A Temprary Resident Visa (TRV) is an fficial dcument issued by a Canadian visa ffice that is placed in yur passprt t shw that yu have met the requirements fr admissin t Canada as a temprary resident (either as a visitr, a student, r a wrker). Yu must btain a Temprary Resident Visa (TRV) befre yur departure. Yu cannt btain ne upn arrival in Canada. What are the requirements yu must meet fr a TRV? Yu must shw the fficer that yu meet the requirements f the Immigratin and Refugee Prtectin Act (IRPA) and the Immigratin and Refugee Prtectin Regulatins and that yu will be in Canada fr a temprary stay. 4 family members in Canada and t return hme, nt intend t wrk r study in Canada unless authrized t d s, be law abiding and have n recrd f criminal activity, nt be a risk t the security f Canada, prvide any additinal dcument requested by the fficer t establish yur admissibility, and be in gd health (cmplete a medical examinatin if required). Entry t Canada Entry t Canada is a privilege, nt a right. If yu want t visit Canada, yu must meet the necessary requirements and yu may need a Temprary Resident Visa. Family Members Family members include a spuse, a cmmn-law partner, dependent children, and the dependent child f a dependent child: Term Spuse A cmmnlaw partner Dependent children Definitin Refers t either f the tw persns (ppsite r same sex) in a legally-recgnized marriage. Refers t a persn wh is living in a cnjugal relatinship with anther persn (ppsite r same sex), and has dne s cntinuusly fr a perid f at least ne year. A cnjugal relatinship exists when there is a significant degree f cmmitment between tw peple. Cmmn-law partners must attach any dcuments that shw they are in a cmmitted and genuine relatinship, fr example, evidence that they share the same hme, that they supprt each ther financially and emtinally, that they have had children tgether, r that they present themselves in public as a cuple. Cmmn-law partners wh are unable t live tgether r appear in public tgether because f legal restrictins in their hme cuntry may still qualify and shuld be included n the applicatin. Cmmn-law partners wh meet the cnditins utlined abve but wh have been separated fr reasns beynd their cntrl (fr example, civil war r armed cnflict) may qualify and shuld be included n the applicatin. 5 Dependent child f a dependent child parent and have been cntinuusly enrlled and in attendance as full-time students in a pstsecndary institutin accredited by the relevant gvernment authrity since befre the age f 22 (r since marrying r entering int a cmmn-law relatinship, if this happened befre the age f 22), r depend substantially n the financial supprt f a parent since befre the age f 22 and be unable t prvide fr themselves due t a medical cnditin. Refers t children f dependent children f the applicant r thse f the spuse r cmmn-law partner. D family members need t apply separately? Yur family members wh als wish t visit Canada must apply by filling ut their wn Temprary Resident Visa applicatin frm. Hwever, yu may send all family member applicatin frms in the same envelpe with nly ne payment receipt fr the ttal amunt. See "Pay the fees" sectin. Medical requirements Yu and yur family members may be required t underg a medical examinatin in rder t cme t Canada. T pass the medical examinatin yu r yur family members must nt have a cnditin that: is a danger t public health r safety, and wuld cause excessive demand n health r scial services in Canada. Nte: Infrmatin n medical instructins will be prvided t yu by the visa ffice. Yu are nt required t have a medical examinatin befre yu submit yur applicatin frms. Can I wrk r study during my stay in Canada? Visitrs are nt allwed t wrk r study in Canada unless they are authrized t d s under the Immigratin and Refugee Prtectin Regulatins. In many cases, a wrk r study permit will be required. A temprary resident may als take a prgram f study up t six mnths duratin withut having t btain a study permit. 6 Infrmatin fr Parents and Grandparents Super Visa Abut the Super Visa On Nvember 4, 2011, CIC annunced a temprary pause n all new spnsrship applicatins fr the parents and grandparents categry. With the intrductin f this pause, CIC implemented a lng-term Temprary Resident Visa (TRV) fr applicants seeking t visit their child r grandchild wh is either a Canadian citizen r permanent resident. The single r multiple-entry Super Visa allws visitrs t stay fr a perid f up t tw years. Applicants wh d nt require a visa must als submit an applicatin t the visa ffice. Wh may apply fr a Super Visa? T apply fr the Super Visa yu must either be the parent r grandparent f a Canadian citizen r a permanent resident f Canada. Nte : Yu cannt include yur dependent children in this applicatin. Only yur spuse r cmmn-law partner is eligible t accmpany yu under this prvisin. What must I d t btain a SuperVisa? In rder t btain an Super Visa, yu will need t apply at a visa ffice and prvide: evidence f the parent r grandparent relatinship t the Canadian citizen r permanent resident yu wish t visit (e.g. birth certificate, baptismal certificate r ther fficial dcuments naming yu as parent), a letter f invitatin frm yur child r grandchild which includes arrangements fr care and supprt, prf frm yur child r grandchild that he meets the Lw Incme Cut- Off (LICO), prf that yu have private medical insurance valid fr a minimum f ne year frm a Canadian insurance cmpany and that: cvers health care, hspitalizatin and repatriatin, prvides a minimum cverage f $ , and is valid fr each entry t Canada and be available fr review by a prt f entry fficer. Nte: Yu will be required t underg a medical examinatin. Medical instructins will be prvided t yu by the visa ffice. 7 What must my child r grandchild d t meet the LICO minimum? Yur child r grandchild s incme must meet r exceed the minimum necessary, as identified annually in the Incme Table. In the letter f invitatin he must calculate his family size. This factr determines the amunt f incme required f him t prvide care and supprt fr yu and yur spuse, if applicable. He may use the table belw t calculate the family size: Step Actin 1 Yur child r grandchild cunts: himself his spuse r cmmn-law partner, his dependent children, if applicable 2 He cunts the number f persns he will be supprting : yu, and yur spuse r cmmn-law partner, if applicable. 3 He adds the number f persns cvered by steps 1 and 2. The ttal represents his family size. 4 He lks at the LICO in the Incme Table sectin in this guide t determine if he meets the minimum required fr his family size. 5 T demnstrate that he meets the minimum incme required, yur child r grandchild may include ne f the dcuments listed in the Dcument Checklist (IMM 5484). Use the Dcument Checklist (IMM 5484) which yu can find in this package t assist yu in gathering the required dcuments t submit yur applicatin. Minrs travelling alne Minrs (under 18 years f age) travelling alne r with a persn ther than their parents r legal guardians shuld have a letter f authrizatin, preferably in English r French, signed by bth parents r legal guardians. It shuld als include the name f the adult wh will be respnsible fr the children in Canada. Minrs travelling with nly ne parent r legal guardian shuld have a letter f authrizatin, preferably in English r French, frm the nn accmpanying parent r guardian. Translatin f dcuments If yur dcuments are in a language ther than English r French, check with the respnsible visa ffice t determine whether they need t be translated. It is a serius ffence t give false r misleading infrmatin n these frms. The infrmatin yu prvide n yur applicatin is subject t verificatin. Be cmplete and accurate Cmplete all sectins. If a sectin des nt apply t yu, write "Nt Applicable" r "NA", except fr yur name (last name and given name[s]). Refer t questins 1 and 2 under Persnal Details sectin fr further instructins. If yur applicatin is incmplete it will be returned t yu and this will delay the prcessing f yur applicatin. 10 Applicatin fr Temprary Resident Visa Made Outside f Canada (IMM 5257) Wh must fill ut this applicatin frm? This frm must be cmpleted by each persn applying fr a Temprary Resident Visa t visit Canada. Cmpleting the frm Yu must answer all the questins n this applicatin frm unless indicated therwise. Dwnlad and fill ut the applicatin frm n a cmputer. Yu als have the ptin f saving yur frm and cmpleting it later. Nte: Cmpleting the frm electrnically is easier and reduces the risk f errrs that can slw dwn the applicatin prcess. In rder t help yu fill ut the applicatin frm, read and fllw the steps belw. Questin Actin 1 Type yur universal client identificatin number (UCI) r client identificatin number, if knwn. Otherwise, leave it blank. If this is yur first time dealing with CIC yu will nt have a client identificatin number r UCI. 2 Frm the list, select the language (English r French) in which yu wuld like t receive yur service. 3 Frm the list, select the type f visa yu are applying fr: Single Entry: allws yu t enter Canada nly nce during the validity f the visa. Nte: This visa may als be used fr repeated entries int Canada frm the USA r St. Pierre and Miqueln prvided yu d nt enter any ther cuntry. Such entries must ccur within the time validated fr yur stay in Canada. Multiple Entry: allws yu t seek entry int Canada frm any cuntry as ften as necessary during the validity f the visa. Transit Visa: is required fr persns travelling thrugh Canada fr less than 48 hurs n their way t anther cuntry. Type all f yur given name(s) (first, secnd, r mre) as it appears n yur passprt, travel r identity dcument (even if the name is misspelled). D nt use initials. T be a citizen f a cuntry means that yu were either brn in that cuntry (in mst cases) r have been granted citizenship by that cuntry. Yur cuntry f residence is the cuntry in which yu are living, prvided that yu have been lawfully admitted t that cuntry. An annulment can als be a declaratin by the Cathlic Church that the marital unin did nt have a binding frce. Cmmn-Law: This means that yu have lived cntinuusly with yur partner in a marital-type relatinship fr a minimum f ne year. Divrced: This means that yu are fficially separated and have legally ended yur marriage. Legally Separated: This means that yu are married, but n lnger living with yur spuse. Married: This means that yu and yur spuse have had a ceremny that legally binds yu t each ther. Yur marriage must be legally recgnized in the cuntry where it was perfrmed and in Canada. Single: This means that yu have never been married and are nt in a cmmn-law relatinship. Widwed: This means that yur spuse has died and that yu have nt re-married r entered int a cmmn-law relatinship. b) Enter the date (year, mnth and day) yu were married r yu entered int yur current cmmn-law relatinship. c) Type the family name(s) and given name(s) f yur current spuse r cmmn-law partner. 29 What Happens Next The applicatin prcess Submissin Cmpletin check Once yu have submitted yur applicatin, CIC will check t determine that: all required applicatin frms have been prperly cmpleted and submitted, the applicatin prcessing fee has been paid, and all requested supprting dcumentatin has been prvided. If yur applicatin package is incmplete: CIC will return it t yu, n file will be created, and n recrd will be kept until a cmplete applicatin has been submitted. Prcessing Review fr decisin Yur applicatin will underg a detailed review by an fficer. The fficer will cnsider all the infrmatin and dcumentatin yu have prvided, and will assess it and will decide if an interview is necessary. If s, yu will be infrmed f the interview date, time and place. If yur applicatin is refused, yur passprt and dcuments will be returned t yu with an explanatin f why yur applicatin was refused. Specificatins The phts must be identical and taken within the last six mnths. They may be either black and white r clur. The phts must be clear, well defined and taken against a plain white r light-clured backgrund. If the phts are digital, they must nt be altered in any way.
