What are the ptins t clear my criminal recrd in Illinis? When yu are arrested r charged with an ffense, a criminal recrd is created, even if yu are nt fund guilty. Yur criminal recrds can be read by the public, including yur family, friends, emplyers, trade rganizatins, banks, and credit agencies. T have yur recrd erased r hidden yu must file a Request with the curt and have a judge apprve yur Request, There are 3 ways t clear yur criminal recrd: Expungement: Erases arrests and curt supervisins frm yur criminal recrd s it is like they never happened. Qualified Prbatins (see definitin n Page 15) are nly sealed by the State Plice, but are erased by the arresting agency. Sealing: Hides yur criminal recrd frm mst f the public. Law enfrcement agencies can still see sealed recrds. Emplyers required by law t cnduct backgrund checks can see sealed felny cnvictins. They cannt see sealed misdemeanr cnvictins r cases nt resulting in cnvictins unless the emplyer is a law enfrcement agency. Executive Clemency: If yu d nt qualify fr expungement r sealing, yu can apply fr a pardn frm the Gvernr frgiving yu fr yur criminal cnvictins. A pardn des nt erase r hide yur cnvictin n its wn. Illinis State Plice Statewide Criminal Histry Transcript: List f all arrests and cnvictins that happened in Illinis. Hw d I get cpies f my criminal recrds? Get infrmatin frm the Illinis State Plice. Yu are allwed t access yur entire criminal histry infrmatin frm the Illinis State Plice. Althugh nt required, it guarantees yu have yur entire criminal recrd, Yu can get this Statewide Criminal Histry Transcript t make sure that yu have yur entire criminal recrd in 3 ways: Directly frm the Illinis State Plice: Illinis State Plice, Bureau f Identificatin 260 Nrth Chicag Street, Jliet, Illinis (815) il.us/crimhistry/chri.cfm Every law enfrcement agency is allwed t prvide yu this infrmatin. Michigan Ave., Chicag, IL (312) Yu shuld als request a cpy f yur Illinis State Plice Statewide Criminal Histry Transcript. The Chicag Plice will prvide yur state recrd fr n additinal cst. STEP 2: REVIEW YOUR CRIMINAL RECORDS & PICK EXPUNGEMENT ANDIOR SEALING T determine if yu can expunge andlr seal yur criminal recrds, cmplete the Case Wrksheet n page 12 f this bklet. Once yu have cmpleted yur wrksheet, yu d nt need t lk at yur curt dispsitins and RAP sheets t cmplete the Request frm. What d I lk fr n my criminal recrd? T figure ut if the ffenses n yur criminal recrd can be expunged (erased) and/r sealed (hidden), yu need t lk at each item in yur criminal recrd and find the: Arrest dates and the plice department which arrested yu. Charge: The type f ffense yu were charged with in curt r arrested fr and released withut charging. Dispsitin: The utcme f the case, fr example, guilty/nt guilty. Sentence: The punishment yu received. The date yu cmpleted any sentence. Once yu find these n yur criminal recrd, review the lists belw t see if yur ffenses can be expunged and/r sealed. What d I need t knw t chse between expungement and sealing? Yu cannt expunge (erase) any recrd that resulted in a cnvictin, unless the cnvictin was reversed, vacated, pardned by the Gvernr, r apprved fr expungement by the Prisner Review Bard. If yu have been cnvicted and nne f the exceptins apply, yu may still be able t seal (hide) yur cnvictin, depending n the charge and hw much time has passed. Instructin Bklet fr Expunging and Sealing Curt Frms What types f ffenses CAN be expunged (erased)? The fllwing types f arrests, charges, r sentences n yur criminal recrd can be expunged: Arrests fr misdemeanrs and felnies that did nt result in a cnvictin. Cnvictins fr misdemeanrs and felnies nly if: The cnvictin was reversed r vacated; OR Yu received a pardn frm the Gvernr allwing expungement f all cnvictins n yur recrd; OR As an Hnrably Discharged Veteran, yu have a Certificate f Eligibility fr Expungement frm the Prisner Review Bard allwing expungement f all cnvictins n yur recrd. Sentences fr curt supervisin nly if: 2 years have passed since yu successfully finished yur curt supervisin, except the ffenses listed directly belw; OR 5 years have passed since yu successfully finished yur curt supervisin fr: Dmestic Battery Criminal Sexual Abuse (victim was 18 r lder) Operatin f an Uninsured Mtr Vehicle Operatin f a Mtr Vehicle when Registratin is Suspended fr Nn-Insurance Display f False Insurance Card Scrap Prcessrs t Keep Recrds If yu are 25 r lder, yur Reckless Driving supervisin ccurred when yu were under 25, and yu have n ther cnvictins. What types f ffenses CANNOT be expunged (erased)? The fllwing types f arrests, charges, r sentences n yur criminal recrd cannt be expunged: Minr Traffic Offenses, unless yu were released withut being charged. Cnvictins fr misdemeanrs and felnies unless they were reversed, vacated, pardned by the Gvernr, r apprved by the Prisner Review Bard. Curt supervisin r Qualified Prbatin that was NOT successfully cmpleted. Even if certain cases are nt eligible fr expungement r sealing, yu can still expunge r seal thse arrests and cases that are eligible. What types f ffenses CAN be sealed (hidden)? Arrests and charges fr misdemeanrs and felnies that did nt lead t a cnvictin can be sealed at any time, except minr traffic ffenses, unless yu were released withut being charged. Cases with the fllwing sentences n yur criminal recrd can be sealed if at least 3 years have passed since the successful cmpletin f yur last sentence: Cnvictins fr mst misdemeanrs and felnies, except thse listed in the next sectin. NOTE: If yur cnvictin requires registratin under the Arsnist Registratin Act r the Murderer and Vilent Offense Against Yuth Registry, that cnvictin may nt be sealed until yu are n lnger required t register.
