onerning restritive measures in view of the situation in Yemen applies as part of the law of the Island. 1 OJ L 143, , p. 1 2 Counil Regulation (EU) No 1352/2014 of 18 Deember 2014 onerning restritive measures in view of the situation in Yemen (OJ L 365, , p. 60). Regulation (EU) No 1352/2014 was applied to the Island with ertain modifiations by 2015/0034. As it has effet in the Island any referene in EU Regulation 1352/2014 to an Annex to that Regulation is onstrued to be a referene to that Annex as amended from time to time. SD No.2015/0244 Page 1

3 European Union (Yemen Santions) (Amendment) Order 2015 SCHEDULE SCHEDULE [Artile 3] MODIFICATIONS TO THE APPLIED EU INSTRUMENT (1) Exept where otherwise provided below, referenes in the applied EU instrument to Member States and the Union shall be read as if the Island were itself a Member State, its territory were inluded within the Union territory and for the purposes of European Union law were a separate ountry from the United Kingdom. (2) In the preamble the referene to the Union in High Representative of the Union for Foreign Affairs and Seurity Poliy does not inlude the Island. (3) Omit artile 2. (4) After artile 2, omit the statement of appliation and effet. SD No.2015/0244 Page 3

4 Explanatory Note European Union (Yemen Santions) (Amendment) Order 2015 EXPLANATORY NOTE (This note is not part of the Order) This Order applies Counil Regulation (EU) No 2015/878, as amended by the Shedule to the Order, as part of the law of the Island. This EU Regulation amends Counil Regulation (EU) No 1352/2014 onerning restritive measures in view of the situation in Yemen whih, as amended by ertain subsequent EU Regulations, was applied to the Island with ertain modifiations by SD 2015/0034. A opy of Counil Regulation (EU) No 2015/878, as amended, is attahed as an Annex but the Annex does not form part of the Order. Page 4 SD No.2015/0244

5 Annex COUNCIL REGULATION (EU) 2015/878 of 8 June 2015 amending Regulation (EU) No 1352/2014 onerning restritive measures in view of the situation in Yemen THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on the Funtioning of the European Union, and in partiular Artile 215 thereof, Having regard to Counil Deision 2014/932/CFSP of 18 Deember 2014 onerning restritive measures in view of the situation in Yemen 1, Having regard to the joint proposal of the High Representative of the Union for Foreign Affairs and Seurity Poliy and of the European Commission, Whereas: (1) Counil Deision 2014/932/CFSP gives effet to United Nations Seurity Counil Resolution (UNSCR) 2140 (2014) of 26 February 2014 onerning restritive measures in view of the situation in Yemen and provides for restritions on admission and the freezing of funds and eonomi resoures of ertain persons designated by the Committee established pursuant to paragraph 19 of UNSCR 2140 (2014). (2) Counil Regulation (EU) No 1352/ gives effet to Deision 2014/932/CFSP. (3) On 14 April 2015, the United Nations Seurity Counil adopted Resolution 2216 (2015) extending the sope of the designation riteria and providing for an embargo on the supply of arms to, or for the benefit of, designated individuals and entities, and those ating on their behalf or at their diretion in Yemen. By means of Counil Deision (CFSP) 2015/882 3 amending Deision 2014/932/CFSP, the Counil deided to extend the sope of the designation riteria aordingly. (4) Some of those measures fall within the sope of the Treaty on the Funtioning of the European Union and, therefore, in partiular with a view to ensuring their uniform appliation by eonomi operators in all Member States, regulatory ation at the level of the Union is neessary in order to implement them. (5) Regulation (EU) No 1352/2014 should therefore be updated aordingly, HAS ADOPTED THIS REGULATION: Regulation (EU) No 1352/2014 is amended as follows: (1) in Artile 1, the following point is added: Artile 1 (j) tehnial assistane means any tehnial support related to repairs, development, manufature, assembly, testing, maintenane, or any other tehnial servie, and may take forms suh as instrution, advie, training, transmission of working knowledge or skills or onsulting servies, inluding verbal forms of assistane. ; (2) the following Artile is added: Artile 1a It shall be prohibited to: (a) provide tehnial assistane related to military ativities and to the provision, manufature, maintenane and use of arms and related materiel of all types, inluding weapons and ammunition, military vehiles and equipment, paramilitary equipment, and spare parts therefor, diretly or indiretly to any natural or legal person, entity or body, as listed in Annex I; (b) provide finaning or finanial assistane related to military ativities, inluding in partiular grants, loans and export redit insurane, as well as insurane and reinsurane, for any sale, supply, transfer or export of arms and related materiel, or for the provision of related tehnial assistane, diretly or indiretly to any natural or legal person, entity or body, as listed in Annex I. ; (3) in Artile 3(1), the following point is added: 1 OJ L 365, , p (2). 6 (d) ats violating the arms embargo imposed by Artile 1 of Deision 2014/932/CFSP or obstruting the delivery of humanitarian assistane to Yemen or aess to, or distribution of, humanitarian assistane in Yemen.. Artile 2 This Regulation shall enter into fore on the day following that of its publiation in the Offiial Journal of the European Union.
