1 HOW TO CHANGE YOUR NAME (fr an Adult) Wh can ask the curt fr a name change? T change yur name yu MUST: Be at least 18 years ld; AND Have lived in Illinis fr at least 6 mnths. Yu CAN NOT change yur name if yu have been cnvicted f: A felny and have nt been pardned r yu finished yur sentence less than 10 years ag; OR Identity theft r aggravated identity theft and have nt been pardned; OR Felny r misdemeanr: criminal sexual abuse when the victim at the time is under 18 years f age, sexual explitatin f a child, indecent slicitatin f a child, r indecent slicitatin f an adult, r any ther ffense that requires yu t register as a sex ffender, and have nt been pardned. Publicatin Ntice f Curt fr Request fr Name Change: tells the public yu are asking the curt t change yur name and is published in a newspaper fr 3 weeks. Order fr Name Change: is used by the judge t say yur Request fr Name Change is granted r denied. What csts will I need t pay t change my name? Filing Fee: t file yur frms with the Circuit Clerk. Publicatin Fee: t put yur ntice in the newspaper. Certified Cpy Fee: if yur name change is granted and yu need certified cpies f the curt rder. If yu cannt affrd t pay the filing fee, yu can ask the curt t file fr free. Fill ut the Applicatin fr Waiver f Curt Fees t ask the curt fr a fee waiver. Find the curthuse in the cunty where yu live: Make 3 extra cpies f each frm and bring them t the Circuit Clerk at the curthuse with the riginals. The Circuit Clerk will give yu a curt date and time. Write them n the Publicatin Ntice f Curt fr Request fr Name Change. Make sure the curt date is at least 8 weeks after the date yu file yur frms at curt. Pay the filing fee r ask the curt fr a fee waiver. In mst cunties it is best t file yur frms with the Circuit Clerk in persn but in certain cunties, yu must file nline. Check with yur Circuit Clerk: Step 2 Publish yur Publicatin Ntice f Curt fr Request fr Name Change in a newspaper in the cunty where yu live nce a week fr 3 weeks in a rw. Cntact a newspaper in yur cunty and set up publicatin f the ntice. If there is n newspaper in yur cunty, cntact a cnvenient newspaper published in Illinis. Give a cpy f the Publicatin Ntice f Curt fr Request fr Name Change t a newspaper. The ntice must appear in a newspaper fr the first time at least 6 weeks befre yur hearing date. Newspapers may charge yu a publicatin fee. If yu have a fee waiver in yur curt case, the newspaper is nt required t waive yur fee fr publicatin. Yu will need t file a Mtin asking the curt t rder the cunty t pay the cst f publicatin. Yu can find the Mtin frm at: Step 3 Get a Certificate f Publicatin frm the newspaper and file it with the curt. After the ntice appears in a newspaper fr 3 weeks get a Certificate f Publicatin frm the newspaper. Ask the newspaper hw yu will get the Certificate f Publicatin. The newspaper will either: Send the Certificate directly t the Circuit Clerk; Mail the Certificate t yu; OR Tell yu t pick up the Certificate in persn. Take the Certificate f Publicatin t the curthuse and file it with the Circuit Clerk befre yur curt date. If the newspaper sends the Certificate directly t the Circuit Clerk, make sure it arrives befre yur curt date and ask the newspaper t send yu a cpy. Step 4 G t yur curt hearing. Get t the curt 45 minutes befre yur hearing time. Bring these items t yur curt date: Pht I.D.; Stamped cpies f: Request fr Name Change, Publicatin Ntice f Curt fr Request fr Name Change, and Certificate f Publicatin; Order fr Name Change; AND

2 Other papers related t yur Request (like papers shwing that at least 10 years have passed since cmpletin and discharge f yur sentence). Cnfirm the curt rm number and g t that rm. Check in quietly with the judge's clerk, curt assistant, r curt bailiff. Wait fr yur name and case number t be called. Yu may be placed under ath, answer the judge s questins truthfully. The judge will either GRANT r DENY yur Request. The judge will write this n the Order and sign it. File the signed Order with the Circuit Clerk. If GRANTED, get certified cpies f the Order frm the Circuit Clerk. Yu need a certified cpy f the Order t change yur name n recrds like birth certificate, scial security card, and a driver s license.
