RECOMMENDED ACTIONS DISCUSSION 1. That the Board of Police Commissioners (Board) REVIEW and APPROVE this report. 2. That the Board TRANSMIT this rep01t to the Los Angeles City Council. It is requested that the Board deny the reward offer under City Council File No S?, to the Witness for providing testimony in the shooting death of victim Dedrick Egger. On December 26, 2001, Dedrick Egger returned to his residence and confronted two male burglars, resulting in one of the suspects shooting Mr. Egger. On February 8, 2002, the Los Angeles City Council passed a motion for a reward of $25, with an expiration date of April 8, 2002, under City Council File No S?. Robbery-Homicide Diyision Detectives William Fallon, Serial No , and George Diaz, Serial No , conducted an extensive investigation, locating and interviewing a number of witnesses. Two separate tape-recorded interviews with the Witness revealed he/she provided the detectives with third hand information, and stated he/she had only observed people walking away from the location where Mr. Egger was shot and killed. The detectives solved the murder investigation as a result of information obtained from an earlier source which led to an interview with one of the suspects who confessed to the crime. The information received from the Witness corroborated this infonnation, but was not instrumental in the arrests and convictions of the involved defendants. Los Angeles County Deputy District Attorney (DDA) Donna McClay was the assigned prosecutor for the preliminary hearing. During this court proceeding, the Witness was an extremely uncooperative witness. Throughout direct examination, the Witness was agitated and directed profanities at DDA McClay and others in the courtroom. Deputy District Attorney McClay requested the judge deem the Witness a "hostile witness" in order to obtain the information he/she previously provided to detectives. The prosecution and the defense declined to summons the Witness for the Jury Trial due to his/her outrageous behavior.

Los Angeles Police Department, Special Order No.6, dated August 23, 2002, states a clairnant(s) must provide continued cooperation within the criminal justice system relative to the case for which the reward offer is made.
